A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING
THE REQUESTS BY I. KUSHNIR INVESTMENTS FOR AN EXTENSION OF
THE PREVIOUSLY APPROVED VARIANCE VA-46-04, APPROVED ON
FEBRUARY 9, 2005, BY RESOLUTION 2005-024 (HEIGHT VARIANCE),
WHICH EXPIRES ON FEBRUARY 9, 2006; FOR AN EXTENSION OF THE
SPECIAL EXCEPTION USE SE-36-04, APPROVED ON FEBRUARY 9, 2005,
BY RESOLUTION 2005-023, WHICH EXPIRES ON FEBRUARY 9, 2006;AND
FOR AN EXTENSION OF THE SITE PLAN REQUEST SP-16-05, APPROVED
ON JUNE 28, 2005, BY RESOLUTION 2005-101, WHICH EXPIRES ON
DECEMBER 28, 2006, FOR PROPERTY GENERALLY LOCATED AT 109 SW
PARK STREET, DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS,on February 9,2005,the City Commission approved a request for a variance to
allow a 10 story/113 foot tall building where the Dania Beach zoning code permits a maximum
building height of 3 stories/40 feet in the C-3 zoning district, for property now owned by Israel
Kushnir as Director/Officer of R.M. Works, Inc., by Resolution 2005-024; and
WHEREAS, on February 9, 2005, the City Commission approved a Special Exception
request to allow a multi-family residential use within a C-3 zoning district,including the allocation
of 112 residential LAC (Local Activity Center)units for the property,by Resolution 2005-023;and
WHEREAS,on June 28,2005,pursuant to Resolution No. 2005-101,site plan approval for
the proposed construction of a 10 story, 112 residential unit condominium building/parking structure
was granted, subject to seven conditions; and
WHEREAS,Israel Kushnir,Director/Officer of R.M.Works,Inc.,is requesting an extension
of the approvals associated with the project relating to the variance request, special exception use,
and site plan until July 10, 2007;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the requests to extend the expiration date of the approvals for the variance,
. special exception use, and site plan until July 10, 2007, are approved.
Section 2. That such approvals are subject to the conditions previously approved by the City
Commission.
Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 4. That this Resolution shall be in force and take effect immediately upon its passage
and adoption.

SUBJECT: EXT-71-05: The applicant, I. Kushnir Investment, on behalf of the

extension of the following previously approved actions:
1) Variance to allow a 10 story building (3 stories140 feet
allowed) in a C-3 Zoning District (Reso. No. 2005-024).
2) Special Exception to assign 112 residential Local Activity
Center units for a property located at 109 SW Park Street
(Reso. No. 2005-023).
3) Site Plan to construction a 10 story residential building
consisting of 3 floors of parking and 7 floors of residential
. (Reso. No. 2005-101).
LOCATION: Lots 1-9, Block 21, Town of Modello Plat; vacant parcel located
directly south of City Hall.
PROPERTY INFORMATION

On February 9, 2005 the City Commission approved a Variance to allow a 10 story building
in C-3 and a Special Exception to assign 112 residential LAC units to the subject property.
The Variance will expire on February 9, 2006, the Special Exception will expire on March 1,
2006. The Site Plan was approved on June 28, 2005 and will expire on December 28, 2006,
however, without the previously approved Variance and Special Exception, the Site Plan is
not valid.
The property owner is requesting an 18 month extension from January 10, 2005 of the
Varaince, Special Exception and Site Plan. If granted the applicant would have until July 10,
2007 to obtain building permits, including payment of all permit and impact fees.
Each of the previously approved resolutions has numerous conditions attached.

THE LAW FIRM OF RUDEN,MCCLOSKY,SMITH, SCHUSTER&RUSSELL,
P.A. AND ISRAEL KUSHNIR OF I. KUSHNIR INVESTMENTS, ON BEHALF
OF PROPERTY OWNER LEONARD STOLAR TRUSTEE,FROM CHAPTER 28,
"ZONING, ARTICLE 5," SUPPLEMENTARY LOT REGULATIONS" FOR
PROPERTY LOCATED AT 109 SW PARK STREET, DANIA BEACH;

