RESOLUTION NO.2021-139 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-46-21), SUBMITTED BY SPIRIT AIRLINES, FOR PROPERTY GENERALLY LOCATED SOUTH OF NORTH MARINER STREET, WEST OF BRYAN ROAD, NORTH OF RADIANT DRIVE AND EAST OF WAY POINTE AVENUE, WITHIN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A" ("PROPERTY"), A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONDITIONS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, The City Code of Ordinances, Chapter 28, entitled "Land Development Code" ("LDC"), Part 6, entitled "Development Review Procedures and Requirements," Article 635, entitled "Site Plans," provides that site plan approval is required as a condition to the issuance of a building permit; and WHEREAS, Kimley-Horn and Associates, Inc., (the "Applicant") is requesting Site Plan approval (SP-46-21) to permit the development of a new 180,222-square foot office building, 108,085-square foot SIM building, and a parking garage on Property in the City, located south of Meridian Drive and west of Bryan Road, as legally described in Exhibit "A"; and and WHEREAS, the Applicant is requesting approval of the proposed Site Plan (SP-46-21); WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Chapter 28, Part 6 of the LDC, Article 610; and WHEREAS, the City Commission finds that the approval of the proposed Site Plan (SP- 46-21) will protect the public health, safety, and welfare of the residents of the City, and furthers the purpose, goals, objectives and policies of the Comprehensive Plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct, and they are made a part of and incorporated into this Resolution by reference. Section 2. That pursuant to Chapter 28, Part 6 of the LDC, Article 635, the following Site Plan, attached as Exhibit "B," which is made a part of and incorporated into this Resolution by reference, is approved. Section 3. That the approvals granted by this Resolution are subject to the Applicant's compliance with the following conditions: CONDITIONS OF APPROVAL: 1. In accordance with City Code of Ordinances in Article 415. SIDEWALKS AND SWALES, Owner is responsible for the construction of sidewalks / swales within the road ROW when buildings are constructed or substantially improved (Engineering). 2. Provide BC standard details for pavement marking and signage. All traffic control signs shall conform to Broward County Traffic Engineering (BCTED) and MUTCD standards. BCTED signs specifications consist of Type XIretroreflective sheeting materials except for school zone and pedestrian signs which shall be comprised of retroreflective fluorescent yellow -green sheeting certified type IV (Engineering). 3. All pavement markings shall be alkyd based thermoplastic and fully retroreflectorized, per BCTED specifications with the exception of parking stall striping (Engineering). 4. Provide Maintenance of Traffic (MOT) Plan by a licensed General Contractor/Professional Engineer in the State of Florida, if applicable (Engineering). 5. Detail and complete engineering plans will be required prior to Building and R/W permit approval (Engineering). 6. Provide utility piping conflict details plan, along with documentation to demonstrate acceptability of the separation between water, sanitary, storm -water service lines, etc. (Engineering). 7. Show also all existing and proposed utilities on the landscaping plans for potential conflicts (Engineering). 8. Provide ADA parking, access / driveway, and sidewalks /ramps including dimensions in accordance with Chapter 553 of the Florida Statutes. "Accessibility of Handicapped Persons" and latest edition of "Accessibility Requirements Manual" by Department of Community Affairs, Florida Board Building Codes and Standards, and 'in accordance with Americans with Disability Act (ADA) (Engineering). 9. Provide drawing file (dwg or dgn) disk of the approved site plan in Florida State Plane Coordinate (NAD 83). This should be addressed as part of the final submittal (Engineering). 10. Provide regulatory agencies' approval documentation and Permits/Licenses (as applicable) as part of the final submittal, prior to issuance of the Building Permit (Broward County Surface Water License, Broward County EPGMD Wastewater Permit, Florida Department of Environmental Protection, FDOT, BC Environmental, 2 RESOLUTION #2021-139 BC Aviation, BCTED etc.). Also, include Utility / Right of Way Permits from City, Broward County, and State Roads as applicable (Engineering). 11. Additional Fire Department Access Information as follows: a. Fire Lane locations and striping detail (demonstrated) b. "NO PARKING" sign locations and sign details demonstrated c. A note or detail identifying the design load for surface compaction of all non -paved roadways and/or Fire Department Access Roads (where applicable) d. Building Accessibility e. Load Limits for Bridges and Grading for significant changes in elevation (if applicable) f. Fire Department Access Routes During Construction (Fire). 12. Additional Water Supply Information as follows: a. Locations of all Post Indicating Valves or Underground Gate Valves, Double Detector Check Valves, etc. (Fire). 13. A detail sheet accompanying the Civil Plans with the following details: a. Fire Hydrant Detail b. Bollard / Impact Protection Detail for Hydrants, FDC's & DDCV's c. Roadway Pavement Marker (RPM) Detail for Fire Hydrant Locations (Blue Reflective Markers) d. Post Indicating Valve Detail (where applicable) e. Underground Gate Valve Detail (where applicable) £ Backflow Preventor / Double Detector Check Valve (DDCV) Detail (where applicable) that identifies the DDCV as being listed for Fire Use g. Signage Detail for the Fire Department Connections (where applicable) (Fire). 14. Address Detail — Contact the Diana Beach Fire Prevention office at 954-342- 4262(Fire). 15. An egress plan demonstrating and dimensioning all common paths of travel and travel distances to all exits within the buildings and/or structures. (Life Safety Plan) (Fire) 16. Minimum Radio Signal Strength for Fire Department Communications — See details on the next page. (BDA) (Fire). 17. Provide a Construction Staging Plan to be approved by the Community Development Director prior to issuance of a building permit. The Construction Staging Plan must include, but is not limited to, all construction employee parking locations and location of equipment and material during construction (Planning). 18. PUBLIC ART PROGRAM: Per Article 811 - Based on the construction value provided by the applicant this project is estimated to contribute $250,000 into the City's Public Art fund. Alternatively, they may choose to install public art on site equal to half of the required contribution and provide payment into the City's Public Art fund equal to $125,000. (Planning & Zoning). RESOLUTION #2021-139 19. RAC Traffic: The August 5, 2021 Transportation Mitigation Impact Feet Calculations prepared by Kimley-Horn and submitted with this application identifies 402 PM Peak Hour Trips for the Spirit Headquarter and Training buildings. Therefore, $8,546.52 (402 trips X $21.26) is due prior to issuance of a building permit (Planning & Zoning). 20. The proximity to the airport will be required FAA/BCAD review and approval. Contact William Castillo, Airport Planner with Broward County Aviation Department, located at 2200 SW 45 Street, Suite 101, Dania Beach, FL 33315, (954) 359-6100. Previous letters have expired. 21. LOADING: See DP DDG Section (7)(3). Identify where loading activity will occur. 22. ROOFTOP MECHANICAL EQUIPMENT: Must meet regulations in Section 220-60. Identify how equipment will be screened from view. Section 4. That pursuant to Chapter 28, Part 6 of the LDC, Article 635, Section 635- 100 entitled "Expiration of site plans; procedure for extension," the Site Plan approval shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the improvements shown on the Site Plan, within eighteen (18) months from the date of this Resolution. Section 5. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law. Section 6. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 7.
