HomeMy WebLinkAboutR-2021-140 Spirit Airlines Residential Site Plan (SP-47-21)RESOLUTION NO.2021-140 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-47-21), SUBMITTED BY SPIRIT AIRLINES, FOR PROPERTY GENERALLY LOCATED SOUTH OF MERIDIAN DRIVE, WEST OF BRYAN ROAD, NORTH OF SOUTH BEARING STREET AND EAST OF ATLAS LANE, WITHIN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A" ("PROPERTY"), A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONDITIONS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Code of Ordinances, Chapter 28, entitled "Land Development Code" ("LDC"), Part 6, entitled "Development Review Procedures and Requirements," Article 635, entitled "Site Plans," provides that site plan approval is required as a condition to the issuance of a building permit; and WHEREAS, Kimley-Horn and Associates, Inc., (the "Applicant") is requesting Site Plan approval (SP-47-21) to permit the development of a new residential building, consisting of 200 residential dwelling units, and 54,415-square foot parking garage on Property in the City, located south of Meridian Drive and west of Bryan Road, as legally described in Exhibit "A"; and and WHEREAS, the Applicant is requesting approval of the proposed Site Plan (SP-47-21); WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Chapter 28, Part 6 of the LDC, Article 610; and WHEREAS, the City Commission finds that the approval of the proposed Site Plan (SP- 47-21) will protect the public health, safety, and welfare of the residents of the City, and furthers the purpose, goals, objectives and policies of the Comprehensive Plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct, and they are made a part of and incorporated into this Resolution by reference. Section 2. That pursuant to Chapter 28, Part 6 of the LDC, Article 635, the following Site Plan, attached as Exhibit `B," which is made a part of and incorporated into this Resolution by reference, is approved. Section 3. That the approvals granted by this Resolution are subject to the Applicant's compliance with the following conditions: 1. Identify ROW lines, dimensions and grading on the Project/Property (Engineering). 2. In accordance with City Code of Ordinances in Article 415. SIDEWALKS AND SWALES, Owner is responsible for the construction of sidewalks / swales within the road ROW when buildings are constructed or substantially improved (Engineering). 3. Provide BC standard details for pavement marking and signage. All traffic control signs shall conform to Broward County Traffic Engineering (BCTED) and MUTCD standards. BCTED signs specifications consist of Type XI retroreflective sheeting materials except for school zone and pedestrian signs which shall be comprised of retroreflective fluorescent yellow -green sheeting certified type IV (Engineering). 4. All pavement markings shall be alkyd based thermoplastic and fully retroreflectorized, per BCTED specifications with the exception of parking stall striping (Engineering). 5. Provide Maintenance of Traffic (MOT) Plan by a licensed General Contractor/Professional Engineer in the State of Florida (If applicable) (Engineering). 6. Detail and complete engineering plans will be required prior to Building and R/W permit approval (Engineering). 7. Provide utility piping conflict details plan, along with documentation to demonstrate acceptability of the separation between water, sanitary, storm -water service lines, etc (Engineering). 8. Show also all existing and proposed utilities on the landscaping plans for potential conflicts (Engineering). 9. Provide ADA parking, access / driveway, and sidewalks /ramps including dimensions in accordance with Chapter 553 of the Florida Statutes. "Accessibility of Handicapped Persons" and latest edition of "Accessibility Requirements Manual" by Department of Community Affairs, Florida Board Building Codes and Standards, and 'in accordance with Americans with Disability Act (ADA) (Engineering). 10. Provide drawing file (dwg or dgn) disk of the approved site plan in Florida State Plane Coordinate (NAD 83). This should be addressed as part of the final submittal (Engineering). 11. Provide regulatory agencies' approval documentation and Permits/Licenses (as applicable) as part of the final submittal, prior to issuance of the Building Permit (Broward County Surface Water License, Broward County EPGMD Wastewater Permit, Florida Department of Environmental Protection, FDOT, BC Environmental, BC Aviation, BCTED etc.). Also, include Utility / Right of Way Permits from City, Broward County, and State Roads as applicable (Engineering). 