WHEREAS, the Dania Beach Code of Ordinances, Chapter 28, "Zoning", Article 4,
"Schedule of Lot, Yard and Bulk Regulations" prescribe the height regulations in the C-3
(Commercial)zoning district; and
WHEREAS,Bonnie Miskel,Esq.,with the law firm of Ruden,McClosky, Smith, Schuster
&Russell,P.A.and Israel Kushnir of I. Kushnir Investments have applied for a variance(VA-46-04)
to allow a 10 story/113 foot"tall building where the Dania Beach zoning code permits a maximum
building height of 3 stories/40 feet in the C-3 zoning district for property located at 109 SW Park
Street; and
WHEREAS,the Planning&Zoning Board on January 19,2005,recommended that the City
Commission grant variance request VA-46-04 based upon the criteria set forth in section 10.13 of
Article 10, of Chapter 28, "Zoning", of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE,BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application(VA-46-04), for a variance as described above(from
requirements in Chapter 28 "Zoning", Article 4, "Schedule of Lot, Yard and Bulk Regulations"), a
copy of which is attached as Exhibit "A" is approved, with the following conditions:
1. The number of LAC units assigned to this property shall be proportional to the building
height as approved by the City Commission.
2. Special Exception approval to automatically expire on March-12006Applicant may apply
. to the City Commission for an extension(Variance approval, if granted, expires within_,
ye4r of approval pursuant to City Code).
3. Applicant to prepare and record deed restriction(enforceable against subsequent owners)to
voluntarily limit use of this parcel to condominium development. Deed restriction to be
approved by the City Attorney and recorded prior to issuance of any development permits.
4. Applicant to prepare and file condominium documents disclosing(i)south runway expansion
plan and potential impacts, and (ii) development potential of adjacent property pursuant to
the CRA and Comprehensive Plan.Rental regulations(frequency and duration)shall also be
included. Condominium documents to be filed with State and submitted to the City prior to
issuance of any development permits.
5. Letter acknowledging payment of Local Activity Center School Impact Fees to Broward
County prior to issuance of a building permit.
6. Payment of$537,600 Local Park Impact Fee prior to issuance of any building,paving,water,
or sewer permits. The fee is based on 20%of the appraised value of the site as required by
Section 19-71, 19-72, and 19-73 of the City Code. Appraisal submitted to staff at the
January 19, 2005 Planning and Zoning Board meeting.
7. The applicant's attorney shall submit documentation(original)that the applicant understands
and agrees that the Special Exception, Variances, and LAC unit allocation confer no vested
rights or entitlements to any of the following: (a) Site design, building design, parking
configuration, architecture,or Fire-Rescue Department requirements; (b)Compliance with
water,sewer,paving,and drainage requirements; (c)Compliance with the regulations of any
other governmental agency.
8. The applicant has submitted detailed peak hour capacity analysis for the intersection of US-1
and Dania Beach Boulevard. The results of the analysis indicate that future signal timing
modifications at US-I and Dania Beach Boulevard are necessary to accommodate the future
demand. Therefore, based on the applicant's analysis, it is recommended that this
intersection be periodically monitored to ensure that the optimum signal timing is
implemented to accommodate the future peak hour demand (Public Services).
9. Sidewalks are required to meet ADA throughout the site,particularly at road and driveway
crossing. Please label accordingly(Public Services).
10. Prior to issuance of any development permits,applicant to enter into a Developer Agreement
with the City Commission addressing the installation of water and sewer improvements
sufficient to meet the demands of the proposed use, including adequacy of fire flow
requirements (Fire-Rescue and Public Services).

12. Staff reserves the right to require additional revisions pending submission of a complete site
plan, including but not limited to the following:
(a) Entryway signage must indicate a height restriction of 6' 8"within the garage.First
floor of the garage shall be high enough to accommodate handicapped vans and some
service vehicles,including vehicular entrances.
(b) Modify parking structure fagade architecture along Park Street and south lot line to
resemble pedestrian scale residential or retail use.
(c) Provide a photometric plan"to review possible hazards&disturbances to the public
and adjacent properties"per Chapter 8, Sec. 8-4(g). Provide foot candle levels at all
property lines; not to exceed 0.5 at south property line.
(d) Landscape plans shall show location of light fixtures, per Sec. 26-46(8).
(e) Identify dimension and location of stabilized soil on landscape plan to accommodate
fire access lane.
(f) All sidewalks (including Park Street) shall be located within public right-of-way.
(g) Prior to issuance of any development permits, applicant to provide nine (9) feet of
additional right-of-way.
(h) Prior to issuance of any development permits, applicant to provide five (5) feet of
right-of-way adjacent to SW 3rd Avenue to allow for future roadway expansion.
(i) Efficiency apartments prohibited; l bedroom apartments not to exceed 25%of total
units (remaining apartments to contain two or more bedrooms). Washer/dryer to be
provided within each unit.
(j) Prior to issuance of any development permits, applicant to submit and obtain
approval of construction plans showing roadway improvements to Park Street,S W 1 sc
Avenue, and SW 3rd Avenue.

