WHEREAS, Chapter 28, "Zoning", Article 4, "Schedule of Use Regulations", allows "Essential Services" as a Special Exception Use in an RS-6000 zoning district; and WHEREAS; the City of Dania Beach is requesting a special exception to allow the construction of Fire Station No. 93 and a Broward Sheriff's Office Substation in an RS-6000(Single Family Residential)zoning district,to be located generally at the southwest corner of SW 45th Street and SW 30th Avenue in Dania Beach; and WHEREAS, the Planning & Zoning Board on May 18, 2005, recommended that the City Commission grant the Special Exception request, based upon the criteria set forth in Chapter 28, "Zoning",Article 6,"Supplementary Use Regulations", Section 6.40,"Special Exception Uses",of the Code of Ordinances of the City of Dania Beach. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application SE-22-05,for a Special Exception Use(Fire Station Number 93 and a Broward Sheriff's office substation)for property located generally at the southwest corner of SW 45th Street and SW 30th Avenue,Dania Beach,a copy of which is attached and made a part of this Resolution as Exhibit"A", is approved. Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 3. Fire Station/OSO substation located at the southwest corner of SW 45 Street and SW 30 Avenue. APPLICANT: City Commission REZONING: • Zoning change from Broward County R1-C (Single Family Residential) to Dania Beach RS-6000 (Single Family Residential). SPECIAL EXCEPTION: To allow Essential Services (Fire station and BSO substation). VARIANCE: Variance to waive fence requirement along north and west property line. SITE PLAN: To allow the construction of a Fire Stations/BSO substation. Prior to 2000, the City Commission purchased the subject property and amended the Comprehensive Plan to "Community Facility" to construct a fire station. A bond referendum to pay for the fire station was approved by Dania Beach voters on June 14, 2005. 1 NEIGHBORHOOD RECOMMENDATIONS • The subject property is located on SW 30 Avenue, the only north/south road across the Dania Cut-Off Canal between Ravenswood Road and State Road 7. On January 5, 2005 a neighborhood meeting was held to provide the public an opportunity to see the plans and provide comments. Courtesy Notices were sent out to property owners within 300 feet of the site. Approximately 8 - 10 homeowners attended the meeting and requested the following site plan changes. 1) Parking spaces shown along the west lot line were relocated to the center of the site. 2) Required fencing along the west lot line has being removed (variance required). A fence exists along the north lot line. 3) The proposed hedge along the west lot line is being moved 24 feet east adjacent to the relocated parking area. Also, the home directly north of the station will be provided a perpetual easement for existing driveway and garden located directly west of her home on city property. Staff has requested the city attorney oregare the easement and resolution granting same. REZONING Changing the zoning of the property from Broward County Single Family Residential (R1-C) to Dania Beach Single Family Residential (RS-6000) is necessary to allow a fire station and BSO substation as an "essential service" pursuant to the Dania Beach Zoning Code. SPECIAL EXCEPTION In the Dania Beach Single Family Residential (RS-6000) zoning district, essential services, such as a fire station and BSO substation, are allowed by a Special Exception. VARIANCE Adjoining neighbors have requested a variance to waive fence requirements along the west and north lot lines. The Code requires a wall or fence with adjacent landscaping along the lot line. Based on the neighbors' request, landscaping would be located 25 feet inside the fire station site. 2 SITE PLAN Two driveways are proposed on SW 30th Avenue. Fire-Rescue vehicles will enter and exit the site through the north entrance. Back-up space has been provided on site. Fire-Rescue workers and BSO detectives will enter and exit the site through the south entrance. There will be no access from SW 45th Street. The City's Zoning Code does not specify parking space requirements for a fire station. Based on the parking provided for the main fire station/fire administrative offices, there should be sufficient parking at Fire Station 93. Fire Station One, including administrative offices, currently provides one parking space/500 gross sq. ft. of building area. Fire Station 93 will provide slightly more parking, at one space/440 gross sq. ft. building area. ARCHITECTURE The appearance of the building is based on Fire-Rescue recommendations in consultation with the building architect. VEGETATION The site plan has been designed to preserve as many trees as possible, either by preservation or relocation elsewhere on the site. Due to Hurricane Wilma and poor natural drainage, resulting in root rot, the canopy is smaller than when the property was first purchased in 1999. The objective is still to preserve or relocate . on-site specimen oaks whenever possible. In those instances where relocation is not feasible, trees that have to be removed will be replaced with new 14 foot tall, 6 foot spread trees at a minimum 1:1 ratio. New vegetation on the site includes approximately 50 shade tree (10' - 12' starting height), 29 sable palms, 70 areca palms, plus additional ground cover/shrubbery. While best efforts will be used, statistically not all relocated trees survive. Some older trees relocated trees may not survive due to pre-existing health conditions. These trees will be replaced with new, albeit smaller, vegetation. is CITY COMMISSION PREVIOUS ACTION On February 14, 2006 the City Commission approved the rezoning request, on first reading.
