AT A COST OF EIGHTY-EIGHT THOUSAND ONE HUNDRED FORTY-NINE DOLLARS ($88,149.00) THAT EXCEEDED THE ANNUAL VENDOR THRESHOLD AMOUNT OF TWENTY FIVE THOUSAND DOLLARS ($25,000.00); PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Charter of the City of Dania Beach, Part III, Article 3, Section 4, Subsection 0), authorizes the City Manager to purchase supplies, services, equipment and materials for the city government in amounts in excess of the established monetary threshold without competitive bidding and without advertisement in cases of emergency or when the work requires immediate completion; and WHEREAS, the Dania Beach Code of Ordinances, Chapter 2, Article 1, Section 2-10, "Monetary thresholds for certain purchases and payment disbursement authorizations", Subsection (a), sets the monetary threshold or limitation at $25,000.00; and WHEREAS, as part of Public Services Department's Citywide review of facility safety, the repair of a support column at the fishing pier bait shop was identified; and WHEREAS, in the interest of safety it was deemed necessary to repair the column prior to the start of the Pier Refurbishing Project, which is expected to begin in late fall of this year; and WHEREAS, the Public Services Department sought quotes from several specialized marine structures contractors and Cone & Graham, Inc. (C&GI) was the only responsive firm within the time frame set for providing proposals; and WHEREAS, City Administration deemed the condition of the column an immediate safety concern and authorized the Public Services Department to proceed with contracting C&GI for the completion of the support column repair under emergency order; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "Whereas" clauses are ratified and confirmed to be true and correct and they are made a part of and are incorporated into this Resolution by this reference. Section 2. That the proper City officials are authorized to retroactively approve the repair of the support column at the pier's bait shop. Section 3. That funding for this repair, at a cost of Eighty -Eight Thousand One Hundred Forty -Nine Dollars ($88,149.00) was available in the Pier Refurbishing Project CIP account no. 405-72-15-572-63-10 and exceeded the annual fiscal year vendor threshold of Twenty -Five Thousand Dollars ($25,000.00). Section 4. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 5. That this Resolution shall be retroactive to July 31, 2021 and shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED on August 24, 2021. Cone & Graham Inc. proposal including all notes, terms and conditions mentioned here -in must be signed where stated. 2. Should the Owner or Contractor require a form other than Cone & Graham. Can and Graham will require the pier to be closed from time to time in order to get its materials and equipment to the location. We may also require the beach to be closed from the pier to 50' north of the pier 5. A Bond is not included in the contract prices. 6. Our prices are based on no retainage. Contract will make one payment request when the project is complete. 7. All monies not paid when due shall bear interest at the prime rate+ 10% per annum allowed by law on the project. 8. No Survey is included in quoted prices. 9. All permits and the cost of all permits are to be paid for a secured by Dania Beach. 10. The failure of Cone & Graham Inc. to enforce any provisions of the agreement shall not be construed as a waiver or limitation of Cone & Graham Inc. right to subsequently enforce and compel strict compliance with every provision of the agreement.
