Call to Order/Roll Call Mayor James called the meeting to order at 7:10 p.m. Present: Mayor: Vice -Mayor: Commissioners City Manager: City Attorney: City Clerk: Tamara James Marco A. Moment of Silence and Pledge of Allegiance Mayor James called for a moment of silence, particularly for the Surfside victims and Haiti, followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Presentation by Maynel Alvarez -Requejo, Marketing Director of Dania Pointe Ms. Alvarez-Requejo gave a PowerPoint presentation which is attached to and incorporated into these minutes. City Manager Garcia noted the presentation would be placed on the City's website for the residents' information. Mayor James asked that events at Dania Pointe be coordinated with City events taking place to avoid scheduling conflicts. 3.2 Update on buildings in the City regarding age and status of 40-year certification - Candido Sosa-Cruz, Deputy City Manager & Eleanor Norena, Director of Community Development Deputy City Manager Sosa-Cruz and Community Development Director Norena gave a PowerPoint presentation which is attached to and incorporated into these minutes. Mayor James asked if we are going to look at buildings on water and be more restrictive than every 40 years. Community Development Director Norena responded the regulations apply to structures that are 3,500 square feet or larger regardless of where they are located. Mayor James said she would like to investigate buildings such as The Place at Dania Beach that have had previous water damage issues and any buildings with a history of instances occurring that were concerning. Staying on top of this is a priority. Community Development Director Norena explained we have started an evaluation of structures that are 20 years old in the City in anticipation of Broward County adjusting their 40-year policy to 30 years or so. Commissioner Odman asked what the approximate cost is of turning in documents that apply to the 40-year certification and in addition to the engineering report fees, if there are additional costs associated with bringing the property into compliance. Community Development Director Norena responded the City charges a fee of $250 for residential and $350 for commercial properties requiring 40-year certification. Deputy City Manager Sosa-Cruz noted the lack of structures on the beach saves us because we do not have saltwater corrosion deteriorating any structures. There is some discussion going on now as counties and cities north of us are trying to implement a 40-year certification to get where we have been since 2005. Many associations are waiting on the Board of Appeals to determine what additional steps, standards, or regulations may be added, which cities and counties would implement. Commissioner Lewellen said the most important thing is making sure the people who live and work here are safe. She wonders since we have so many condos and apartment complexes whether there is an opportunity to provide education to the property owners and managers to explain the process of compliance. Deputy City Manager Sosa-Cruz responded definitely; if any homeowner association boards request training, we are available to attend their board meetings any time and place to give them the education they need and to guide them. We will provide our contact information in case there are any follow up questions. Community Development Director Norena noted the program details have been posted on the City's website. 3.3 Parks Master Plan presentation by Parks & Recreation Eric Brown, Director of Parks & Recreation, noted at the direction of B&A, discussion took place with Pompano Beach regarding taking on a Construction Manager At Risk position, which would provide us a guaranteed maximum construction price. Our timeline for the Construction Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday, July 13, 2021 — 7:00 p.m. Manager At Risk for CW Thomas Park is the RFQ would go out September 1st and we are looking to award no later than December. The RFQ for design services would go out in January for 45 days and a firm selected in March. Once the design process is complete, the Construction Manager at Risk will bring us a guaranteed maximum price and shovels would go in the ground in June 2022. 3.4 Special Event request from Broward County, Environmental Planning & Community Resilience Division, for the 44th Annual Ocean Conservancy International Coastal Cleanup to be held on September 18, 2021, at the end of North Beach Road, from 9:00 a.m. - 12:00 p.m. The applicant is requesting a fee waiver and parking passes. (Parks & Recreation) Commissioner Lewellen motioned to approve the Special Event request for the 44th Annual Ocean Conservancy International Coastal Cleanup, including fee waiver and parking passes; seconded by Commissioner Odman. The motion carried unanimously. 4. Proclamations 4.1 Parks and Recreation Month - Mayor James Mayor James read the proclamation for Parks and Recreation Month. 