Call to Order/Roll Call Mayor James called the meeting to order at 7:00 p.m. Present: Mayor: Vice -Mayor: Commissioners: City Manager: City Attorney: City Clerk: Tamara James Marco A. Moment of Silence and Pledge of Allegiance Mayor James called for a moment of silence followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Dania Beach Transit Bus Service — Presentation of Comprehensive Operations Analysis by the Corradino Group Fernando Rodriguez, Director of Public Services, gave a brief introduction of Mark Alvarez, Lead Analysist, Corradino Group. Mr. Alvarez, Corradino Group, gave a PowerPoint presentation which is attached to and incorporated into these minutes. Commissioner Odman questioned the thought process behind the nine -to -four -time recommendation as those times would not fit the working class. She asked who the time zone is geared toward capturing. Mr. Alvarez responded not very many people use the system for work and he realizes that is backwards as a service, but we must continue to get Broward County transit funding. Commissioner Odman asked what kind of rider this captures. Mr. Alvarez explained the riders are those who are using the bus for recreational and shopping purposes and explained the type of riders and the process of getting them to adapt. For now, we need to get our rider numbers up for Broward County funding. If there were a lot of people using the transportation for work, we would not cut the hours back. Mayor James noted she looks forward to discussion during the budget process. City Manager Garcia said we will incorporate these recommendations in the budget discussions and noted many people do not realize the transit system we have available. Addendum Presentation by Congresswoman Debbie Wasserman Schultz Congresswoman Wasserman Schultz spoke of the challenging year we have experienced due to COVID, and federal legislation passed to provide relief to Americans. She addressed each program included in the federal relief and spoke of the pending American Jobs Plan. She gave updates on the appropriations process, including Dania Beach's water infrastructure and CW Thomas Park facility projects, as well as MPO road improvement projects and Tri Rail. 3.2 2021 Legislative Session update by State Representative Joseph Geller Representative Geller gave an update on the 2021 Legislative Session and noted it was the worst legislative session he had ever seen. He addressed the negative legislation passed, such as anti- transgender legislation and voting rights curtailment, and added it was not a very productive session. 3.3 Public Art Plan and Guidelines - Leslie Fordham, Broward County Cultural Arts Corinne Lajoie, Assistant Director of Community Development, gave a brief PowerPoint presentation which is attached to and incorporated into these minutes and introduced Ms. Fordham. Commissioner Odman noted she looks at the plan like a playbook and pathway for us to get where we want to be. She asked that a bound Art Plan be made available for the public in the atrium. Mayor James thanked Ms. Fordham and staff for their hard work. 3.4 City Place Development update and request support for Housing Credit - Francisco Rojo, Vice President, Landmark Companies, Inc. Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday, June 22, 2021 — 7:00 p.m. Attorney Dennis Mele introduced Mr. Rojo. Mr. Rojo gave a brief background and update on the City Place development. Attorney Mele addressed item 7.14 on the Consent Agenda. Mayor James noted she was told this would be affordable housing for 50 years and the project has her full support. City Manager Garcia said she and staff visited other projects by this team and they were very impressed with them; she is happy to support this project. 3.5 Overview of the Guardian ad Litem Program of the 17th Judicial Circuit, Broward County by Adena R. Wilson, Volunteer Recruiter - requested by Commissioner Davis Ms. Wilson gave an overview of the Guardian ad Litem Program and noted they are always in need of volunteers who make sure the children do not fall through the cracks. She spoke of information sessions they completed with the City of Sunrise and asked that they be allowed to duplicate this with Dania Beach. She would like to piggyback on the way the City reaches its residents. Commissioner Davis spoke of the program and noted Linda Gonzalez, Director of Human Resources, is going through the final phase of the training program. Human Resources Director Gonzalez described her training and her involvement in the program and said it is a wonderful program. Ms. Wilson noted they anticipate an uptick in cases; her main goal is to spread the word and enlist volunteers. 3.6 Funding for Parks Master Plan projects - Frank DiPaolo, Director of Finance Finance Director DiPaolo gave a brief background on the Parks Master Plan and addressed the next steps to be taken so that funding is available to begin the projects in early 2022. 4. Proclamations There were no proclamations on this agenda. 5. Citizen Comments Linda Wilson, President of the Friends of the Dania Beach Library, commented on the Juneteenth presentation given by Emanual George at the June 8th Commission meeting. She Minutes of Regular Meeting 3 Dania Beach City Commission Tuesday, June 22, 2021 — 7:00 p.m. noted the Honor the Legacy program is still out there; it is important that the video be shown again and become part of the Historical Society. She addressed the discussion regarding funding being held in abeyance for the Historical Society. Brother Mac, Lighthouse Community Church, Lighthouse for Students, thanked the Commission for their help during Black History Month. He addressed the programs offered by Lighthouse for Students and the Nation's Report Card for States, which is attached to and incorporated into these minutes. 