Approval of Minutes of the Planning and Zoning Board /Local Planning Agency fr•oon the March 17, 2021 virtual regular Kneeling. Chair Robertson spoke about a correction to the March 17`I' minutes under the Public Hearings Section for VA-005-21 to fix the typo in the First paragraph, line 4, and reflect the lot size correctly as 6,000 sq. ft. III. PUBLIC HEARINGS 1. VC-010-211: The applicant, Lawrence Kramer, on behalf of the property owner 800 Old Griffin, LLC is requesting a vacation of right-of-way for the portion of NW 3 Place located between NW 8 Avenue and NW 9 Avenue. Assistant City Attorney Eve Soutsis swore in Assistant Director Community Development Corinne Lajoie, Planning and Zoning, Manager Richard Lorber, and Senior Planner Anne -Christine Carrie, Senior Planner Anne -Christine Carrie gave a PowerPoint presentation stating that the property was in the Marine Zoning District (MA) and land use was Regional Activity Center (RAC), The applicant was proposing to vacate approximately 300 linear feet of right-of-way (ROW) on NW 3 Place between NW S Avenue and NW 9 Avenue, This request was being made before Site Plan approval for redevelopment of the site. If it was vacated, the owners would then own the full width of the ROW. The Land Development Code (LDC) was where the vacation process was identified and required the applicant to provide evidence of notification to all public and private utilities that may have an interest in the proposed vacated area, The LDC stated that the City Commission could approve, approve with condition, or deny a request to vacate a ROW based on certain criteria. Ms. Carrie went over the criteria and stated that the applicant demonstrated the request was consistent with all the criteria. The vacation application was reviewed by the Development Review Committee (DRC) and that the vacation request required two City Commission public hearings. Tonight, the Planning and Zoning Board was to make a recommendation to the City Commission. She told the Board that the applicant was online to answer any questions. Albert Jones asked about the width of easement and Senior Planner Carrie explained that it was a 9,000 sq. ft. public road and not an easement. This owner would have 9,000 sq. ft. added to its property. She further answered that the utilities were notified that the vacation would come forward and to her knowledge, none of the utilities expressed interest. Chris Burke, applicant, was sworn in by Assistant City Attorney Eve Boutsis, and testified that all the notified utilities came back with no interest in having continuing access to the roadway. There were no current easements on the roadway except for City water and the City would maintain having that easement. Albert Jones also wanted to know the value of the street being vacated and any future vacation value amounts. City Attorney Boutsis explained that in this case, they originally gave us the land. By the vacation, this was being returned to the original property owner. Vice Chair Harris stated that based on the pages in the packet and all the applicant's due diligence, this would be a marine inspired business that would create some type of revitalization on the Old Griffin Road corridor. This was a job creator and a business creator that was consistent with the post- COVID recovery program in the County and in our City. He would like to move the item, if there were no more questions/comments. As no other board members wished to speak and no members of the public had questions/comments or wished to speak, the public hearing closed. Motion was matte by lice Chair Harris to recommend approval of fibs agenda item (VC-010-21) to the City Commission and was seconded by Derrick Hankerson. Motion passed 4-0. IV. BOARD ITEMS 1. Upcoming Meeting Dates. May 19, 2021 Assistant Director Community Development Corinne Lajoie said that there was already a May agenda item, so there would be a May meeting. V. REQUEST VARIANCE To place pool equipment at three (T-0) feet from the north side property line, where Section 215-50(E) requires a minimum of seven (7'-W) feet from the property line. PROPERTY INFORMATION EXISTING ZONING: Single -Family 8000 Residential (RS-8000) LAND USE DESIGNATION: Regional Activity Center (RAC) CODE VIOLATIONS There are no outstanding Code Violations. PUBLIC HEARING NOTICE This item was duly advertised, posted and noticed pursuant to Article 610 of the LDC. VARIANCE POOL EQUIPMENT The applicant, homeowner Charles Camacho, is requesting to locate pool equipment at a location In the side yard of the home, at three (3) feet from the side property line. Section 215-50(E) of the City's Land Development Code (LDC) requires a seven (7) foot side setback for single-family homes. The subject property at 206 NE 2"d Avenue is located adjacent to a platted alley on the north. The north side of the property is where the pool equipment is to be located. An existing six (6) foot high wooden fence screens the property from the alley and neighbors. The proposed location of the pool equipment minimizes any issues of disturbance to nearby neighbors. It is directly adjacent to an alley and screened by a perimeter fence, and is an acceptable iocation for the pool equipment. Section 625 of the City's LDC provides that the City Commission or Planning and Zoning Board, as applicable, shall hold its public hearing and, after consideration of the staff June 15, 2021 VA-081-20 Page 2 recommendation and public input, if any, may deny, approve or approve with conditions the application for variance, based upon its determination that the request meets the criteria identified In Section 625-40, which are identified below- (1) "That the requested variance maintains the basic intent and purpose of the subject regulations, particularly as it affects the stability and appearance of the city." The request maintains the basic intent of the code to permit pool equipment in a location that aloes not affect nearby adjacent properties. The proposed location for the pool equipment would be next to existing air conditioning equipment, screened by a wooden fence, and is adjacent to an alley rather than a private home or properly. (2) "That the requested variance is otherwise compatible with the surrounding land uses and would not be detrimental to the community. The proposed location for the pool equipment was chosen to best minimize any negative impact on neighboring residential properties and is next to an existing air conditioning unit, (3) "That the requested variance is consistent with, and in furtherance of, the goals, objectives and policies of the adopted Comprehensive Plan, as amended from time to time, and all other similar plans adopted by the city." The request in consistent with the goals, objectives and policies of the City's Comprehensive Plan, and especially with policies in Objective V of the Future Land Use Element. Maintain land development regulations, zoning ordinances and other administrative rules to implement the Comprehensive flan. (4) "That the plight of the petitioner is due to unique circumstances of the property or petitioner which would render conformity with the strict requirements of the subject regulations unnecessarily burdensome." The applicant has submitted a building permit application to the pool equipment in the optimal location. (5) "That the variance requested is the minimum variance that is necessary to afford relief to the petitioner, while preserving the character, health, safety and welfare of the community." The request is the minimum necessary in order to afford zoning relief to the applicant; granting the request would allow the homeowner to place the pool equipment next to the existing air conditioning unit, and nothing more. The applicant has provided written justification identifying how this request is consistent with these criteria. STAFr RECOMMENDATION Approve the resolution. V. 0 RESOLUTION NO.2021-PZ-002 A RESOLUTION OF THE PLANNING AND ZONING BOARD OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING A VARIANCE (VA-031- 21) TO SECTION 215-50(E) OF THE LAND DEVELOPMENT CODE, TO PERMIT POOL EQUIPMENT TO BE PLACED AT THREE (3%0") FEET FROM THE NORTH SIDE PROPERTY LINE, WHERE A MINIMUM OF SEVEN (7%0") FEET FROM THE PROPERTY LINE IS REQUIRED, SUBMITTED BY THE PROPERTY OWNER CHARLES CAMACHO, FOR PROPERTY LOCATED A,r 206 NE 2 AVE, 1N THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT `°A", A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. Beach, FL 33004, located within the RS-8000 Single -Family 8000 Residential Zoning District, legally described in Exhibit "A" and incorporated by this reference; and WHEREAS, LDC Section 625-40 states that the Planning and Zoning Board may grant a variance based on its determination that the Applicant has demonstrated that the criteria identified in the City Code have been satisfied; and WHEREAS, the Applicant proposes to place pool equipment at three (Y-0") feet from the side property line, where Section 215-50(E) requires a minimum of seven (7'-0") feet from the side property line; and WHEREAS, Section 215-50(E) permits pool equipment in a rear yard to be a minimum of five (5%0") feet from the side property line, but the applicant desires to place the equipment next to the existing air conditioning equipment along the side of the house in the side yard; and WHEREAS, the subject side yard of the applicant's house is adjacent to an unimproved alley and fully screened by a six-foot high side property fence, and therefore there is no potential for the subject pool equipment to disturb adjacent neighbors; and WHEREAS, the Applicant has provided sufficient justification demonstrating compliance with the approval criteria to meet the requirements of the Code-, and WHEREAS, the Planning and Zoning Board conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS, the Planning and Zoning Board finds that the Variance (VA-031-21) request is consistent with the LDC and Comprehensive Plan; NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING= AND ZONING BOARD OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. Section 4. Pursuant to Section 625-50 "Expiration of Variances," of the Land Development Code, the variance (VA-031-21) shall automatically expire and become null and void unless the applicant files a complete building permit application with construction drawings for the improvements shown on the site plan, within eighteen (18) months from the date of this Resolution. Section 5. That the associated Planning & Zoning Division Staff Report prepared for application VA-031-21 is hereby incorporated into this resolution as findings of fact. 06 Section 6. My home was built in 1977 & It is the last house on the street, Each side of the house does not have the variance required by today's law to install the new pool equipment or any equipment for that matter. when the house was built the air -conditioner was installed on the North side, which is adjacent to an alley way. This side of the house, has the electric service required, it is out of sight from any neighbors and since it is against the alley, any noise generating from the operating equipment will not be heard. The house Is surrounded by a fence which will also hide all the equipment as it sits today. Further on any safety issues or concerns, fire department, special services have an easier access in case of an emergency, since It is adjacent to the alley & it gives the affordability of fast & easy access. Our AC unit was an exception when the house was built due the South Side of the building only having 6' of easement between homes. The north side has 7.5 feet & it is backing up to the alley, this only make sense to add the pool equipment in keeping It all together for service & maintenance. REQUEST TEXT AMENDMENT 1, To increase maximum lot coverage and clarify pervious area calculations for townhomes: Section 205-10. 2. To clarify parking requirements for day care, preschool use; Section 265- 50. 3. To add bakeries, delicatessens, and coffee shops to the list of permitted uses allowing outdoor dining; Section 302-10. 4. To amend district maps for the South Federal Highway Mixed -Use zoning district to illustrate all property included in the district; Section 303-80. 