A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO
EXECUTE AN AMENDMENT TO AN AGREEMENT EXISTING BETWEEN
THE CITY OF DANIA BEACH AND ROBERT MCDONALD AND
ASSOCIATES, P.A., DATED APRIL 20, 1999, TO REVISE
ARCHITECTURAL AND CONSULTING COSTS RELATING TO
CONSTRUCTION OF THE CITY OF DANIA BEACH PUBLIC SAFETY
FACILITY (FIRE-RESCUE STATION 93), TO REFLECT INCREASES IN
FEES AND EXPENSES; PROVIDING FOR CONFLICTS; FURTHER
PROVIDING FOR AN EFFECTIVE DATE.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA
BEACH,FLORIDA:
Section 1. That the proper City officials are authorized to execute an amendment to the
Agreement existing between the City of Dania Beach and Robert McDonald and Associates,
P.A., dated April 20, 1999; a copy of the details of the amendment is included in Exhibit A,
attached and incorporated into this Resolution by this reference.
Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 3. That this Resolution shall be in force and take effect immediately upon
passage and adoption.

AMENDMENT TO CITY-ARCHITECT SERVICES AGREEMENT
BETWEEN THE CITY OF DANIA BEACH
AND ROBERT MCDONALD AND ASSOCIATES, P.A.
THIS IS AN AMENDMENT TO THE CITY-ARCHITECT SERVICES AGREEMENT
("Amendment") made on 7!� '; , 2006 between the CITY OF DANIA BEACH
("City"), a Florida municipal corporation, and ROBERT MCDONALD AND ASSOCIATES,
P.A. ("Architect"), a professional association organized and existing under the laws of the State
of Florida.
WHEREAS, City and Architect entered into an Agreement on April 20, 1999, in
connection with plans to be developed for City Fire Station No. 93; and
WHEREAS, plans originally developed for the construction now need to be revised and
updated, due to the passage of time and changes in the scope of the project;
NOW, THEREFORE, in consideration of the mutual promises contained in this
Amendment and other good and valuable consideration, the receipt and adequacy of which are
acknowledged and agreed upon, the parties agree as follows:
I. Recitals: The foregoing recitals are true and correct and they are incorporated into
this Agreement.
2. Attached to this Amendment and incorporated by reference into it is an April 19,
2006 document entitled "Scope of Services and Professional Fees", consisting of three pages,
which is incorporated into this Amendment by this reference.
3. Except as specifically provided in this Amendment, all other terms and conditions
of the Agreement remain in full force and effect.

Original agreement did not encompass recent changes in architectural and consulting fees to both the structure and
surrounding area, the most significant being the inclusion of a BSO substation and attendant costs. Amendment to the
1999 agreement will provide for the payment of significant changes to the original scope of services.

Robert McDonald and Associates, P.A. won the architectural bid and entered into a good faith contract with the city on
April 20, 1999. City personnel attempted to move this project forward but were met with neighborhood concerns, some of
an "easy fix"nature and others requiring time consuming consideration. The city budget allowed funding for this project;
however, over the years, all related costs have increased. Additionally, a major hurricane that notably changed the
environmental conditions of the designated property, together with the inclusion of a BSO substation and attendant costs,
have significantly changed the scope of services for this project. A referendum vote, passed by the electorate, approved
a bond issue to cover this project which has facilitated the process with a targeted completion date no later than August,
2007. This amendment to the 1999 agreement covers costs associated with the foregoing which are in line with current
architectural and consulting fees. This resolution will approve the payment of updated expenditures upon the
presentation of detailed statements submitted by Mr. McDonald.

Please find transmitted copy of correspondence dated March 14, 2006 regarding the
• review of our A/E Proposal to the City of Dania Beach for the above-mentioned Project,
as well as a copy of Architectural / Engineering / Landscaping Services and
Professional Fees dated February 1, 2005/ Revised March 14, 2006.
Please know that we have reviewed the costs of A/E Services with all Consulting
Engineers and our Landscape Architect to provide the City of Dania Beach with the best
possible proposal for professional Services
As per your request to show a reduction of cost of services to the City, we have held
additional negotiations with our Consultants. We have reduced the Basic A/E Fees by
$5,150., in the interest of moving this Project forward without any further delays.
Looking at the percentage of Basic A/E Fees to construction cost, we are now at 7.2%
of the building construction cost. This represents a bottom-line for projects of this
complexity. This deduction in A/E Basic Fees is contingent on the condition that this
Project moves forward without delays, as we are continuing to work on this Project as
requested.

