A RESOLUTION OF THE, CITY OF DANIA BEACH, APPROVING THE
VARIANCE REQUEST SUBMITTED BY MICHAEL A. THOMPSON,
PERTAINING TO THE ZONING APPENDIX TO THE CITY CODE OF
ORDINANCES, SECTION 33-40 (12)(A), "REGULATION AND USE OF
WATERWAYS AND FACILITIES", FOR PROPERTY LOCATED AT 2789 SW
46TH STREET, DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS,the Zoning Appendix to the City of Dania Beach Code of Ordinances, Section
33-40(12)(a)"Regulation and use of Waterways and Facilities related thereto',regulates the use and
construction of facilities on or adjacent to waterways in the City of Dania Beach; and
WHEREAS, Michael A. Thompson has applied for a variance (VA-61-05)to allow for the
construction of a dock 16 feet beyond the rear property line, and a boat lift 24 feet beyond the rear
property line where a maximum of a 5 foot extension beyond the property line is allowed for docks
and boat lifts; the property is located at 2789 SW 46th Street, Dania Beach; and
WHEREAS,the Planning&Zoning Board on January 18,2006,recommended that the City
Commission grant variance request VA-61-05; based upon the criteria set forth in section 10.13 of
Article 10, of Chapter 28, Zoning, of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application VA-61-05, for a variance as described above (from
requirements in the Zoning Appendix of the City of Dania Beach Code of Ordinances,Section 33-40
"Regulation and use of Waterways and Facilities related thereto'), a copy of which is attached as
Exhibit "A" is approved.
Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 3. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.

To whom it may concern:
This is my appeal letter written to the city of Dania in reference to the boat dock&lift
that has been designed by Morrison builders a state licensed GC to replace the old
existing dock. I Mike Thompson have discussed with my neighbors Bill Masters&Joe
White my intent to replace my existing dock&also have shown them the drawing that
Morrison builders has designed for me. They have both agreed that this dock&lift will
not affect ether one of their properties. In fact it will make it easier for all of our boats to
maneuver around at the end of our canal. Please reconsider my permit as we appeal the
city.

SUBJECT: VA-61-05 — Request by property owner Michael A. Thompson for a
setback variance for a dock and boat lift for the property located
at 2789 SW 46 Street.
VARIANCE
To allow a dock 16 feet from the rear property line and a boat lift 24 feet from
the property line; code permits a maximum 5 foot extension beyond property
lines for docks and boat lifts.
The subject property is zoned Broward County Residential Single Family (R1-C).
The property is located at the end of a dead-end canal and has an unusual side and
rear property line. Only the northwest corner of the property touches the canal.
Please see attached sketch for more detail.
The applicant has not provided a justification statement addressing the 6 variance
criteria identified in the City's Zoning Code as staff requested.
PLANNING AND ZONING BOARD
On January 18, 2006 the Planning and Zoning Board recommended approval of the
requested variance.
STAFF RECOMMENDATION
The applicant shall prove his hardship to the City Commission.