5. To reduce the allowable square footage of a temporary sign; Section 505- 160, 6. To expand exceptions and temporary uses; Section 635-100 & On September 14, 2010, the City Commission approved the City's new Land Development Code (LDC) referred to as OneCode. As staff continues to use the new regulations, scrivener's errors, inaccuracies and vague, imprecise or ambiguous language continues to emerge, some of which staff is proposing to address at this time. In addition, overtime any set of regulations becomes antiquated unless periodically updated. The following amendments to the Unified LDC are proposed, 1. TOWNHOMES This amendment increased the allowable building coverage from forty percent (40%) to fifty (50%) per lot. This amendment also clarifies pervious area is calculated per development projects, assuming each townhouse lot ]:1 P&Z Work Folder\V-7. Starrkeports1202116-16\'1'X-032,21 Townhows atc,doc is calculated at maximum buildout_ This will ensure minimum pervious area is maintained on townhouse developments while allowing townhouse owners to install a patio behind their unit, 2. PARKING — DAY CARE This change will add clarifying language to the parking requirement for daycare use. The parking requirement is one (1) parking space for each 400 square feet or five (5) parking spaces; whichever is greater. This parking requirement is not changing. 3, OUTDOOR DINING This amendment adds bakeries, delicatessen, and coffee shops to the list of uses allowing outdoor dining as an accessory use. The amendment also deletes reference to internet cafes. 4. (H) Temporary special event signs, other. Temporary special event signs for commercial uses are permitted only for grand openings, semi-annual sales, licensed going out of business sales, established legal holidays, and changes in ownership or management. Noncommercial entities can only qualify for a legitimate, established activity or event directly related to their function or purpose as determined by the director, including but not limited to, grand openings and special promotions. (4) Permitted signage. Total signage for any special event shall not to exceed one hundred sixty (160) square feet of total signage and twenty (20) signs. The total peiTnissible signage may be allocated among the different types of authorized signage, but is subject to the restrictions on size and number established below for each type of sign. For establishments with more than one building frontage, the longest such frontage that has a public entrance shall be utilized to calculate allowable signage area. (a) Attached banner signs. 1. Two (2) square feet of banner signage is permitted for each foot of building frontage of the establishment having the special event, not to exceed effe hundred +went,� fifty 50 square feet per building frontage. Sec, 635-20. - Applicability. (B) Small-scale site plain. A site plan shall be processed under the small-scale site plan procedure if the site plan complies with the following limitations: (1) A net land area of one (1) acre or less; and (2) Fewer than fifty (50) dwelling units, or (3) Fewer than twenty thousand (20,000) square feet of nonresidential use; and (4) Does not include both residential and nonresidential uses; and (5) Does not include a request for assignment/allocation of residential dwelling units or nonresidential acreage under the flexibility provisions of the Braward County Land Use Plain. Sec, 635-1 OD. - Expiration of site plans; procedure for extension, (A)All site plan and site plan modification approvals automatically expire and become null and void unless the applicant filed complete building permit applications with construction drawings for all improvements shown on the site plan within eighteen (1 8) months from the date of site plan approval, and the permits remain valid until a certificate of occupancy or its equivalent is issued for the improvements_ x ARTICLE 675. - TEMPORARY USE AND SPECIAL EVENT PERMITS See. 675-20. - Temporary uses authorized. (A) All temporary uses or special events must be located on developed property with an active business tax receipt issued by the City, or upon city property as authorized in accordance with this article, and must meet one of the following criteria: (1) The temporary use or special event must benefit a business currently licensed and occupying a permanent place of business in the City; or (2) The temporary use or special event must benefit a not -for -profit entity or charitable organization; or (3) The temporary use or special event must be organized and operated solely for charitable purposes; or (4) The temporary use or special event must be a private gathering, This section does not to apply to local shows or amusements held in theaters, auditoriums or permanent buildings designed and permitted for asser bly uses. (B) The following temporary uses and special events shall be approved by the City Commission after staff review and recommendation, as provided in this subsection. (1) Events with more than five hundred (500) persons in attendance, as estimated by the parks and recreation director; or (2) Consecutive Multi -day events.; -mot The City Commission may, in its initial resolution approving a temporary use, authorize the subsequent administrative approval by the City Manager or designee of a 'future event or use that recurs on a regular basis (e,g,, approved events or uses recurring manually, or approved events or uses recurring seasonally but no more than four (4) times per calendar year) at specific locations except as provided in section 675-20(F) and section 675-20(G). Recurring events subject to administrative approval shall be consistent with all terms and conditions provided in the original resolution providing for temporary use approval. (C) Notwithstanding the provisions of this section, the following temporary uses are authorized in the commercial, industrial and CIA mixed -use districts, and on lots developed for assembly and institutional uses in other zoning districts subject to approval of the City Manager or designee after staff review and recommendation, as provided in this subsection. The City Manager or designee may require City Commission approval of any temporary use or special event which is normally subject to administrative approval under this subsection, if the City Manager or designee has determined that neighboring property may be impacted by the proposed event. (1) Temporary sales of a seasonal nature (e.g., holiday sales of Christmas trees, pumpkins for Halloween), excluding fireworks and sparklers; and (2) Events with less than five -hundred (500) persons in attendance. (D) The following temporary uses are permitted without further review, in connection with development projects which are subject to City Commission approval, unless the use was previously reviewed during the site plan approval process, in which case administrative approval is authorized. (1) Offices for sale of real estate or for persons engaged in the development, within temporary buildings or office trailers which are approved consistent with all building permit submittal requirements for temporary structures, (2) Construction materials storage and processing. (3) Equipment storage. (4) Model homes or sample apartments. (5) Activities of religious, institutional, or governmental entity under construction, reconstruction, renovation or enlargement. (6) Ground -breaking ceremonies on the site of a future development. (7) Temporary parking associated with construction of an approved site plan.. Section If any clause, section, sentence or phrase of this Ordinance is for any reason held unconstitutional or invalid by a competent jurisdiction, the holding shall not affect the validity of the remaining portions of this Ordinance. Request Recommend approval of the Water Supply Plan for the City and associated amendments to the City's Comprehensive Plan regarding water supply. Background This is a recommendation for the Planning and Zoning Board, sitting as the City's Local Planning Agency, to recommend approval of the following: • amendments to the City's Water Supply Ilan + amendments to the City's Comprehensive Plan to reflect the 2018 update to the South Florida Water Management District Lower East Coast Water Supply Plan to address potable water supply for the City consistent with the proposed Water Supply Plan, and + City Commission adopt an ordinance to formally amend the plans as proposed. In 2005 the Florida Legislature enacted significant changes to Florida Statute (F.S.) Chapter 163 - Intergovernmental Resources and Chapter 373 - Water Resources to address the State's water supply needs. These changes required a stronger link between regional water supply plans prepared by water management districts and comprehensive plans prepared by local governments. In addition, improved coordination between local land use planning and local water supply planning was mandated. Dania Beach is located within the South Florida Water Management District (SFWMD) Lower East Coast (LEC) water supply planning area Chapter 163 F.S. and Chapter 373 F.S. requires that Dania Beach identify how future water supply needs will be met through the preparation of a Water Supply Plan (WSP). The WSP must have a minimum planning horizon of 10 years and must be incorporated into the Dania Beach Comprehensive Plan. The WSP must be completed within 18 months of the SFWMD adopting or updating its own regional LEC water supply plan. The most recent update to the SFWMD regional LEC water supply plan was prepared in November 2018. As such, Dania Beach must update its Water Supply Plan, Potable Water sub -element and any other corresponding chapters within its Comprehensive Plan. The attached proposed updates will serve to meet these requirements. Included in your packet for consideration is the relevant changes to Chapters 1, 4, 6, and 9 of the City's Comprehensive Plan, amended with regard to future water supply. The WSP is incorporated into Chapter 4 (Sanitary Sewer, Solid Waste, Drainage, Potable Water, Natural Groundwater Aquifer Recharge Element) as a sub -element in accordance with the Florida Statutes. The amendments are shown in strike-through/underline format. Only the sections of each chapter related to water supply were amended. The City of Dania Beach is served by the both the City and Broward County_ The area generally located east of Ravenswood Road is served by the City. Information from the City's amended Water Supply Flan prepared by public Utility Management & Planning Services, Inc. (City Consultant) is incorporated into the Potable Water Supply Sub -Element amendments attached. The area generally located west of Ravenswood Road is served by Broward County. Broward County's Water Supply Plan was adopted on March 28, 2019. Information from that Plan relevant to the City of Dania Beach is incorporated into the Potable Water Supply Sub -Element amendments attached. This Water Supply Plan must be incorporated into the City's Comprehensive Plan. Therefore, this item must be approved by ordinance, which required two readings by the City Commission. SANITARY SEWER SUB -ELEMENT A. Introduction The City of Dania Beach Charter establishes Departments of Public Works and Utilities whose responsibility is to oversee the operation, maintenance and construction of the City wastewater system. The area west of Ravenswood Road is served by Broward County Utilities. Dania Beach originally operated its own treatment facility but it was abandoned in 1974 and the City entered into a large user agreement with the City of Hollywood to provide for wastewater treatment. The City presently operates and maintains its own sanitary sewage collection system and sewage lift station. S. Existing Conditions The City sewage collection and transmission system consists of approximately thirty-three (33) miles of gravity sewer lines ranging from eight (8) inches in diameter to twenty-four (24) inches in diameter. There are eleven (11) sewage pump stations and approximately six (6) miles of sewage force mains with diameters of up to eighteen (18) inches. Approximately ninety (90) percent of the