D. INVESTMENT REALTY,LLC,FROM CHAPTER 28,"ZONING",ARTICLE 6.21 "OFF-STREET PARKING", FOR PROPERTY LOCATED AT 3010 RAVENSWOOD ROAD, IN THE CITY OF DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,the Dania Beach Code of Ordinances,Chapter 28,"Zoning",Article 6.21,"Off- Street Parking", sets the off-street parking requirements for the City of Dania Beach; and WHEREAS, K & P Mechanical Solutions, Inc., on behalf of the property owner J. D. Investment Realty, LLC, has applied for a variance (VA-06-06) to allow the following: 1. 316 square feet of office space while providing zero parking spaces;the zoning code requires 1 additional parking space(Chapter 28,"Zoning",Article 6.21,"Off-Street Parking"requires that 1 parking space be provided for each 250 square feet of office space). • 2. An additional 720 square feet of floor area (mezzanine) is to be added while providing zero parking spaces; the zoning code requires 1 additional parking space (Chapter 28, "Zoning", Article 6.21, "Off-Street Parking"requires 1 parking space for each 800 square feet of warehouse space). WHEREAS, the Planning & Zoning Board on February 15, 2006, recommended that the City Commission grant variance request VA-06-06,based upon the criteria set forth in section 10.13 of Article 10, of Chapter 28, "Zoning", of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application VA-06-06, for a variance as described above from requirements in Chapter 28,"Zoning",Article 6.21,"Off-Street Parking",of the City of Dania Beach Code of Ordinances, a copy of which application is attached and made a part of this Resolution as • Exhibit "A", is approved. Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 3. PROPERTY INFORMATION ZONING: Industrial, Office, Research, Marine (IROM) LAND USE DESIGNATION: Industrial The subject property is between Ravenswood Road to the west and the railroad tracks to the east. The current use is an existing office/warehouse condominium project. VARIANCE 3. To add 316 s.f. of office space with no additional parking (Code requires 1 additional parking space). Office use requires parking at 1:250 s.f. while warehouse requires parking at 1:800. Therefore, any increase in office use over 10% requires additional parking. In this case, 1 additional parking space is required. 1. To allow an additional 720 s.f. of floor area (mezzanine) to be added while providing zero parking spaces To add 316 s.f. of office space with no additional parking (Code requires 1 additional parking space). The originally approved site plan did not include mezzanine space. The applicants request to add 720 s.f. of mezzanine space requires 1 additional parking space. The project has recently been completed. The developer has stated that all units are now sold. Numerous visits to the site by staff has indicated that the provided parking appears to be under utilized. On one visit, no more than 3 cars were parked on site. The applicant has provided a letter of support from the condominium association. Dear Mr. Kneiss: The letter is regarding your correspondence on the above referenced property. The site plan for the subject property envisioned 10% of the total floor area for office use, 45% for storage and 45% for industrial uses. Therefore. parking was provided based on these calculations, which require 48 parking spaces, 49 are provided. Therefore, because of the additional parking provided, a total of 1,200 additional square feet of mezzanine space may be added to the project. To date, 400 square feet of mezzanine has been permitted, 800 s.f. remain available. In order to building mezzanine floor area, you must apply for a building permit, identify proposed use of mezzanine and submit a letter from the condominium association (on letter head) permitting the additional square footage, since the remaining balance is for the entire site not each bay. The alternative is to apply for a variance to allow for the construction of mezzanine space with no additional parking. To apply for a variance an application must be completed with all required submittal information and an application fee of$700.00. During or conversation John stated he wants to use shelving for storage to take advantage of the ceiling heights and would like to have a reception area with a desk and files for his secretary to conduct business larger than what the city approved. The city approved 100 Sq. Ft. and he would like to have 300 —400 Sq. Ft. He stated he would only be storing old customer files and non-combustibles like tools and mechanical parts. He further added he said he would be parking his work van inside but is not necessary. At this time, from a fire standpoint there are no fire protection concerns with this variance request. I further explained to John [(954) 818-1527] 1 spoke with Corrine from Planning & Zoning, and she communicated his issue was mainly parking requirements not met because of a mezzanine addition. This office informed the applicant we would approve the variance from the fire department standpoint (Parking Related), but this does not mean he can do everything he intended to do with the space. He was further explained we would have to look at the architectural plans, research the proposed build out, and submit any requirements not met for him to adjust. We would require knowing the type of storage, warehouse design and all related storage measurements, type of storage arrangement, etc. As of our conversation for an office and shelving storage of some type there are no life-safety or fire protection issues. Enclosed is a site plan that shows there are 20 units and 49 parking spots (4 being handicapped), so we are hoping this is deemed 2 spots per unit with 5 guest spots. The attached drawinos for the space are only preliminary as we were in discussion with the Architect on the final layout when she stopped. Her words were "the City of Dania Beach would not let you do what you want to do there." She recommended we sell the building and move to another location. I'm hoping this is not the final decision. We have been operating our business in the City of Dania Beach for over 5 years. We hold a mechanical contractor's license, unlimited electrical contractor's license and a NEBB certification for test and balance. Our work primarily is based on test and balance and controls. It is our conscience decision not to grow into a big company as we have a recurring customer base that treats us well and it is our decision to take care of those customers. We are extremely selective and do not want every potential customer that comes our way. Besides me, the only office employee is a secretary, who is there most of the time by herself. My wife comes in one day a week to do payroll, and other than me bouncing in once in a while that is all the people expected in our office at one time. Please note it is my intention to park my vehicle in the facility, as I keep expensive instrumentation in it and have previously witnessed how quickly it can be stolen within minutes! If it is deemed that we have 2 parking spots allotted to us, based on our last conversation where 1 parking spot is allowed per 250 square foot of office space and 800 square foot of storage, and 2 spots would double that, it would great, as what we want to do with the space has us slightly over one spot's requirements but under 2 spots. Whether that is true or not we intend to have our Architect show this on the plans and include them on the permit set. We want to make sure we comply with all fire codes and access. While operating our business we realized that we lose storage space quickly. We havee to keep drawings/plans, test and balance reports, business records and test instruments, so we need storage! We are currently tripping over storage boxes now. We look forward to staying in Dania as vve love the access and location.
