MONDAY, SEPTEMBER 13, 2021 - 7:00 P.M.

2. Moment of Silence and Pledge of Allegiance
Mayor James called for a moment of silence followed by the Pledge of Allegiance to the United
States Flag.
3. Presentations, Special Event Approvals, and First Budget Public Hearings
3.1 Presentation by Broward County Property Appraiser Marry Kiar - requested by
Commissioner Lewellen
Mr. Kiar addressed the functions of his office, the TRIM notice, where Dania Beach is right now
with property values, and the Owner Alert program to deal with title fraud.
3.2 Presentation by Bryan Caletka, Metropolitan Planning Organization, on the West
Dania Beach Boulevard project - requested by Commissioner Lewellen
Commissioner Lewellen gave a brief introduction.
Mayor James noted there would also be a community meeting held on September 27ffi featuring
Mr. Caletka.
Mr. Caletka gave a PowerPoint presentation which is attached to and incorporated into these
minutes.
Commissioner Davis noted a lot of her concerns were about displacement of residents and she
wanted to be sure there could be something put in writing. She confirmed it could be specified
in writing in the project specifications. She asked if there are any projections how this would
affect property values in the area.
Mr. Caletka said it is expected there would be an impact on property values, and it would be
considered an amenity, so property values would rise.
Mayor James questioned if staff submitted this project in 2018.
Mr. Caletka responded he did not know who specifically submitted the project.
City Manager Garcia noted it was before her time, but staff would research it.
Mayor James confirmed this bridge is an amenity and not a necessity. She questioned the
process of community meetings.
Mr. Caletka said the MPO simply ranks projects and explained the reason he suggested
community meetings beforehand. No residents need to be displaced and this requirement and
other concerns should be incorporated in the design process.
Mayor James noted a lot of the community is aging and we will probably have several residents
speak regarding this during the Citizen Comments.
City Attorney Ansbro noted this announcement is for tonight's Budget Hearing for the City of
Dania Beach, Florida for Fiscal Year 2021-2022.
City Attorney Ansbro announced:
The proposed OPERATING MUNICIPAL MILLAGE will be 5.9998 MILLS, which
reflects no change from the City's current fiscal year millage rate. This operating millage rate
represents a 3.64% increase over the rolled back rate of 5.7890 MILLS as computed in
accordance with the provisions of Section 200.065(1), Florida Statutes.
The voter -approved debt service millage rate is 0.1441 mills in accordance with the
provisions of law pursuant to Chapter 200, Florida Statutes.
The City's aggregate millage rate is 6.1439 Mills (5.9998 Mills for operating and 0.1441
Mills for debt service).
The final hearing for the Budget and ad valorem tax Millage will be held at:

3.3 RESOLUTION #2021-126 PUBLIC HEARING
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AS
REQUIRED BY THE CITY CHARTER AND SECTION 200.065, FLORIDA STATUTES, APPROVING THE
PROPOSED MILLAGE RATE NECESSARY TO BE LEVIED FOR THE FISCAL YEAR 2021-2022 FOR
OPERATING PURPOSES; ESTABLISHING THE DEBT MILLAGE APPROVED BY THE ELECTORATE;
PROVIDING FOR A PUBLIC HEARING WHEN AND WHERE OBJECTIONS MAY BE HEARD AND

Vice -Mayor Salvino motioned to adopt Resolution 92021-126; seconded by Commissioner
Lewellen. The motion carried unanimously.
3.4 RESOLUTION #2021-127 PUBLIC HEARING
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, RELATING
TO THE IMPOSITION OF FIRE RESCUE ASSESSMENTS AND PROVISION OF FIRE PROTECTION
SERVICES, FACILITIES AND PROGRAMS IN THE CITY OF DANIA BEACH, FLORIDA; CONFIRMING,
SUPPLEMENTING, AND AMENDING THE PRELIMINARY RATE RESOLUTION AND ADDING A NEW
DEFINITION; REIMPOSING FIRE RESCUE ASSESSMENTS WITH UPDATED ASSESSMENT RATES
AGAINST ASSESSED PROPERTY LOCATED WITHIN THE CITY OF DANIA BEACH FOR THE FISCAL
YEAR BEGINNING OCTOBER 1, 2021; APPROVING THE RATES OF ASSESSMENT; APPROVING THE

BUDGET WILL BE ANSWERED; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN

4. Proclamations
4.1 Suicide Prevention Month - Mayor James
Mayor James read the proclamation for Suicide Prevention Month.

