HomeMy WebLinkAboutR-2006-013 Doderer Variance RESOLUTION NO. 2006-013 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA APPROVING THE VARIANCE REQUEST SUBMITTED BY KAY LYNN DODERER, PROPERTY OWNER, FROM CHAPTER 28, "ZONING", FOR PROPERTY LOCATED AT 425 SE 7TH STREET, IN THE CITY OF DANIA BEACH; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach Code of Ordinances, Chapter 28, "Zoning", Article 4, "District Regulations" and Article 5 "Supplementary Lot Regulations" set the lot, yard and bulk regulations for the City of Dania Beach; and WHEREAS,Kay Lynn Doderer has applied for a variance(VA-68-05)to allow a shed 3 feet from the rear property line and 6 feet from the side property line (Chapter 28, Zoning, Article 4, "Schedule of Lot, Yard and Bulk Regulations" requires a ten (10) foot setback from side and rear property lines.) for property located at 425 SE 71h Street, Dania Beach; and WHEREAS,the Planning&Zoning Board on January 18,2006,recommended that the City Commission grant variance request VA-68-05,based upon the criteria set forth in section 10.13 of Article 10, of Chapter 28, "Zoning", of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application VA-68-05, for the variances described above from requirements in Chapter 28, "Zoning", Article 4, "District Regulations" and Article 5 "Supplementary Lot Regulations",of the City of Dania Beach Code of Ordinances,a copy of which application is attached and made a part of this Resolution as Exhibit"A",is approved,subject to the applicant's execution of a Hold Harmless letter. Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are • repealed to the extent of such conflict. Section 3. That this Resolution shall be in force and take effect immediately upon its passage and adoption. VARIANCE To allow a shed 3 feet from the rear property line and 6 feet from the side property line; code requires 10 feet setback from side and rear property lines. The subject property is zoned Residential Single Family (RS-6000). There is an alley at the rear of the property. On September 12, 2005 a violation was issued for construction of a shed without a permit. _ According to the survey provided by the applicant, there is one patio attached to the house. No other structures, decks or pools are locating in the rear yard which would limit the property owner's ability to relocate the shed. The Public 1 Services Director indicates a 4" sewer line is located below the shed and in the event of a sewer break, it may be necessary to remove the shed and break up { the slab to repair the line. I CITY COMMISSION PREVIOUS ACTION On January 24 the City Commission continued this item to February 14. Applicant indicates they have no objection to granting the City a hold harmless letter if the shed/slab have to be removed to access the sewer line. PLANNING AND ZONING BOARD Approval.