6. Public Safety Reports Captain Daniel Marks, BSO Chief of Police, reported on recent criminal activity in the City, traffic enforcement, regional traffic unit, homeless outreach, COP Program, and the Shred-a-thon scheduled for September I Ith at 10:00 a.m. at Bass Pro Shops. He noted he met with the City Manager and Major Granville about our youth and a spring camp program. District Chief Brad Masters, BSO, reported on the repaving and new equipment and training at Stations 1 and 17. He also reported on call volumes. 7. Mayor James noted the temporary use for parking has become an issue with the developments we have going. The workers and trucks are leaving dust on the streets; we need to make sure developers are washing down the roads after the daily work. She asked if the developers were responsible for washing down dusty vehicles close to their construction sites and she addressed construction workers' vehicles taking up residential parking spaces. Assistant Director of Community Development Lajoie explained it was not part of this text amendment but felt it could be added as a discussion item for the DRC and could be made conditions of approval in the resolution on a project basis, with standard verbiage and with recommendations, after verification from Legal. Mayor James asked if any changes need to be made to this item. Assistant Director of Community Development Lajoie proposed allowing temporary usage for the cars; this would address temporary staging of vehicles. Assistant City Attorney Boutsis felt we could do it administratively. If it comes to the City Commission, we can make sure it is a condition of approval. Vice -Mayor Salvino questioned who regulates the temporary use and follows up on it. Assistant Director of Community Development Lajoie explained we have required the applicant to submit an application to the City identifying the length of time and the location where the parking will occur. In that case, they did provide a lease agreement with Dania Pointe, and she will follow up with them. A small aspect of what they did was to establish requirements for commercial buildings to have some level of LEED certification, which planted a seed in her head. She spoke to three of our developers and learned the developments one does already incorporates these in anticipation of climate change and environmental sustainability. After speaking with developers who are not currently practicing these standards, they were not surprised to hear the initiative and it was well received, which pleased her. She asked for consensus for her to work with staff on bringing something forward to the Commission of what a green sustainability building ordinance would look like for Dania Beach that would be met with interest and approval. Mayor James asked if this would be for residential or commercial. Commissioner Odman clarified the current focus is only for commercial. Commissioner Lewellen said the initiative has been going on all over the world and she had no problem with it. The Commission consensus was for Commissioner Odman to work with staff on a green sustainability building ordinance. 10.2 Marina/Beach health standards - City Manager Garcia City Manager Garcia said the priorities of this Commission have been safety, the environment, and aesthetics to ensure we have the highest standards in our City facilities as well as the beach. We started dialogue with Westrec, the Dania Beach Marina and Harbour Towne contractor, and one of the challenges at the beach is loose dogs in the parking lot and on the beach. This is a great safety concern. Westrec is stepping up their security in Harbour Towne, and Deputy City Manager Sosa-Cruz and Parks & Recreation Director Brown are working on having a designated pet area within the Marina. They are working on a policy to prevent pets in the parking lot and on the beach, particularly since we are investing in the beautification of the beach. She asked for Commission support for the policy so we can continue open dialogue with Westrec to have a policy we can enforce. Deputy City Manager Sosa-Cruz described the area as a little south of the Marina, on a strip of grass that currently houses waste baskets for a pet station. It is an area of about 25 to 30 feet long and 15 feet wide. If we fence that area, dogs will not have to go in the parking lot or on the beach to eliminate. He confirmed dogs are banned on the beach but there are restrictions due to ADA compliance and the City Attorney has advised us of those. Mayor James asked if dogs are allowed on any other City property. City Attorney Ansbro responded not unless it is for ADA usage. Staff is updating the policy so staff and BSO know what they can and cannot do once someone claims it is a service dog; emotional support dogs are not permitted. Minutes of Regular Meeting 11 Dania Beach City Commission Tuesday, June 22, 2021 — 7:00 p.m. Deputy City Manager Sosa-Cruz explained many of the challenges we are currently having are boat owners letting their dogs on our beach and parking lots. Commissioner Davis said this is something she lives with daily; it is really a sanitation issue that is the largest problem. She agreed with working with Westrec, designating an area, and bringing in signage. She loves the dogs, but not on the beach as people allow them to leave their excrement. She noted less than half a mile in Hollywood is a dog beach; we have invested so much into our beach we want to keep it pristine. The Commission consensus was to move forward with a policy at the Marina and beach. 