HomeMy WebLinkAboutR-2021-116 East Side Five, LLC (Atlantica) Site Plan (SP-018-21), Flex Units (OT-020-21), Waiver of Dumpster Enclosure (OT-029-21) REVISED 8-13-21RESOLUTION NO.2021-116 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-018-21), THE ALLOCATION OF FORTY-SIX (46) FLEXIBILITY UNITS (OT-020-21), AND A WAIVER OF THE DUMPSTER ENCLOSURE REQUIREMENT (OT-029- 21), SUBMITTED BY LEIGH ROBINSON KERR & ASSOCIATES, INC., ON BEHALF OF EAST SIDE FIVE, LLC, FOR PROPERTY GENERALLY LOCATED SOUTH OF NE 2 STREET AND WEST OF NE 6 COURT, IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A", A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Leigh Robinson Kerr & Associates, Inc., on behalf of East Side Five, LLC (the "Applicant"), is requesting approval of a site plan (SP-018-21) and the allocation of forty-six (46) flexibility units (OT-020-21) to permit the future construction of 124 multi -family dwelling units for property generally located south of NE 2 Street and west of NE 6 Court, in the City of Dania Beach, Florida (the "City") as legally described in Exhibit "A", a copy of which is made a part of and incorporated into this resolution by this reference; and WHEREAS, the City Code of Ordinances, Chapter 28, entitled, "Land Development Code" ("LDC") of Part 6, entitled, "Development Review Procedures and Requirements," of Article 635, entitled, "Site Plans" of Section 635-20(A), provides that site plan approval is required prior to commencement of construction; and WHEREAS, the Applicant is requesting site plan approval to permit the future redevelopment of the subject property pursuant to and consistent with the attached site plan provided as Exhibit `B"; and WHEREAS, the Applicant is requesting the allocation of forty-six flexibility units (OT- 020-21); and WHEREAS, per Part 2 of the LDC, Article 290, entitled, "Garbage Dumpsters," Section 290-90, entitled "Waivers," provides that a property owner may request a waiver of the requirement for a dumpster enclosure in accordance with the public notice requirement of article 625, Variances; and WHEREAS, Section 290-90(E) of the LDC provides that the City Commission may grant the requested waiver upon consideration of the factors identified in the LDC; and WHEREAS, the Applicant has submitted documentation justifying the waiver request; and WHEREAS, the Applicant is requesting a waiver of the requirement for a dumpster enclosure (OT-029-21); and WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS, the City Commission finds that the approval of the site plan (SP-018-21), the allocation of forty-six (46) flexibility units (OT-020-21) and waiver of the dumpster enclosure requirement (OT-029-21) will protect the health, safety, and welfare of the residents of the City, and furthers the purpose, goals, objectives and policies of the City's Comprehensive Plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct and they are made a specific part of this Resolution. Section 2. That pursuant to Chapter 28 "Land Development Code," Part 6 "Development Review Procedures and Requirements," Article 635 "Site Plan," the following site plan (SP-018-21), attached as Exhibit "B", the allocation of forty-six (46) flexibility units (OT- 020-21), and the dumpster waiver (OT-029-21), which is made a part of and incorporated into this Resolution by reference are approved. Section 3. That the approvals granted by this Resolution are subject to the Applicant's compliance with the following conditions: 1. Prior to building permit, the Developer shall provide signage at Fronton Blvd. and NE 2 Street providing direction to use Dania Beach Blvd to travel south on Federal Highway. (Planning) 2. Prior to building permit, the Developer shall provide conceptual designs for potential roadway improvements on NE 2 Street to be approved by Public Services. (Planning) 3. The Applicant must provide a copy of a plan or contract detailing trash collection services for the individual units on the property. (Planning) 4. The applicant must control dust during construction by taking the necessary steps and appropriate actions to retain dust at the immediate vicinity of the project, confirming that water supply is available, and ensuring that no dust is transmitted to neighboring properties or streets. In the event that construction activities affect neighboring properties with settling dust or construction debris, the applicant shall provide third -party car washing services to those affected. (Planning) 2 RESOLUTION #2021-116 5. IMPACT FEES: At the time of building permit an impact fee in the amount $169,136 (124 D.U. x $1,364) will be due for Recreation and Open Space; per R-2014-071. (Planning) 6. OTHER IMPACT FEES: Other Impact Fees will be assessed at the time of building permit in accordance with Article 810. (Planning) 7. PUBLIC ART PROGRAM: Per Article 811, the project is estimated to have a construction value in the $2 million range. The Public Art impact fee is estimated at $10,000 (one-half of one percent (0.5%) of construction value). The final amount will be calculated and due at the time of building permit issuance. (Planning) 8. Provide elevations for the clubhouse, which shall be designed in accordance with Sec. 205- 10. (Planning) 9. Provide additional Fire Department Access Information as follows: a. Fire Lane locations and striping detail (demonstrated) b. "NO PARKING" sign