Barbara Markley, Co -Chair, Gun Safety Committee, League of Women Voters of Broward,
spoke about the importance of locking up guns to prevent suicides and other crimes.
4.2 Hispanic Heritage Month - Mayor James
Mayor James read the proclamation for Hispanic Heritage Month.
Jose Armand, Artistic Producing Director, Latino Ensemble, Inc., thanked the Commission for
the honor and gave a brief history of Latino Ensemble, Inc.
5. Citizen Comments
Rev. Paul Wiggins, 321 SE 3rd Street, commented he heard what he needed to hear regarding the
W. Dania Beach Boulevard bridge being an amenity and not a necessity. We must keep the
community involved and he looks forward to the community meeting on September 27th
Gaurav Butani, 2451 Brickell Avenue, Miami, Florida, spoke about his company and submittal
for development of the Dania Beach Grill. He requested the Commission give them a chance to
make a presentation to them.
Kathleen Kauffinan, 2616 NW 25th Place, Gainesville, Florida, spoke about her firm's proposal
submitted for the Dania Beach Grill and encouraged the Commission to select a team that is
befitting of the project.
Bobbie H. Grace, 110 NW 8th Avenue, addressed her concerns about the proposed W. Dania
Beach Boulevard bridge.
Mike Lally, the Wave Project at 90 N. Bryan Road and 70 S. Bryan Road, noted he deeded land
in 2002 to the City for a bridge. However, after approvals of his project with a boardwalk and
according to the County and Kimley-Horn, a bridge is not needed so he now opposes a bridge on
W. Dania Beach Boulevard. If the neighbors do not want the bridge, he wants to support them.
Ivie Cure, 209 NW 14th Court, noted her main concern with a bridge on W. Dania Beach
Boulevard are the kids playing in the area. It would not be safe with the heavy traffic coming
through the residential neighborhood.
6. Public Safety Reports
Captain Sergio Pellecer, BSO District Fire Chief, gave an update on departmental activities,
including 2,719 inspectable buildings under their jurisdiction and the number of calls for the
month of August. He thanked the Commission and City Manager for being able to serve the City
for two years as Chief.

Monday, September 13, 2021 — 7:00 p.m.
City Attorney Ansbro read the title of Resolution #2021-139 and Resolution #2021-140 as they
are related. He noted these items were quasi-judicial hearings and swore -in those who would
speak as they came forward. He asked the Commission to disclose any communication they had
on these matters.
Corinne Lajoie, Assistant Director of Community Development, gave a presentation on the site
plan requests for Spirit Airlines headquarters and residential projects.
Mayor James said she wanted to confirm the use of the Dania Beach logo on their screening
would conform to our standards.
Commissioner Davis questioned where the Spirit logo would be placed.
Community Development Assistant Director Lajoie responded it would be on the corporate
campus.
Dennis Mele, Greenspoon Marder, representing the applicant, gave a PowerPoint presentation
which is attached to and incorporated into these minutes.
Mayor James questioned the possibility of using the City logo on the top of the building.
Attorney Mele noted they are working on this and are hoping something can be done.
Mayor James added she is excited to have Spirit Airlines in the City.
Commissioner Lewellen felt perhaps our logo could be placed on one of the other buildings if
not on the roof with the Spirit Airlines logo.