• Additionally, we requested that Keith and Associates re-evaluate their Scope of Work
and Fees for any task that they may be able to deduct from their services and cost. The
task that seems most appropriate is the Construction Administration Phase, of which we
have deducted $3,774.
Therefore the total deduction for Basic A/E Services and Additional Civil Engineering
Services is $8,924.
We respectfully request that this proposal be presented to the City Commission, as
soon as possible, so as not to further delay the progress of this Project.

Dear Deputy Chief Michael Cassano:
We have been requested to review our proposed, revised Agreement to evaluate cause
for the cost increase from the 1999 original Agreement. The following items have
increased the cost of the Project and Professional A/E fees:
The large ticket items that have caused the increase in the cost of this project and
scope of work are the following:
ADDITION OF THE BROWARD SHERIFF OFFICE
First and foremost is the change in program from a Two Bay Drive-Through Fire Station
to a Public Safety Facility, eliminating the drive-through capability and incorporating a
Broward Sheriffs Office (BSO) sub-station space, which is 37.5% of the total former
apparatus room. The BSO Sub-Station exists as a stand alone facility within the Public
Safety Building requiring its own power, plumbing, lighting, A/C system and floor, wall,
ceiling finishes, where as basically before this program change we had a garage type
space which housed the fire engines.
The electrical requirements for power and light will increase within floor pover and
audio system and tower for wireless communication. Electrical requirements will not
only be for normal use, but also as a requirement for emergency back-up power. The
emergency generator capacity will increase along with an increase in fuel capacity and
storage tank size.

In essence, the change in program, to add a BSO Sub-Station, not only affected the
interior design of the Fire Station, but also the exterior design such as additional
windows and doors with separate access and parking for BSO staff, requiring re-design
of the Site Plan.
FACTORS AFFECTING THE SITE AND BUILDING
o Community requirement to Increase landscape plantings to shield neighbors from
the Public Safety Facility, requiring Landscape Architectural re-design.
o A strong will of the Community required a change to the exterior design of the
building to meet new program requirements for a more residential appearance.
• Community requirement to re-design foot-candle lighting on all driveways and
buildings to minimum standards and assure zero foot-candles at all property
lines.
• Community requirement to relocate BSO parking and driveways so as not to be
near the west property line.
• Damages to site by Hurricane Wilma effecting tree removal and requiring
landscape services to provide a site grading plan and design to preserve as
many existing trees as possible.
CHANGE IN BUILDING CODE(SFBC)TO (FBC)
In 2001 The Florida Building Code, (F.B.C.), was incorporated to replace the South
Florida Building Code (SFBC). This Code was updated in 2004, and has contributed to
an increase cost of construction and Professional Architectural and Engineering
Services, because of new and expanded building requirements.
All items listed below have increased our Scope of Work and significantly extended our
workload beyond our 1999 Agreement, which was under the previous SFBC :
• Occupancy change from Fire Station to Public Safety Facility places the BSO
Sub-Station offices in a "vehicle occupancy category with combustible storage
and hazardous materials" requiring fire-rated construction to protect human
occupancy in these offices and an automated sprinkler system.
• New structural design requirements due to High Velocity Hurricane Zone
(HVHz) requires upgrades on wall, roof and all structural members.
• Higher energy efficiency requirements
• Additional structural test and standards and special inspections affect all
structural items including bearing capacity of soils for foundations and slabs on
grade.
• The HVHz requirements stipulate higher wind and dead load design of al ll glass,
glazing, windows and exterior doors.
• Concrete, Masonry and Steel all have upgrades in design due to the
requirements of HVHz.