5. Citizen Comments Christopher Fleming, 209-213 SW 12th Street, thanked the Tamara James Foundation and those who assisted with the beach cleanup. He said he gets nothing but static and resistance from Code Compliance; he pays $12,000 per year in taxes and is requesting mediation. He asked the Commission to give him someone to talk to; no one has helped him to come to conclusion. Samantha Angelos, 43 SW 12m Street, spoke about bulk pickup, SW 2nd Avenue and Sheridan Street, the five rental condos going up near her neighborhood, poverty and homeownership rates, affordable homeownership, and walkability in the City. Linda Wilson, President of Friends of the Dania Beach Library, spoke about the planning to have a Dania Beach Historical Society reorganizational meeting and archival items recently received. She also spoke of inconsistency with funding the Art in Public Places Board when no other City board receives funding; this is an imbalance and they all should be considered for funding. Pastor Paul Wiggins, 321 SE 3rd Street, #405, spoke of the importance of parks and recreation and education in the City, and thanked the Commission for a job well done. 6. Public Safety Reports Minutes of Regular Meeting Dania Beach City Commission Tuesday, July 13, 2021 — 7:00 p.m. Captain Daniel Marks, BSO Chief of Police, reported on recent criminal activity in the City, traffic enforcement, the regional traffic unit, homeless outreach, the BSO Summer Program with 50 children cleaning our beach this Saturday, and the COP Program. Captain Sergio Pellecer, BSO District Fire Chief, reported on personnel sent to assist in Surfside, the BSO Benevolence Association annual golf tournament this Saturday, and call volumes. He thanked City Manager Garcia for participating in BSO's strategic planning and noted there would be an event in front of Station 1 to mark the 20th anniversary of September 11. 7. The motion carried unanimously. 7.13 RESOLUTION 42021-110 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE A TWO (2) YEAR RENEWAL OF THE EXISTING AGREEMENT WITH WESTREC MARINA MANAGEMENT, INC. FOR MARINA MANAGEMENT SERVICES AND AMENDING THAT AGREEMENT TO INCLUDE NIGHT-TIME SECURITY SERVICES AT THE MARINA AND THE PIER AND INCREASED MARINA FEES; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (Parks & Recreation) City Attorney Ansbro read the title of Resolution #2021-110. Commissioner Lewellen noted we have had a lot of complaints regarding the marina security, especially with overnight guests on boats, and this contract appears to be shorter than what we would normally do with a renewal. She asked if there are specific deliverables so we can review because she wants to make sure we are following up to ensure what they are doing complies with the contract. City Manager Garcia said we could have extended the contract for five more years but instead we extended it for two years with many provisions they must adhere to. Staff met with Westrec so they have an understanding they must adhere to every part of this contract, and they assured us they will. They will have security at the beach from 6 p.m. to 6 a.m., 7 days per week, 365 days of the year, to ensure a safe beach and Marina. Vice -Mayor Salvino motioned to adopt Resolution #2021-110; seconded by Commissioner Odman. (Community Development) City Attorney Ansbro read the title of Resolution #2021-116 and Resolution #2021-117 as they relate to the same property. Corinne Lajoie, Assistant Director of Community Development, gave a presentation on the site plan, flex units, waiver, and plat requests for the Atlantica project. Mayor James asked about the parking spaces and what 237 spaces equates to per unit. Assistant Community Development Director Lajoie responded our code requires parking based on use so when it comes to residential, it varies based on the number of bedrooms in each unit. She spoke of alternative parking studies offered by various applicants, and noted this applicant is not doing that; they are asking for a variance. Commissioner Davis questioned the number of units the property is zoned for versus what they are requesting. Assistant Community Development Director Lajoie said the applicant is requesting a total of 124 residential units. Commissioner Davis noted she is concerned about the Seba development in that area as well as additional traffic on Gulf Stream Road. Residents are concerned the additional units are going to cause major traffic concerns. Assistant Community Development Director Lajoie replied the applicant had a traffic engineer who provided City staff with a traffic analysis that our engineers reviewed as to whether our roads are compatible to handle the additional trips. Minutes of Regular Meeting 9 Dania Beach City Commission Tuesday, July 13, 2021 — 7:00 p.m. Commissioner Odman asked what is being put in to handle drainage issues the project may possibly have and if anything would be draining on to them. Assistant Community Development Director Lajoie responded most likely yes; the vacant lot ends up being the lowest point. As they develop, they must raise it as well as maintaining any drainage onsite. Water will no longer flow off the site but by raising it, water from the neighborhood likely would not be able to drain any longer. Once it is built, they will be maintaining all their water on their site, and it will not be running off. Commissioner Lewellen noted garbage pick-up is twice a week and asked if these residents would be putting garbage outside of their homes. Assistant Community Development Director Lajoie said yes and noted the applicant could provide further details. Mayor James commented we have approved a lot of units in this City and asked if our lift stations are able to accommodate the units. Dincer Ozaydin, Deputy Director of Public Services, explained the 17 current lift stations and noted they