City is served by the sanitary sewer system with an area of single family homes located north and east of the Dania Cut -Off Canal and west of U.S. 1 presently being served by septic tank. The City still services about ninety (90) percent of developed areas within a sanitary sewer system. The area served by septic tanks in the City of Dania Beach is known as Melaleuca Isles which encompasses approximately 102 acres and 367 dwelling units which translates to a density of less than four (4) dwelling units per acre. This density does not exceed the maximum density for septic tanks as specified by State regulations. In addition, the area is fully developed at this time and no additional septic tanks are anticipated, The Broward County Health Unit is responsible for permitting septic tanks. At this time, representatives of the Broward County Health Unit are not aware of any problems related to the existence of septic tanks in the City. Specifically, no ground Page 1 Sanitary Sewer, Solid Waste, Drainage, Potable Water, Groundwater Aquifer Recharge City of Dania Beach water problems linked to the existence of septic tanks are known to exist. As indicated on Map 4, Soils Map, of the Comprehensive Plan Map Atlas, the soils in the area served by septic tanks are the Hallandale -Margate Association. According to the USDA Soil Survey of Broward County, these soils are described as follows: Hallandale soils are poorly drained and nearly level. Typically they have a thin surface layer of black fine sand, and subsurface layer of light brownish gray fine sand, and a subsoil of brown and yellowish brown fine sand that has slightly more clay than the subsurface layer. Beneath the subsoil is hard limestone. Depth to hard limestone ranges from 7 to 20 inches but is typically 16 inches. Margate soils are poorly drained and nearly level. Typically they have a surface layer of very dark gray fine sand and a subsurface layer of light brownish gray fine sand. The subsoil is brown fine sand that is slightly more clayey than the subsurface layer. It has a layer, about 4 inches thick, of brown fine sandy loam mixed with fragments of limestone. Hard limestone is at a depth of about 32 inches. Depth to hard limestone ranges from 20 to 40 inches. These soils are poorly suited to cultivate crops. For urban development, fill material must be added to the surface for building site. The area west of Ravenswood Road is served by Broward County. Broward County is currently preparing a master plan for their entire system. When available in early 1999, the data section will be updated. The remainder of the City"s commercial, industrial, multi -family and single family areas are served by sanitary sewer facilities. The area served by septic tank is of a relatively high elevation and has soils consisting of the Lauderdale --Dania Association. The septic tank area is essentially built out but any future septic tanks would be permitted on a case by case basis by the Broward County Public Health Unit, Septic tanks are permitted if existing sewers are more than 100 feet from a single family residence. The level of service for a septic tank maximum discharge as established by the Broward County Public Health Page 2 Sanitary Sewer, Solid Waste, Drainage, Potable Water, Groundwater Aquifer Recharge City of Dania Beach Unit is as follows: Residential 2,500 gallons/acre/day Commercial 1,500 gallons/acre/day with the following utilized as a design criteria for septic tank: Residential served by potable water .0574 gallons/day/s.f. Commercial .0034 gallons/day/s.f. The entire area served by septic tank has potable water service to the vicinity. The Broward County 201 facilities plan, as approved by the State, provided for the wastewater from the City of Dania Beach to be treated by the City of Hollywood Wastewater Treatment Facility. The Hollywood plant is located on a 32 acre site in the eastern portion of that City. The plant has a design capacity of thirty-eight (38) million gallons per day and currently treats approximately thirty-three (33) million gallons per day on an average day. The treatment is secondary and the disposal is via an ocean outfall. The City of Dania Beach utilizes the design flows established by the Broward County ❑epartment of Planning and Environmental Protection for determining the adequacy of wastewater service during the development review process. These flow items have adopted in Dania Beach Ordinance 4 1- 86 with the following flows being used to establish a level of service and an equivalent residential connection (ERC) being defined as the flow generated by a standard single family dwelling which shall represent three hundred (300) gallons per day of wastewater generated. The sewage lift stations and force main systems were analyzed in 1986 for the ultimate flow projections. Certain deficiencies were identified, such as undersized stretches of force main, undersized master meters and upgrading of pumps. These deficiencies were addressed by the City and the improvements have been completed. The remaining improvements to the system that would need to be addressed is the installation of a pump station and force main to service the north end of the Dania Cut -Off Canal, should the septic tank system fail. The gravity sewer collection system was installed by the City in the early 1960's and the installations are of vitrified clay pipe in organic soil areas. Some settlement has occurred, particularly in the eastern area of the City and infiltration is occurring. Inflow is also occurring due to flooding of streets in extremely low areas. The City performed an Inflow and Infiltration Study in 1984 with repairs being made in 1985 that accomplished a reduction in sewer flow of approximately 500,000 gallons per day. The City has undertaken a program whereby the gravity sewage collection system will be divided into three geographic sections, with each section being examined yearly for leaks and therefore the necessary repairs accomplished. It is estimated that this program will result in a savings of 500,000 gallons per day or approximately $250/day. The level of service standard for the City's sanitary sewer facilities shall be 300 gallons per day per residence which shall equal one ERC. The level of service standards as approved by the Broward County Department of Planning and Environmental Protection and the City Ordinance establishing design sewer flows shall continue to be utilized. D. Economic Assumptions The City of Dania Beach has two primary sources of income for wastewater expenditures. The first is rates for use which can be adjusted as needed and the second is unit and acreage charges or connection charges. Connection charges are established in Ordinance 4 1.--86 and are based on the estimated flow as determined in the level of service charts. They are collected from all new construction and are utilized only for capital expenditures and not operating. Any new wastewater infrastructure will be funded from the connection charges as will the ongoing Inflow and Infiltration Study. The inflow and infiltration examination is estimated to cost $35,000 per year. E. Goal, Objectives And Policies The goal of the Sanitary Sewer Element will be to provide wastewater customers, both new and existing, within the City of Dania Beach adequate sewerage facilities meeting all local, state and federal criteria. Objective I Continue to contract with the City of Hollywood to provide wastewater treatment. Policy 1,1 Negotiate a new Large User Agreement with the City of Hollywood to facilitate the treatment needs of Dania Beach. Objective II Meet the wastewater service demands of the City of Dania Beach. Policy 2.4 The City shall pledge approximately $30,000 per year to implement the inflow and infiltration study. Policy 2,5 The City shall continue to collect unit and acreage charges as a mechanism to provide for new wastewater capital expenditures. Objective III Provide sanitary sewer for the entire City. Policy 3.1 The City shall coordinate with Broward County in the planning process underway to replace the existing septic tanks in the area north of the Dania Cut -Off Canal and to determine a funding mechanism and timetable for the installation of the sanitary sewers. Objective IV Continue to require the use of sanitary sewer facilities by all new development so as to discourage urban sprawl. Policy 4.1 The City will discourage urban sprawl by requiring all new development to provide sanitary sewer facilities. Policy 4.2 The City will discourage urban sprawl by requiring single family residences to hook up to sanitary sewer facilities if they are within 100 feet of a sewer line. F. Plan Implementation And Monitoring Procedures The City of Dania Beach Growth Management Department shall prepare a list of goals, objectives and policies and distribute these to all affected City departments for their implementation. The Growth Management Department shall be responsible for monitoring these goals, objectives and policies and determining their compliance with the plan. The Growth Management Department will review yearly status reports from the Public Works and Utilities Department as to the achievements of the Page 10 Sanitary Sewer, Solid Waste, Drainage, Potable Water, Groundwater Aquifer Recharge City of Dania Beach goals, objectives and policies and shall ensure that adequate funding is budgeted to meet the same. The Growth Management Department shall immediately notify the City Manager and the City Commission of any unaddressed deficiencies so that they may be addressed. U.S011-I113 WASTE ELEMENT A. Introduction The City Charter of the City of Dania Beach establishes a Department of Public Works which has the responsibility of providing for fawn trash and brush pick up and administering the private contractor that picks up garbage. B. Existing Conditions The City of Dania Beach Public Works crews pick up lawn trash and brush on a continuous basis and haul the refuse to the National Resource Recovery site located at the Turnpike and S.R. 84 in Davie. The solid waste generated by other sources is hauled to the Reuter Recycling facility in Western Pembroke Pines. The facility has a design capacity of 660 tons/day. The current demand is 550 tons/day. The City of Dania Beach's portion of the demand is 10,000 tons/year or 27 tons/day. C. Analysis The City of Dania Beach entered into a disposal contract with Reuter Recycling of Florida Inc. for disposal of its processable waste. The contract, which was executed in 1988, provides for disposal of waste from the Cities of Pompano Beach, Hallandale, Pembroke Pines and Dania Beach. The plan is scheduled to go into production in July 1990 and will have a capacity of 200,000 tons per year. The contract allows that when a capacity of 175,000 tons per year is reached then the plant capacity will be increased by 100,000 tons per year to 300,000 tons per year, When a capacity of 275,000 tons per year is reached then the plant will be expanded to 400,000 tons per year. If a plant breakdown should occur then Reuter is responsible for providing an alternate means of disposal. The agreement is valid for 20 years after completion of the plant or until the year 2010. The plant is being designed to handle processable waste and to compost the product for ultimate sale. The contract calls for the following minimum waste stream for the City of Dania Beach. This facility has a design capacity of 660 tons per day. The current demand at the facility is 550 tons per day. The City of Dania Beach's portion of this demand is established at 29.5 tons per day. The City no longer hauls to the Central Disposal Land Fill facility. This shall be adjusted yearly by the average of the increase of the sum of the Producer Wholesale Price Index for Durable Goods and the Consumer Price Index, The fee shall be increased by "pass through costs" consisting of: a. $3.00/ton host fee for the City of Pembroke Pines; b. Any governmental taxes; c. The amount of land acquisition cost in excess of $2,400,000 subject to a maximum of $300,000 and the amount of earth removal and site development in excess of $2,000,000 subject to a maximum of $350,000; d. Any tipping fees or