HomeMy WebLinkAboutR-2021-118 Drore Spec Homes, LLC (Dania Gardens) Site Plan (SP-021-21) and Variance (VA-34-21)RESOLUTION NO.2021-118 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE REQUESTS FOR SITE PLAN APPROVAL (SP-021-21), AND APPROVAL OF VARIANCE REQUEST (VA- 34-21) SUBMITTED BY BARI DRORE, ON BEHALF OF DRORE SPEC HOMES, LLC, FOR THE PROPERTY AT 4633 AND 4655 SW 32ND AVENUE, IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A," A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONFLICTS; AND FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Code of Ordinances, Chapter 28, "Land Development Code" (the LDC), of Part 6, "Development Review Procedures and Requirements," Article 635, "Site Plans," states that site plan approval is required as a condition to the issuance of a building permit; and WHEREAS, Bari Drore, on behalf of Drore Spec Homes, LLC., (the Applicant) has requested Site Plan approval (SP-021-21) to allow the development of sixteen (16) townhomes at 4633 and 4655 SW 32" d Avenue (the Property) as legally described in Exhibit "A;" and WHEREAS, the property does not front on a collector or arterial roadway; and WHEREAS, Chapter 28, Part 6 of the LDC, Article 625, entitled "Variances," at Section 625-40, entitled "Variance Review Criteria; City Action," states that the City Commission may grant a variance based on its determination that the Applicant has demonstrated that the necessary criteria identified in the LDC have been satisfied; and WHEREAS, the Applicant has requested a variance (VA-34-21) to permit the lot coverage for individual lots to be a maximum of 49%; and WHEREAS, Section 205-10 of the LDC, entitled "Schedule of Lot, yard, and bulk regulations", states that a maximum of 35% lot coverage is permitted per lot and building group; and WHEREAS, the requested variance maintains the basic intent and purpose of the subject regulations, particularly as it affects the stability and appearance of the city; and WHEREAS, the requested variance is otherwise compatible with the surrounding land uses and would not be detrimental to the community; and WHEREAS, the requested variance is consistent with, and in furtherance of, the goals, objectives and policies of the City's adopted Comprehensive Plan, as amended from time to time, and all other similar plans adopted by the City; and WHEREAS, the request is more particularly consistent with Policy 8.1 of the Comprehensive Plan, which states that "[a]dequate drainage and stormwater management shall be provided for all development;" and WHEREAS, the development will include the installation of stormwater structures to ensure that adjacent properties are not negatively impacted by the requested variance; and WHEREAS, the request is more particularly consistent with Policy 8.2 of the Comprehensive Plan which states that "[o]pen space shall be provided in accordance with the Comprehensive Plan and the Land Development Regulations;" and WHEREAS, the development as a whole meets or exceeds the minimum open space and pervious area requirements of the Land Development Code; and WHEREAS, the plight of the petitioner is due to unique circumstances of the property or petitioner which would render conformity with the strict requirements of the subject regulations unnecessarily burdensome; and WHEREAS, that the variance requested is the minimum variance that is necessary to afford relief to the petitioner, while preserving the character, health, safety and welfare of the community; and WHEREAS, the requested Variance is consistent with Section 625-40 of the LDC, entitled "Variance review criteria; City action;" and WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS, the City Commission finds that the approval of the proposed site plan (SP- 021-21) and variance (VA-34-21) will protect the public health, safety, and welfare of the residents of the City, and furthers the purpose, goals, objectives, and policies of the Comprehensive Plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing WHEREAS clauses are ratified and confirmed as being true and correct and they are made a part of and incorporated into this Resolution by reference. Section 2. That pursuant to Chapter 28, entitled "Land Development Code," Part 6, entitled "Development Review Procedures and Requirements," Article 635 "Site Plan," the following site plan (SP-021-21), attached as Exhibit `B" is approved subject to the Applicant's compliance with the following conditions: 1. No offsite stormwater retention allowed. (Planning) 2 RESOLUTION #2021-118 2. The applicant must control dust during construction by taking the necessary steps and appropriate actions to retain dust at the immediate vicinity of the project, confirming that water supply is available, and ensuring that no dust is transmitted to neighboring properties