A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA APPROVING
THE VARIANCE REQUEST SUBMITTED BY JOSE CASTELLANOS,OWNER
OF "PANCHO'S BACKYARD" RESTAURANT, FROM CHAPTER 28,
"ZONING",ARTICLE 4.201 "PROXIMITY OF BEVERAGE ESTABLISHMENTS
TO CHURCHES AND SCHOOLS",FOR PROPERTY LOCATED AT 433 EAST
SHERIDAN STREET,IN THE PUBLIX SHOPPING CENTER,IN THE CITY OF
DANIA BEACH;PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS,the Dania Beach Code of Ordinances,Chapter 28,"Zoning",Article 4.201,sets
the distance separation for beverage establishments from churches and schools for the City of Dania
Beach; and
WHEREAS, Jose Castellanos, owner of"Pancho's Backyard" has applied for a variance
(VA-29-06) to allow alcohol sales in connection with the restaurant 575 feet from Olsen Middle
School, for his business which is proposed to be located at 433 East Sheridan Street, Dania Beach;
and
WHEREAS, the Planning & Zoning Board on May 17, 2006, recommended that the City
Commission grant variance request VA-29-06, based upon the criteria set forth in section 10.13 of
Article 10, of Chapter 28, "Zoning", of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application VA-29-06, for the variance described above from
requirements in Chapter 28, "Zoning", Article 4.201, of the City of Dania Beach Code of
Ordinances, a copy of which application is attached and made a part of this Resolution as Exhibit
"A", is approved.
Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 3. That this Resolution shall be in force and take effect immediately upon its passage
and adoption.

SUBJECT: VA-29-06: The applicant, Jose Castellanos, is
requesting a variance to waive the distance
separation for alcohol sales from a school for the
property located at 433 East Sheridan Street.
VARIANCE
To allow the sale and consumption of alcohol approximately 575
feet from a public school; code requires 1,000 feet separation.
The subject property is zoned Commercial (C-2) and is located at the
Publix shopping center at the north west corner of Sheridan Street and SE
5 Avenue.
The applicant is proposing to sell beer and wine for consumption on site.
This site was previously the location of Michael's Kitchen, which also sold
beer and wine for consumption on premises.
The subject property is approximately 575 feet from Olsen Middle school,
as measured in a straight line.
PLANNING AND ZONING BOARD RECOMMENDATION
On May 17, 2006 the Planning and Zoning Board recommended approval
of the requested variance.

RE: Variance Criteria Statement
Pancho's Back Yard, located at 433 East Sheridan Street, Dania Beach,
Florida, requests a variance to sell beer and wine to patrons for consumption
on premises. Jose Castellanos and Gus Molano, the principals of Pancho's
Holding, Inc., d/b/a Pancho's Back Yard, a Florida Corporation, have resided
in Broward County, Florida, for twenty and thirty years respectively. Both Mr.
Castellanos and Mr. Molano have been employed in the hospitality industry in
Broward County for this period and are citizens of outstanding character.
The Sheridan Square Shopping Center, located on Sheridan Street in Dania
Beach is within one thousand feet of Olsen Middle School. However, the
school property does not share a common entrance or egress with the school,
and there are no direct walking paths from the school to the shopping center.
Within the recent past, the shopping center was home to a Mediterranean-
American restaurant with a beer and wine license and a bar-and-package
store which provided alcoholic beverages for consumption on and off
premises. At present, the granting of the variance will not confer on the
applicant any special privilege that has been previously denied by Chapter
10.13 of the Dania Beach Building Code.
In today's marketplace it is inconceivable to think of a Mexican or Latin
restaurant that does not afford its patrons a choice of beer and wine. The
viability of the project is in question without the ability to satisfy the refreshment
desires of patrons. Pancho's Back Yard is designed as a family restaurant
and will not cater to bar-only patrons. In addition, there will be no enticements
to encourage underage or excessive drinking. Further more, Mr. Castellanos
and Mr. Molano fully endorse the State of Florida Department of Business
Regulation and Division of Alcoholic Beverages & Tobacco Responsible
Vendor Act. All employees will be trained to ensure that only those persons of
legal drinking age will be able to purchase beer and wine.
We respectfully request that the City of Dania Beach grant a variance to
Pancho's Holding, Inc., d/b/a Pancho's Back Yard to sell beer and wine.

NOTICE IS HEREBY GIVEN that a public hearing will be held before the City Commission on
Tuesday, June 13, 2006, at 7:00 p.m., or as soon thereafter as possible, in the Dania Beach City
Commission Chambers, Dania Beach Administrative Center, 100 West Dania Beach Blvd., Dania
Beach, Florida 33004, for the purpose of hearing any comments which might be made to the
following request:
Applicant: Jose Castellanos, Owner of "Pancho's Backyard" Restaurant
Property Owner: Inland Southeast Sheridan, LLC.
Location: 433 East Sheridan Street, (Publix Shopping Center) Dania Beach
VA-29-06 - The applicant Jose Castellanos, is requesting a variance to allow sales and
consumption of alcohol 575 feet from Olsen Middle School. (Chapter 28, Zoning, Article 4.201
"Proximity of beverage establishments to churches, schools, requires a distance separation of
at least 1,000 feet from a school.)
Legally described as: Tract "A" of "Sandpiper Bay Commercial", according to the plat thereof

portion described as Transflorida bank office building, a condominium according to the
