A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA APPROVING THE WAIVER OF REPLAT REQUEST (OT-
011-21) SUBMITTED BY LAWRENCE KRAMER, ON BEHALF OF THE
PROPERTY OWNER, 800 OLD GRIFFIN, LLC FOR THE PROPERTY
GENERALLY LOCATED AT 800 OLD GRIFFIN ROAD IN THE CITY OF
DANIA BEACH, FLORIDA AS LEGALLY DESCRIBED IN EXHIBIT "A," A
COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, Chapter 28, Land Development Code (the "LDC"), Part 6 "Development
Review Procedures and Requirements," Article 655, "Vacations of Right -of -Way," states that no
platted street alley or other property dedicated to the public use shall be vacated or abandoned
except by a new plat submitted to and approved by the City Commission, unless the City
Commission waives the requirement of a new plat; and
WHEREAS, Lawrence Kramer, on behalf of the property owner 800 Old Griffin, LLC,
(the "Applicant"), has requested a waiver of replat (OT-011-21) approval in order to submit an
application to vacate a dedicated City right-of-way located within a portion of NW 3rd Place,
between NW 8th Avenue and NW 9th Avenue, as legally described in Exhibit "A," a copy of
which is attached to this Resolution; and
WHEREAS, the request is consistent with Section IV of the Future Land Use Element of
the City of Dania Beach Comprehensive Plan (the "FLU Element"), titled "IV. Requirements for
Future Land Use Goals, Objectives and Policies"; and
WHEREAS, the request more particularly furthers Objective V, Policy 5.3 of the FLU
Element to "[... ] streamline the development approval process where practical"; and
WHEREAS, Section 635-30.D of the LDC allows the City Commission to waive the
submission and approval of a new plat for a vacation of right-of-way if it would cause undue
hardship to the property owner; and
WHEREAS, the Applicant, on behalf of the Property Owner, has provided evidence and
statements demonstrating undue hardship which are incorporated into the Staff Report for this
vacation request (OT-011-21); and
WHEREAS, pursuant to the criteria of Section 655-30(d) of the LDC, the City
Commission finds that replatting would cause undue hardship to the property owner; and
WHEREAS, the request more particularly furthers Policy 5.13 of the FLU Element
according to which "Dania Beach shall adopt land development regulations that require platting at
least in those circumstances where the Plan Implementation Requirements section of the Broward
County Plan requires platting; and such regulations may establish additional standards, procedures,
and requirements as may be necessary to regulate and control the platting of lands within their
boundaries. (B.C.P. #08.02.01)"; and
WHEREAS, the Broward County Planning Council issued a letter dated February 23,
2021, indicating that pursuant to the Broward County Plan this vacation does not require replatting
for the "principal building(s) is constructed solely on Blocks 2 and 3, which is the specifically
delineated portion of the subject site"; and
WHEREAS, the Broward County Planning Council letter and supporting documents are
incorporated into this resolution as Exhibit C; and
WHEREAS, the City Commission conducted a duly noticed public hearing in accordance
with Article 610 of the City's LDC; and
WHEREAS, the City Commission finds that approval of the requested waiver of replat
(OT-011-21) is consistent with the LDC and Comprehensive Plan.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as
being true and correct and they are made a specific part of this Resolution.
Section 2. That the waiver of replat (OT-011-21), a copy of which is attached as
composite Exhibit "B," is made a part of and incorporated into this resolution by this reference, is
approved.
Section 3. That the City's Staff Report is ratified and confirmed as being true and
correct and is made a specific part of the resolution as findings of fact.
Section 4. That this resolution only allows the Applicant to submit and process an
application to vacate the right-of-way without the need to replat the subject property but does not
grant the vacation itself nor constitute the approval of such vacation.
Section 5. That the issuance of a development permit by a municipality does not in any
way create any right on the part of an applicant to obtain a permit from a state or federal agency
and does not create any liability on the part of the municipality for issuance of the permit if the

Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state
or federal agency or undertake actions that result in a violation of state or federal law.
Section 6. That all resolutions or parts of resolutions in conflict with this Resolution
are repealed to the extent of such conflict.
Section 7. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.