or streets. In the event that construction activities affect neighboring properties with settling dust or construction debris, the applicant shall provide third -party car washing services to those affected. (Planning) 3. IMPACT FEES: $29,200 will be due in Park Impact Fees for this project at the time of building permit; per Article 810 and R-2014-071. (Planning) 4. OTHER IMPACT FEES: Based on the building footprint shown on the site data table, the impact fees for water and sewer, as well as the administrative, police and fire fee will amount to $14,143.97 (19,296 SF X $0.733); per Article 810, 0-2011-035 and 0-2005-037. (Planning) 5. Along the west property line, at the end of the driveway, the hardscape is different on the landscape plans from the site plan. Revise sheets to show the same elements. (Planning) 6. In accordance with City Code of Ordinances in Article 415. SIDEWALKS AND SWALES, Owner is responsible for the construction of sidewalks / swales within the road ROW when buildings are constructed or substantially improved. (Civil) 7. Provide BC standard details for pavement marking and signage. All traffic control signs shall conform to Broward County Traffic Engineering (BCTED) and MUTCD standards. BCTED signs specifications consist of Type XI retroreflective sheeting materials except for school zone and pedestrian signs which shall be comprised of retroreflective fluorescent yellow -green sheeting certified type IV. (Civil) 8. All pavement markings shall be alkyd based thermoplastic and fully retroreflectorized, per BCTED specifications with the exception of parking stall striping. (Civil) 9. Provide Maintenance of Traffic (MOT) Plan by a licensed General Contractor/Professional Engineer in the State of Florida (If applicable). (Civil) 10. Detail and complete engineering plans, satisfactory Drainage Report/Calculations will be required prior to Building and R/W permit approval. (Civil) 11. The existing site grades are below FEMA base flood elevation. Please provide flood plain compensation calculations per SFWMD regulations. (Civil) 12. Provide utility piping conflict details plan, along with documentation to demonstrate acceptability of the separation between water, sanitary, storm -water service lines, etc. (Civil) 3 RESOLUTION #2021-118 13. Show also all existing and proposed utilities on the landscaping plans for potential conflicts. (Civil) 14. Provide ADA parking, access / driveway, and sidewalks /ramps including dimensions in accordance with Chapter 553 of the Florida Statutes. "Accessibility of Handicapped Persons" and latest edition of "Accessibility Requirements Manual" by Department of Community Affairs, Florida Board Building Codes and Standards, and 'in accordance with Americans with Disability Act (ADA). (Civil) 15. Provide drawing file (dwg or dgn) disk of the approved site plan in Florida State Plane Coordinate (NAD 83). This should be addressed as part of the final submittal. (Civil) 16. Provide regulatory agencies' approval documentation and Permits/Licenses (as applicable) as part of the final submittal, prior to issuance of the Building Permit (Broward County Surface Water License, Broward County EPGMD Wastewater Permit, Florida Department of Environmental Protection, FDOT, BC Environmental, BC Aviation, BCTED etc.). Also, include Utility / Right of Way Permits from City, Broward County, and State Roads as applicable. (Civil) 17. PUBLIC ART PROGRAM: Per Article 811, the project is estimated to have a construction value in the $3 million range. The Public Art impact fee is estimated at $15,000 (one- half of one percent (0.5%) of construction value). The final amount will be calculated and due at the time of building permit issuance. (Planning) 18. Tree mitigation requirements for this project have not been finalized. A Tree Removal Permit reflecting the final Tree Disposition Plan, Landscape Plan, and Mitigation Requirements shall be obtained prior to any other building permit approval. (Landscape) Section 3. That pursuant to LDC Section 635-100, entitled "Expiration of Site Plans," and Section 625-50, entitled "Expiration of Variances," the site plan (SP-021-21) and variance (VA-34-21) approvals shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the improvements shown on the site plan, within eighteen (18) months from the date of this Resolution. Section 4. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency, and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. 4 RESOLUTION #2021-118 Section 5. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 6. That the City's staff report is ratified and confirmed as being true and correct and is made a specific part of the Resolution as finding of fact. Section 7. That this Resolution shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED on July 13, 2021.