7. The applicant's attorney shall submit documentation(original)that the applicant understands
and agrees that the Special Exception, Variances, and LAC unit allocation confer no vested
rights or entitlements to any of the following: (a) Site design, building design, parking
configuration, architecture,or Fire-Rescue Department requirements; (b) Compliance with

8. The applicant has submitted detailed peak hour capacity analysis for the intersection ofUS-1
and Dania Beach Boulevard. The results of the analysis indicate that future signal timing
modifications at US-1 and Dania Beach Boulevard are necessary to accommodate the future
demand. Therefore, based on the applicant's analysis, it is recommended that this
intersection be periodically monitored to ensure that the optimum signal timing is
implemented to accommodate the future peak hour demand (Public Services).
9. Sidewalks are required to meet ADA throughout the site,particularly at road and driveway
crossing. Please label accordingly(Public Services).
10. Prior to issuance of any development permits,applicant to enter into a Developer Agreement
with the City Commission addressing the installation of water and sewer improvements
sufficient to meet the demands of the proposed use, including adequacy of fire flow

NOW, THEREFORE,BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application (SP-16-05) for site plan approval, a copy of
which is attached and made a part of this Resolution as Exhibit "A", is approved, subject to the
following conditions:
1• Applicant.(or his attorney)sign and acknowledge agreement with these conditions,subject to
any modifications by the City Commission.
2. Applicant to prepare and record deed restriction(enforceable against subsequent owners) to
voluntarily limit use of this parcel to condominium development. Voluntary restriction shall
�. be reviewed by the CityAttorney and y recorded prior to issuance of any building,paving,
water, or sewer permits.
3• Applicant to prepare and file condominium documents disclosing the following(i)short and
long term south runway expansion plan and potential impacts, (ii)development potential of
adjacent property to the south based on the CRA Plan and Local Activity Center Land Use
Designation, and(iii)rental restrictions (condominium rental shall be limited to one tenant
per year regardless of duration or lease). Condominium document language to be approved

4. Proof of payment of the Local Activity Center School Impact Fees to Broward County must
be provided prior to submission of building permits.
5. Payment of$537,600 Local Park Impact Fee prior to issuance of any building,paving,water,
or sewer permits. The fee is based on 20% of the appraised value of the site pursuant to
Section 19-71, 19-72, and 19-73 of the City Code,

Site Plan
RM Works, Inc., in conjunction with I. Kushnir Investments(the"Petitioner"), is
submitting for review the site plan and architectural exhibits for final review and
approval. The enclosed plans are consistent with the conceptual plans presented to the
City Commission during consideration of LAC unit allocation and height variance
approvals.
The proposed condominium project is located within the Dania Beach Downtown
.Area Local Activity Center("LAC"). The property is located at 109 SW Park Street,
which comprises the northerly half of the block(Block 21 of the Town of Modelo plat)
between SW 3rd Avenue and S W Is'Avenue(the "Property"), across the street from City
Hall. The general use and zoning pattern in the area can be described as follows:

The Petitioner has obtained variance approval to allow a building consisting of
seven residential floors, above a three-story parking garage, for a total of ten (10)stoks
or 100' roufline. The proposed project is within the Dow rntown Redevelopment Area.The City's Downtown Redevelopment PIan provides for a height of 5-8 stories for
redevelopment projects to provide intensities within the downtown area that will provide
synergy between uses and enhance economic viability of downtown businesses.
The proposed 109 Park Condominium project was allocated 112 LAC units. The
City's LAC is approved for a total of 2,465 dwelling units. hhe C'ity's C-3 zon' a district allows residential uses within the Downtown Redevelopment Area as special
exception uses. Such special exception approval was granted by the City Commission.
It should be noted that the proposed architecture of the building is consistent with
the architectural guidelines for the downtown area.
In consideration of the Conditions of Approval, the following are acknowledged
by the Petitioner:
I) A deed restriction voluntarily limiting use of the property to condominium shall
be approved by the City Attorney and recorded prior to issuance of any permits.
2) Condominium documents, disclosing south runway expansion plans and
development potential of adjacent property,as well as rental regulations, shall be
submitted to the City and filed with the State prior to issuance of any permits.
3) LAC School Impact Fees shall be paid prior to issuance of a building permit.
4) Payment of Local Park Impact Fee shall be made prior to issuance of permits.
5) Special Exception, variance and LAC unit allocation confer no vested rights or
entitlements in respect of site plan approval and other permitting and regulatory
approvals.
6) Signal timing at the intersection of US-I and Dania Beach Boulevard will be
monitored during the first peak season (between November-March) after
certificate of occupancy of the condominium building to ensure optimum signal
timing to accommodate peak hour traffic demand. Monitoring activities will be
coordinated with the City Enginc;er. In the event that the monitoring period occurs
after FDOT has improved the vomc try and signal timing for the subject
intersection, no further monitoring activities will be necessary.
7) Sidewalks are r,quircd and are depicted on the site plan.
g) A developer's agreement pertaining to installation of water;and sewer
improvements shall be entered into prior to issuance of any permit.

EXPLANATION OF REQUEST
The City has adopted Resolution 2005-101, which granted site plan approval for
the proposed construction of a 10 story, 112 residential unit condominium building and
parking structure at 109 SW Park Street ("Property"). Prior to adopting this Resolution,
the City has adopted Resolutions 2005-023 and 2005-024.
Resolution 2005-023, which allocated certain local activity units for the Property,
automatically expires on March 1, 2006. Resolution 2005-024, which authorized certain
height and parking variances, expires one (1) year from approval or approximately
February 9, 2006.
Prior to adopting these three Resolutions, the City's Fire Marshall had conducted
certain tests at the Property; and determined that the water supply required to support fire
flow demand was inadequate. At that time, RM Works, Inc. ("Owner") recognized that a
water system meeting fire flow demand is a prerequisite to obtaining a Certificate of
Occupancy. While the City has continued its planning to put in place necessary
infrastructure, Owner has been advised that such a water utility may not be available until
Spring 2007.
Owner is attempting to coordinate the timing of preparation of construction drawings and
the obtaining of construction bids and financing for the Project with the installing of
necessary infrastructure. To do so, Owner is requesting an 18-month extension of which
Owner will be required to file for permit no later than August 1, 2007. In addition,
Owner will be required to submit construction drawings for review to the City no later
than August 1, 2006.
Accordingly, RM Works is seeking to enlarge the time granted by Resolutions
2005-023, 2005-024 and 2005-101 as provided herein.

NOTICE IS HEREBY GIVEN that a public hearing will be held before the City Commission on
Tuesday, January 24, 2006 at 7:00 p.m., or as soon thereafter as possible, in the Dania Beach
City Commission Chambers, Dania Beach Administrative Center, 100 West Dania Beach Blvd.,
Dania Beach, Florida 33004, for the purpose of hearing any comments which might be made to
the following request:
Request by Bonnie Miskel, Esq., representing Israel Kushnir Investments, on behalf of R. M. Works,
Inc., for property located at 109 SW Park Street, Dania beach. The request is for approval of an
extension of expiration time until July 10, 2007 to obtain building permits, for variance VA-46-04 and
special exception SE-36-04 which were approved on February 9, 2005 and site plan SP-16-05 which
was approved on June 28, 2005 as follows:
VA-46-04 — To allow a 10 story multifamily building; Article 4 District Regulations, Schedule of Lot Yard
and Bulk Regulations of the City of Dania Beach Zoning Code permits a maximum building height of 3
story/40 feet. (Approved February 9, 2005, will expire on February 9, 2006)
SE-36-04 — To assign 112 Local Activity Center (LAC) residential dwelling units on commercially zoned
(C-3) property. (Approved February 9, 2005, will expire on February 9, 2006)
• SP-16-05 — Site Plan approval for the proposed construction of a 10 story, 112 residential unit
condominium building/parking structure.
The property is legally described as — LOTS 1, 2, 3, 4, 5, 6, 7, 8, AND 9, BLOCK 21, OF THE TOWN
OF MODELO, ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK B, PAGE 49,
OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA.
Copies of the proposed request are available for viewing in the Community Development Department,
100 West Dania Beach Blvd., Dania Beach, Florida between the hours of 8:00 a.m. and 4:00 p.m.,

the public hearing and be heard with respect to the proposed petition.