11. Commission Comments 11.1 Commissioner Davis Commissioner Davis spoke of the kickoff partnership with the Trash Pirates, an organization that helps kids with ocean conservation awareness, particularly microplastics and single -use plastics. They have worked with Parks & Recreation staff to spread awareness at our various parks. Commissioner Davis noted she participated in a class with the junior lifeguards, taught by expert Robert Barron, which focused on saving lives and beach preservation. Commissioner Davis said at the last Dania Lions Club meeting, City Manager Garcia was recognized for all her service to our City and community. Commissioner Davis spoke of partnering with Lighthouse for Students. 11.2 Commissioner Lewellen Commissioner Lewellen thanked Public Services for the lights going up out west and noted it is nice to see everyone in person. 11.3 Commissioner Odman Commissioner Odman said she was invited to an exhibition called "The Mad Art Parlor Games" at the WMODA Gallery of Amazing Things; it is a beautiful exhibition and will be there for several weeks. Commissioner Odman reminded everyone the Mermaids will be launched in the water on July 20t'; the date the Commission decided upon depends on the weather. Vice -Mayor Salvino noted he received a phone call complaint from someone stating the Mermaid statue at the beach had already been vandalized. He reassured the caller the intent is to stand behind it and take a picture. 11.5 Mayor James Mayor James thanked Congresswoman Debbie Wasserman Schultz for speaking at the meeting about the Tri Rail and AIA improvements, as well as the water and CW Thomas projects pending approval. Mayor James stated she enjoyed the Westlawn Tree dedication ceremony where life was planted in this City. Mayor James said a new business, Niche Med Spa, opened at Dania Pointe and specializes in non-invasive services. Mayor James noted she received emails from residents regarding the City installing Broward Heights signage for their neighborhood. Mayor James said she had a headache from looking at her reflection in the bulletproof glass and requested an item be put on the agenda for the next meeting for discussion and possible action so the Commission can decide what they want to do. Mayor James noted the Tamara James Foundation is working with Parks & Recreation to provide four industrial -sized fans for the City parks to assist with cooling the children during sporting activities. 12. City Manager Garcia thanked Mayor James and noted as we have a great partner in Josh Gaboton, we have just submitted a grant application for between $5-7 million for STEM programing. Transportation would be the only thing we would have to take care of along with the FAU partnership. City Manager Garcia stated she received official documentation from Ms. Debra Black with the MLK Renaissance Corporation confirming scholarships will be awarded to scholars in the community. Events and activities did not take place due to COVID, so the committee members would like to re -appropriate funding to seven deserving Dania Beach residents. City Manager Garcia said since we are making our beach pristine and with the 1000 Mermaids project, now everyone wants to clean our beach. We will continue to educate and promote awareness of cleanliness throughout our City facilities. City Manager Garcia noted striping on NW 1st Street is almost ready to begin and we are moving forward with the RFP for the crosswalk. The crosswalk leading from the parking lot to our beach is completed. City Manager Garcia said with the completion of our Strategic Master Plan, it will be brought forward on July 13th for adoption. Also, on July 13th, the proposed millage will be set, and the draft budget will be provided. She added the City is moving forward and thanked staff for their efforts and the Commission for their support. City Manager Garcia noted the official opening of the RFP for the Dania Beach Grill is on July 13th at 11:00 a.m. City Manager Garcia announced every Thursday, between 10:00 a.m. and 12 noon at PJ Meli and CW Thomas Park, kids can pick up food to last the week for themselves and their families. Eve Boutsis, Assistant City Attorney, gave an update on LaChaim Farm, 5527 Woodland Lane, which sets on 16 acres of land. The current property owner has sold 6.25 acres to LaChaim Farm. We are investigating and Code Compliance has gone out to the property since seemingly farm activity has increased with 24 goats, two donkeys, one horse, and fifty chickens. There is a market, fishing is offered, ax throwing and petting zoo. We are facing home rule here because there is a law called Florida Right to Farm Act meant for rural and cross-country areas, but there is no distinction between rural and downtown Dania Beach. It may mean we are preempted but we are still doing our investigation as the state Legislature recently passed an amendment to this act increasing farmers' rights for agriculture tourism. The Code Compliance case we do have has been moved to August to further investigate the state legislation. Assistant City Attorney Boutsis also addressed mounds of mulch placed at JA Ely Boulevard and Sheridan Street, and stated the property was cited due to mounds of mulch. The Cultural Division's Public Art & Design program was established in 1976 and since then has commissioned more than 280 artworks for the Fort Lauderdale - Hollywood International Airport, Port Everglades, County libraries, parks and other County facilities. The program is funded through an ordinance that allocates 2% of capital improvement budgets for public art. The County recently received 3 National Association of Counties awards for its public art.
