HomeMy WebLinkAboutR-2021-059 800 Old Griffin, LLC Site Plan (SP-087-20), Design Exception (OT-012-21), Variances (VA-006-21, VA-007-21, VA008-21, VA-009-21) AMENDED 4-27-21RESOLUTION NO.2021-059 AMENDED A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE REQUESTS FOR A SITE PLAN (SP- 087-20), DESIGN EXCEPTION (OT-012-21) AND VARIANCES (VA-006-21, VA-007-21, VA-008-21 AND VA-009-21) SUBMITTED BY LAWRENCE KRAMER ON BEHALF OF 800 OLD GRIFFIN, LLC., FOR THE PROPERTY AT 800 OLD GRIFFIN ROAD, IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A," A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONFLICTS; AND FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, The City Code of Ordinances, Chapter 28, "Land Development Code" (the LDC), of Part 6, "Development Review Procedures and Requirements," Article 635, "Site Plans," states that Site Plan approval is required as a condition to the issuance of a building permit; and WHEREAS, Lawrence Kramer, on behalf of 800 Old Griffin, LLC., (the Applicant) has requested Site Plan approval (SP-087-20) to allow the addition of an office to an existing building, the construction of 17 boat docks, an outdoor storage area for 20 boats, and surface parking for 87 cars on the property at 800 Old Griffin Road (the Property) as legally described in Exhibit "A;" and WHEREAS, Chapter 28, Part 5 of the LDC, Article 511, "Industrial Design Standards," Section 511-20, "Applicability," states that the City Commission may approve Exceptions to the Industrial Design Standards as conditions to a site plan approval based on its determination that the Applicant has demonstrated that the necessary criteria identified in the LDC have been satisfied; and WHEREAS, the Applicant has requested a Design Exception from the Industrial Design Standards (OT-012-21); and WHEREAS, there are circumstances peculiar to the site or the intended use that makes compliance with a particular requirement of this article impracticable; and WHEREAS, the applicant has offered significant enhancements to other pertinent aspects of the site that the City Commission determines will offset any negative impact that an exception to these standards might otherwise create; and WHEREAS, the property does not front on a collector or arterial roadway; and WHEREAS, the requested Exception from the Industrial Design Standards is consistent with Section 511-20 of the LDC; and WHEREAS, Chapter 28, Part 6 of the LDC, Article 625, "Variances," Section 625-40, "Variance Review Criteria; City Action," states that the City Commission may grant a Variance based on its determination that the Applicant has demonstrated that the necessary criteria identified in the LDC have been satisfied; and WHEREAS, the Applicant has requested a Variance (VA-006-21) to permit no more than a four (4) foot street setback where Section 303-100 of the LDC, titled "Marine district", states that 30 feet are required; and WHEREAS, the Applicant has requested a Variance (VA-007-21) to allow no right-of- way dedication to the south of the Old Griffin Road Centerline where Section 815-30, of the LDC, titled "Undesignated streets", requires a minimum dedication of 13 feet; and WHEREAS, the Applicant has requested a Variance (VA-008-21) to allow perimeter buffer trees to be 14 feet tall where Section 275-120 of the LDC, titled "Perimeter buffer landscape requirements for business, commercial and industrial properties", requires a minimum of 16 feet; and WHEREAS, the Applicant has requested a Variance (VA-009-21) to allow a reduction in the tree type percentage where Section 275-190 of the LDC, titled "Plant material and installation requirements," requires a minimum of forty percent (40%) of the required trees to be shade trees, thirty percent (30%) maximum intermediate trees and maximum of ten percent (10%) small trees; and WHEREAS, the requested Variances maintain the basic intent and purpose of the subject regulations, particularly as it affects the stability and appearance of the city; and WHEREAS, the requested Variances are otherwise compatible with the surrounding land uses and would not be detrimental to the community; and WHEREAS, the requested Variances are consistent with, and in furtherance of, the goals, objectives and policies of the adopted Comprehensive Plan, as amended from time to time, and all other similar plans adopted by the city; and WHEREAS, the requests more