landfill surcharges in excess of $30.00 per ton For non-processable waste. The charges shall be prorated to the respective cities. The City of Dania Beach will charge its residents and customers a fee that will cover the expense incurred to Reuter Recycling of Florida, Inc. Goal, Objectives And Policies To provide a solid waste disposal means to the residents of the City of Dania Beach that is efficient, economical and environmentally sound. Objective I Meet the contractual obligations of the Reuter Recycling of Florida, Inc. contract. Policy 1.1 Encourage environmental awareness through composting and recycling. Policy 1.2 Attain the goals of an estimated 10,000 tons per year waste stream and 10 % per year increases. Objective II Adopt the standards of level of service as established by Broward County and the South Florida Regional Planning Council. Policy 3.1 Prohibit urban sprawl by requiring all residents and business to require solid waste pick up through the City of Dania Beach/Reuter contract. F. Plan Implementation The Growth Management Department of the City of Dania Beach shall prepare a list of goals, objectives and policies and distribute them to the Public Works Department to determine the compliance with the contract with Reuter Recycling of Florida, Inc. The City Manager and the City Commission shell also be provided the goals, objectives and policies. G. Monitoring And Evaluation Procedures The City Manager and Growth Management Department shall require an annual report from the Department of Public Works as to the actual tonnage of solid waste produced as well as the conformance to the level of service requirements. The City Manager and the Growth Management Department shall notify the Public Works Department of any deficiencies so corrective action can occur. III. DRAINAGE AND NATURAL GROUNDWATER RECHARGE A. Introduction The City of Dania Beach Growth Management Department is responsible for assuring proper drainage is installed on all new projects as per Section 4505 of the South Florida Building Code and the Public Works Department is responsible for existing systems and their extensions. This process is as per the City Charter and the Code of ordinances. Dania Beach also requires that projects obtain approval from the Broward County Water Management Division which follows the criteria as set forth in the "Grading and Drainage Regulations and Standards" Manual. The City also requires adherence to the "South Florida Water Management District Basis of Review" and the rules and regulations of the Broward County Department of Planning and Page 15 Sanitary Sewer, Solid Waste, Drainage, Potable Water, Groundwater Aquifer Recharge City of Dania Beach Environmental Protection. Any dredge and fill projects within the City require prior review of the U.S. Army Corps of Engineers and the State of Florida Department of Environmental Regulation. Due to the nature of the geography of the City and its drainage patterns it was chosen to combine the drainage element and the natural groundwater recharge into one element. B. Existing Conditions The primary drainage system of the City of Dania Beach, as well as Broward County, is controlled by the canal and pump system of the South Florida Water Management District (SFWMD). The SFWMD maintains a canal and pump systems and controls discharge based on the capacity of the system to remove storm water. Drainage systems primarily consist of storm sewers, exfiltration trench systems and onsite retention/detention systems. Retention/detention systems consists of Wet which retains or detains storm water in lakes and Dry which retains or detains storm water in areas that are normally dry. Both of these methods provide for storm water storage and aquifer recharge, however, dry retention systems provide for the added benefit of improving water quality due to the filtration action of the soils. The area is underlain by two aquifers, the Floridian and the Biscayne. The Floridian is confined and approximately 1,000 feet below the surface and is quite high in chlorides. The Biscayne Aquifer is essentially on the surface as is approximately 300 feet in depth. The Biscayne Aquifer is the primary source of drinking water. The western portion of Broward County through the 790 square mile conservation area is the primary aquifer recharge area. These areas are maintained by the South Florida Water District. Other aquifer recharge occurs through the Dania Cut Off Canal, exfiltration trench systems and onsite retention/detention areas. The southeast area of the City is quite low in elevation, having an average elevation of 4.0 to + .5.0 N.G.V.D. This area is drained by a series of storm sewers connecting to a 3-acre lake with a 15,000 gallon per minute pump system that discharges through a series of ditches to the Dania Cut-off Canal. The pump system is automatically operated and regularly maintained by Page 16 Sanitary Sewer, Solid Waste, Drainage, Potable Water, Groundwater Aquifer Recharge City of Dania Beach the Public Works Department. The antecedent stage of the lake can be regulated to prevent flooding. Other areas of the City are provided drainage either through natural percolation or exfiitration trench systems. The City adheres to the minimum standards of Broward County and the South Florida Water Management District and establishes the following levels of service. Road Protection Residential and primary streets crown elevation meet the minimum elevations as published on the Broward County 10 year Flood Criteria Map. Buildings The lowest floor elevation shall not be lower than the elevation published on the Broward County 100 year flood elevation map or 18 inches above the adjacent crown of road for residential and G inches above the adjacent crown of road for commercial/industrial. Storm Sewers Shall be designed using the Florida Department of Transportation zone 10 rainfall curves. Flood Plain Routing Modified SC5 routing method as established by the SFWMD "Basis of Review". Best Mana_gment Practice Efforts shall be utilized to use best management practice to reduce pollutants entering the groundwater. C. Analysis Of Existing System The drainage system of the City functions adequately and is able to meet the area wide level of service standards. The review process of new developments ensures that SFWMD, Broward County and City drainage and recharge criteria are met. This review is conducted based ❑n the fallowing criteria: Public road elevation: 10 year, one -day storm event. • Floor elevation: 100 year. Three day -storm event. Storm Sewers Shall be designed using the Florida Department of Transportation Zone 10 rainfall curves. Flood Plain Routing Modified SCS routing method as established by the SFWMD "Basis of Review". Best Management Practice Efforts shall be utilized to use best management practice to reduce pollutants entering the groundwater. The southeast area of the City located east of U.S. 1 and south of Dania Beach Boulevard perhaps has the most severe drainage problems. The area is quite low wilt elevations as low as +3.0 N.G.V.D. and the soils have poor percolation. The existing system consists of storm sewers and swale drainage being collected and discharged into a three acre lake. When the stage of the lake reaches elevation: +4.0, the 151,000 gallon per minute pump is started that discharges through a series of ditches to the Dania Cut Off Canal. The City has installed $200,000 worth of drainage improvements to the southeastern portion of the City, This included upgrading the pump system. The southwest and northwest area of the City is of a higher Page 18 Sanitary Sewer, Solid Waste, Drainage, Potable Water, Groundwater Aquifer Recharge City of Dania Beach elevation and soil permeability is greater. This area has utilized natural ground percolation and exfiltration trenches and the system functions to meet the level of service. The northeast area of the City is essentially undeveloped and any new development will meet the criteria of SFWMD, Broward County and the. City as far as attaining the specified level of service. Aquifer recharge occurs through the recently adopted Broward County Wellfield protection ordinance and Broward County Environmental Quality Standards as well as SFWMD standards. The western portion of Broward County through the 790 square mile conservation area is the primary aquifer recharge area for the City of Dania Beach and Broward County and these areas are maintained by the South Florida Water Management District. Other aquifer recharge occurs within the City limits through the Dania; Cut Off canal, exfiltration systems and on --site retention/detention areas. However, it is important to note that most of the entire limits of the City of Dania Beach are impacted by salt water intrusion due to its close proximity to the coastal areas of eastern Florida. Water quality is improved in the City through the encouragement of the use of swales and water detention/retention systems. The ratio of pervious area to impervious area is also utilized to encourage water quality. D. Economic Assumptions The indicated drainage improvements and system maintenance will be financed through general fund revenues, special assessments and developer contributions. E. Goal, Objectives And Policies Provide for storm water protection for the residents of the City of Dania Beach that assures flooding protection while encouraging water quality and aquifer recharge. Objective I Ensure flood protection. Policy 1.4 The City adopts the surface water standards of Chapter 27 Pollution Control of the Broward County Code of Ordinances (27-195) as the standards for stormwater discharge in the City. Objective II Encourage use of Best Management Practice for all drainage systems. Policy 2.1 Follow the regulations of Broward County and SFWMD to encourage Best Management Practice, Objective III Continue to implement drainage improvements in the southeast area of the city. Policy 3.1 Provide for necessary funds for southeast drainage improvements through the general fund, special assessments or developer contributions. Policy 3.2 In conjunction with linear park development on Southeast 5th Avenue, develop enhancements to drainage for the area. Objective V Work with Broward County and SFWMD to implement drainage rules and criteria. Policy 4.1 Establish staff communication and encourage utilization of Broward County and SFWMD criteria. Objective V Maximize water management systems, rules and regulations to discourage urban sprawl. Policy 5.1 The City Growth Management Department will ensure that water management criteria are utilized that discourage urban sprawl. Introduction The Charter of the City of Dania Beach provides for a Department of Public WeFl"' and UtilitiesServices which is responsible for the potable water treatment system and distribution system. The department's task is to assure the residents of the City with a safe, quality drinking water to half e€ the—ctrrefitportions of corporate limits; east of Ravenswood Road. The areas west of Ravenswood Road are served by Broward County_ Withdrawal of raw water from the aquifer is governed by the South Florida Water Management District. The BFeward f'ow�c F]Hh" - LJ..a lth I nitFlorida Department of Environmental Protection is charged with the responsibility of approving distribution systems and overseeing the operation of treatment facilities. The Broward County Environmental Protection Department is responsible for implementing wellfield protection protocols to protect wellfields throughout the county. B. City Water System 1. Existing Conditions The City's water system currently provide_ water for the portion of the City lying east of Ravenswood Road. The City of Dania Beach first constructed a well in the downtown area in the 1920s. In the _late 1940s new wells were constructed on the existing water plant site designated D E and F were installed near the current water plant along the Florida East Coast_ railroad. The plant itself was constructed in 1952,Much of the water distribution system east of the railroad tracks was constructed shortly thereafter. In the mid- 1960s the rest of the distributions stem was constructed west of the