HomeMy WebLinkAboutR-2021-060 Brauser Maimonides Academy Site Plan (SP-38-08MOD2), Variances (VA-005-20, VA-006-20), Special Exception (SE-008-20), Public Art Waiver (OT-024-21) AMENDED 4-27-21RESOLUTION NO.2021-060 AMENDED A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE FOLLOWING REQUESTS FOR SITE PLAN (SP-38-08MOD2), TWO VARIANCES (VA-005-20 AND VA- 006-20), AND SPECIAL EXCEPTION (SE-008-20) APPROVAL, AS SUBMITTED BY BRAUSER MAIMONIDES ACADEMY, FOR THE PROPERTY LOCATED AT 5300 SW 40 AVENUE, WITHIN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A" ("PROPERTY"), A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONDITIONS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Dania Beach's Code of Ordinances, Chapter 28, entitled "Land Development Code" ("LDC"), Part 6, entitled "Development Review Procedures and Requirements," at Article 635, entitled "Site Plans," provides that site plan approval by the City Commission is required as a condition to the issuance of a building permit; and WHEREAS, Brauser Maimonides Academy ("Applicant") is requesting site plan (SP-38- 08MOD 2) approval to permit the expansion of a private school on the property located at 5300 SW 40t' Avenue ("Property"); and WHEREAS, the LDC, at Part 2, entitled "Site Development Regulations," Article 235 entitled "Walls, fences, and Hedges, at Section 235-30, entitled "Requirements for placement within required yards", permits walls in the front yard not to exceed four (4) feet in the RS zoning district, or six (6) feet in other zoning districts; and WHEREAS, the northern portion of the Property is zoned RM-1, and the southern portion of the property is zoned RS-6000. The Applicant has requested a variance (VA-005-20) to install an eight (8) foot masonry wall along the length of the front yard of the Property, along the western property line; and WHEREAS, the LDC, at Part 2 entitled "Site Development Regulations," Article 205, entitled "Tabular Summary Of Site Development Standards For All Zoning Districts", at Section 205-10, entitled "Schedule of lot, yard and bulk regulations", permits structures in the RS-6000 zoning district to a maximum building height of two stories or 25 feet measured by the vertical distance from the building slab to the tie beam of the top story; and WHEREAS, the Applicant has requested a variance (VA-006-20) to authorize a two-story structure, with a maximum height of 28 feet (3 additional feet than authorized under the district regulations) from the building slab to the tie beam of the top story on the portion of the Property zoned RS-6000; and WHEREAS, The LDC at Part 6, Article 625, entitled "Variances," at Section 625-40, entitled "Variance review criteria; city action", provides that the City Commission may grant a variance based on its determination that the Applicant has demonstrated that the necessary criteria identified in the LDC have been satisfied; and WHEREAS, the LDC at Part 1, of LDC, entitled "Use Regulations for Residential and Open Space Zoning Districts," Article 105 entitled "Use Regulations For Residential And Open Space Zoning Districts", at Section 105-20, entitled "List of residential and open space districts permitted, special exception and prohibited uses" permits the academic school use as a special exception in the RM-1 and RS-6000 zoning districts; and WHEREAS, the Applicant has requested a special exception to allow the private school use in order to build a Pre-K, elementary and secondary school (SE-008-20); and WHEREAS, the LDC at Part 6, Article 630, entitled "Special Exception Uses," at Section 630-50, entitled "Special exception use review standards; application disposition", provides that the City Commission may grant a special exception based on its determination that the Applicant has demonstrated that the necessary criteria identified in the LDC have been satisfied; and WHEREAS, the Applicant is requesting approval of the proposed site plan (SP-38- 08MOD2), two variances (VA-005-20 andVA-006-20), a special exception (SE-008-20), and public art waiver (OT-024-21) requests; and WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Chapter 28, Part 6 of the LDC, Article 610, entitled "Public Hearing Notices"; and WHEREAS, the City Commission finds that the approval of the proposed site plan (SP- 38-08MOD2), two variances (VA-005-20 and VA-006-20), and special exception (SE-008-20) will protect the public health, safety, and welfare of the residents of the City, and furthers the purpose, goals, objectives and policies of the Comprehensive Plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct, and they are made a specific part of this Resolution. 2 RESOLUTION #2021-060 AMENDED 4/27/2021 Section 2. That the City's staff report (SP-38-08MOD2/VA-005-20/VA-006-20/SE- 008-20/OT-024-21) is ratified and confirmed as being true and correct and is made a specific part of the Resolution as finding of fact. Section 3. That pursuant to LDC, Part 6, Article 635 entitled "Site Plans", the following site plan, attached as Exhibit "B," which is made a part of and incorporated into this Resolution by reference, is approved. Section 4. That pursuant to the LDC, Part 6 of the LDC, Article 625, entitled "Variance", the following variance applications are approved consistent with the site plan provided in Exhibit "B": variance (VA-005-20) and variance (VA-006-20). Section 5. That pursuant to LDC, Part 6 of the LDC, Article 630, entitled "Special Exception Uses", the special exception application (SE-008-20) is approved consistent with the site plan provided in Exhibit `B". Section 6. That pursuant to Chapter 28, entitled, "Land Development Regulations", Part 6, entitled, "Development Review Procedures and Requirements", the site plan (SP-38- 08MOD2), is approved with the following conditions of approval: 1. Identify ROW lines, dimensions and grading on the Project/Property. (Engineering) 2. Show sight -visibility triangle of 25' at all proposed driveways and/or ingress -egress. Missing at entrances/driveways on driveways and FDOT Index 546 on all ROW, showing minimum distances as per speed within Passenger Vehicle/SU Vehicle/ Combination Vehicle Tables. e.g. Number of lanes — Divided -Undivided — and ways, flared, etc. (Engineering) 3. Any road cuts for utilities, curb cuts and/or others with the City ROW shall be restored to full lane width for 50' minimum length centered on the proposed cut. (Engineering) 4. Provide Maintenance of Traffic (MOT) Plan by a licensed General Contractor/Professional Engineer in the State of Florida (If applicable). (Engineering) 5. In accordance with City Code of Ordinances in Article 415. SIDEWALKS AND SWALES, Owner is responsible for the construction of sidewalks / swales within the road ROW when buildings are constructed or substantially improved. - Provide the following civil engineering drawings, signed and sealed by a Florida registered professional Civil Engineer. (Engineering) 6. A Preliminary Conceptual Paving, Grading and Drainage Plan was provided. Please provide a complete PGD Plan including sizes and dimensions of all storm -water 3 RESOLUTION #2021-060 AMENDED 4/27/2021 infrastructures. Please be advised that all storm drains shall be constructed with RCP and/or approved equivalent piping in the City ROW. Provide table of conflict points between utilities. Provide Drainage Structures Tables. E.g. Different FFE, verify unidentified drainage well, clarify roof drainage connections. See Mark -Ups. (Engineering) 7. Provide an on -site drainage system plan along with storm -water management calculations (signed, sealed and dated by a registered professional engineer) including geotechnical information supporting the proposed drainage design.. The calculations shall show how the minimum crown of the road and finished floor elevations are met, and how the 25-year, 3 day storm event is maintained on site with zero discharge to the ROW and adjacent properties. The site must store at least the 25 year, 3 day event onsite with NO EXCEPTIONS. Provide a copy of pre -and-post development storm -water management and drainage calculations. The City specifically needs the following information: 5 Year, 10-year, 25-year, and 100, year 1, 24- hour and 72-hour flood stage elevations respectively. Showing Lowest minimum Inlet Elevation, Parking Lot Minimum Design Elevation, Crown of Road Elevation, Minimum Berm Elevation, FFE including 100 Year Flood Map. Storm -water quality design shall be provided in the amount of 2.5 inches times the percent impervious or the first 1 inch of rainfall over the entire site whichever is greater. Be advised that the applicant shall not be authorized to connect the on -site drainage system to those within the public ROW of FDOT, BCHCED, and/or the City. Provide authorization as appropriate from FDOT, BCHCED, and/or the City for the existing and proposed connections between the on -site drainage system and public ROW. Clarify existing drainage system connection to any basin or any existing offsite drainage system. Provide copies of Broward County 100 Year Elevations and FEMA Flood Designations maps. (Engineering) 8. Identify and describe location of building(s) roof drains, and their proposed connection(s) to the onsite drainage system. Please provide Florida Department of Environmental Protection's Permit. (Engineering) 9. A preliminary conceptual proposed water and sewer -utilities —plan was provided. Please, provide a complete Utilities Plan indicating all water and sewer appurtenances including but not limited to point of connection to the existing system, cleanout, water meter, check valve, etc. See mark ups. (Engineering) 10. Provide utility piping conflict details plan, along with documentation to demonstrate acceptability of the separation between water, sanitary, storm -water service lines, etc. (Engineering) 11. Show also all existing and proposed utilities on the landscaping plans for potential conflicts. (Engineering) 12. Please Provide a Complete Pavement, Marking and Signage Plan with details. (Engineering) 4 RESOLUTION #2021-060 AMENDED 4/27/2021 13. Provide ADA parking, access / driveway, and sidewalks /ramps including dimensions in accordance with Chapter 553 of the Florida Statutes. "Accessibility of Handicapped Persons" and latest edition of "Accessibility Requirements Manual" by Department of Community Affairs, Florida Board Building Codes and Standards, and'in accordance with Americans with Disability Act (ADA). Be advised that ADA van accessibility for structured parking garages (including automated parking) shall be provided as appropriate and consider the taller specialized ADA vehicles. (Engineering) 14. Contractor shall provide, before issuance of C.O., to the FOR and City of Dania Beach" a CD with a full As -Built drawings of the project giving horizontal and vertical dimensions of all the Utilities connections signed and sealed by a registered surveyor. (Engineering) 15. Provide drawing file (dwg or dgn) disk of the approved site plan in Florida State Plane Coordinate (NAD 83). This should be addressed as part of the final submittal. (Engineering) 16. Provide regulatory agencies' approval documentation ( Florida Department of Environmental protection, BC PDMD - Transportation Concurrency Satisfaction Certificate, - Environmental Review Approval Certificate, BC HD — General Permit for Water Extension, BC EEPD- Environmental Resource Permit - Surface Water Management - License for Installation of Wastewater Collection/Transmission System, BC WWED -Utility Connection Permit -, BC Aviation Department, FAA, BC Planning Council, BC Asbestos Program Certificate of Submittal, etc.), including Utility / ROW/ Drainage Connection and Access Driveway permits from FDOT, BC and City prior to issuance of the Building Permit as applicable. (Engineering) 17. The school shall provide traffic control personnel during the peak times of operation to assist with guiding traffic in and out the site safely. School shall ensure that personnel at the entrance to the north access point keep the traffic flowing on SW 40th Avenue as they are entering the site and discourage any vehicle traveling southbound on SW 40th Avenue attempting to turn eastbound or left onto the site. (Traffic Engineering) 18. The school should provide guidelines to the parents picking up and dropping off students at the school, including periodic reminders. The guidelines should include specific instructions as to how to use the northern and southern access points to this site. Specifically, the school will only be accessed from the south side of SW 40th Avenue at the northern driveway, adding that any left turns onto the site will not be allowed. (Traffic Engineering) 19. Add visual cues (i.e. traffic cones) to indicate that the southern access is not open to school traffic during peak times. Only allow for emergency access during peak times if needed. (Traffic Engineering) 20. If feasible, the school should consider modifying the dismissal periods from the currently established times for 3 :15 pm and 4:25 pm to a time that wouldn't conflict with the regular 5 RESOLUTION #2021-060 AMENDED 4/27/2021 afternoon peak hour for traffic typically travelling on SW 40th Avenue, from 4 pm to 6 pm. (Traffic Engineering) 21. As a condition of approval, the applicant should provide a traffic engineering report to confirm the assumptions made on the traffic study. The report should be based on actual findings after conducting an evaluation of the traffic operations plan for this site six months after the school has been fully operational. The applicant should provide a report to the city with a full description of what has been evaluated, including conclusions and recommendations. If traffic operational deficiencies are detected as a result of the evaluation, the applicant should provide mitigation measures. A second follow-up report should be provided to the city after a year of the site being fully operational, or six months after the first evaluation, following the same format as the initial report. (Traffic Engineering) 22. Proposed project requires the installation of a fire sprinkler system without a fire pump. (Fire) 23. The fire protection level of service requirement for the project site as per the design profession of record is: N/AGPM at 20 PSI residual pressure in the public water supply system for non -fire sprinkler (hydrant) fire protection requirements, and 1132 GPM at 75 PSI residual pressure in the public water supply system for the fire sprinkler system. (Fire) 24. The proposed number and location of fire hydrants is acceptable for this project. (Fire) 25. Per Article 811, new development and redevelopment in non-residential, mixed -use and multi -family zoning districts valued at $1 Million dollars or more shall provide fee for the creation, acquisition and installation of public art in the city. a. Pay In -Lieu Public Art Fee: Pay one-half of one percent (0.5%) of the cost of the proposed development project, as an "in -lieu" public art fee, with a minimum payment of $5,000 and a maximum payment of $250,000; or b. Combination of In -Lieu Public Art Fee and Placement of Art on Site: Placement of art on the site of the development project, which shall have a minimum value of one -quarter of one percent (0.25%) of the cost of the proposed development project combined along with a one -quarter of one percent (0.25%) payment of an "in -lieu" public art fee. The owner shall provide documentation to the City that the art fee has been deposited into an escrow account for said purpose prior to the issuance of a building permit. Prior to placement on the development site, the art must be approved by the Community Services Director or designed and conform to the adopted public art guidelines. Section 7. That pursuant to LDC Section 635-100 "Expiration of Site Plans", the site plan (SP-38-08MOD) shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the improvements shown on the site plan, within eighteen (18) months from the date of this Resolution. 6 RESOLUTION 42021-060 AMENDED 4/27/2021 Section 8. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency, and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 9. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 10. That this Resolution shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED on April 27, 2021.