locations and sign details demonstrated c. A note or detail identifying the design load for surface compaction of all non -paved roadways and/or Fire Department Access Roads (where applicable) d. Building Accessibility e. Load Limits for Bridges and Grading for significant changes in elevation (if applicable) f. Fire Department Access Routes During Construction (Fire) 10. Additional Water Supply Information as follows: Locations of all Post Indicating Valves or Underground Gate Valves, Double Detector Check Valves, etc. (Fire) 11. A detail sheet accompanying the Civil Plans with the following details: a. Fire Hydrant Detail b. Bollard / Impact Protection Detail for Hydrants, FDC's & DDCV's c. Roadway Pavement Marker (RPM) Detail for Fire Hydrant Locations (Blue Reflective Markers) d. Post Indicating Valve Detail (where applicable) e. Underground Gate Valve Detail (where applicable) f. Backflow Preventor / Double Detector Check Valve (DDCV) Detail (where applicable) that identifies the DDCV as being listed for Fire Use g. Signage Detail for the Fire Department Connections (where applicable) (Fire). 12. Address Detail — Contact the Diana Beach Fire Prevention office at 954-342-4262. (Fire). 3 RESOLUTION #2021-116 13. An egress plan demonstrating and dimensioning all common paths of travel and travel distances to all exits within the buildings and/or structures. (Life Safety Plan) (Fire). 14. Minimum Radio Signal Strength for Fire Department Communications — See details on the next page. (BDA) (Fire). 15. Any road cuts for utilities, curb cuts and/or others with the City ROW shall be restored to full lane width for 50' minimum length centered on the proposed cut. (Civil) 16. Provide Maintenance of Traffic (MOT) Plan by a licensed General Contractor/Professional Engineer in the State of Florida (If applicable). (Civil) 17.In accordance with City Code of Ordinances in Article 415. SIDEWALKS AND SWALES, Owner is responsible for the construction of sidewalks / swales within the road ROW when buildings are constructed or substantially improved. (Civil) 18. Detail and complete engineering plans and satisfactory Drainage Report/Calculations will be required prior to Building and R/W permit approval. Preliminary Drainage Report/Calculation and preliminary plans are provided with Site Plan application. (Civil) 19. Provide utility piping conflict details plan, along with documentation to demonstrate acceptability of the separation between water, sanitary, storm -water service lines, etc. (Civil) 20. Show also all existing and proposed utilities on the landscaping plans for potential conflicts. (Civil) 21. Provide ADA parking, access / driveway, and sidewalks /ramps including dimensions in accordance with Chapter 553 of the Florida Statutes. "Accessibility of Handicapped Persons" and latest edition of "Accessibility Requirements Manual" by Department of Community Affairs, Florida Board Building Codes and Standards, and'in accordance with Americans with Disability Act (ADA). (Civil) 22. Provide drawing file (dwg or dgn) disk of the approved site plan in Florida State Plane Coordinate (NAD 83). This should be addressed as part of the final submittal. (Civil) 23. Provide regulatory agencies' approval documentation and Permits/Licenses (as applicable) as part of the final submittal, prior to issuance of the Building Permit (Broward County Surface Water License, Environmental Resource Permit, Broward County Wastewater Permit, Florida Department of Environmental Protection, FDOT, BC Environmental, BC Aviation, BCTED etc.). Also, include Utility / Right of Way Permits from City, Broward County, and State Roads as applicable. (Civil) 4 RESOLUTION #2021-116 24. Modify Figure 3 in Appendix A to include the intersection at NE 2nd Street and US 1. (Per revised traffic study dated August 2, 2021) 25. According to the provided PSCF data included in Appendix D, the PCSF for the week of the year when the counts were collected (7/15/2021) at US 1 & NE 2nd Street is 1.20 instead of the used 1.12. Please revise Volume Development Sheet, Synchro Output Reports and Tables 2, 3 and 4 of the report. (Per revised traffic study dated August 2, 2021) 26. Please double check the calculation of the growth rate being utilized and provided in Appendix D. If needed, please modify volume development tables, figures, and Synchro output reports. (Per revised traffic study dated August 2, 2021) 27. There is a discrepancy on the dates of the counts that were conducted for this study. The Executive Summary indicates that data collection was conducted on Tuesday March 16, 2021. Page 6 of the study indicates that existing volumes were collected on Wednesday 20, 2021. Please clarify. (Per revised traffic study dated August 2, 2021) Section 4. That pursuant to LDC Section 635-100 "Expiration of Site Plans," the site plan (SP-018-21) approval shall automatically expire and become null and void unless the Applicant commences with construction of the improvements shown on the Site Plan, within eighteen (18) months from the date of this Resolution. Section 5. That the issuance of a development order by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency and does not create any liability on the part of the municipality for issuance of the development order if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 6. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 7.