railroad tracks. plaFit along the Florida East Coast railroad. - Ilse of these wells has been discontinued due to high levels of chlorides in the water, and formally abandoned in 2007. These wells are currently in use (referenced as Wells G and H). These wells are restricted due to saltwater intrusion although it appears that the chloride content of the raw water is diminishing slightly with time and responds to rainfall. In 2010 the "H" well was no longer viable saltwater, well issues so a new well "I" was constructed. This well was to be shallower since saltwater underlies the City's wells. The City has been testing for salt water intrusion for the past five thirty fifteen years on a monthly basis in both the production wells and adjacent monitoring wells. The capacity of the 65-foot deep "G" well is has been reduced from 2100 to 1400 to 700 cipm in each of the last water use permits. The well is currently throttled to under 350 qpm when operating. The "I" well is 40 ft deep in sand. A screen was required to l2revent collapse. This well only um s 250 qpm. This report indicated that the Dania Beach wells were at their peak capacity and that a regional wellfield would provide the long-term permanent solution. The Broward County raw water agreement was executed in June 1990 between the City of Dania Beach and the County. An addendum was issued in 1994 because no water had been delivered by that date. See Appendix A: Broward County Raw Water Agreements. The concept was to permit several eastern communities, Dania Beach, Hallandale and Hollywood among them, to draw raw water from a new western wellfield to replace lost capacity in the eastern wellfields. The agreement has the following provisions: Page 24 Sanitary Sewer, Solid Waste, Drainage, Potable Water, Groundwater Aquifer Recharge City of Dania Beach • Defined the service area -- limiting Dania Beach to the then -City limits. • Created a large User Advisory Board that was to meet regularly • Determined that the County would construct the wellfield and all appurtenances • Defined a rate methodology for the raw water • Defined meter locations, readings, meter inaccuracies and a dispute resolution • Requires a 10% renewal surcharge for wellfield maintenance • Reserves certain flows for each user The County used Certificates of Participation, paid off via General Fund revenues, to construct the regional 21 MGD wellfield. The wellfield came on line in 1994 with an installed capacity of 21 MGD. The South Florida Water Management District permitted the wellfield at 14.9 MGD average daily flow and 21 MGD maximum daily flow. The intent was for the wellfield to be incrementally increased in flow until full allocated. The City had planned on the BPP sugply as its long- term raw water solution which is a situation that may be changing due to the .SFWMD's rules. However, the Count 's -regional wellfield permit was restricted to 11.8 m d in 2019 reducing the Cit 's capacity to 1.58 m d. The Cit 's wells are currently permitted for 0 m d. In 2019, the City entered into an agreement for 1.0 mgd from the C51 reservoir project, with expected delivery in 2022. Based on the options laid out in Section 4, the following werepursued: Brian Piccolo Supply 1.58 m d Dania Beach Wells G_ &I -- 0.3 mgd C51 reservoir 1.0 mad Horizontal Well test 0.7 _mgd TOTAL = 3.58MGD This would create four potential water supply sources that would diversify the Cit 's water supply needs and alternatives and provide a means to address future needs or changes. It would entail the least costly set of solutions. The status of these is as follows: • Brian Piccolo Supply 1.58 MGD - no action needed • CS1 reservoir 1.0 MGD - agreement executed. Expected timeline for completion is 2022 at which time the City will be required to complete their 12ortion of the agreeagreem n which is a $4.6 million payment, proposed as an SRF loan • Dania Beach Wells G&I - 0.3 _MGD - water use permit agglication has been submitted. The modeling -is complete and- supports the City's request for allocation that does not impact the regional system. SFWMD is reviewin the results. At such time as the permit is issued in 2021, the City will need to rehabiliWte_Well G or I. • Horizontal Well _test 0.7MGD - initial wells were installed 10 years ago. Water quality sampling needs to be initiated (in the 2021 budget). The current permit application is for 0.3 mcid from City well G with well I as a backup. Based on permit discussions, the City will attempt to skim additional water from its coastal wellfield to regain lost capacity (0.2 MGD)_ which will solve the water supply issues through 2029. Modeling conducted for the City suggests that this allocation is appropriate and achievable to the City. The raw water is submitted to the water treatment plant via a sixteen (16) inch diameter raw water line. The City has a lime softening treatment plant with a nominal capacity of three (3) million gallons per day. The treatment plant was built in 1952 and renovated in _1991. The top of the accelerators were reconstructed in 2013. A 2.0 m d nanofiltration water treatment plant was completed in 20.11. The current capacity is now 5.04 m d. The City has 384,000 gallons_ of storage in its clear wells. A new 2 million gallon around storage tank was completed September 2008. The plant operates twenty-four hours per day. plant was built in 19S2 and Fenevated in . The plant operates adequately and is in good condition. It is expected that the plant will operate satisfactorily for approximately twenty years without major replacements. Because people in urbanized South Florida use groundwater supplies that are replenished directly by summer rainfall, the quantity of water available is finite and the quality must be protected for the end users - the public and the ecosystem. Water supplies in South Florida are regulated by the South Florida Water- Management District. The District issues water use permits based upon availability of the resource. These withdrawals limit both annual average and maximum daily withdrawals from the aquifer by the utility. The City is located east of the salinity structures and as a result all shallow groundwater is rainfall. The canal system is very effective at draining the sands above the Biscayne aquifer effectively. As the City reads the Regional Water Availability Rule, the intent is to reduce demands on the Everglades recharge area for the Biscayne aquifer and to reduce saltwater intrusion, so harvesting direct rainfall that would otherwise be lost to tide would qualify as long as it does not encourage saltwater intrusion. The distribution system of the City has been analyzed by hydraulic analysis and three areas of the City were determined to have weakness, the extreme southeast area, the area north of the ❑ania Cut -Off Canal known as Melalucca isles and the area north and south of the Dania Cut -Off Canal in the extreme eastern part of the City. This analysis was performed both for present demands and build out demands utilizing an average per capita consumption of 100 gallons per day; a maximum day factor of 1.6 and a peak hour factor of 3.2. Fire flow was established at 1.,500 gallons per minute. The distribution system weaknesses in the extreme southeast area of the City have already been corrected. Other improvements would involve are additional subaqueous crossing of the Dania Cut -Off Canal to strengthen the system in the Melalucca Isles area and replacement of mains in the extreme eastern area. The City has completed two water main projects to deal with low pressure and flow volume problems in the northeast section at a cost of $2.6 million. Economic Assumptions The City of Dania Beach's primary sources of revenue for the potable water system is through rates charges to users and connection charges on unit and acreage charges as set forth in Ordinance 41-85 of the City, which are charges to new users. Other capital expenditures will utilize bond issues supported by utility revenues or low interest bank loans, The City upgraded is impact fee ordinance and policies in 2007. No level of service improvements are needed until 2019. C. County Water System The fallowing information was obtained from the Broward County Water Supply Facilities Work Plan. Existing Conditions The City of Dania Beach does -not control the water system in the western part of the City, generally defined as the portion of the City lying west of Ravenswood _Road. This service area is within the Broward County 3A service area. The area was annexed into Dania Beach and Hollywood in the early1990s. Broward County Water & Wastewater Services .(BCWWS) operates two regional wellfields that provide bulk raw Biscayne aquifer water to Deerfield Beach in north county and Dania Beach Hallandale Beach Hollywood and Florida Power and Light in south county through large user agreements. BCWWS operates three service districts known as District 1 District 2, and District 3. The three service districts are operated as independent entities but are supported by BCWWS Operations as a single entity. 2. County -Served Service Area and Population District_ 3 service area contains portions of the Cities of Dania Beach, Davie, Fort Lauderdale, Miramar, West Park, Pembroke Park Pembroke Pines and Hollywood and provides water to the Fort Lauderdale -Hollywood International_ Airport. District 3 is further divided into Districts 3A and 3BC. The west portion of Dania Beach is located within District 3A. Per _Broward County's Water Supply Facilities Work Plan (adopted March 2 2019 to plan and coordinate water supply utility activities within its three service_ areas. BCWWS uses utility analysis zones (UAZ)..wh_ich divide service_ districts into smaller units by UAZ. Pulling TAZ information into UAZ involves allocating populations___ based on the split in residential units between the TAZ-UAZ subsections using- Broward County Property Appraiser parcel shapefile. The arcel sha efile permits the calculation of single-family and multi -family units within each TAZ-UAZ subsection. A TAZ-UAZ subsection is a portion of a UAZ sits within a TAZ. The calculation method sums up the total residential units (single family and multi -family) within each TAZ-UAZ subsection. The population is allocated based on the percent of residential_ units in a TAZ-UAZ subsection out of the total TAZ dwelling units count. Broward County works closely with the City of Hollywood_ through involvement in the County Commission's Water Advisory Board and its Technical Advisory Committee, Southeast Florida Utility Council, Broward Water partnership and other area technical and policy groups. 3. County -Served Water Supply District 3 service area is divided into two geographically_ separate subdistricts 3A and 3B/C. The area of Dania Beach served by the County is in District 3A.. The County purchases bulk treated water from the Citv of Hollywood and distributes the treated water through the County's distribution system. District _3 has a combined service area of approximately < 14.3 square miles and contains 223 miles of transmission and distribution mains. Subdistrict 3A contains the Fort Lauderdale - Holt wood International Page 52 Sanitary Sewer, Solid Waste, Drainage, Potable Water, Groundwater Aquifer Recharge City of Dania Beach Airport which is approximately 20 percent of the total area of the district. District 3A has interconnects with the City of Hollywood, for is primary water supply, and with the Cit of Fort Lauderdale and the City of Dania Beach, to provide for emergency water supply. The City of Hollywood is resl2onsible for ensuring adequate raw water supply and treatment facilities to serve the County_ District 3 service areas. The City's existing CUP (Permit No, 06-00038-W) was issued by the SFWMD on April 9, 2008 and expires April 9, 2028. The Hollywood CUP raw water allocation for the subdistrict 3A136C areas is 13.16 MGD to meet demands through the year 2028. 