HomeMy WebLinkAboutO-2006-020 Watercraft Restrictions (amending 6-12) ORDINANCE NO. 2006-020 AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA, PERTAINING TO CHAPTER 6 OF THE CITY CODE OF ORDINANCES, WHICH CHAPTER IS ENTITLED "BEACHES, PARKS AND RECREATION"; AMENDING SECTION 6-12 OF THAT CHAPTER TO CLARIFY THE PROHIBITION APPLICABLE TO THE OPERATION OF WATERCRAFT NEAR THE MUNICIPAL FISHING PIER AND, FURTHER TO PROHIBIT THE OPERATION OF WATERCRAFT WITHIN AREAS RESTRICTED TO SWIMMING BY SIGNS, BUOY MARKERS OR BOTH; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That Section 6-12 of the City Code of Ordinances is amended to read as follows: Sec. 6-12. Fishing, skin-diving, scuba diving, spearfishing, launching of boats and operating vehicles restricted. (b) It shall be unlawful to fish from boats, to fish from the beach, to fish from the surf, to swim, to scuba dive, to skin-dive or bring or allow any boat to come within an area of fif4y (50) one hundred (100) yards from the outside perimeter of the municipally-owned fishing pier at Dania Beach. It shall also be unlawful to operate any type of boat, vessel or watercraft of any kind within any restricted area as designated by any signs, buoy markers or both, located within a one-hundred (100) yard distance off-shore as measured at low tide in all beach areas located within the City. It shall also be unlawful to fish or surf cast from any part of the public beach between the hours of 9:00 am and 6:00 pm or any day. Additionally, it shall be unlawful to fish from any boat within three-hundred (300) yards of the low water mark along the entire beach abutting the Atlantic Ocean in the City. ® O • Section 2. That all ordinances or parts of ordinances in conflict with the provisions of this Ordinance are repealed. • Section 3. That if any section, clause, sentence or phrase of this Ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this Ordinance. Section 4. That this Ordinance shall be effective immediately at adoption on second reading. PASSED on first reading on May 23, 2006. PASSED and ADOPTED on second reading on June 13, 2006. AgsbRb CITY ATTORNEY • 2 ORDINANCE 42006-020 NOTICE OF HEARING BEFORE CITY COMMISSION • CITY OF DANIA BEACH, FLORIDA, REGARDING ADOPTION OF THE FOLLOWING PROPOSED ORDINANCES: NOTICE IS GIVEN that on June 13, 2006, at 7:00 p.m. or as soon thereafter as the matter.may be heard, the City Commission of the City of Dania Beach, Florida, will conduct a public hearing in the Commission Chamber at Dania Beach City Hall, 100 West Dania Beach Boulevard, Dania Beach, Florida, to consider the proposed adoption of the following Ordinances: ORDINANCE NO. 2006-019 AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING SECTION 2-7 OF THE CODE OF ORDINANCES OF THE CITY OF DANIA BEACH, WHICH PROVIDES A PER DIEM RATE OF TRAVELING EXPENSES FOR CITY COMMISSIONERS, THE CITY MANAGER AND THE CITY ATTORNEY; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. ORDINANCE NO. 2006-020 AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA, PERTAINING TO CHAPTER 6 OF THE CITY CODE OF ORDINANCES, WHICH CHAPTER IS ENTITLED "BEACHES, PARKS AND RECREATION"; AMENDING SECTION 6-12 • OF THAT CHAPTER TO CLARIFY THE PROHIBITION APPLICABLE TO THE OPERATION OF WATERCRAFT NEAR THE MUNICIPAL FISHING PIER AND, FURTHER TO PROHIBIT THE OPERATION OF WATERCRAFT WITHIN AREAS RESTRICTED TO SWIMMING BY SIGNS, BUOY MARKERS OR BOTH; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. Copies of the proposed Ordinances are on file in the Office of the City Clerk, City Hall, 100 West Dania Beach Boulevard, Dania Beach, Florida, and may be inspected by the public during normal business hours. Interested parties may appear at the aforesaid meeting and be heard with respect to the proposed. Any person who decides to appeal any decision made with respect to any matter considered at this hearing will need a record of the proceedings and for such purpose may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based.