can handle all the loads we have. Staff has also looked at sewer lines and there are no issues. Next year, staff will propose nine new lift stations to increase capacity. Dennis Mele, Greenspoon Marder, representing the applicant, addressed the questions regarding garbage and trash, noting collection would be five days a week from the units and would be hauled from the trash compactor two days a week. He indicated they are only doing one- and two -bedroom units and will have extra parking that exceeds what City code calls for. He addressed the community meetings held with the surrounding neighborhoods and gave a PowerPoint presentation which is attached to and incorporated into these minutes. He also addressed questions regarding drainage. Commissioner Odman asked how the drainage assessment affects the properties that are directly adjacent to the site. Attorney Mele responded it should not affect it at all. The developer would still have the same capacity for drainage after development as they did before development. He noted permitting is being sought which is required to be approved by Broward County, and he continued with the PowerPoint presentation. Commissioner Lewellen asked if each of the several projects in this area is doing something regarding the drainage. Assistant Community Development Director Lajoie replied each project must go through the same analysis such as drainage on the site, maintenance, and raised parking. Minutes of Regular Meeting 10 Dania Beach City Commission Tuesday, July 13, 2021 — 7:00 p.m. Deputy Public Services Director Ozaydin responded as the applicants inform us, they must keep their rainwater on their site. Site plans are reviewed at the DRC level and pipes are recommended to add drainage so there is no flooding of the neighbors' property. Mayor James questioned the status of the SE drainage project. Deputy Public Services Director Ozaydin explained the SE drainage project has started; we are in design and will be submitting the design to Broward County at the end of this month. We are looking to be in the construction phase once we receive funding from the County, with a projected start date of March 2022. Mayor James opened the Public Hearings. Lloyd Zdroba, 180 NE 6th Court, said the developer is proposing three times the density as the neighboring properties. There will be 200 plus cars flying through the area with speed humps and all rental property is being built with no ownership. Sandra Edwards, 178 NE 6th Court, noted she is upset about this development which is directly behind her home, and she would like to see what the real traffic study shows. Stacy Brown, 621 NE 2nd Street, spoke in opposition to the project due to traffic concerns. Charles Hubbard, 604 NE 2nd street, expressed opposition to the project due to traffic issues. Seeing as there was no one else to speak in favor or opposition, Mayor James closed the Public Hearings. Attorney Mele spoke about the zoning of the property, which allows a 5-story building, and addressed the other concerns raised by the residents. He also addressed the traffic study, traffic lights, cut -through traffic, and drainage. Mayor James asked if there could be a compromise by a reduction of number of units proposed. Attorney Mele noted they started at a higher number of 142 than what is now proposed at 124. Although the people present tonight were objecting to the project, the people who support a project never show up at these meetings. He added the current plan fits height, parking, drainage, and zoning district requirements. Commissioner Lewellen said we are all aware of the traffic on NE 2nd Street and though there are speed humps, they are not very effective. She questioned perhaps the use of roundabouts. City Manager Garcia felt we should investigate a traffic circle for traffic calming in certain areas. Attorney Mele noted they are committed to continue working with the City to see what kind of traffic calming would be best. Minutes of Regular Meeting 11 Dania Beach City Commission Tuesday, July 13, 2021 — 7:00 p.m. Commissioner Davis commented she is not clear how the traffic study indicated the amount of traffic stacking to turn out onto US-1 will not increase. Attorney Mele responded the traffic study showed an acceptable level of service. He noted they are committed to continue working with the City to alleviate the situation. Commissioner Odman noted the area really has changed and has reached the tipping point; she does not know how we address it. At the end of the day, they are increasing density. Lon Tabatchnick, 17605 Scarsdale Way, Boca Raton, representing the applicant, commented focusing on units rather than bedrooms is the wrong emphasis, and addressed zoning, land use, and the traffic study. Attorney Mele explained the traffic study looks at intersections and provided the ratings for level of service for numerous intersections. Vice -Mayor Salvino motioned to adopt Resolution 42021-116; seconded by Mayor James. Discussion ensued regarding traffic. Commissioner Lewellen said this project is not causing the traffic issues in this neighborhood as they have existed for a long time. She would like to see the traffic study regardless of whether the Commission votes today or not, but traffic has always been an issue in that area. Attorney Mele commented whether the Commission continues this tonight, they would continue working with the City on