4. Count Served Water Demand BCWWS' current finished water demand for District _ _3 averages around 6.4 MGD and is projected to increase to R.Q9 MGD by 2040 as shown in Table 8 below. District 3's raw _water demand is anticipated to be around 8.8 MGD in 2040 as shown in Table 9, based on historical raw to finished water ratio of 1.09. BCWWS continues to coordinate closely with the City to ensure that future demands for District 3 are adequately addressed. Finished water demand was estimated as shown in Table 10 (District 36Lby using the finished water 5-year historical gallons per capita day of 127 and the municipal populations. Policy 5.2 Remodeling of buildings requires that new fixtures meet the Florida Building Code - Plumbing requirements which require low flow fixtures. Policy 5.4 The City will continue its public information and education programs - the City has SFWMD brochures on water conservation and Florida Friendly Landscaping available for the public (on display). Policy 5.5 The City will continue its water conservation rate structure that penalizes residents using in excess of 10,000 gallons -per month. The typical single family use in Dania Beach is currently under 5-8,000 gallons per month, or 157 gpd/ERU. Policy 5.6 The City requires the installation of low flow plumbing fixtures in accordance with the Florida Building Code. Policy 5.7 The City will provide educational literature for the public. The Growth Management Department shall be responsible for monitoring these goals, objectives and policies and determining their compliance with the plan. The Growth Management Department will review yearly status reports from the Utilities and Public Works Department as to the achievements of the goals, objectives and policies and shall ensure that adequate funding is budgeted to meet the same. This ordinance adopts the Districts criteria for restrictions, that note that a Water shortage "means a period of time specified by the district when sufficient water is not available to meet present or anticipated needs of persons using the water resource, or when conditions are such as to require temporary reduction in total water usage within a particular area to protect the water resource from serious harm. A water shortage usually occurs due to drought." The ordinance also specifies that a Water shortage emergency "means that situation determined by the district when the powers which can be exercised under part II of Chapter 40E-21, Florida Administrative Code, are not sufficient to protect the public health, safety, or welfare, or the health of animals, fish or aquatic life, or public water supply, or commercial, industrial, agricultural, recreational or other reasonable uses." The ordinance also adopts by reference the District`s Water shortage plan "that the District will utilize in declaring a water shortage, describing the procedures for declaring and implementing a water shortage emergency and establishing water use restrictions, describing enforcement procedures, and establishing specific water use restrictions and a classification system." The declaration of a water shortage or water shortage emergency within all or any part of Dania Beach by the governing board or the executive director of the district shall operate to invoke the provisions of this article. Upon such declaration, all water use restrictions or other measures adopted by the district applicable to Dania Beach, or any portion thereof, shall be subject to enforcement action pursuant to this article. The City`s law enforcement personnel will enforce the ordinance. Penalties are as follows. (1) First violation: Twenty-five dollars ($25.00). ((2) Second and subsequent violations: Fine not to exceed five hundred dollars ($500.00), or imprisonment in the county jail not to exceed sixty (50) days, or both. The ordinance also specifies _permanent restrictions -for lawn and. Beyond water restrictions, a typical water conservation program is composed of the following elements: develop/maintain an accurate database of water consumption to reduce municipal water waste; a retrofit program; the modification of relevant City Codes (plumbing, irrigation, landscaping, the promotion of xeriscaping; and public information and education programs. The City implements these measures in the following manner: 1) Develop/maintain an accurate database of water consumption to reduce municipal waiter waste - all services in the City are metered, including all irrigation services. The City also recalibrates large meters every two years and plant meters annually. The City changes out a number of older meters each year, depending on the age - prior change -outs were not recorded). 2) A retrofit program - is not pursued in the City at this time since unaccounted-for water is below 15%. However, remodeling of buildings requires that new fixtures meet the Florida Building Code - Plumbing requirements which require low flow fixtures. Therefore, while the City does not have an active retrofit program (or the funds and personnel to implement same), the building code is accomplishing this purpose. 3) As noted above, the Florida Building Code addresses the plumbing aspects requiring low flow plumbing fixtures. As the majority of homeowners in Dania Beach use wells for irrigation, not potable water the benefits to the utility from a water savings potential from xeriscaping, rain sensors and landscaping is minimal and the City has limited capability to impose restrictions on well use. A water conservation policy is in the process of being developed at this time for landscaping and the promotion of xeriscaping. The policies may help with these issues. 4) Public information and education programs - the City has District brochures on water conservation and xeriscaping available for the public (on display). The typical single family use in Dania Beach is less than 8,000 gallon per month, or 267 gpd/BRU. In addition the City has looked at two other issues associated with water conservation - reclaimed water and ASR. Both were rejected as discussed in the following paragraphs. Effluent reuse is of substantial benefit to the area for a number of reasons, the most important of which is the reduction of competing water withdrawals from the surficial aquifer system by the application of the reclaimed water. The drainage system has lowered the water table, causing saltwater intrusion to occur. Carefully designed applications of effluent to critical areas of the surficial aquifer could protect and maintain freshwater sources. However, the City must rely on the City of Hollywood for reclaimed water, as the City has no treatment plant of its own. To date, the City of Hollywood has not had facilities or water quantity to extend reclaimed water to the City of Dania Beach. This situation could change if the City of Hollywood extends reclaimed water to Port Everglades. ASR Wells are a water supply management option some utilities have pursued in south Florida, Unfortunately there is only one successfully operated ASR well in Southeast Florida - Boynton Beach. dn.-.,-snds. Investment in additional water treatment plant capacity and a well for this purpose does not seem reasonable. The City utilizes formal and informal coordination mechanisms for coordination including sharing data and information with water providers, and viceversa, on an as - needed basis, and maintaining agreements as needed. Purpose The Conservation Element of the City of Dania Beach is prepared to provide a guide for the conservation, use, and protection of natural resources within the City and immediately adjacent property. The Element first identifies the significant resources occurring within the community and the impacts occurring on those resources. The element then provides goals, objectives, and policies which will help to insure commitment to long term programs. This will help conserve the natural resources of the community and hereby provide a high quality of life for current and future residents of the City of Dania Beach. B. Physiography The City of Dania Beach is situated in southeastern Broward County which is the second largest county based upon population within the State of Florida. The County consists of approximately 1,200 square miles; however, only the eastern third (414 square miles) is considered within the planning or development area. Of the 414 square miles, the City of Dania Beach comprises approximately 7 square miles. The eastern part of the county where Dania Beach is situated is made up of low, sandy ridges, which are commonly referred to as flat woods. The vegetation where remaining is mostly Pine, Palmetto and native grasses. These flat wood areas were made up of deep poorly drained nearly level sandy soils. Many of these soils were original used for truck crops, but most of the areas have been developed into urban uses. Agriculture is virtually non-existent within the City of Dania Beach. Some eastern portions of Dania Beach consist of mangrove vegetation. II.DATA AND ANALYSTS REQUIREMENTS A. Water Resources 1. Surface Water The Dania Beach area is generally drained by the Dania Cut - Off (C-11) canal which divides the City north and south. This canal also serves the western parts of Broward County. In addition, the C-10 Canal provides the major drainage Page 1 Conservation Element Citv of Dania Beach conveyance primarily serving the southern and western portions of the community. C-10 ultimately discharges into the Dania Cut -Off Canal which in turn discharges into the Intracoastal and ultimately through Port Everglades inlet into the Atlantic Ocean. Existing drainage in the City is adequate and as development occurs each development is to meet drainage improvement requirements in accordance with the standards of the South Florida Water Management District, Broward County Water Resources Management Division, as well as the City requirements. The New Rivet- Sound and estuarine system is located in the most easterly portion of the City of Dania Beach as noted on the Estuarine Map. Because of its proximity to the Port Everglades Inlet (approximately 2 miles to the North), this system receives a high level of flushing activity which enhances the quality of water within the estuary. All water bodies are designated as a Class III water body by the Florida Department of Environmental Regulation. As noted earlier, Dania Beach lies within the jurisdiction of the South Florida Water Management District as does most of Southern Florida. The District is responsible for water conservation, flood control and drainage requirements for all developments within its jurisdiction. Additionally, the Broward County Water Resources Management Division reviews plats as they are processed through Broward County to insure that the drainage meets the immediate guidelines and requirements of the county -wide concern, This will insure that during wet periods there will be adequate drainage not to over burden the master drainage system of the county wide system and still protect public and private property. 2. Flood Plains The Flood Plains Map for Dania Beach, which is prepared pursuant to the National Flood Insurance Program, identifies areas within the City that are subject to flooding for the 100 year period. There are two types of flood zones within the City of Dania Beach these being AF; two types of X and V zones. AE zones are areas expected to flood in a 100 year storm event. These areas represent approximately 2/3 of the City of Dania Beach. The V zone is restricted to the immediate ocean front portion of Dania Beach. There are no structures within this public beach area accept for the existing Dania Pier. Page 2 Conservation Element City of Dania Beach The Broward County Water Management Division has County wide review of permit authority as it relates to water management activities. That agency requires flood elevations to meet a 3-day, 100 year design storm criteria. That agency also requires all road crown elevations to meet 1-day storm, 10 year event design criteria for local roads. The City of Dania Beach has managed flooding in a successful manner through development and maintenance of the existing network of canals and water bodies designed to handle drainage within the City. Dania Beach participates in the National Flood Insurance Program of the U.S. Department of Housing Urban Development. Also, Dania Beach's emergency preparedness plan establishes a procedure for evacuation and rescue in the event of an emergency such as a hurricane. Also, it is required that all new development meet the guidelines of the National Flood Insurance Program to insure that both they are able to gain insurance for the residents of the development plus protect property from potential hazardous flooding conditions. 