Call to Order/Roll Call Mayor James called the meeting to order at 7:00 p.m. Present: Mayor: Vice -Mayor: Commissioners: City Manager: City Attorney: City Clerk: Tamara James Marco A. Moment of Silence and Pledge of Allegiance Mayor James called for a moment of silence followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Introduction of new Assistant Director of Parks & Recreation by Eric Brown, Director of Parks & Recreation Parks & Recreation Director Brown introduced Cassandra (Cassi) Waren, Assistant Director of Parks & Recreation. 3.2 Youth Advisory Council Presentation - Parks & Recreation Eric Brown, Director of Parks & Recreation, introduced Kyla Holmes and Ka'Niyah Anderson, members of the Youth Advisory Council, who gave a brief presentation on the Council, their participation in the community, and issues of importance to them. Mayor James felt one youth could shadow each of the Commissioners for the day. Commissioner Odman noted the two were spot-on and had well laid -out points. She would enjoy participating with the shadow idea. Commissioner Lewellen thanked Ms. Holmes and Ms. Anderson for their well -prepared presentation. Commissioner Davis complimented and thanked the youth for speaking so eloquently. Vice -Mayor Salvino thanked Ms. Holmes and Ms. Anderson. City Manager Garcia noted a Special Event application was submitted and went through administration on behalf of Sharon Sharabi to host a non-profit "Community Food Distribution" every Wednesday from 12:00 p.m. — 7:00 p.m., beginning February 10 to July 7, 2021, at 2750 Griffin Rd (Griffin Living Site), with approximately 50-100 boxes for families with children. 4. Proclamations 4.1 Eating Disorders Awareness Week - Mayor James Mayor James read the proclamation for Eating Disorders Awareness Week. 5. Citizen Comments There were no comments at this meeting. 6. Public Safety Reports Captain Daniel Marks, BSO Chief of Police, noted the food giveaway event, sponsored by the Dolphins Foundation, is scheduled for tomorrow. He reported on recent criminal activity in the City, as well as SROs in schools and speeding enforcement. He gave a brief update on homeless outreach and bicycle patrols at the beach. Captain Sergio Pellecer, BSO District Fire Chief, gave an update on nursing homes and COVID vaccinations in furtherance of keeping our seniors safe. He noted Firefighters Jerome Snell and Chris Chandler retired, and on February 12th, Chief Caruso will have completed 38 years and seven months service to our community. 7. ("PUMPS, INC.") BASED ON A NEWLY ESTABLISHED CCNA CONTRACT PURSUANT TO RFQ NO. 2020-005, FOR HYDRAULIC MODELING OF THE CITY'S WATER DISTRIBUTION SYSTEM IN THE AMOUNT OF SEVENTY THOUSAND DOLLARS ($70,000.00); PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (Public Services) Minutes of Virtual Regular Meeting 3 Dania Beach City Commission Tuesday, February 9, 2021 — 7:00 p.m. 7.8 RESOLUTION #2021-019 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AFFIRMING PARTICIPATION IN THE N 22 AVENUE / SW 12 AVENUE FROM SHERIDAN STREET TO STIRLING ROAD PROJECT; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (Public Services) Vice -Mayor Salvino motioned to adopt the Consent Agenda; seconded by Commissioner Lewellen. The motion carried unanimously. 8. Bids and Requests for Proposals There were no proposals on this agenda. 9. Public Hearings and Site Plans 9.1 ORDINANCE #2021-010 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, REPEALING ORDINANCE 2004-019 WHICH IS CODIFIED AS SECTION 2-5 OF THE CODE OF ORDINANCES, ENTITLED "ADOPTION OF CIVIL SERVICE RULES"; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (SECOND READING) (Human Resources) City Attorney Ansbro read the title of Ordinance #2021-010. Mayor James opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, she closed the Public Hearing. Vice -Mayor Salvino motioned to adopt Ordinance #2021-010, on second reading; seconded by Commissioner Lewellen. The motion carried unanimously. 9.2 ORDINANCE #2021-011 AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING CHAPTER 2, ENTITLED "ADMINISTRATION," TO AMEND SECTION 2-1.2, ENTITLED "RESERVED" TO DEFINE THE TERM "CHAMBERS" FOR PURPOSES OF CITY COMMISSION MEETINGS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (SECOND READING) (City Attorney) City Attorney Ansbro read the title of Ordinance #2021-011 and gave a brief overview of the code amendment. Mayor James opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, she closed the Public Hearing. Minutes of Virtual Regular Meeting 4 Dania Beach City Commission Tuesday, February 9, 2021 — 7:00 p.m. Commissioner Odman motioned to adopt Ordinance #2021-011, on second reading; seconded by Vice -Mayor Salvino. The motion carried unanimously. 