HomeMy WebLinkAboutR-2021-077 Waiver of Collective Bargaining for Addition of Juneteenth as Paid HolidayRESOLUTION NO.2021-077 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, JOINING WITH THE AMERICAN FEDERATION OF STATE, COUNTY AND MUNICIPAL EMPLOYEES ("AFSCME") UNION IN WAVING COLLECTIVE BARGAINING OVER THE ADDITION OF JUNETEENTH AS A PAID HOLIDAY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City and AFSCME are parties to a Collective Bargaining Agreement which provides AFSCME bargaining unit employees with eleven (11) paid holidays; and WHEREAS, City Resolution No. 2021-020, dated February 9, 2021, established Juneteenth as a City holiday and provided as follows: Section 2. That the City Commission of the City of Dania Beach, Florida recognizes "Juneteenth" as a City Holiday. Juneteenth will be effective immediately for all City employees whose classifications are not covered by the AFSCME bargaining unit, and, recognizing that the City may not unilaterally enhance benefits for unionized employees, effective for AFSCME bargaining unit employees immediately following the successful completion of the collective bargaining process, as required by law; and WHEREAS, the Juneteenth paid holiday was incorporated into the City's Personnel Policy Manual ("PPM") which is applicable to non -bargaining unit City employees but not yet applicable to AFSCME employees as the result of AFSCME's decision to defer discussion of the PPM negotiations until the next Collective Bargaining Agreement, which negotiations will not occur until late Spring or early Summer 2022; and WHEREAS, on May 19, 2021, AFSCME representatives requested a waiver of the collective bargaining agreement so that its bargaining unit members may have Juneteenth as a paid holiday for 2021 and prior to the next round of collective bargaining; and WHEREAS, although the City Commission finds it better practice to negotiate benefit issues such as paid holidays in combination with all other wage and benefit issues when collective bargaining occurs in full, the City Commission also finds that the first City celebration of Juneteenth is sufficient grounds for a limited waiver of collective bargaining so that all City employees can celebrate the day as a paid City holiday; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "Whereas" clauses are ratified and confirmed to be true and correct and they are made a part of and are incorporated into this Resolution by this reference. Section 2. That the City Commission of the City of Dania Beach, Florida waives collective bargaining with AFSCME so that AFSCME bargaining unit employees may join in the City's first Juneteenth celebration on June 19, 2021 on an equal basis as non -bargaining unit City employees that are covered by the PPM who will be paid for the holiday. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 4. That this Resolution shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED on May 25, 2021. ATTEST: V r.