3. Ground Water The sub -surface strata below the City can be grouped into three general categories (1) Biscayne Aquifer, (2) The Floridian Aquiclude, and (3) The Floridian Aquifer. The Biscayne Aquifer is the unit closest to the surface and is composed Primarily of Pahnico Sands, Miami Oolite, Anastasia Formation and Fort Thompson Formation. The Floridian Aquiclude primarily consists of impermeable strata which prohibits the intermingling of water between the Biscayne Aquifer and the Floridian Aquifer which is beneath the aquiclude. The upper zone of the Floridian Aquifer extends about 900 ft. to 1,900 ft, below sea level and consists of a series of limestone strata including Tampa (Miocene), Suwanne (Oligocene), Ocala (Eocene), Avon Park and Lake City Limestones. The lower zone of the Floridian Aquifer extends for 1,900 ft. to what is known as the "Boulder Zone". The Biscayne Aquifer is one of the most productive water producing aquifers in the world. It has been designated the only reliable source of drinking water for all of Broward County and since 1979 has been designated as the sole source of drinking water by the U.S. Environmental Protection Agency. Despite its high productivity and continuous ability to supply water for drinking, growth in the water use _. Page 3 Conservation Element City of Dania Beach areas has placed the aquifer under stress in recent years. The aquifers are highly permeably and recharge depends on local rainfall and water released from Lake Okeechobee through the network of canals. When water demands are increased so is the threat from saltwater intrusion from the Atlantic Ocean during drought conditions. The City has been impacted by saltwater intrusion as the City's wells have decreased from 3 MGD to 1.1. MGD, and why the City is getting water from Froward County and looking at more innovative options to acquire added waters (see Infrastructure element, Potable Water Element - Section F). Broward County has embarked upon a program to develop future wellfield sites to ensure an adequate supply of quality drinking water for the current and future residents of Broward County. A study has been completed and is now in the implementation phase. The County Commission has authorized development of well sites throughout the County. This effort, modeling of the Brian Piccolo wellfield to secure more water, and the saltwater intrusion model being developed but the County are ongoing. B. Flora and Fauna As noted earlier, the City of Dania Beach has an extremely flat topography with very little native flora occurring within the community. If mangroves are Involved the SFWMD, the Florida Department of Environmental Protection as well as the United States Army Corps of Engineers would have review responsibilities for this type of plant community. Also, as part ❑f the site design, native plants are encouraged to the greatest extent possible to help develop a canopy as the City grows and matures. Table I will provide a generalized list of the flora and fauna which generally occurs within Dania Beach. Table II will provide a generalized list of the wildlife; however, there are no endangered animals or plants within the community. C. Wetland Communities The remaining wetland communities within the City of Dania Beach consist of mangrove communities in the eastern fringes of the City. While many of these mangrove areas are highly stressed they are still protected through the permitting process of the Florida Department of Environmental Protection and the United Page 4 Conservation Element City of Dania Beach States Army Corps of Engineers. In addition, the Broward County Department of Planning and Environmental Protection issues dredge and fill permits for wetland communities within Broward Cou nty. Since 1989, the Dania Saltmarsh has been acquired by the public. This represents the majority of the vacant land east of Southeast Fifth Avenue between Sheridan Street and Dania Beach Boulevard. The area consists of approximately 130 acres. This is an area that was previously designated for residential utilization at a maximum density of one (1) unit per acre. D. Air Quality Due to the prevailing breezes occurring in southeastern Florida, the air quality is generally good for the Delia Beach area. The major impact to the community would be ozone emission from automobiles as very little industry is presently occurring within the community. While the Comprehensive Plan provides for expansion of industrial opportunities for the community, these will be light industrial/office park type developments which will have minimal impacts on the air quality. Additionally, the Department of Planning and Environmental Protection, which is an agency of Broward County government, is responsible to insure to the United States Fnvironmental Protection Agency that air quality standards are maintained. Broward County has received certification from the E.P.A. that the air quality is at an adequate standard for the residents of the community. E. Lakes and Mine All of the lakes occurring within the City are man made and have been developed for providing fill for development or for providing commercially valuable minerals. Adequate areas have been reserved and secured to provide for provision of sand and rock material for the future growth and development of the City. F. Soil Erosion At the present time the City of Dania Beach is not experiencing any soil erosion problems. However, an office of the United States Soil Conservation Service is located in the Town of Davie, Florida which is approximately 5 miles from City Hall. Whenever soil erosion problems occur or a situation arises which may indicate Page 5 Conservation Element City of Dania Beach that soil erosion could potentially occur, the Soil Conservation Service office is contacted to provide proper planning to minimize any negative impact. Also, the City in its review of site plans particularly for new lake excavations insures that all sites are properly sloped and vegetated as soon as possible after construction. This applies to the slopes of all lakes both residential and non-residential developments. G. Fisheries, Wildlife, Marine Habitat, and Vegetated Communities The existing mangrove communities East of S. E. Sth Avenue and East of the airport do contain wildlife habitat. Through proper site planning controls and mitigation of any impacts to wetlands areas these habitats can be enhanced and provide for a more suitable habitat for the propagation of a greater variety of flora and fauna. Manatees are generally found in the New River Sound estuary and to a limited extent along Dania Cut-off Canal. The principal threats to manatees are encounters with boats or other marine navigational activities as they have no natural predators. Manatees are protected under the Endangered Species Act and the Marine Mammal Protection Act but because of these impacts by navigational uses a general decrease in the population is expected. The authority of posting of navigational aids which will help prevent accidents with manatees is administered by the Florida Marine Patrol. It is felt that through the existing controls that the wildlife habitats can be enhanced and protected through mitigation and site design practices. H. Pollution Problems There are no known pollution problems affecting existing natural resources within the City of Dania Beach. Hazardous waste are controlled through the Broward Department of Planning and Environmental Protection adopted hazardous material regulations and storage tank regulations. These regulations are applicable County wide and they are also designed to help safeguard the overall Broward County water supply. Urban storm runoff is regulated by the criteria of the South Florida Water Management Page 6 Conservation Element City of Dania Beach District, Broward County Water Resources Management Division and the City of Dania Beach before discharge into the major drainage conveyances serving the City. The existing habitats outlined will be protected from any discharges by these sources. The South Florida Water Management District also encourages the discharge of storm water runoff through mangrove systems as a form of cleansing the runoff prior to discharge int❑ the drainage system. While this is an approved program of the Water Management District to date no developments have incorporated this type ❑f water management plan into any existing activities. L Current and Projected Water Needs Water Conservation As noted in the Potable Water Element, there exists adequate capacity of both present and projected water needs for the build - out of the community. These projections incorporate the anticipated land uses within the City. The City of Dania Beach also complies and endorses all programs of the South Florida Water Management District as it regards Water Conservation and Protection. Additionally, the City endorses and complies with the Broward County Wellfield Protection Ordinance which further ensures continuance of the existing quality of water. Please refer to Section I of the Potable Water Section of the Sanitary Sewer, Solid Waste, Drainage, Potable Water, Groundwater Recharge element of the Cit 's comprehensive 121an as amended. The City of Dania Beach approved a formal water conservation program in August! 2010. The water conservation plan included requirements for Florida Friendly plants, rain sensors on _irrigation_ systems, exclusions to irrigation systems where Florida Friendl plants are used, WaterSense Plumbing fixtures, -and evaluation of water conservation solutions. 1. Maintain an accurate database of water consumption to reduce municipal water waste - all services in the City are._ metered including all irrigation services. The City also recalibrates large meters every two years_ and plant meters annually. The City changes out a number of older meters each year, depending on the -age - prior change -outs were not recorded). Page 7 Conservation Element City of Dania Beach 2. A retrofit pm -gram - is not gursued in the City at this time since unaccounted-for water is below 151/16. However, remodelina of buildings requires that new fixtures meet the Florida Building Code - Plumbing requirements which require low flow fixtures. Therefore, while the City does not have an active retrofit grogram or the funds and personnel to im lement same),the building code is accomplishing this .purpose. 3. Adopted WaterSernse plumbing fixture ordinance requiring low flow plumbing fixtures. As the majority of homeowners in Dania Beach use wells for irrigation, not potable water the benefits to the utility from a water savings potential from xeriscaping_, rain sensors and landscaping is minimal and the City has limited capability to impose restrictions on well use. A water conservation policy is in the process of being developed at this time for landscaping and the promotion of xerisca in . The policies may help with these issues. 4. Public information and education ro rams - the City has District brochures on water conservation and xeriscaping available for the public (on display). 