9.3 ORDINANCE #2021-012 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING CHAPTER 13, ENTITLED "HEALTH AND SANITATION," TO CREATE SECTION 13-11, ENTITLED "VIRTUAL PUBLIC MEETINGS" AUTHORIZING THE CITY MANAGER TO MAKE PROVISIONS FOR PUBLIC MEETINGS BY USE OF COMMUNICATION MEDIA TECHNOLOGY AND FOR ATTENDANCE BY USE OF SUCH TECHNOLOGY BY ELECTED AND APPOINTED OFFICIALS DURING PERIODS WHEN THE CITY MANAGER DETERMINES AND DECLARES A LOCAL PUBLIC HEALTH EMERGENCY OR OTHER CIRCUMSTANCES IN WHICH THE CITY COMMISSION DETERMINES IT IS NECESSARY TO PROTECT THE HEALTH AND SAFETY OF CITY OFFICIALS, CITY STAFF, AND THE PUBLIC FOR THE DURATION OF THE DECLARED PUBLIC EMERGENCY; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (SECOND READING) (City Attorney) City Attorney Ansbro read the title of Ordinance #2021-012 and explained this would codify the utilization of virtual public meetings when necessary and would eliminate the need to adopt emergency ordinances to hold such meetings. Commissioner Odman asked if there is an indication of when the Commission would be required to return to in -person meetings. City Attorney Ansbro noted this occurred several months ago when the Governor's order expired, and explained the Commission adopted an Emergency Ordinance to continue with virtual meetings. Mayor James opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, she closed the Public Hearing. Commissioner Lewellen motioned to adopt Ordinance #2021-012, on second reading; seconded by Commissioner Odman. The motion carried unanimously. 10. Discussion and Possible Action 10.1 Exploring Mobility Partnerships for Dania Beach - Mayor James Mayor James said as we conclude our Mobility Study with the next phase of Commission adoption, she wants to consider possible partnerships that would greatly benefit the City. She asked if there was consensus to explore partnerships, such as a trolley system, and move forward with it and she would bring something back to the Commission. Commissioner Lewellen said she would prefer the Mobility Study be completed first. Minutes of Virtual Regular Meeting 5 Dania Beach City Commission Tuesday, February 9, 2021 — 7:00 p.m. Mayor James noted she will continue to meet with City Manager Garcia and explore the possibilities with the private sector and take the next steps, including further Commission discussion and future adoption of an agreement per the direction of administrative and legal staff. Commissioner Davis said she supports something like this as this was discussed in her individual meetings. City Manager Garcia noted the Mobility Study will give us a very good outlook; any way that we can get private partnerships is a win -win, and this could be expanded. 10.2 RESOLUTION NO. 2021-020 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, SPECIFICALLY RECOGNIZING "JUNETEENTH "AS A CITY HOLIDAY, WHICH IS CELEBRATED ON JUNE 19TH ANNUALLY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (Commissioner Lewellen) City Attorney Ansbro read the title of Resolution #2021-020. Commissioner Lewellen read the Juneteenth proclamation that accompanied the Resolution included in the agenda packet. She noted this would be a paid holiday for non -bargaining employees and for union employees in the future, and there are related activities that would be undertaken in the community to educate, celebrate and recognize the holiday. Commissioner Lewellen motioned to adopt Resolution #2021-020; seconded by Commissioner Davis. The motion carried unanimously. 10.3 RFP for food trucks for beach/ parks and City facilities - City Manager Garcia City Manager Garcia noted after numerous meetings and discussions, her request to the Commission is to put an RFQ out to include language such as local vendors and diversity in food to connect with all the cultures in the City, as well as to have affordable options and snacks for our youth. The Commission consensus was to move forward with the RFQ. 10.4 Lawsuit involving the City and Dania Jai Alai - City Attorney Ansbro City Attorney Ansbro reviewed the information included in the agenda packet, particularly the additional legal expenses required. He noted he could provide more details and strategy plans if he speaks with each Commissioner separately but cannot disclose those in a public memorandum. Alternatively, we could conduct an attorney -client session to discuss litigation expenditures; he could announce such a meeting tonight. Mayor James asked if he had spoken to the Finance Director about a funding source. Minutes of Virtual Regular Meeting 6 Dania Beach City Commission Tuesday, February 9, 2021 — 7:00 p.m. Frank DiPaolo, Director of Finance, noted he has had discussions with City Attorney Ansbro; he recommended an appropriation of a certain amount from reserves be made by the Commission. Commissioner Lewellen questioned the insurance monies and City Attorney Ansbro responded. Commissioner Lewellen motioned to approve a maximum of $80,000 for legal expenses for the lawsuit, to be taken from reserves; seconded by Commissioner Odman. The motion carried unanimously. 