HomeMy WebLinkAboutR-2021-021 Building Permit and Other Department Fees Revision and Update to the Schedule of FeesRESOLUTION NO.2021-021 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, REVISING AND UPDATING THE SCHEDULE OF BUILDING PERMIT AND OTHER DEPARTMENT FEES, PURSUANT TO ARTICLE I, SECTION 8-3, "BUILDING PERMIT FEES" OF CHAPTER 8, "BUILDING" OF THE CITY CODE OF ORDINANCES; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Dania Beach, Florida, is authorized by state law to enact user fees commensurate with the cost to the City of providing services, in such amounts as are necessary for the conduct of municipal government and affairs; and WHEREAS, it is in the best interest of the City that large scale development projects be processed for permits and inspections in an expedited manner without impacting City day to day permit applications; and WHEREAS, the City wishes to update the existing fee schedule (established by Resolution No. 2016-056) to include "Building Permit Fees" and "Land Development and Application Fees"; and WHEREAS, the City of Dania Beach Code of Ordinances, pursuant to Section 8-3, "Building Permit Fees" of Chapter 8, "Building", establishes permit fees; and WHEREAS, the cost of plan review, administration and inspection services should be borne by the users benefiting from the services; and WHEREAS, the fees contained in this Resolution have been developed to properly accommodate the costs for providing plan review, permitting, inspection services, and advisory services provided to citizens and contractors; and WHEREAS, the Director of Community Development believes that it is in the best interest of the citizens and residents of the City of Dania Beach to approve the recommended fee schedule: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct, and they are made a part of and incorporated into this Resolution by this reference. Section 2. That a revised and updated fee schedule is adopted as follows: SCHEDULE OF PERMIT FEES FOR CONSTRUCTION (a) Calculation of permit fee: The cost of construction or a project may be determined in the following ways as determined by the Building Official as provided by Florida Building Code: • Cost of construction as submitted by the applicant. • Copy of a signed contract for work to be performed. • Using the values in the most recent edition of the RS Means Construction Valuation System. • Using the values in the most current International Code Council (ICC) Valuation System • Using the values in the most current Broward County Board of Rules and Appeals (BORA) Cost of Construction Guidelines The Building Official has the discretion to choose which one of the methods to be used best reflect the true cost of work being performed. (b) Processing and Plan Review Fees: A Processing/Plan Review fee is due at time of plan submittal and is due for each subsequent review. Job Value: $0 — $2,500 $2,501—10,000 $10,001 - $50,000 $50,001 - $100,000 $100,001 - $300,000 $300,001 - $500,000 $500,001 - $1,000,000 $1,000,001 - $5,000,000 $5,000,001 + (c) Building Permit Fees: Plan Review Fee: (due for each submittal & re -submittal $0 $50 $100 $250 $350 $500 $1,000 $2,000 $3,000 Permit fees are calculated on a percentage of the construction cost, plus a $90 inspection fee is added for each discipline (Structural, Mechanical, Electrical & Plumbing). • Job Value: 0 — $7,500 Minimum permit fee $90.00, plus $90 for each discipline • Job Value: $7,501 — $25,000 1.4% of total construction value, plus $90 for each discipline 2 RESOLUTION #2021-021 • Job Value: $25,001— $500,000 2.0% of total construction value, plus $90 for each discipline • Job Value: $500,001— $5,000,000 1.8% of total construction value, plus $90 for each discipline • Job Value: $5,000,001— $20,000,000 1.6% of total construction value, plus $90 for each discipline • Job Value: $20,000,000 + 1.4% of total construction value, plus $90 for each discipline (d) Miscellaneous Fees: The following listed fees will be assessed as applicable: • Private Provider Fee: 1.3% of total construction value • Miscellaneous Permit Fee: $90 • Demolition of Buildings: 1.0% of total project value • Elevators, Escalators, and other Lift Devices: Regulated by Broward County • Change of Contractor $75 • Plan Revisions after Permit is issued: Plan revisions will be charged additional fees at $40 per discipline and $20 per page. • Re-inspections/Partial Inspections: $90 fee for each failed inspection; exception for permits pulled by an owner -builder, the first re -inspection fee will be waived. • Overtime, Specialty, and After Hours Inspections: Three hour minimum at $360, each additional hour or fraction of an hour at $120. • Permit Card Replacement: $35 • Penalty for work without a Permit: Double the applicable permit fee • 40 Year Building Safety Inspection Program: All applications for recertification or extension are $350 per commercial building and $225 per residential condominium building. • Expired Permit Renewal Fee: $90 permit renewal fee; must submit a permit renewal letter to building official. • Early Start Authorization: $250 3 RESOLUTION #2021-021 • Special Permitting Office Surcharge: 2.5% of the total building permit fee or a minimum fee of $100 Permits for a development project with a construction value at or above $1,000,000 can receive expedited and dedicated plan review and inspection services if the applicant requests special permitting office services. The Director of Community Development may allow other large-scale projects to be processed by the special permitting office due to the scale, nature or complexity of the project and workload of the department. • Certificate of Occupancy (CO) / Certificate of Completion (CC) / Temporary Certificate of Occupancy (TCO): Residential CO fee (per unit) 1% of permit fee or $100 (whichever is greater) Commercial CO fee 2% of permit fee or $200 (whichever is greater) Commercial TCO fee $500 for job values $100,000 or less $1,000 for job values greater than $100,000 • Mandatory State and County fees: 1. Broward County Board of Rules and Appeals Surcharge as adopted by BORA 2. Department of Business & Professional Regulations (DBPR) surcharge as adopted by Florida Statute 553.721 3. Building Code Administrators & Inspectors surcharge as adopted by Florida Statute 468.631. • Impact Fees and Assessments: Per City Ordinance, Article 7, Section 19-86: additional fees for City required Impact Fees are due prior to securing a Building Permit. Impact fees and assessments include but are not limited to the following: Water and Sewer, Administrative, Fire, Police, and Open Space. • Fire Safety Inspection and Plan Review Fees: Fire safety inspection and plan review fees will be in accordance with Dania Beach Code of Ordinances Chapter 11, Article III. Fire Prevention, Section 11-46.1, "Establishment of fees", Fire plan review and inspection fees are not included in this Schedule. • Zoning Review / Permit Fees: Residential zoning review fee $15 Commercial zoning review fee $85 Land clearing, excavation, or fill, per acre, or portion of such area $250 Landscaping, per acre or portion of such area $150 Temporary Sign/Banner Permit $25 Temporary Structure Permit $180 4 RESOLUTION 42021-021 • Tree Removal Fees: (1) Application Fee Commercial and Multi -Family $150 Single Family and Duplex $25 (2) Permit Fee * Commercial and Multi -Family $150 Single Family and Duplex $25 *This fee is in addition to the tree replacement (equivalent value) requirements as required in the Dania Beach Land Development Code, Part 8, Article 825. "Tree Preservation". Applicants are advised to review Article 825 of the City Land Development Code to determine all tree preservation/relocation requirements. (e) Land Development Application Fees: The following fees shall apply to all applications for land use plan amendments, rezoning, special exception use, variances, site plans and other zoning related applications. These fees are used to defray staff cost in the evaluation of the proposal made and provide for the required notices and public advertisements according to Florida State statutes and the Dania Beach Land Development Code. Should any applicant have more than one type of request submitted to the City, the applications involved should be submitted at the same time. The present City policy is to have concurrent reviews being processed before the final review and actions by the Planning and Zoning Board, City Commission, or both. It is the obligation of each applicant to review the appropriate City Codes and design standards related to the proposal before making any application to the City. The standard review process for all development applications are two (2) review cycles.
