BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section' 1. That the appropriate City officials are authorized to execute aquatic management agreements with Allstate Resource Management, Inc., for the provision of aquatic management services for certain lakes located within the city without competitive bidding or advertisement for bid. Copies of the Agreements are attached, identified as composite Exhibit "A", and incorporated by this reference. Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 3. Ansbro, City Attorney DATE: February 3, 2006 RE: Updated Aquatic Management (Lakes' Maintenance) Agreements Between the City and Aquatic Management Services, Inc. For a substantial period of time (in excess of 10 years) Aquatic Management Services, Inc. (and it predecessor company) has been maintaining a number of lakes which maintenance aids the City in its stormwater management program. For the first time in 10 years, the company has proposed modest increases to its monthly fees due to the increased costs of fuel. A number of the lakes are maintained as a result of annexation commitments made by the City some years ago to the residents of the Estates of Fort Lauderdale and Playland Isles. As an example of one of the proposed increases, maintenance of "Lake George" in Playland Isles has been proposed to increase from $425.00 to $437.00 monthly. It is my understanding from the Public Service Department that the various affected residents are satisfied with the services which do require a certain degree of care needed to avoid upsetting each lake's own ecological balance. Additionally, Public Services has reported that the services are consistently satisfactory. While this work is something that can be competitively bid, that is a decision the City Commission can require. In light of the modest increases and long-standing track record, this is being presented to the City Commission for its decision. If approved, approval would be by a Resolution. We enclose a copy of the resolution and two original agreements that have been executed by the City of Dania Beach. These agreements now require final execution by your company. ZA4� B A TON MAYOR — CCU MISSIONER ATTEST: CHARLENE JOHNS'ON CITY CLERK 1 RESOLUTION NO. 2003-282 SECOND AMENDMENT TO AQUATIC MANAGEMENT AGREEMENT This is a Second Amendment to the Aquatic Management Agreement existing between Allstate Resource Management, Inc. ("ARMI"), a Florida corporation and the City of Dania Beach ("Customer"). It is entered into and becomes effective on 2003 ("Second Amendment"), and it is a second amendment to the Agreement existing between ARMI and Customer, which Agreement is dated January 1, 2002 (the "Agreement"). The Customer and ARMI wish to amend the Agreement, to provide that in addition to its current services (aquatic management services for five (5) lakes designated by City in the Agreement) and as designated in the First Amendment to the Agreement (aquatic management services for two lakes for the Estates of Ft. Lauderdale and eight lakes for The Estates of Ft. Lauderdale Golf Course), such services are also desired by the City for Lake George, located in Playland Isles, a residential community located in the City. In consideration of the mutual covenants, terms and conditions contained in this Second Amendment and other good and valuable consideration, the adequacy and receipt of which are acknowledged, the parties agree as follows: 1. Paragraph 1 of the Agreement, as first amended, is deleted and in its place it shall read as follows: • 1. ARMI will provide aquatic management services on behalf of the Customer in accordance with the terms and conditions of this Agreement at the following aquatic sites(s): Five (5) lakes (6,745 total linear foot perimeter, located in the City of Dania Beach, Broward County, Florida) and Two (2) lakes owned by the Estates of Ft. Lauderdale and eight (8) lakes owned by the Estates of Ft. Lauderdale for use with the Estates' Golf Course (10,335 total linear foot perimeter for the two (2) lakes and 7,865 linear foot perimeter for the eight (8) lakes associated with the Golf Course) located in the City of Dania Beach, Broward County, Florida, and Lake George, located in the residential community known as "Playland Isles", which lake consists of a 3,300 total linear foot perimeter, also located in the City of Dania Beach, Broward County, Florida. Paragraph 2 of the Agreement is amended to add the following services' costs provisions: • Customer agrees to pay ARMI the following amount(s) during the term of this agreement for these specific waterway management services: Algae And Aquatic Plant Control—The Estates' Lakes $400.00/monthly Algae And Aquatic Plant Control —The Estates Golf $385.00/every other month Course Lakes Algae And Aquatic Plant Control—Lake George $425.00/monthly 12 treatments per year minimum — The Estates' lakes. 6 treatments per year - The Estates' Golf Course lakes. 24 treatments per year minimum,— Lake George. Additional necessary visits to all lakes at no extra cost. 4. All other terms and conditions of the Agreement and the First Amendment, except as amended by this Second Amendment, shall remain in full force and effect. 5.
