A RESOLUTION OF THE CITY OF DANIA BEACH, APPROVING THE
VARIANCE REQUEST SUBMITTED BY PATRICK VACCARO, FROM
CHAPTER 28,"ZONING",FOR PROPERTY GENERALLY LOCATED AT 2982
SW 45TH STREET, IN THE CITY OF DANIA BEACH; PROVIDING FOR
CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS,the Dania Beach Code of Ordinances,Chapter 28, "Zoning", sets the lot,yard
and bulk regulations for the City of Dania Beach; and
WHEREAS,Patrick Vaccaro has applied for a variance(VA-72-05)to allow construction of
two single homes adjacent to each other,each home to be located on an unplatted 50 foot lot(Zoning
code requires minimum 50 foot lot width unless the property is platted). Applicant further requests
permission to extend a lot size variance(for the east lot only)to provide for an expiration date for an
additional three (3) years; (extending the variance for those years would allow applicant until the
year 2010 before he would be obligated to begin construction on the west lot). The lots are generally
located at 2982 SW 451" Street, Dania Beach; and
WHEREAS,the Planning&Zoning Board on March 15,2006,recommended that the City
Commission grant variance requests VA-72-05,based upon the criteria set forth in section 10.13 of
Article 10, of Chapter 28, "Zoning", of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application VA-72-05, for the variances described above from
requirements in Chapter 28, "Zoning", of the City of Dania Beach Code of Ordinances, a copy of
which application is attached and made a part of this Resolution as Exhibit "A", is approved.
Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 3. That this Resolution shall be in force and take effect immediately upon its passage
and adoption.

SUBJECT: VA-72-05 - Variance to allow two single homes adjacent
each other, each home to be located on an unplatted 50 foot.

permission to extend lot size variance (east lot only)
expiration date for an additional three (3) years. Extending
this variance for 3 years would allow applicant until. 2010 to
begin construction on the west lot.
Property located at 2982 SW 45th Street, Dania Beach, Florida.
PROPERTY INFORMATION
ZONING: Broward County Residential (R1-C)
LAND USE DESIGNATION: Low Residential (5 units per acre)
The subject property was annexed into the City in 1990. The minimum lot width
required in R1-C is 60 feet unless the property consists of a platted lot of record.
The applicant's property consists of a 100 foot wide unplatted lot. Applicant was
incorrectly granted a permit to build a single home on the west 50 feet of the
lot. Applicant now wishes to build a second single family home on the east 50
feet of the lot.
The City Attorney indicates a variance is required to grant a Certificate of
Occupancy for the home under construction on the west 50 foot parcel; and that
a variance is required to grant a building permit on the east 50 foot parcel.
Applicant has requested a third variance to extend approval for the east lot until
2010.
PLANNING AND ZONING BOARD RECOMMENDATION
On March 15, 2006 the Planning and Zoning Board recommended approval of all
3 variances. There were no objections at P and Z.

NOTICE IS HEREBY GIVEN that a public hearing will be held before the City Commission on Tuesday, March
28, 2006 at 7:00 p.m., or as soon thereafter as possible, in the Dania Beach City Commission Room,
Administrative Center, 100 West Dania Beach Blvd., Dania Beach, Florida 33004, for the purpose of hearing
any comments which might be made to the following request:

Property is legally described as: The west 100 feet of the east 200 feet of the north 115 feet of Tract 13, Block

Dade County, Florida, less the north 25 feet thereof,for road. (East Site) along with the west 50 feet of the
