RESOLUTION NO. 2006-001 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN REQUEST SUBMITTED BY GENE BIEBER,REPRESENTING THE BROWARD COUNTY POLICE BENEVOLENT ASSOCIATION, FOR PROPERTY LOCATED AT 2650 WEST STATE ROAD 84, DANIA BEACH; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach, Florida, states that a site plan is required as a condition to the issuance of a building permit; and WHEREAS,Gene Bieber,representing the Broward County Police Benevolent Association, has applied for site plan approval for the proposed construction of a new building and associated parking, to be located at 2650 West State Road 84, Dania Beach; and WHEREAS,the Planning&Zoning Board on October 19,2005,recommended that the City Commission grant the site plan request(SP-21-04),based upon the criteria set forth in Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application(SP-21-04)for site plan approval,a copy of which is attached and made a part of this Resolution as Exhibit "A" is approved with the following staff recommendations: 1) Site plan to be revised to delete Marina Mile access through the PBA site. Staff will reconsider this recommendation at such time as applicant submits a traffic study prepared by a P.E.allowing the City Traffic Consultant to determine if additional roadway improvements to SW 26`" Terrace are required. ® 2) Tree removal permit required. 3) Before issuance of any development permits, applicant to deposit $16,000.00 into City Landscape Trust Fund (for removed trees) and post a bond for $24,250.00 to assure the replacement of any relocated/existing trees damaged/destroyed during construction. 4) Property owner and architect to submit letter agreeing to replace trees damaged during construction with trees of equal caliper inches prior to issuance of a building permit. It is further noted that the original Site Plan is maintained in the office of the Community Development Department of the City of Dania Beach. Section 2. That based upon the criteria set forth in Section 84(p)of Article 1 of Chapter 8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals shall automatically expire and become null and void unless building permits are obtained on or before 12 months from the date of this Resolution. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 4. That this Resolution shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED on January 10, 2006. SITE PLAN To allow the construction of a new building with associated parking. PROPERTY INFORMATION ZONING: Commercial (C-3) FUTURE LAND USE: Commercial STREET FRONTAGE: SW 26 Terrace & State Road 84 The applicant is proposing the construction of a free standing building to be used as a meeting hall for the Broward County Police Benevolent Association, whose main office is located immediately north of this parcel. The applicant is proposing cross access between the existing building site to the north and the subject property at 2 points. The applicant also shows a 24 foot wide driveway on the south side of the parcel. The site plan was circulated to various City departments for review. The following comments were provided: © The site plan indicates that the south driveway will also provide a second entrance/exit to the 160,000 sq. ft. Marina Mile Office/Warehouse Complex. This through-drive constitutes a revision to the Marina Mile Site Plan, potentially adding significant additional traffic to SW 26th Terrace when the project is completed. PLANNING AND ZONING BOARD RECOMMENDATION On October 19, 2005 the Planning and Zoning Board recommended approval of the request provided the applicant address each of the above comments prior to this item being scheduled for a City Commission agenda unless otherwise identified. STAFF RECOMMENDATION Approval subject to applicant addressing the following prior to issuance of a building permit: • Site plan to be revised to delete Marina Mile access through the PBA site.
