HomeMy WebLinkAboutR-2021-042 Harbor Landings (CCI Properties 1) Site Plan (SP-058-20)RESOLUTION NO.2021-042 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN FOR THE CONSTRUCTION OF A 275 UNIT RESIDENTIAL BUILDING IN THE PRD-1 (PLANNED RESIDENTIAL) ZONING DISTRICT (SP-058-20), SUBMITTED BY CCI PROPERTIES 1, LLC, FOR PROPERTY LOCATED AT 4695 SW 45TH TERRACE, IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, CCI Properties 1, LLC, (the "Applicant") has requested site plan approval, for the proposed construction of a new 275 unit residential building in the PRD-1 zoning district at 4695 SW 45th Terrace in the City of Dania Beach, Florida, as legally described in Exhibit "A"; and WHEREAS, the City Code of Ordinances, Chapter 28, entitled "Land Development Code" (the "LDC"), of Part 6, entitled "Development Review Procedures and Requirements", Article 635, entitled "Site Plans" of Section 635-20(A), provides that site plan approval is required as a condition to the issuance of a building permit; and WHEREAS, on July 29, 2020 and again on September 24, 2020, the City's Development Review Committee (the "DRC"), which includes representatives from the Broward Sheriff's Office, Broward Fire Department, Public Services Department, the City's landscape consultant and the Planning Division staff, reviewed the site plan for compliance with all applicable regulations; and WHEREAS, the City Commission conducted a duly noticed public hearing on March 23, 2021, in accordance with Article 610 of the LDC; and WHEREAS, the City Commission finds that the approval of the proposed site plan (SP- 058-20) is consistent with the City's Comprehensive Plan; and WHEREAS, the City Commission finds that the approval of the proposed site plan (SP- 058-20) is consistent with the City's LDC Section 635-60 by demonstrating compliance with the applicable land development regulations; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct, and they are made a specific part of this Resolution. Section 2. That the City's staff report (SP-058-20) is ratified and confirmed as being true and correct and is made a specific part of the Resolution as finding of fact. Section 3. That pursuant to Chapter 28, entitled, "Land Development Regulations", Part 6, entitled, "Development Review Procedures and Requirements", the following Site Plan (SP-058-20), is approved subject to the following conditions: 1. The existing SFWMD ROW permit mod 2745, which authorizes the use of SFWMD lands for facilities including boat ramps, docks boardwalk, fencing, meter boxes, etc., has been transferred to CCI LLC. Provide the authorization which allows CCI LLC to modify SFWMD-owned landscape. (Landscaping) 2. Existing trees 172-183 appear to be within the City of Dania Beach on SFWMD-owned property, not within the City of Hollywood. Update the tree disposition plan/table accordingly. (Landscaping) 3. The included environmental permit packages claim there are no mangroves onsite, yet there are existing mangrove resources onsite. The Broward County meeting minutes state that if there are any mangroves onsite, they shall be preserved with the redevelopment. Show the mangrove resources as "to remain" on the tree disposition plan. (Landscaping) 4. Provide additional Fire Department Access Information as follows: a. Fire Lane locations and striping detail (demonstrated) b. "NO PARKING" sign locations and sign details demonstrated c. A note or detail identifying the design load for surface compaction of all non -paved roadways and/or Fire Department Access Roads (where applicable) d. Building Accessibility e. Load Limits for Bridges and Grading for significant changes in elevation (if applicable) f. Fire Department Access Routes During Construction (Fire) 5. Provide additional Water Supply Information as follows: a. Locations of all Post Indicating Valves or Underground Gate Valves, Double Detector Check Valves, etc. (Fire) 6. Provide a detail sheet accompanying the Civil Plans with the following details: a. Fire Hydrant Detail b. Bollard / Impact Protection Detail for Hydrants, FDC's & DDCV's 2 RESOLUTION #2021-042 c. Roadway Pavement Marker (RPM) Detail for Fire Hydrant Locations (Blue Reflective Markers) d. Post Indicating Valve Detail (where applicable) e. Underground Gate Valve Detail (where applicable) f. Backflow Preventer / Double Detector Check Valve (DDCV) Detail (where applicable) that identifies the DDCV as being listed for Fire Use g. Signage Detail for the Fire Department Connections (where applicable) (Fire) 7. Provide an egress plan demonstrating and dimensioning all common paths of travel and travel distances to all exits within the buildings and/or structures. (Fire) 8. Provide Minimum Radio Signal Strength for Fire Department Communications (Fire) 9. Provide Maintenance of Traffic (MOT) Plan by a licensed General Contractor/Professional Engineer in the State of Florida (If applicable). (Engineering/Planning) 10. Detail and complete engineering plans will be required prior to Building permit approval. (Engineering). 11. Wheel stops, five and one-half (5 %) inches high, shall be installed two (2) feet from the head (front) of a parking space (Engineering). 12. Provide utility piping conflict details plan, along with documentation to demonstrate acceptability of the separation between water, sanitary, storm -water service lines, etc. (Engineering) 13. Show also all existing and proposed utilities on the landscaping plans for potential conflicts. (Engineering) 14. Provide ADA parking, access / driveway, and sidewalks /ramps including dimensions in accordance with Chapter 553 of the Florida Statutes. "Accessibility of Handicapped Persons" and latest edition of "Accessibility Requirements Manual" by Department of Community Affairs, Florida Board Building Codes and Standards, and'in accordance with Americans with Disability Act (ADA). (Engineering) 15. Provide drawing file (dwg or dgn) disk of the approved site plan in Florida State Plane Coordinate (NAD 83). This should be addressed as part of the final submittal. (Engineering) 16. Provide regulatory agencies' approval documentation and Permits/Licenses (as applicable) as part of the final submittal, prior to issuance of the Building Permit (Broward County 3 RESOLUTION #2021-042 Surface Water License, Environmental Resource Permit, Broward County Wastewater Permit, Florida Department of Environmental Protection, FDOT, BC Environmental, BC Aviation, BCTED etc.). Also, include Utility / Right of Way Permits from City, Broward County, and State Roads as applicable. (Engineering) 17. RECREATION AND OPEN SPACE IMPACT FEE: Per Resolution 2014-071, Recreation and Open Space Impact Fee of $375,100 (275 units x $1,364) to be paid at the time the building permit is issued. (Planning & Zoning) 18. PUBLIC ART PROGRAM: Per Article 811, new development and redevelopment in non- residential, mixed -use and multi -family zoning districts shall provide fee for the creation, acquisition and installation of public art in the city. a. Pay In -Lieu Public Art Fee: Pay one-half of one percent (0.5%) of the cost of the proposed development project, as an "in -lieu" public art fee, with a minimum payment of $5,000 and a maximum payment of $250,000; or b. Combination of In -Lieu Public Art Fee and Placement of Art on Site: Placement of art on the site of the development project, which shall have a minimum value of one -quarter of one percent (0.25%) of the cost of the proposed development project combined along with a one -quarter of one percent (0.25%) payment of an "in -lieu" public art fee. The owner shall provide documentation to the City that the art fee has been deposited into an escrow account for said purpose prior to the issuance of a building permit. Prior to placement on the development site, the art must be approved by the Community Services Director or designed and conform to the adopted public art guidelines. (Planning & Zoning) Section 4. That pursuant to Section 635-100 "Expiration of Site Plans" of the Land Development Code, the site plan (SP-039-20) shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the improvements shown on the site plan, within eighteen (18) months from the date of this Resolution. Section 5. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency, and does not create any liability on the part of the municipality for issuance of the permit if the 4 RESOLUTION #2021-042 Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 6. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 7. That this Resolution shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED on March 23, 2021.
