A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA APPROVING
THE VARIANCE REQUEST SUBMITTED BY RAYMOND SMITH,
PRESIDENT, E & S CONSTRUCTION, INC., PROPERTY OWNER, FROM
CHAPTER 28, "ZONING", ARTICLE 4, "DISTRICT REGULATIONS",
"SCHEDULE OF LOT,YARD AND BULK REGULATIONS",FOR PROPERTY
GENERALLY LOCATED SOUTH OF NW 1ST STREET AND EAST OF NW 13Tx
AVENUE, IN THE CITY OF DANIA BEACH; PROVIDING FOR CONFLICTS;
FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Dania Beach Code of Ordinances, Chapter 28, "Zoning", Article 4,
"District Regulations", sets the lot, yard and bulk regulations for the City of Dania Beach; and
WHEREAS, Raymond Smith, President, E & S Construction, Inc., property owner, has
applied for a variance(VA-08-06)to allow for the construction of a single family home located south
of NW 1st Street and east of NW 131h Avenue, Dania Beach, as follows:
1) To allow a 14 foot front setback(Chapter 28,"Zoning",Article 4, "Schedule of Lot,
Yard and Bulk Regulations" requires a 25 foot front setback).
2) To allow a 12 foot side yard setback for a combined side setback of both side yards of
24 feet; Code requires each side yard setback to be 15 feet (Chapter 28, "Zoning",
Article 4, "Schedule of Lot, Yard and Bulk Regulations" requires a 15 foot side
setback).
WHEREAS, the Planning & Zoning Board on February 15, 2006, recommended that the
City Commission grant variance request VA-08-06,based upon the criteria set forth in section 10.13
of Article 10, of Chapter 28, "Zoning", of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application VA-08-06, for a variance as described above from
requirements in Chapter 28,"Zoning",Article 4,"District Regulations","Schedule of Lot,Yard and
Bulk Regulations", of the City of Dania Beach Code of Ordinances, a copy of which application is
attached and made a part of this Resolution as Exhibit "A", is approved.
Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 3. That this Resolution shall be in force and take effect immediately upon its passage
and adoption.

SUBJECT: VA-08-06: The property owner E & S Construction, Inc.,
is requesting variances for the proposed construction of
a single family home at property located north of Dania
Beach Boulevard, south of NW 1 Street and east of NVV
13 Avenue.
VARIANCE
1. To allow a 14 foot 4 inch front setback; code requires 25 feet.
• 2. To allow a 12 foot side setback for a combined side setback of 24
feet; code requires 15 foot side setback and 30 foot combined.
PROPERTY INFORMATION
ZONING: Residential (RD-8000)
LAND USE DESIGNATION: Low Medium Residential (10 units
per acre)
The subject property is located in the North West neighborhood just north of
Dania Beach Boulevard. The property owner plans to construct a new 2-story
single family home on the property.
VARIANCE
1. To allow a 14 foot 4 inch front setback; code requires 25 feet.
The property has 100 feet of street frontage on NW 13 Avenue and is only 75.02
feet deep. Because the lot is long and shallow, the applicant is proposing a front
setback of 14 feet 4 inches. The distance from the front property line to the
garage door will be 20 feet, which is deep enough to accommodate a parked car
on the drive way. In addition, the applicant is proposing a 2 car garage, which
meets the minimum internal dimension of 20' X 20'.
2. To allow a 12 foot side setback for a combined side setback of 24 feet;
code requires 15 foot side setback and 30 foot combined.
The required 15 foot side yard requirement was intended to assure sufficient
open space for new duplexes. The 15 foot side yard was not intended to apply
to single family homes, where the required side yard setback is 7 — 10 feet. The
applicant is proposing 12 feet, exceeding the minimum for a single family home.
