AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, AMENDING THE FUTURE LAND USE PLAN ELEMENT
OF THE LOCAL COMPREHENSIVE PLAN IN RESPONSE TO A REQUEST
BY CCI PROPERTIES 1, LLC (LU-061-20), TO REDESIGNATE CERTAIN
PROPERTY FROM "LOW -MEDIUM (10) RESIDENTIAL" TO "IRREGULAR
(50 DU/AC)", WHICH PROPERTY IS GENERALLY LOCATED AT 4695 SW
45TH TERRACE, DANIA BEACH, WHICH LEGAL DESCRIPTION IS
DESCRIBED IN EXHIBIT "A", A COPY OF WHICH IS ATTACHED TO THIS
ORDINANCE; PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the applicant, CCI Properties 1, LLC, the owner of the property located at
4695 SW 45th Terrace, Dania Beach, and legally described on Exhibit "A", has made an
application (LU-061-20) to amend the City of Dania Beach Future Land Use Plan Map for the
subject property from "Low -Medium (10) Residential" to "Irregular (50 du/ac), in order to
redevelop the existing mobile home park with multifamily residential use; and
WHEREAS, the applicant has also submitted an application for Rezoning the subject
property (RZ-062-20) from the existing Residential Mobile Home (RHM) District to the proposed
Planned Residential Development (PRD-1) District; and
WHEREAS, the applicant has also submitted an application for Plat approval (PL-060-
20), as part of the same development proposal, all concurrently known as Harbor Landings; and
WHEREAS, the applicant has also submitted an application for Site Plan (SP-058-20)
approval, proposing to remove the existing mobile home park and construct a 275-unit multifamily
apartment building with a portion including affordable housing as part of a newly proposed larger
development; and
WHEREAS, the applicant has indicated that adding the proposed multifamily residential
project to this location will provide new and affordable housing for a growing market to ensure
residents can live in close proximity to transit and major employment centers; and
WHEREAS, the City Commission desires to approve such application;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the Future Land Use Element and Map is amended as described below:
THE FUTURE LAND USE PLAN ELEMENT OF THE LOCAL
COMPREHENSIVE PLAN OF THE CITY OF DANIA BEACH, FLORIDA, IS
AMENDED TO REDESIGNATE CERTAIN PROPERTY FROM "LOW -
MEDIUM (10) RESIDENTIAL" TO "IRREGULAR (50 DU/AC)", WHICH
PROPERTY IS GENERALLY LOCATED AT 4695 SW 45TH TERRACE,
DANIA BEACH AND LEGALLY DESCRIBED IN EXHIBIT "A", A COPY OF
WHICH IS ATTACHED TO THIS ORDINANCE.
Section 2. That the associated Planning & Zoning Division Staff Report prepared for
application LU-061-20 and the graphic map attached as Exhibit "B" are hereby incorporated into
this ordinance as findings of fact.
Section 3. That if any section, clause, sentence or phrase of this Ordinance is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not
affect the validity of the remaining portions of this Ordinance.
Section 4. That all ordinances or parts of ordinances in conflict with the provisions of
this Ordinance are repealed.
Section 5. That staff shall submit this amendment to the Broward County Planning
Council for a concurrent small-scale amendment to the Broward County Land Use Plan Map.
Section 6. That this Ordinance shall take effect immediately at the time of its passage.
However, this plan amendment shall not become effective until the conclusion of the process and
time frames set out in Section 163.3187(3)(a) of the Florida Statutes and re -certification by the
Broward County Planning Council.

PASSED AND ADOPTED on second reading on March 23, 202 1.