2 RESOLUTION #2021-140 12. PUBLIC ART PROGRAM: Per Article 811, The City's Public Art Program specifies a fee to be paid into the Public Art fund by new development projects over $1 million in construction value. (Planning & Zoning) 13. RAC TRAFFIC IMPACT MITIGATION: Kimley-Horn Traffic Impact Analysis signed and dated June 29, 2021 identifies 78 PM Peak Hour Trips for the Spirit Residential site plan. Therefore, $1,658.28 (78 trips X $21.26) is due prior to issuance of a building permit. (Planning & Zoning) 14. RECREATION AND OPEN SPACE IMPACT FEE: Per Resolution 2014-071, Recreation and Open Space Impact Fee of $1,364.00 per Multifamily Dwelling must be paid at the time of building permit issuance. Therefore, $272,800.00 (200 X 1364) is due at time of issuance of a building permit (Planning & Zoning). 15. Add "native" status to thatch palm, and move into "Palm Tree" category (Landscaping). 16. Provide the following additional Fire Department Access Information as follows: a. Fire Lane locations and striping detail (demonstrated) b. "NO PARKING" sign locations and sign details demonstrated c. A note or detail identifying the design load for surface compaction of all non - paved roadways and/or Fire Department Access Roads (where applicable) d. Building Accessibility e. Load Limits for Bridges and Grading for significant changes in elevation (if applicable) f. Fire Department Access Routes During Construction (Fire) 17. Additional Water Supply Information as follows: a. Locations of all Post Indicating Valves or Underground Gate Valves, Double Detector Check Valves, etc. (Fire) 18. Address Detail — Contact the Diana Beach Fire Prevention office at 954-342-4262. (Fire) 19. Provide an egress plan demonstrating and dimensioning all common paths of travel and travel distances to all exits within the buildings and/or structures - Life Safety Plan (Fire). Section 4. That pursuant to Chapter 28, Part 6 of the LDC, Article 635, Section 635- 100 entitled "Expiration of site plans; procedure for extension," the Site Plan approval shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the improvements shown on the Site Plan, within eighteen (18) months from the date of this Resolution. Section 5. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency and does not create any liability on the part of the municipality for issuance of the permit if the RESOLUTION #2021-140 Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law. Section 6. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 7. This residential parcel is located in the southeast portion of Phase II, east of Atlas Lane, between Meridian Drive and South Bearing Street. The overall project has received a Conceptual Drainage Permit and Phase I Construction Surface Water Management License No. SWM2016-059-0, issued on 8/8/2016 and updated on June 20, 2017. The conceptual Drainage Permit was modified to include full buildout of Phase II and Phase II Construction Surface Water Management License No SWM2016-059-3 and then was revised and issued on March 25, 2020 to include the buildout of an outparcel and update the drainage rating curves (License No SWM2016-059-4). On November 13, 2020 the License was updated to include construction of Residential parcel B by granting ERP No. 06-07386-P and Surface Water Management License No. SWM2016-059-5. Most recently a minor modification was granted for revisions to T-Plaza near the intersection of Point Boulevard and Sunset Drive which was issued as Surface Water Management License No. SWM2016-059-3. The proposed residential parcel building within this application to the City of Dania Beach is consistent with the Conceptual ERP and the Phase II Construction Surface Water Management License. Spirit Residential C is within drainage sub -basin "Area 2" of the drainage report. As approved under License Numbers SWM2016-059-0, SWM2016-059-3 and SWM2016-059-5, the proposed stormwater management system meets the following conditions: • Provides 0.5" dry pretreatment volume for the 109.01-acre overall Dania Pointe basin area. • Provides 2.5" water quality treatment volume for the impervious area. • Maintains predevelopment discharge during the 25-year 72-hour storm event. (Assumed at zero discharge). • Regulates the 100-year 72-hour peak stage to less than, or equal to, the Broward County Flood Map proposed elevation of 6.0' NAVD. • Provides head differential on drainage wells. • Finished Floor Elevations are a minimum of 1' above the