9.3 RESOLUTION #2021-140

10. Discussion and Possible Action
10.1 Grant/donations policy - Frank DiPaolo, Director of Finance
Mayor James noted she received phone calls about applications being accepted this year and not
advertised for. There was no process for it, and she felt this year we should give only to those
we have given to in the past, which included the Chris Hixon Foundation.
Vice -Mayor Salvino questioned if we were going to table the grant/donations policy for this
year.
Mayor James said we should give to the Chris Hixon Foundation.
Vice -Mayor Salvino suggested we should perhaps come with suggestions for the next three or
four months.
Commissioner Lewellen said there is a guideline in the proposed policy that might need
discussion, perhaps in our one-on-one meetings. She is hesitant to fund anything. If we are not
going to fund anything this year and hold off until next year's budget, we should not give to
anyone.
Mayor James noted we funded the library last year and she is not opposed to giving out the same
amounts to them and to the Chris Hixon Foundation. She agreed there is a better and more
efficient manner to do this and said the Commission should proceed with having one-on-one
meetings with the City Manager and Finance Director. At the next meeting, the Finance Director
could bring only the program to approve.
Commissioner Odman asked if a motion is needed for this.
Discussion ensued.
The Commission consensus was to donate only to the library, if needed, and the Chris Hixon
Foundation, and a policy would be brought for approval after one-on-one meetings with the City
Manager and Finance Director.
Finance Director DiPaolo noted at the budget workshop, the Commission increased the
charitable amount. He confirmed he should decrease it and allocate $5,000 for the library and
$2,500 for the Chris Hixon Foundation.
The Commission agreed.

10.2 Dania Beach Grill - City Manager recommendation of the top 3 firms to make
presentations before the Commission

City Manager Garcia noted after review of proposals and proposer presentations, the evaluation
committee ranked the top three firms as follows:
1. LM Restaurants
2. PDKN Holdings, LLC
3. Caddy's Restaurant Group
She said her recommendation is for the Commission to request presentations from these top three
firms before the September 28 h meeting.
Commissioner James noted she would like to see presentations from all six proposers.
Vice -Mayor Salvino said he knew this would come up. The step forward is that we relied on the
committee; the firms that submitted on time were accepted. He noted we had a staff committee
that chose three and questioned why we did that if we wanted all six. If we make that change, it
will open a can of worms insofar as a proposer is going to come back and ask why they cannot
have their submittal in. The beach is highly occupied more by tourists than by the residents; he
realizes 10-12 people are vocal about what they want the Grill to be. He is watching the progress
that has been made and right now, we are on a timeline; everybody cannot be a winner. We
should move forward, and he asks the Commission to allow only three presentations.
Mayor James said she supports staff, but we cannot vote on something we cannot see; she wants
a very transparent process.
Commissioner Davis noted she had the opportunity to go through all six proposals; those top
three incorporated what people said they wanted. She is having trouble within the top three of
who she wants the most. She agrees with the staff and agrees the three are the best reflection of
what the LOI requested.
Commissioner Lewellen said this is a difficult situation; she tends to agree with the top three and
is looking at a variety of things, such as timelines, who is involved, and the impact on beach.
She felt at this point, there has been a lot of time for everyone to look at the proposals and we
need to narrow them down. We have a process in place, and we must trust our staff; there was a
lot of time taken on this. She is more inclined to go with the top three at this point and
understands this is important to everyone. It is difficult as we want to do the right thing with this
one; we do not want this to become a monstrosity and change the way our beach is known.
Mayor James noted we trust staff.
Commissioner Odman said we all know the importance of this; she is okay with the process and
trusts what has been gone through.
City Manager Garcia noted she would send the Commission dates for presentations at a separate
meeting.

Discussion ensued about details of a workshop.
The Commission agreed to holding a workshop from 5:30 p.m. to 8:30 p.m. on a date to be
determined, either September 201h or 21'.
11. Commission Comments
11.1 Commissioner Davis
Commissioner Davis spoke of the Lions Club commemoration of the 20th anniversary of 9/11;
the car show (Pearl Girls attended) our Dania Beach lifeguards and organizing a walk in the City.
11.2 Commissioner Lewellen
Commissioner Lewellen spoke about attending the Moonlight Car Show and the 9/11
commemoration event. She reminded everyone COVID testing is still being conducted in the
parking garage, including Sundays.
11.3 Commissioner Odman
Commissioner Odman had no comments.
11.4 Vice -Mayor Salvino
Vice -Mayor Salvino said he attended many of the same events the other Commissioners
attended. He noted a Deuces Wild Amateur MMA event would be held at the Casino on
Saturday, October 9th, and CDC guidelines would be followed.
11.5 Mayor James
Mayor James reminded everyone about the September 27th community meeting at St. Ruth
Baptist Church. She encouraged everyone to take a tour of the schools in our community; many
do not have air conditioning. She is going to start attending School Board meetings. It has
nothing to do with staff; it is about the bond money and allocation. She encouraged the
Commission to set up meetings with our Principals to see our schools.

