® RESOLUTION NO. 2006-058 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA APPROVING THE VARIANCE REQUEST SUBMITTED BY JOHN GLARENTZOS, FROM CHAPTER 28,"ZONING",ARTICLE 28,"SIGNS",FOR PROPERTY LOCATED AT 1040 SOUTH FEDERAL HIGHWAY, DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach Code of Ordinances, Chapter 28, "Zoning", Article 28, "Signs", prescribes the signage regulations for businesses within the City of Dania Beach; and WHEREAS, property owner John Glarentzos, for property located at 1040 S. Federal Highway,has applied for a variance(VA-50-05)from Chapter 28,"Zoning",Article 28,"Signs",to allow a monument sign 10 feet from the intersection of SW 11 Street and Federal Highway at its closest where a setback of 30 feet from the intersection of any two streets is required; and WHEREAS,the Planning&Zoning Board on November 16,2005,recommended denial of • the variance request, based upon the criteria set forth in Chapter 28,"Zoning",Article 28, "Signs", Section 28.200 of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application VA-50-05, from requirements in Chapter 28, "Zoning", Article 28, "Signs", of the City Code of Ordinances is approved with the condition that when the sign is moved back, the front of the sign area is landscaped and that beautification is completed within 30 days Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. • Section 3. SUBJECT: VA-50-05: The owner, John Glarentzos, is requesting a variance for a monument sign at 1040 South Federal Highway. VARIANCE To allow a monument sign 11.5 feet from the intersection of SW 11 Street and Federal Highway at its closest; code required a 30 foot setback from the intersection of two streets. PROPERTY INFORMATION ZONING: Commercial (C-2) OVERLAY DISTRICTS: Principal Arterial Commercial Design Standards; Community Redevelopment Area (CRA) STREET FRONTAGE: SW 11 Street & Federal Highway The subject property is an existing gasoline service station that previously had a pole sign. The applicant is proposing the construction of a monument sign. The dimensions of the proposed monument sign meets the provisions of the code, however the location does not. The applicant is requesting to locate the proposed monument sign 5 feet from the property line and approximately 11.5 feet from the intersection of SW 11 Street and South Federal Highway at its closest point. The Zoning Code requires a 30 foot setback from the intersection of any 2 streets to insure maximum visibility for motorists. There appears to be room available on site to locate the sign further interior to the site, thereby reducing the amount of the variance required. In addition, staff has requested a beautification plan. The applicant has provided a drawing showing the addition of approximately 455 square feet of landscaping which she has already installed on.site. i PLANNING AND ZONING BOARD RECOMMENDATION On September 29, 2005 the Planning and Zoning Board continued this item to allow the applicant to provide staff with additional information. Mayor, Vice-Mayor and commissioners : I would like to request that you pass my request for a varience for a sign set-back. Citgo removed the pole sign back in July - 2005 . I would like to replace pole-sign with a monument sign in original location. Due to the new 30 foot setback , it is impossible to follow, the site is small and has no room to push sign back. Directly to the west of sign are the underground gas tanks, therefore like to ask that the vaience be granted. We have made great improvements to the site. The building was given a face-lift, which consists of new plaster and a new paint job. We have added 142 linear feet of new landscaping, consisiting of 5 new areas. Each area has combination of . ficus hedges and either fox-tail palms or christmas palms. One of those areas is designated for seasonal flowers which is to border new monument sign . We have been working with a temporary price sign which is on wheels, this sign is considered a violation we where told, but is impossible to sell gas without your prices posted. Customers think that you are closed or out of gas. We ask for your cooperation, and feel that we have tried to add as much landscaping as possible, and correct any other distasteful appearance.