particularly further Policy 1.62 of the Future Land Use Element of the City of Dania Beach Comprehensive Plan, titled "Marine Industrial Uses," which states that the "[... ] Marine Industrial development shall be planned, designed, and built to be as 2 RESOLUTION #2021-059 AMENDED 4/27/2021 fully enclosed in buildings as is reasonably possible and to minimize adverse secondary impacts of noise, outdoor activities, environmental pollution, vibration, dust, odors, is generat[ed], or other physical activity [... ];" and WHEREAS, substantial improvements are proposed for this marine development including the enclosure of the ongoing industrial marine activities; and WHEREAS, the plight of the petitioner is due to unique circumstances of the property or petitioner which would render conformity with the strict requirements of the subject regulations unnecessarily burdensome; and WHEREAS, that the variance requested is the minimum variance that is necessary to afford relief to the petitioner, while preserving the character, health, safety and welfare of the community; and WHEREAS, the requested Variances are consistent with Section 625-40 of the LDC, titled "Variance review criteria; city action;" and WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS, the City Commission finds that the approval of the proposed Site Plan (SP- 087-20), Exception (OT-012-21) and Variances (VA-006-21, VA-007-21, VA-008-21 and VA- 009-21) will protect the public health, safety, and welfare of the residents of the City, and furthers the purpose, goals, objectives, and policies of the Comprehensive Plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing WHEREAS clauses are ratified and confirmed as being true and correct and they are made a part of and incorporated into this Resolution by reference. Section 2. That pursuant to Chapter 28 "Land Development Code," Part 6 "Development Review Procedures and Requirements," Article 635 "Site Plan," the following Site Plan (SP-087-20), attached as Exhibit `B" is approved. Section 3. That pursuant to Chapter 28 "Land Development Code," Part 5 "Signage and Design Regulations," Article 511, "Industrial Design Standards," Section 511-20, "Applicability," the requested Exception (OT-012-21) to the Industrial Design Standards is approved consistent with the Site Plan provided in Exhibit `B". 3 RESOLUTION #2021-059 AMENDED 4/27/2021 Section 4. That pursuant to Chapter 28 "Land Development Code," Part 6 "Development Review Procedures and Requirements," Article 625 "Variances," the following Variance Applications (VA-006-21, VA-007-21, VA-008-21 and VA-009-21) are approved consistent with the Site Plan provided in Exhibit `B." Section 5. That the approvals granted by this Resolution are subject to the Applicant's compliance with the following conditions: 1. That the vacation request, VC-10-21, be approved by the City Commission on second reading and prior to submittal of a building permit. (Planning) 2. PUBLIC ART PROGRAM: Per Article 811, the project is estimated to have a construction value in the $2 million range. The Public Art impact fee is estimated at $10,000 (one-half of one percent (0.5%) of construction value). The final amount will be calculated and due at the time of building permit issuance. (Planning) 3. RAC TRAFFIC IMPACT MITIGATION: In accordance with Section 810-70 and Resolution No. 2014-049, a fee in the amount of $21.26 per p.m. peak hour trip is required for this proposal. Based on the traffic study by KBP Consulting, Inc., dated January 2021, 34 net new PM Peak hour trips will be generated by this development, and a fee of $212.60 shall be paid prior to issuance of a building permit. (Planning) 4. The Applicant shall provide a recorded copy of the dedications and vacations, as depicted on Sheet SP-1. I, at the time of building permit. (Civil) 5. The submitted Drainage Statement, Report and Calculations are unsatisfactory and not approved with the Site Plan application. Onsite drainage basin shall contain 25-year 3-day rainfall without offsite discharge or overflow. Drainage facilities for offsite roadways shall be provided to protect the road crown for a minimum of 5-year 1 day design storm events. (Civil) 6. Provide drainage facilities along Old Griffin Road. (Civil) 7. Please provide satisfactory Topographic Survey. The provided survey is unsatisfactory and incomplete. (Civil) 8. The Site Plan approval shall be concurrent with Variance approvals. (Civil) 9. In accordance with City Code of Ordinances in Article 415. SIDEWALKS AND SWALES, Owner is responsible for the construction of sidewalks / swales within the road ROW when buildings are constructed or substantially improved. (Civil) 4 RESOLUTION #2021-059 AMENDED 4/27/2021 10. Provide BC standard details for pavement marking and signage. All traffic control signs shall conform to Broward County Traffic Engineering (BCTED) and MUTCD standards. BCTED signs specifications consist of Type XI retroreflective sheeting materials except for school zone and pedestrian signs which shall be comprised of retroreflective fluorescent yellow -green sheeting certified type IV. (Civil) 11. All pavement markings shall be alkyd -based thermoplastic and fully retro reflectorized, per BCTED specifications with the exception of parking stall striping. (Civil) 12. Provide Maintenance of Traffic (MOT) Plan by a licensed General Contractor/Professional Engineer in the State of Florida (If applicable). (Civil) 13. Detail and complete satisfactory engineering plans, satisfactory Drainage Report/Calculations will be required prior to Building and R/W permit approval. (Civil) 14. Provide utility piping conflict details plan, along with documentation to demonstrate acceptability of the separation between water, sanitary, storm -water service lines, etc. (Civil) 15. Show also all existing and proposed utilities on the landscaping plans for potential conflicts. (Civil) 16. Provide ADA parking, access / driveway, and sidewalks /ramps including dimensions in accordance with Chapter 553 of the Florida Statutes. "Accessibility of Handicapped Persons" and latest edition of "Accessibility Requirements Manual" by Department of Community Affairs, Florida Board Building Codes and Standards, and'in accordance with Americans with Disability Act (ADA). (Civil) 17. Provide drawing file (dwg or dgn) disk of the approved site plan in Florida State Plane Coordinate (NAD 83). This should be addressed as part of the final submittal. (Civil) 18. Provide regulatory agencies' approval documentation and Permits/Licenses (as applicable) as part of the final submittal, prior to issuance of the Building Permit (Broward County Surface Water License, Broward County EPGMD Wastewater Permit, Florida Department of Environmental Protection, FDOT, BC Environmental, BC Aviation, BCTED etc.). Also, include Utility / Right of Way Permits from City, Broward County, and State Roads as applicable. (Civil) 19. Wayfinding signing details shall be provided by the applicant that should show at a minimum direction, dimension of signs and installation details. The purpose of the 5 RESOLUTION #2021-059 AMENDED 4/27/2021 wayfinding signing is to guide the site traffic to the new boat storage located on Parcel G. (Traffic) 20. The crosswalk across Old Griffin Road and its associated signage shown on the Master Site Plan (drawing MSP-I) cannot be constructed until after an engineering study has been performed once the site has been in operation for at least six months, as discussed in the meetings with the applicant. The applicant should coordinate with Broward County to obtain the requirements of the study and subsequent approval prior to the installation of the crosswalk and signage since Old Griffin Road is under County jurisdiction. (Traffic) 21. The crosswalk(s) along Old Griffin Road shall be approved by the City Engineer and Broward County prior to issuance of a building permit. (Planning) 22. Plans from all disciplines, including but not limited to Landscape, shall be consistent with the Master Site Plan sheet prior to building permit submittal. (Planning) 23. Construction truck traffic to be limited to Old Griffin Road, not neighborhood streets. (Planning) 24. No boat repairs are allowed on the docks. (Planning) Section 6. That pursuant to LDC Section 635-100 "Expiration of Site Plans," and Section 625-50 "Expiration of Variances," the Site Plan (SP-087-20) and Variances (VA-006-21, VA-007-21, VA-008-21 and VA-009-21) approvals shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the improvements shown on the Site Plan, within eighteen (18) months from the date of this Resolution. Section 7. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency, and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 8. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 9.