13. Administrative Reports
13.1 City Manager
City Manager Garcia said she also wanted to emphasize the conditions of our schools; they are
not up to Dania Beach standards. There is COVID testing being conducted in the parking garage
Sunday through Thursday, 8:00 a.m. — 5:00 p.m.; this is a great service. She is very excited that
the Melaleuca wall painting is complete; we are now working on landscaping. We are working
with Public Services to make sure we send letters, whether to the airport, FDOT, the County, and
every entity that has obligations to the City that they need to step it up. We are about 40%
complete with the SE Drainage Project design and look forward to submitting it to Broward
County in the next six weeks to get shovels in the ground. We are working and moving forward
with the Ocean Park drainage project and refurbishment of the pier.
13.2 City Attorney
City Attorney Ansbro noted receipt of a letter and a map from 1000 Mermaids and questioned if
the Commission desired to have this as a discussion and possible action item. They have already
hired a lawyer, and as the Legal Department would not make the decision, he asked the
Commission if they wanted Legal to send a demand letter to 1000 Mermaids.
Commissioner Odman questioned the best way to present this information so the Commission
could make a well-informed decision.
Assistant City Attorney Boutsis recapped that 1000 Mermaids had plans to put a structure 40 feet
deep in the water near the beach for a man-made coral reef. The Navy came back and said we
could not place it anywhere in the water because they test there. Our contract says they need to
get Navy approval. 1000 Mermaids has already created the sculptures and there has been
discussion with them of how to make us whole. One option was to place the sculptures in other
locations, and they have also reached out to Hollywood to see if they want to make us whole.
She thought about 1000 Mermaids coming to the next meeting to discuss the options; otherwise,
we would look to a demand letter and possible litigation if they do not pay us back.
Commissioner Odman noted the meeting held after she had reported to the Commission; they
made it very clear the mermaids cannot be anywhere in the waters of Dania Beach according to
the Navy and County. 1000 Mermaids were good, but there is no negotiating that can be done in
the next 10 years.
Deputy City Manager Sosa-Cruz described the area the map depicts, noting it goes far out east
and not only covers our jurisdiction, but goes past it. Broward County said they would not issue
a permit and the Navy said they would not approve it. There was a strongly worded email from
the Navy stating they do not want this.

Dania Beach staff submitted this project to MPO staff on June 4,
2018, to be added to the Metropolitan Transportation Plan
(MTP).
* The most recent MTP was adopted by the MPO on December
12, 2019.
Surtax Oversight Board approved funding for DANI-001 (West
Dania Beach Bridge) on June 4, 2020.
Broward County Commission approved funding during budget
hearings in September 2020.

The Process and "Stops"
• This project has been approved to receive $480K design money
utilizing Surtax funds. The current Dania Beach Commission
must approve the Surtax funding agreement to receive
fundings. This must be done by September 30, 2022 or the
project is removed from funding.
• Place parameters in the project design when sending to bid. A)
No displacement of residents B) Utilize the current road
northern boundary as the terminal point for the northern end of
road and bridge construction. The design bid must be approved
by the Commission.
The Process and "Stops"
Before construction can begin, the Commission must approve the
Construction Surtax Funding Agreement.
Upon bid of the construction project, the Commission must approve
the $3,520,000 construction contract with the vendor.
• When you were approved for design money, you were also awarded
construction dollars. The construction dollars are just a matter of
when. This year's recommendation was for 2026 construction
dollars to MAP Administration. The recommendation must be
approved by the O.B. and County Commission.

• The current
roadway is
estimated to be
around 20 ft. wide,
which
is too
small
to
be
considered
two
lanes.
• The 1 St Street bridge is estimated to be 38 feet wide.
• Dania Beach has the ROW south of the existing road.
If the existing northern boundary is the beginning of the new
road and bridge, there is plenty of room south of the existing
northern boundary without encroaching on existing driveways
within the City's current ROW.

into consideration the adjacent community
Recommend additional outreach:
• 1) Identify negative issues related to construction of the bridge
(Construction work times or days of the week for construction.)
2) Identify positive aspects (Maybe name the bridge after a
founder or pillar of the adjacent community.)
3) Hold two or more outreach events for each phase, to obtain
concerns and answer questions.
4) It would be helpful for the design/construction team to be
present at the outreach events.