11. Commission Comments 11.1 Commissioner Davis Commissioner Davis thanked Parks & Recreation for bringing out the Youth Council at this meeting. 11.2 Commissioner Lewellen Commissioner Lewellen gave an update on the CARES Act task force; they are continuing to meet with the County Commissioners regarding distributions to the cities. She will keep the Commission posted as things continue. 11.3 Commissioner Odman Commissioner Odman had no comments. 11.4 Vice -Mayor Salvino Vice -Mayor Salvino had no comments. 11.5 Mayor James Mayor James reminded everyone of the BSO food giveaway at Island Joe's tomorrow and thanked BSO for the Dolphins Foundation sponsorship. Mayor James said she is excited about the Youth Advisory Council; she was very impressed with the two ladies presenting tonight. Eric Brown, Director of Parks & Recreation, noted the youth will have blazers and they are designing their logo. 12. Appointments Minutes of Virtual Regular Meeting 7 Dania Beach City Commission Tuesday, February 9, 2021 — 7:00 p.m. The Commission appointed Commissioner Davis to represent the City for the Broward County Solid Waste MOU group. The Commission appointed Commissioner Lewellen to represent the City at the MPO. 12.1 Airport Advisory Board Commissioner Lewellen appointed Dean Harley and Keith Roberts. Commissioner Odman appointed Charlene Tanner and Dolores Boegli. Vice -Mayor Salvino appointed Randy Wright and Gary Luedtke. 12.2 Creative Arts Council Advisory Board Vice -Mayor Salvino appointed: Henriette Arnold (subsequently declined to serve) 12.3 Education Advisory Board Vice -Mayor Salvino appointed: Bonnie Carlton 12.4 General Employees Pension Board — no appointments 12.5 Green Advisory Board Commissioner Odman appointed: Charlene Hogan Vice -Mayor Salvino appointed: Patricia Chukerman 12.6 Marine Advisory Board Vice -Mayor Salvino appointed Chris Bartle and Thomas Angelos. 12.7 Parks, Recreation and Community Affairs Advisory Board Commissioner Lewellen appointed: Pilar Rodriguez Commissioner Odman appointed Sheila McCray and Markus Slamanig. Vice -Mayor Salvino appointed Christine LaBarca and Rich Aube. 12.8 Planning & Zoning Board The Commission appointed Charlotte Sloboda as an Alternate Member. Minutes of Virtual Regular Meeting 8 Dania Beach City Commission Tuesday, February 9, 2021 — 7:00 p.m. Vice -Mayor Salvino motioned to approve the appointments; seconded by Commissioner Lewellen. The motion carried unanimously. 13. Administrative Reports 13.1 City Manager City Manager Garcia noted we would advertise board appointments again. City Manager Garcia gave an update on the old Olsen Middle School demolition. City Manager Garcia spoke of holding a workshop on the West Wing of City Hall regarding ADA and usage. She provided the Commission with tentative dates and asked that they decide on one that will work for them all. Discussion ensued regarding a date. The Commission agreed to hold a workshop on the West Wing on Tuesday, February 23rd, from 5:00 p.m. to 6:30 p.m. City Manager Garcia said she will come back in March with dates to schedule a workshop for discussion on the next steps to the Parks Master Plan. She reviewed the letter she submitted to the Chamber of Commerce, which was included in the agenda packet. City Manager Garcia noted a Strategic Master plan session will take place for key senior members of our team on March 11tn City Manager Garcia spoke of moving forward with the Ocean Park RFP; we have received support from FAU and FDOT to procure land needed for the project and are currently receiving appraisals. City Manager Garcia said the next step in the Art in Public Places program is one -on -ones with the Commissioners. We received 174 responses from residents on the Art in Public Places engagement survey. Commissioner Davis asked about the process of notifying the residents how they can be involved. City Manager Garcia noted we had an online survey where we received 174 responses from our residents. We are waiting on the next step, working with the Broward County Cultural Division; the one -on -ones with the Commissioners is important. Commissioner Davis responded she thought selected residents would be recommended to serve on a board. Minutes of Virtual Regular Meeting 9 Dania Beach City Commission Tuesday, February 9, 2021 — 7:00 p.m. Commissioner Odman said once we have our one -on -ones, the Commission and City staff can recommend community members to be involved. City Manager Garcia noted there will be a committee. City Manager Garcia spoke about the Mobility Study and noted an item will be brought forward no later than April to adopt the plan. City Manager Garcia said we are in Phase II of iLove Local and she would like Commission approval if they wanted to move forward with it now. She will have Mr. Andrews reach out to the Commissioners individually to schedule the sessions. City Manager Garcia noted she is excited about the new Assistant Parks & Recreation Director; we will be augmenting our Parks programming.
