HomeMy WebLinkAboutR-2021-146 Trafficways Plan Amendment (TA-060-21) - Dixie HighwayRESOLUTION NO.2021-146 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING AN APPLICATION FOR AN AMENDMENT TO THE BROWARD COUNTY TRAFFICWAYS PLAN BY THE CITY, REQUESTING DELETION OF THE FORTY TWO FOOT ONE- WAY PAIR TRAFFICWAY ON SW 4 h AVENUE (DIXIE HIGHWAY) BETWEEN DANIA BEACH BOULEVARD AND SHERIDAN STREET, AND AUTHORIZING STAFF TO TRANSMIT THE APPLICATION TO THE BROWARD COUNTY PLANNING COUNCIL WITH A RECOMMENDATION OF APPROVAL; PROVIDING FOR CONFLICTS, SEVERABILITY AND AN EFFECTIVE DATE. WHEREAS, the SW 4th Avenue (a/k/a Dixie Highway) Trafficway is specified as a planned forty-two foot (42') one-way pair Trafficway on the Broward County Trafficways Plan (Trafficways Plan), extending from Sheridan Street northward along either side of the FEC Railroad corridor to Dania Beach Boulevard; and WHEREAS, the Trafficways Plan requires properties along this alignment to dedicate up to forty-two feet of privately owned land as right-of-way for purposes of future roadway development; and WHEREAS, the requirement for additional dedication of privately owned land, whether for a portion of, or the entirety of the forty-two (42) feet dedication requirement, has proven to be an obstacle to the development and redevelopment of several properties along the Trafficway alignment; and WHEREAS, there are discontinuities in the existing right of way along this corridor, including fully developed commercial and residential properties that contain land within the corridor, including properties containing several existing buildings of a substantial value, and other factors which render the envisaged future Trafficway corridor as highly unfeasible; and WHEREAS, failure to delete this Trafficway from the Trafficways Plan will cause continued difficulties for the development of properties located along its alignment, and may contribute to the further economic stagnation in an economically disadvantaged community; and WHEREAS, removal of SW 4th Avenue (Dixie Highway) from the Trafficways plan would allow the adjacent neighborhoods to proceed with infill development and vitally needed redevelopment with stability and certainty without the uncertainty of future right-of-way dedications; and WHEREAS, the City Commission finds that the proposed Trafficways Plan Amendment will be beneficial to the surrounding neighborhoods by unencumbering a large amount of private property that is unnecessary for future transportation needs and protecting long established residential neighborhoods; and WHEREAS, the City Planning and Zoning Board, sitting as the Local Planning Agency, held a duly advertised public hearing on September 22, 2021 and determined that the proposed Trafficways Plan Amendment is consistent with the goals and objectives of the City of Dania Beach Comprehensive Plan (the "Comprehensive Plan"), and therefore, recommended approval of the proposed amendment; and WHEREAS, City of Dania Beach professional planning and transportation staff recommend approval of the proposed Trafficways Plan Amendment application; and WHEREAS, the City Commission finds that the proposed Trafficways Plan Amendment is consistent with the City's Comprehensive Plan; and WHEREAS, the City Commission wishes to approve the Trafficways Plan Amendment application, and recommends that the Broward County Planning Council approve the Amendment; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct and they are made a specific part of this Resolution. Section 2. That the City Commission of the City of Dania Beach authorizes City staff to submit Trafficways Plan Amendment TA-060-21 (attached to this Resolution as Exhibit "A"), to the Broward County Planning Council, with a request that the SW 4th Avenue (Dixie Highway) corridor, from Sheridan Street to Dania Beach Boulevard, within the City of Dania Beach, be deleted from the Broward County Trafficways Plan. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 4. Attached please find City of Dania Beach Resolution 2021- approving an application for an amendment to the Broward County Trafficways Plan, for the deletion of the forty-two (42) foot one-way pair SW 4th Ave (Dixie Highway) Trafficway between Dania Beach Boulevard and Sheridan Street, and directing a copy of this Resolution to the Broward County Planning Council with a recommendation of approval, prior to the council's consideration of the amendment. The Planning Council requests a condensed version suitable for inclusion in the Planning Council staff report. EXISTING ADJACENT LAND USES: Single-family Residential Dwellings, Duplexes, Multifamily Resdential, Commercial, Industrial, Cemetery. Eastern side almost completely Single-family Residential. FUTURE LAND USE: The BrowardNext 2017 Broward County Land Use Plan designates the entire subject corridor as within Activity Center. The City of Dania Beach Future Land Use Map of the Comprehensive Plan designates the entire corridor as within the Regional Activity Center designation. 3D. EXISTING FACILITY: Eastern (northbound) side: Two way roadway with 2 travel lanes within variable 40 to 50 ft. ROW. Blocked south of Dixie Highway Extension; continuous north of Dixie Highway extension. Western (southbound) side: North of Dixie Highway: 32.5% is currently existing right-of-way, lying in two separate discontinuous sections labeled SW 4th Court; 66.5% of the corridor is privately developed property containing existing buildings and associated development. South of Dixie Highway: Two way roadway with 4 travel lanes within 50 ft. ROW. 3E. EXISTING FUNCTIONAL CLASSIFICATION: City Collector between Stirling Road and Dixie Highway Extension; County Collector between Dixie Highway Extension and Sheridan Street. 3F. At this time, considering the development history of the past thirty years, acquiring additional rights - of -way along the subject corridor as per the current Trafficways Plan requirements through the redevelopment of adjacent parcels is highly unlikely. This is an older, established neighborhood built out with a variety of existing residential and commercial land uses. The dedication requirement is proving to be a hindrance to redevelopment, and the likelihood of enough redevelopment occurring that would dedicate the required additional right of way for the proposed southbound corridor to be continuous is very low. 3H: Failure to adopt the amendment will impact the properties adjacent to the subject corridor by requiring the dedication of up to 42 linear feet of property, in some cases rendering properties undevelopable or inaccessible. 3G. There should be no impact on transit, bicycle, or pedestrian travel along the subject Trafficways segment or on the surrounding regional roadway network should the amendment be approved. Existing traffic volumes along the subject segment are generally low, and existing facilities will remain as they are currently operating. A traffic analysis should verify little to no impact. H. Provide the current average daily traffic volumes, roadway capacity, and level of service for the Trafficways segment proposed for amendment and the affected surrounding regional roadway network. According to FDOT Florida Traffic Online (https://tdaappsprod.dot.state.fl.us/fto/), the average daily traffic volume for the segment of the subject Trafficway from Sheridan Street to Dixie Highway Extension is 2.654 trips Der day.
