A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA RELATING TO MEMBERSHIP OF FUTURE ELECTED
OFFICIALS IN THE FLORIDA RETIREMENT SYSTEM; PROVIDING FOR
CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Dania Beach, Florida ("City"), in lawful session and in regular
order of business properly presented, finds that one of the policies and purposes of the City is to
extend to the future elected officials of the City, if not excluded by law, the benefits of the
Florida Retirement System, on the basis of applicable state laws and amendments to them, and
applicable rules and regulations, and the City Commission is willing to authorize the Mayor to
execute agreements with the Florida Department of Management Services for coverage of the
future elected officials; further, City staff is to be authorized to provide for withholding from
salaries and wages of future elected officials of the City so covered to be made and paid over as
provided by applicable state laws or regulations; further, to provide that the City shall appropriate
and pay over employer's contributions and assessments as provided by applicable state laws and
regulations; further, the City shall keep records and make reports as required by applicable state
laws and regulations:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That it is declared to be the policy and purpose of the City of Dania Beach,
Florida that all of its future elected officials who are initially elected on or after the effective date
of participation in the Florida Retirement System, except those excluded by local law, shall
participate in the Florida Retirement System as authorized by Chapter 121, Florida Statutes.
All future newly elected officials shall be compulsory members of the Florida Retirement
System as of the effective date of participation in the Florida Retirement System so stated in this
Resolution.
Section 2. That the Mayor is authorized to execute all necessary agreements and
related amendments with the Administrator of the Florida Retirement System for the purpose of
extending the benefits provided by the Florida Retirement System to the future elected officials
of the City as provided by Sections 1 and 2 of this Resolution, which agreement shall provide for
• such methods of administration of the plan by the City as are found by the Administrator of the
Florida Retirement System to be necessary and proper, and shall be effective with respect to any
employment covered by such agreement for services performed on and after March 1, 2006.
Section 3. That withholding from salaries, wages, or other compensation of future
elected officials for the purposes provided in Section 1 above is authorized to be made, and shall
be made, in the amounts and at such times as may be required by applicable state laws and
regulations, and shall be paid over to the Administrator designated by law or regulations to
receive such amounts.
Section 4. That there shall be appropriated from available funds, derived from the
General Fund, such amounts and at such times as may be required to pay promptly the
contributions and assessments required of the City, as employer, by applicable state laws and
regulations, which shall be paid over to the lawfully designated Administrator of the Florida
Retirement System at the times and in the manner provided by law and regulation.
Section 5. That the City shall keep such records and make such reports as may be
required by applicable state laws and regulations, and shall adhere to all laws and regulations
relating to the Florida Retirement System.
Section 6. That the City adopts the terms, conditions, requirements, reservations,
benefits, privileges, and other related conditions of the Florida Retirement System for and on
behalf of all future elected officials to be covered under the agreement.
Section 7. That the Mayor of the City is designated the custodian of all sums
withheld from the compensation of future elected officials as authorized in this Resolution and of
the appropriated funds for the employer's contributions as provided in this Resolution. Also, the
City Finance Director is designated the custodian of all withholding and designated as the
reporting agent and charged with the duty of maintaining records for the purpose of this
Resolution.
Section_.8. That all resolutions or parts of resolutions in conflict with this Resolution
are repealed to the extent of such conflict.
Section 9. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.