FEMA 100-year elevation at the time of the conceptual permit. At this time the FEMA map shows elevation 4.0 NAVD. Please note that the following information is how the overall system achieves water quality treatment and attenuation. Water Quality Water quality treatment has been provided for the entire 109.01-acre project area in exfiltration trenches and the dry pond located towards the north end of the project site. As shown on the Dania Kimley»>Horn Pointe Phase 2 construction plans, primary stormwater conveyance "trunk" lines are located throughout the project site to convey treated water from the dry pond and exfiltration trench to the drainage wells. No inlets are directly connected to the primary trunk lines. The roof drains will connect directly to the primary trunk lines. Other than the roof drains directly connected to the trunk lines, all water entering the trunk lines will be treated by the exfiltration trench or dry pond prior to entering the trunk lines. The parking areas shall sheet flow to a series of inlets and to exfiltration trench or the dry retention pond to achieve water quality treatment before discharging into drainage wells or the wet retention area. All water quality facilities have been constructed in the overall Dania Pointe project. No new water quality treatment devices systems are proposed with this project as it has already been accounted for in the overall system. Water Quantity Water quantity for the proposed improvements has been provided to meet Broward County and City of Dania Beach regulatory criteria. Attenuation has been provided through the use of exfiltration trench, the dry retention area, wet detention area, surface storage within the parking areas and infiltration through the drainage wells. The Interconnected Channel and Pond Routing Model (ICPR) computer program was used to model the post -development maximum stage within the project. Additional attenuation facilities are being proposed for this parcel outside of the already constructed overall Dania Pointe master drainage system. Storm Events The onsite stormwater system has been analyzed for the 5-year 1 hour, 5-year 24 hour, 10-year 24 hour, 25-year 72 hour, 100-year 72-hour rainfall events. The individual analyses with required rainfall amounts and durations are given in the [CPR models. The SFWMD72 and SCSII rainfall files were utilized to create the basin hydrograph. This includes the retail Building K, Parking Garage 2 and Avery Dania Pointe residential parcels 1 and 2 and Spirit residential parcel 3. The original calculations separated building area from garage area. These are combined in one structure on Spirit residential parcel 3. The table below provides a summary of the areas assumed in the original calculations versus those being constructed. With the construction of this parcel, the original calculations included a total of 0.03 acres more building and garage area than constructed. Therefore, 0.03 acres are now able for site storage. The pervious area of Spirit Residential C is 0.68 acres which is graded for storage from elevation 4.5 to 5.9, consistent with the conceptual ERP assumptions of 4.5 to 6.0. Finished Floor Elevation The finished floor elevation of 6.10 ft NAVD was established per the documents that were in place at the time of the conceptual permit approval, which included the following: • Approved conceptual drainage report • FEMA Letter of Map Revision Case No.: 16-04-1347P identifies that effective on September 14, 2016, the BFE was lowered to 4 ft NAVD across the project site. • Broward County FEMA Flood Zones and 100-year Flood Elevations map (6.0 ft NAVD). Recently, Broward County has been evaluating drainage criteria and is in process of changing the flood maps. FEMA has not yet revised their preliminary flood zone map however the County's current map shows a new BFE of elevation 6.0 ft NAVD. Based on the approved conceptual permit, this project is grandfathered in at elevation 6.0 ft, however the proposed FIFE is 6.1 to be above the latest published maps. Summary The proposed development of Spirit Residential C with this application is consistent with the data used in the Conceptual ERP Drainage Report and the Phase II Construction Surface Water Management License. Furthermore, the information provided on the Site Plan, Drainage Plan and Paving and Grading Plans is consistent with the Conceptual ERP Drainage Report and the Phase II Construction Surface Water Management License and the information provided within this drainage statement.