5. Water conservation rate structure - The City has long had in lace a water conservation rate structure that enalized residents using in excess of 10,000 _gallons per month. REQUIREMENTS FOR, CONSERVATION GOALS, OBJECTIVES AND POLICIES The goal of the conservation element is to establish a long term program for the development of conservation programs and activities that will protect and ensure the highest environmental quality possible for the City of Dania Beach. Objective I Maintain or improve present air quality within the City. Policy 1.1 Continue to cooperate with the State and Federal Government in monitoring the existing air pollution standards within the community. Policy 1.2 Promote the efficient operation of motor vehicles which is a major contributor to air pollution within the City. Policy 1.3 Ensure that all industrial uses within the community minimize the impact on air quality to the greatest extent possible. Page 9 Conservation Element Citv of Dania Beach Policy 1.4 Encourage the development of heavy vegetative cover which aids in the cleansing of the air. Policy 1.5 Promote alternative transportation modes such as pedestrian walkways, bikeways, mass transit and other means of travel. Policy 1.6 Continue to coordinate with the Broward County Traffic Engineering Division to synchronize traffic signals on highways. Objective II Maintain or improve the quantity/quality of water resources. Policy 2.1 Restrict activity which could have an effect on the sole source Biscayne Aquifer which provides all drinking water for the City. Coordinate with the Broward County Department of Planning and Environmental Protection to ensure adequate protection of water resources. Where necessary restrict uses which may have an effect on water resources. Policy 2.2 Comply with emergency conservation program of SFWMD in the event a drought affects the amount of available potable water. Policy 2.3 Comply with the Broward County Wellfield Protection Program. Objective III Continue to maintain present mineral areas. Policy 3.1 Ensure land has been set aside for the excavation of required materials for development within the area. Policy 3.2 Ensure the development and protection of these mining areas does not preclude the future development of an attractive plan once mining operations have been completed. Policy 4.6 The City shall continue to require the identification of potential impacts on flora, fauna, air quality and water quality and quantity with all applications for new development which may potentially impact existing natural resources identified within this Comprehensive plan. Policy 4.7 The City shall review and revise land development regulations by August 2000 to protect and conserve the natural functions of existing soils, wildlife habitats, canals, lakes rivers and marine habitats during the review of applications for new development and/or redevelopment to address the following: a. Site plan for new development identify the location and extent of wetlands located on the property; Page 11 Conservation Element City of Dania Beach b. Site plans provide measures to assure that normal flows and quality of water will be provided to maintain wetlands after development; c. Where alteration of wetlands is necessary in order to allow reasonable use of property, either the restoration of disturbed wetlands will be provided or additional wetlands will be created to mitigate any wetlands destruction; d. Proposed developments comply with Broward County`s Wellfield Protection Program; e. All endangered and threatened plant and animal populations are protected; f. All habitats of significant value to existing populations of endangered and threatened species are preserved:, g. All nuisance vegetation (i.e. Brazilian Pepper, Australian Pine, and Melaleuca) is removed by the developer at the time of development or redevelopment of a site; h. All native woody vegetation of a significant size is preserved or replaced. Policy 4.8 Encourage the provision and maintenance of a buffer zone of native upland (i.e. transitional) vegetation and littoral zones in and around wetland and retention areas which are constructed or preserved on new development sites. Policy 4.9 Development orders and permits for development and redevelopment activities shall be issued only if the conservation of wildlife and natural systems is ensured consistent with goals, objectives, and policies of this Comprehensive Plan. Policy 4.10 The City shall coordinate review of proposed wetlands mitigation activities with the Broward County Department of Planning and Environmental Protection Page 12 Conservation Element City of Dania Beach to ensure that Broward County's "Wetlands Benefit Index" is utilized as one basis for determining the scope of need mitigation. Policy 4.11 The City of Dania Beach shall distribute land uses in a manner that avoids or minimizes, to the greatest degree possible, the effect and impact on wetlands. Those future land uses identified in the table provided below as being incompatible with the protection and conservation of wetland functions shill be directed away from wetland, or when incompatible land uses are allowed to occur, shall be mitigated or enhanced, or both, to compensate for loss of wetlands functions. Ansbro, City Attorney ThamaslApsbro M r - SUBJECT: Amendment of Program Exemptions for the Public Art Ordinance and Program The Reguest A recommendation in support of the changes to the Ordinance of an amendment of the Public Art Program's possible grant of exemptions of program requirements. Backuroulnd The City Code of Ordinances, Code Sec. 81 1-60, entitled "Applicability," provides for possible exemptions to be granted by the City Commission from the Public Art Program for the following categories of entities: I . Projects consisting of the reconstruction of structures which have been damaged by fire, flood, wind, or other natural disaster. 2. Schools. 3. Churches or places of worship. 4. Affordable housing and projects receiving economic development grants or incentives. The City is seeking to remove the ability of applicants to request to be exempt from the program for schools, churches or places of worship and affordable housing projects that receive economic development grants or incentives. During discussion of the possible change to the program at the last Commission meeting, I stated that we would review current law to determine if removal of the exemption for these entities would ne• be in violation of state or federal law. Below is a synopsis of our research, Issue: Whether there are any laws that would hinder the City's ability to enforce its public art fee program with respect to a religious institution, a school, or an affordable housing or similar project. Summary Answer: 'there does not appear to be a violation of state or federal law in removing the exemption for private schools, religious institutions and affordable housing projects. Public schools are exempt from paying the public art fee or installing public art, understate law. There is no need to create an exemption for public schools in the Code since state law preempts the City's code. The same is true for federal buildings. Federal law preempts the City's zoning code and local ordinances. However, affordable housing projects are not afforded such federal protection. Analysis:. (1) Public Schools Pursuant to Florida Statutes, Section 1013.37, traditional public schools are exempt from the Florida Building Code and the Fire Code. This statute provides for a state uniform building code for the construction of public educational facilities and exempts schools from local laws relating to the state building code. Section 1013.371(1)(a), Florida Statutes, requires that all educational facilities constructed by a school board are required to incorporate the state building and Fire codes and shalt be "exempt from all other state building codes; county, municipal, or other local amendments to the Florida Building Code and local amendments to the Florida Hire Prevention Code; building permits, and assessments of fees for building permits, except as provided in s. 553.80; ordinances; road closures; and impact fees or service availability fees." Public schools are not exempt from the provisions of the Focal Government Comprehensive planning and Land Development Regulation Act, sections 163,3161-163,3217, Florida Statutes. Rather, the Legislature has made it clear that school districts and school boards are subject to local land development regulations enacted to implement local comprehensive land use planning and development. Each city has adopted a Public School Element into its Comprehensive Plan and entered into Interlocal Agreements with its School Board. Under such agreements, cities can review n limited criteria of items but those criteria do not include art in public places. As can be seen from Section 1013.371 public schools are also exempt from other city ordinances and impact fees. The School Board would maintain that application of the public art ordinance to it has been preempted by the State. Alternatively, a charter school, being built on private land would have to adhere to the City's Zoning Code, subject to certain restrictions. (Florida Statutes Section 1002.33(a)). Imposition of Public Art requirements on a charter school could result in a challenge by the Charter School that the City is disparately treating the charter school, i.e., not treating it equitably or comparably as compared to a public school, since public schools do not need to comply with Public Art requirements. It is notable that the Legislature did not mirror the language applied to traditional public schools for charter schools, but it did provide language that charter schools must be treated "equitably". We would maintain that a charter school is subject to the City art requirements. (2) Religious facilities. Religious facilities, and uses associated with them, are protected under federal law pursuant to the Religious Exercise in Land Use Protection Act, ("RLUIPA") 2 USC 2000cc-1. Under the provisions of the City ordinance, the City would maintain that its Public Art Program does not impose a substantial burden on the religious exercise of a person and that the City is treating all facilities equally. The City would also maintain that there is a compelling governmental interest to provide public art. Religious institutions are not usually the recipient of federal financial assistance and the art program would not affect commerce or create a substantial burden. The "substantial burden" and "compelling government interest" tests are examined by courts when applying RLU IPA. There have been no cases challenging a public art program under the federal law. The City is not imposing or implementing a land use regulation in a manner that treats a religious assembly or institution on less than equal terms with a nonreligious assembly or institution. t~utl.her, the City is not imposing or implementing a land use regulation that discriminates against any assembly or institution on the basis of religion or religious denomination. The City's uniFarm application of its Public Art Program is designed to be neutral in its enforcement and application. (3) Private Schools. The City's uniform application of its Public Art Program is designed to be neutral in enforcement and application. There is no federally recognized or state recognized law precluding the City from applying; its Public Art Program with respect to private schools, which was recently done by the City Commission by denial of requested exemption. (4) Affordable housing projects. There is no federal or state exemption or preemption when local governments seek to implement a public art program when applied to a public housing project. In fact, many affordable housing projects receive CBDG, HOME and SHIP funding, which also provide a public art requirement, tied to the government funding. Again, no preemption was raised in the other recent City Commission decision as to the Saratoga III housing development. (5) Federal facilities. Federal laws exempt and preempt most federal buildings from local zoning laws as well as building and fire codes. The Public Buildings Amendments of 1988, 40 U.S.C. 3312 (formerly section 21 of the Public Buildings Act of 1959, 40 U.S.C. 619), "require that each building constructed or altered by GSA (General Services Administration) or any other federal agency shall, to the maximum extent feasible, be in compliance with one of the nationally recognized model building codes and with other applicable nationally recognized codes. Legally, buildings built on federal property are exempt from state and local building codes. " Pursuant to a federal case from 1947, it was stated that the federal government is exempt from local zoning whcnevei• it chooses to be. The same is true for post office facilities and numerous other federal buildings. Budgetary Impact There is no budgetary impact fi•om this item.