CIVIL ENGINEERING—INCREASE IN SCOPE OF WORK
® Paving Grading and Drainage
There have been substantial increases in cost due to additional design,
permitting and platting requirements, required by Broward County Plat
Development Order, which we did not have knowledge of on December 16th,
1998, when we submitted our Scope of Services and Professional Fees to the
City of Dania Beach. These costs include the following;
1. Off-site design plans for two driveway connections onto SW 30th
Avenue, modifying the drainage structure and culvert along SW 30th
Avenue, including changes to location of access and width of those
accesses.
2. Design for the turn lane, sidewalk, bus stop, median cut for northward
access and other improvements required by the Broward County Plat
Development Order.
o Wastewater Plans
The original scope called for a sewer drain field, which has been upgraded to a
gravity sewer, to tie into the existing Broward County sewer system. In making
this change, there has been an increase in cost due to additional design, details
and specifications required for permitting through Broward County Office of
Environmental Services (BCOES).
• a Permitting
Due to the design changes to the project we are now required to permit through
additional agencies, which were not included in our original scope of work. In
addition, in recent years, the permitting application process has become more
cumbersome, therefore requiring additional hours being expended in completing
the required documentation and processing the permit applications through the
appropriate regulatory agencies.
BUILDING COST INCREASES
Building cost increases are at 2% per month or 6% per quarter compounded for this
Public Safety Facility Building. Allowing for a 12 month building program, the probable
construction cost is expected to be $2,227,015. We are on a present schedule to see
that this project is put out to bid as soon as possible.
In closing, I would like to comment that our firm has been involved, off and on for over 8
years, at no cost to the City, updating the construction cost and Professional F Ses on
this Project. We have worked continually and diligently on this Project in order that it
could be brought to a successful completion for the City of Dania Beach.

SCOPE OF ADDITIONAL CIVIL. ENGINEERING SERVICES
Task 1.0 1Vlathematized Site Plan
Consultant shall prepare a mathematized site plan from the site plan approved by the Client. Using
coordinate geometry, the site plan will be fixed to the survey with coordinates for key control points
and proposed improvements. Existing improvements to remain shown on the Topographic Survey
provided through a task herein or by the Client will also be included. Specifically included for
purposes of preparing final engineering plans are horizontal and vertical information pertaining to
water mains, valves, and fire hydrants; sanitary sewer lines and laterals; storm drainage; asphalt and
concrete pavement; sidewalks; etc. within and adjacent to the property. This document will also serve
as the basis for the onsite construction layout activities by the Contractor.
Task 2.0 Preliminary Site Civil Engineering Plans
Consultant shall prepare preliminary site civil engineering plans, including paving, grading, drainage,
sewer and water to support the proposed development improvements. Preliminary calculations shall
be performed to address the impacts of the proposed improvements in order to comply with the
submittal requirements of the City of Dania Beach.
Task 3.0 Water Distribution and Sanitary Sewer Plans
Consultant shall prepare final engineering plans for the improvements that include combined on-site
water distribution system and on-site sanitary sewer system plans. It is anticipated that the potable
water and sanitary sewer improvements will connect to the existing main on SW 45`h Street and that
adequate capacity is available for the development of the site. The standard utility details and notes
for the construction of the water distribution and gravity sewer system are included. The City of
Dania Beach shall provide water pressure and flow information on the existing potable water main
system adjacent to the site.
Task 3.1 On-Site Paving,Grading, and Drainage Plans
Consultant shall prepare final engineering plans for the improvements that include an on-site paving,
grading and drainage plan in accordance with the requirements of the regulatory agencies. The storm
water management system will address water quality treatment and water quantity storage. Typical
sections and standard paving and drainage details and notes for the construction of the paving,
grading, and drainage system are also included.

Task 3.2 Off Site Turn Lane Improvements Plans
Consultant shall prepare final engineering plans for the off-site improvements that include sidewalks,
turn lanes, possible relocation of a bus stop as required by the Plat Development Review Report dated
July 22, 2005. Consultant shall prepare final engineering plans for off-site turn lane improvements in
accordance with the regulatory agency requirements.
Task 3.3 On-Site Signing and Pavement Markings Plans
Consultant shall prepare an on-site signing and pavement markings plan in accordance with the
requirements of the regulatory agencies. This plan shall include standard details and notes.
Task 3.4 Off-Site Signing and Pavement Markings Plans
Consultant shall prepare an off-site signing and pavement markings plan in accordance with the
requirements of the regulatory agencies. This plan shall include standard details and notes.
Task 4.0 Permitting
Consultant shall prepare and submit the permit applications to facilitate the construction of the
improvements designed as defined by this Agreement and process them through the following
regulatory agencies. Application, Impact and permitting fees are not included in this Agreement.

