RESOLUTION NO. 2006-042 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA APPROVING THE VARIANCE REQUEST SUBMITTED BY PROPERTY OWNER DAVID J. WALLACE, FROM CHAPTER 28, "ZONING", ARTICLE 4, "DISTRICT REGULATIONS","SCHEDULE OF LOT,YARD AND BULK REGULATIONS" AND CHAPTER 28, "ZONING", ARTICLE 5, "SUPPLEMENTARY LOT REGULATIONS", FOR PROPERTY LOCATED AT 317 NE 2 COURT IN THE CITY OF DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach Code of Ordinances, Chapter 28, "Zoning", Article 4, "District Regulations", sets the lot, yard and bulk regulations for the City of Dania Beach; and WHEREAS, the Dania Beach Code of Ordinances, Chapter 28, "Zoning", Article 5, "Supplementary Lot Regulations", sets the requirements for air conditioning units, heating units, pool pumps, and related equipment in the City of Dania Beach; and WHEREAS,John Bartley,representing property owner David J. Wallace,has applied for a variance (VA-02-06) to allow for the construction of a single family home at 317 NE 2 Ct., as follows: 1) Construction on a lot which contains an area of 7,630 square feet (Chapter 28, "Zoning", Article 4, "Schedule of Lot, Yard and Bulk Regulations", requires a minimum lot size of 8,000 square feet in an RS-8000 zoning district). 2) 38% lot coverage is proposed, which is 3% more than the maximum coverage allowed (Chapter 28,"Zoning",Article 4,"Schedule of Lot,Yard and Bulk Regulations",specifies that a maximum of 35% lot coverage is allowed). 3) A five (5) foot variance from the required lot width is sought; applicant is proposing construction on a lot with 70' of width and 109' of lot depth (Chapter 28, "Zoning", Article 4,"Schedule of Lot,Yard and Bulk Regulations"requires that the width of a lot be 75' or greater in the RS-8000 zoning district). 4) An air conditioning compressor and pool pump is proposed to be installed with a three(3) foot side yard setback(Chapter 28,"Zoning",Article 5,"Supplementary Lot Regulations", Section 5.31(c)provides that air conditioning units,heating units,pool pumps,and related equipment shall not be located in a front yard or within a required seven(7)foot side yard. Such devices and related equipment may be located in a rear yard provided a minimum five-foot setback is provided to any property line.) • WHEREAS, the Planning & Zoning Board on February 15, 2006, recommended that the City Commission grant variance request VA-02-06,based upon the criteria set forth in section 10.13 of Article 10, of Chapter 28, "Zoning", of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application VA-02-06, for a variance as described above from requirements in Chapter 28,"Zoning",Article 4,"District Regulations","Schedule of Lot,Yard and Bulk Regulations" and Chapter 28, "Zoning", Article 5, "Supplementary Lot Regulations", of,the City of Dania Beach Code of Ordinances,a copy of which application is attached and made a part of this Resolution as Exhibit "A", is approved. Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 3. PROPERTY INFORMATION ZONING: Single Family Residential (RS-8000) LAND USE DESIGNATION: Low Residential (5 units per acre) The subject property is located in the Poinciana Park neighborhood. The property owner plans to demolish an existing 1-story house to construct a new 2-story single family home on the property. The dock at the rear of the property will remain. VARIANCE 1) To allow the construction of a single family house on a lot which contains an area of 7,630 square feet; code requires a minimum lot size of 8,000 square feet. The parcel consists of portions of two adjoining lots totaling less than the minimum required 8,000 square feet. The applicant wishes to replace the existing one story home with a two story home. 2) To allow 38% building lot coverage; code allows no more than 35% building lot coverage. The applicant is proposing more building coverage (land area covered by the building) than allowed by the City's Zoning Code. The existing house is approximately 2,069 square feet; the proposed house is 2,905 square feet. Applicant meets the 40% pervious area requirement. 3) To allow the construction of a single family house on a lot 70 feet wide; code requires a minimum lot width of 75'. The parcel consists of portions of two adjoining lots totaling less than the required minimum 80 feet lot width. 4) To allow 7 foot side yard setback from mechanical equipment; code requires a 10 foot side yard setback. In an RS-8000 zoning district, mechanical equipment shall be set back 10 feet from the adjacent side lot line. Applicant proposes a 7 foot setback. The 7 foot setback . is consistent with the mechanical equipment setback in the RS-6000 zoning district, the most common single family zoning district in the City. PLANNING AND ZONING BOARD RECOMMENDATION On February 14, 2006 the Planning and Zoning Board recommended approve of the requested variances.