The following fees shall apply to all applications for land use plan amendments, rezoning, special exception use,
variances, site plans and other zoning related applications. These fees are used to defray staff cost in the evaluation of
the proposal made and provide for the required notices and public advertisements according to Florida State Statute and
the Dania Beach Land Development Code. Should any applicant have more than one type of request to the City, the
applications involved should be submitted at the same time. The present City policy is to have concurrent reviews being
processed before the final review and actions by the Planning and Zoning Board and/or City Commission. It is the
obligation of all applicants to review the appropriate City Codes and design standards related to their proposal before
making any application to the City. The standard review process for all development applications are two (2) review
cycles. Any additional review or public notice required by staff or professional consultants due to the
incorrect interpretation of the Land Development Code will be charged to the applicant as per "Section

Plat Waiver request reference the vacation of NW 3rd Place (Section 655-30(D)
1. The City of Dania Beach is requiring a Plat per Section 655-30(D)
The requirement to Plat the property due to the vacation of NW 3rd Place will cause an undue
hardship on the property owner.
The property lies between two parcels of land owned by 800 Old Griffin LLC and had been built
by the previous property owner. NW 3rd Place does not intersect with any other street and serves
only this property. By abandoning the property, the City will allow the owner to provide a secure
access to his adjoining properties and intern improve the facilities operations.

Re: Platting requirements for a parcel legally described as all of Blocks 2 and 3, and the West 46
feet of Block 4, "Corrected Plat of Dania Manor," according to the Plat thereof, as recorded
in Plat Book 10, Page 53, of the Public Records of Broward County, Florida, together with a
portion of unplatted land in Section 34, Township 50 South, Range 42 East, together with the
proposed vacated 30 feet of Northwest 3 Place right-of-way, said lands situate, lying and
being in Broward County, Florida. This parcel is generally located west of Northwest 6 Avenue,
between the Dania Cut-off Canal and Northwest 3 Terrace, in the City of Dania Beach.
This letter is in response to your correspondence regarding the Broward County Land Use Plan's
platting requirements for a proposed non-residential development on the above referenced parcel.
You have indicated that the current proposal is to attach 14,722 square feet of industrial space to the
existing structure, add a 5,326 square feet office space as a second floor above an existing office
space, and to construct an adjacent boat storage yard/parking facility as well as docks on the north
side of the parcel.
Planning Council staff has determined that replatting would be required by Policy 2.13.1 of the
Broward County Land Use Plan for the proposed development, subject to compliance with any
applicable Broward County Trafficways Plan requirement.
As per the criteria of Policy 2.13.1, replatting is required for the issuance of building permits when
constructing a non-residential or multi -family development, unless all of the following conditions are
met:
a. The lot or parcel is smaller than 10 acres and is unrelated to any adjacent
development;
b. The lot or parcel has been specifically delineated in a recorded plat;
C. All land within the lot or parcel which is necessary to comply with the County
Trafficways Plan has been conveyed to the public by deed or easement; and
d. The proposed development is in compliance with the applicable land development
regulations.

The subject parcel is less than 10 acres (approximately 4.33 acres), but it does not meet the
specifically delineated requirement. A lot or parcel which has been specially delineated in a recorded
plat is one which can be described solely by reference to a plat and one or more identifying numbers
such as a block and lot number. For example, Lot 5, Block 3, of John Doe Subdivision. The description
of "West 46 feet of Block 4" is an example of a parcel which is not specifically delineated.
Planning Council staff notes that when a specifically delineated parcel (i.e. all of Blocks 2 and 3) is
combined with land which has been included in a plat recorded before June 4, 1953, but not
specifically delineated (i.e. West 46 feet of Block 4), and/or with unplatted lands (i.e. unplatted land
in Section 34, Township 50 South, Range 42), and/or with vacated right-of-way (Northwest 3 Place),
Policy 2.13.1 of the Broward County Land Use Plan does not require replatting if the specifically
delineated portion of the parcel constitutes the majority of the enlarged parcel; in this case the
specifically delineated portion does not constitute a majority of the enlarged parcel; therefore,
replatting would be required.
However, Planning Council staff also notes that if the principal building(s) is constructed solely on
Blocks 2 and 3, which is the specifically delineated portion of the subject site, then replatting would
not be required. Conversely, as described above, replatting is required if any portion of the principal
building(s) is located on the non -specifically delineated lands of the subject site.
It is recommended that you contact Broward County's Planning and Development Management
Division at 954-357-6666, regarding the platting process.
The contents of this letter are not a judgment as to whether this development proposal complies
with the Broward County Trafficways Plan, permitted uses and densities, local zoning, the land
development regulations of the municipality or the development review requirements of the
Broward County Land Use Plan, including concurrency requirements.

be required.
In regards to the boat storage yard/parking facility and docks, these structures do not constitute a "principal building,"