the traffic study and calming analysis. Commissioner Davis made a substitute motion to continue Resolution #2021-116 until the August 24, 2021, City Commission meeting at 7:00 p.m.; seconded by Commissioner Lewellen. Commissioner Davis spoke of the previous decision made to install the bullet proof glass. She does not support wasting taxpayer money and opposes removing it. Commissioner Odman recalled the context of the previous partition discussions. She felt the glass should be removed as sound is distorted and functionally, this cannot continue to work due to hearing concerns. Minutes of Regular Meeting 13 Dania Beach City Commission Tuesday, July 13, 2021 — 7:00 p.m. Vice -Mayor Salvino said he is sorry we spent the money, mistakes were made, and somewhere along the line we will make up the $100,000 with the great staff we have. Commissioner Lewellen agreed with Commissioner Davis; this was voted on and installed. She noted she opposed the installation during the original discussion. The Commission consensus was to have the bullet proof glass on the dais removed. Mayor James recessed the meeting at 9:57 p.m. and reconvened the meeting at 10:02 p.m., with all present as before. 10.2 Dania Beach annexation of beach land in Hollywood jurisdiction - Commissioner Odman Commissioner Odman indicated the site currently being investigated for potential annexation is property in Hollywood and noted the July 20t1i event for the installation of the mermaids has been cancelled. She said we ran into some snags with the Navy as the site is also a Naval restricted zone and the installation location would be changed to closer to the shore, making it more accessible to inexperienced divers. They will host activities and continue putting the modules in the water until the new sought -out permitting spot has been approved. She noted being faced with this challenge revived the conversation about the land just to the north side of the pier that we maintain but is not Dania Beach. She asked the City Manager to elaborate on the options and discussions on this topic. City Manager Garcia spoke of a meeting in 2019 with City staff and the City of Hollywood regarding annexation of the land on the beach. She felt there should be some sort of a directive to her to start dialogue and to possibly nominate a Commissioner as liaison. Mayor James said she would like to be the liaison to start the conversation with the fellow Commission colleagues. Vice -Mayor Salvino noted he recently had a conversation with Mayor Levy from Hollywood on the annexation subject and the parking concerns. City Attorney Ansbro stated the beach land has been researched several times; one thing for sure is, you cannot get the beach land unless both owners are willing to sell. As it stands, the private owner has no desire to de -annex from Hollywood to sell his land to our City. Mayor James said she will meet with City Manager Garcia, City Attorney Ansbro, and if it makes sense, they all will meet with Mayor Levy of the City of Hollywood and ultimately follow up with the Commission. 10.3 Selling City merchandise - City Manager Garcia Minutes of Regular Meeting 14 Dania Beach City Commission Tuesday, July 13, 2021 — 7:00 p.m. City Manager Garcia noted Commissioner Odman asked about the status of this item from a year ago when we were preoccupied with COVID. Discussions with the CRA Executive Director and Chamber of Commerce have led to the possibility of a store front. She would like to move forward with an RFP for merchandise and asked what kind of merchandise the Commission would like, such as key chains or mugs. She added the conversation could be had at the budget workshop. Mayor James recommended bringing back ideas to shorten the conversation tonight. Commissioner Odman agreed with bringing back the brainstorming. In the meantime, we can look at what other cities are doing. 10.4 Melaleuca wall - City Manager City Manager Garcia spoke of the adoption of the Strategic Master Plan; safety and beautification have been a top priority. She noted the deterioration of the Melaleuca wall stands out. We have cleaned up the wall and it has been well received, and Public Services reached out to the County, and they will be maintaining the wall. She suggested investing to paint the wall; the cost would be $17-18,000 and would come from Commission contingency. The Commission consensus was to move forward with painting the Melaleuca wall and to pay the cost for removal of the glass on the dais and painting the wall from Commission contingency. City Manager Garcia reassured the Commission we will be working on the wall as well as the removal of the dais glass. 11. Commission Comments 11.1 Commissioner Davis Commissioner Davis had no comments. 11.2 Commissioner Lewellen Commissioner Lewellen spoke of an MPO meeting regarding bike lanes and noted preventing bike riders from riding all over the road cannot be enforced unless we have bike lanes. She distributed a bike map from the MPO identifying all current bike lanes in the City. Commissioner Lewellen also spoke of concerns regarding LaChaim Farm traffic issues and questioned if we have any additional enforcement there keeping an eye on traffic to determine if it is a significant problem. City Attorney Ansbro said the farm's lawyer reached out to us today and advised arrangements are being made for Code enforcement to inspect the property and meet with the owner.