The Services included in this Task will be invoiced on a Time and Materials basis in accordance with
our current Professional Services Fee Schedule. An estimated amount is included in the new proposal
to the amended Agreement.
Task 5.0 Preparation of Engineering Cost Estimates
Consultant shall provide professional services associated with the preparation of 90% and 100% cost
estimates which shall be submitted to the City of Dania Beach. The 125% engineering cost estimate to
facilitate plat recordation shall be submitted to Broward County for review and approval.
Task 6.0 Construction Phase Services
Consultant shall provide construction observation services in order to certify to the regulatory
agencies that the construction of the upland site facilities has been completed in substantial compliance
with the approved documents and permits. Services included in this item are described as follows:
Shop Drawings: Consultant shall review shop drawings, samples, and other data and reports, which
the selected contractor is required to submit for review. This review will only be for conformance
with the design concept of the project and compliance with the information provided on the design
drawings and specifications. Such review will not extend to methods, means, techniques, construction
sequence(s) or procedures, or to safety precautions and related programs.
Periodic Site Visits and Construction Observation: Consultant shall visit the Project at intervals
appropriate to the various stages of construction, as Consultant deems necessary, to observe as an
experienced and qualified design professional to review the progress and quality of the various aspects
of the contractor's work. Consultant shall coordinate and attend one pre-construction meeting.
Inspections and Tests: Consultant shall observe the utility testing required as part of the final
certification to the regulatory entity responsible for that utility. Others are responsible for and will
perform the actual testing. Materials testing, density tests, and other construction testing services are
not included.

Final Certification: Consultant shall review the record drawings provided by the Contractor or
obtained by other means agreed to by Consultant and Client. The preparation of record drawings is
not included. Upon satisfactory review of the record drawings, Consultant shall prepare and submit
one (1) final certification package to each of the applicable agencies. This task does not include
processing of Partial Certifications for a portion of the completed construction work in order to obtain
Certificate of Occupancies (C.O.'s) for a portion of the buildings. If the Client requires processing of
partial certifications for a portion of the Work being performed, Consultant shall process such
certifications on an additional Time and Materials Fee basis in accordance with our current
Professional Service Fee schedule.
The budget estimated may require adjustment as a result of the actual construction schedule, which is
for a six (6) month construction period for the site work. The Services included in this Task will be
invoiced on a Time and Materials basis in accordance with our current Professional Services Fee
Schedule. We have included an estimated amount in the new Proposal to the amended Agreement.
Task 7.0 Project Meetings and Coordination
Consultant shall attend meetings with the agencies having jurisdiction over the project to review the
proposed design. In addition, Consultant shall provide miscellaneous project coordination efforts
that may include, but are not limited to:
® Attend meetings with the Client, other team members, and representatives of the Broward
County and City of Dania Beach, as may be requested by the client, to facilitate approval and
completion of the work effort.
o Attend meetings with the agencies having jurisdiction over the project to review the proposed
design.
® Provide representation at public meetings as may be required.
® Assist Client and other team members with plat comments from Broward County Engineering
Division
This task will be invoiced on a time and material basis in accordance with our current Professional
Service Fee Schedule. An estimated amount is included in the new Proposal to the amended
Agreement.

Consultant shall provide assistance to Client during the bidding and award phase of the construction
contract. This assistance shall consist of attending a pre-bid meeting, issuance of addenda for
clarification as necessary, preparation of bid tabulation and assistance with the evaluation of bids. The
Services included in this Task will be invoiced on a Time and Materials basis in accordance with our
then current Professional Services Fee Schedule. An estimated amount is included in the new
Proposal to the amended Agreement.
The following services are not included in this Scope of Work:
