AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA,
APPROVING THE REQUEST MADE BY BONNIE L. MISKEL OF RUDEN,
MCCLOSKY, SMITH, SCHUSTER & RUSSELL, P.A. ON BEHALF OF JOHN
E. SABTY, MANAGER OF WSSA FLORIDA, LLC., FOR THE "WSSA
FLORIDA, LLC" PLAT, SUCH PROPERTY BEING GENERALLY LOCATED
ON THE EAST SIDE OF NE 71H AVENUE BETWEEN TAYLOR ROAD AND
ELLER DRIVE, IN THE CITY OF DANIA BEACH AND LEGALLY
DESCRIBED IN EXHIBIT "A", A COPY OF WHICH IS ATTACHED TO THIS
ORDINANCE; ACCEPTING THE DEDICATION FOR PUBLIC USE OF ALL
STREETS, HIGHWAYS AND ALLEYS AS SHOWN ON SUCH PLAT OF
THE "WSSA FLORIDA, LLC" PLAT; PROVIDING FOR SEVERABILITY;
PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA
BEACH,FLORIDA:
Section 1. That the plat of "WSSA Florida, LLC" (PL-35-06), such property being
generally located on the east side of NE 7th Avenue between Taylor Road and Eller Drive, in the
City of Dania Beach and legally described in Exhibit "A", a copy of which is attached to this
Ordinance, is accepted and approved. The City of Dania Beach consents and agrees that such
plat may be recorded in the Public Records of Broward County, Florida, upon further approval of
all agencies of Broward County, Florida, having jurisdiction in the matter.
Section 2. That the dedication for public use of all streets, highways and alleys, as
shown on the "WSSA Florida, LLC."plat, is accepted by the City of Dania Beach, Florida.
Section 3. That if any section, clause, sentence or phrase of this Ordinance is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not
affect the validity of the remaining portions of this Ordinance.
Section 4. That all ordinances or parts of ordinances and all resolutions or parts of
resolutions in conflict with the provisions of this Ordinance are repealed.
• Section 5. That this Ordinance shall take effect immediately at the time of its passage
and adoption.

SUBJECT: PL-35-06: The .applicant, Bonnie Miskel, �on behalf of the
property owner WSSA Florida, LLC., is requesting plat approval
for a property located on the east side of NEB 7 Avenue between
Taylor Road and Eller Drive (15t READING).
PLAT
• The proposed plat contemplates the construction of United
States Border Patrol Facility on a 4.3 acre parcel.
Property Information '
ZONING: Industrial General (IG)
LAND USE DESIGNATION: Employment Center (EC)
PROPOSED USE: Border Patrol Facility
The subject property is located east of US 1 and north of the Dania Cut-Off
canal. The property is currently vacant. The applicant proposes a U.S.
Border Patrol Facility, a use not currently permitted under the current IG
Zoning.
The parcel abuts NE 7th Avenue to the west and is surrounding by industrial
zoned lands to the north, south, and east. The main building is setback
over 200 feet from NE 7th Avenue. A smaller building and gas fuel
• dispensers are located to the rear of the main building.
The main building contains 26,000 square feet and resembles a one-story
office building. The floor plan shows offices meeting/squad rooms, patrol
command unit, and interrogation and interview areas. The plan also shows
an armory (260 sq. ft.), temporary holding cells (3,300 square feet), and
processing areas (2,200 sq. ft). The smaller 4,300 sq. ft. building contains
a kennel and storage area.
The Zoning Code does not allow federal, state, or county offices or facilities.
As such, the applicant has submitted a zoning text amendment to allow U.S.
Border Patrol Facilities in IRO subject to conditions. At the same time, the
applicant has submitted a petition rezone the subject parcel from IG to IRO.
The City Commission has deferred action on the 'plat' pending the applicant
responding to requests for addition information concerning use of property,
property tax status, and enforceability of zoning code requirements relating
to operational issues (ie. size of holding areas, time limits on holding
detainees).
