WHEREAS, the Dania Beach Zoning Code provides that residential developments are allowed as a Special Exception Use in C-2 zoning districts with the allocation of reserve or flex units; and WHEREAS, Beacon Investment Properties, LLC, representing property owner Archibald Weiner, Sr., has applied for a Special Exception request to allocate 280 Local Activity ("LAC") dwelling units to construct a residential development generally located on the northeast corner of Dania Beach Boulevard and Gulfstream Road(801 East Dania Beach Blvd.),which is located within the Community Redevelopment Area and the C-2 (Commercial) zoning district; and WHEREAS, the Planning & Zoning Board on July 19, 2006, recommended that the City Commission grant the Special Exception request, based upon the criteria set forth in Chapter 28, "Zoning",Article 6,"Supplementary Use Regulations", Section 6.40,"Special Exception Uses",of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application SE-42-06, for a Special Exception Use to construct a residential development for property generally located at the northeast corner of Dania Beach • Boulevard and Gulfstream Road (including 801 East Dania Beach Blvd.), Dania Beach, which is located within the Community Redevelopment Area and the C-2 (Commercial) zoning district (a copy of which application is attached and made a part of this Resolution as Exhibit "A"), is approved, subject to the following conditions: 1) Submission of complete site plans (including DBB/Gulfstream Road intersection improvements) for formal review by February 1, 2007. 2) Approval of site plan submission by City Commission. Section 2. Allocation of the Local Activity("LAC")dwelling units shall automatically expire and become null and void unless building permits are obtained on or before 12 months from the date of this Resolution. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. • Section 4. ANSBRO CITY ATTORNEY 2 RESOLUTION#2006-122 • CITY OF DANIA BEACH COMMUNITY DEVELOPMENT DEPARTMENT STAFF REPORT DATE: August 8, 2006 TO: Ivan Pato, City Manager FROM: Laurence Leeds, AICP, Director SUBJECT: VA-43-06/SE-42-06 - The applicant, Beacon Investment Properties LLC., on behalf of Archibald Weiner, Sr., is requesting a height variance (up to 14 stories) and special exception to allocate up to 280 Local Activity Center ("LAC") dwelling units to construct a residential development for property located at 801 East Dania Beach Boulevard (Weiner's Mobile Home Park). • Existing Property Regulations ZONING: General Commercial (C-2) LAND USE DESIGNATION: Local Activity Center (LAC) OVERLAY DISTRICTS: CRA, Principal Arterial Commercial Design Standard Overlay The subject property is located on the north east corner of Dania Beach Boulevard and Gulfstream Road. The property is currently occupied by a Trailer/RV Park and an abandoned gas station. The applicant has submitted a conceptual plan showing building location, building height, and entrance driveways. The concept proposes 3 to S story townhouse condominiums along the south (vacant land) and east (Gulfstream Road) lot lines. A multi-story parking structure is located in the middle of the site, in between 12 to 14 story condominium towers. Access driveways are located on Dania Beach Boulevard and Gulfstream Road. Proposed density is 280 units, or approximately 60 units per acre. Building setbacks have not been provided. In terms of proposed density (60, units per acre) and building height (3-14 stories with step-back height adjacent to residential) the conceptual plan is generally consistent with preliminary City Commission zoning criteria (see below). At the same time, information was not provided to evaluate parking, landscape, building setbacks, and architecture. Also, information was not submitted to determine appropriate intersection improvements at DBB and Gulfstream Road. As such, any P and Z approval shall be of limited duration and subject to City Commission approval of a complete site plan. CITY COMMISSION RECOMMENDATIONS: MAY 23, 2006 CRA ZONING DISTRICTS (1) EAST DANIA BEACH BOULEVARD (EAST OF NE 1 sT COURT/SE 1 ST AVENUE) MAXIMUM HEIGHT: Up to 14 stories; based on parcel size. Special exception applications are required to demonstrate compliance with the following criteria: (1) That the use is permitted as a special exception as set forth in the Schedule of Reviews Regulations, Article 4 of the City of Dania Beach City Code. In District Zone C2, multi- family housing is permitted when located within the Downtown Dania Beach Redevelopment District or the Dania Beach Community Redevelopment Area ("CRA"). This Project is located within the CRA and as such is provided for under Article 4 of the City Code. (2) That the use will not cause a detrimental impact to the value of existing contiguous uses or the uses in the general area. This upscale residential development will not be detrimental to the contiguous properties. In fact, this site is a very important redevelopment site in the downtown area and this particular proposal is consistent with the CRA Plan and the goals that have previously been set forth by the City Commission. The Project site is currently a mobile home park and the Project will constitute a more beneficial use of this land as it will serve to increase the aesthetic quality of the surrounding area and to raise property values in the area. Additionally, the Project will be built according to the current building code and using the newest materials for superior wind resistance, which will make the Project a safer use of the land. This is especially true in an area located in the eastern portion of the City, making it more susceptible to damage caused by hurricanes. Accordingly, this Project not only meets the City's FTL•1825594:1 1 goals contained within the CRA Plan, but also meets other important goals of the City's Zoning Code and Comprehensive Plan for the general health, safety and welfare of the Cit 's population. g Y Y p p (3) That the use will be compatible with existing uses on the contiguous properties and in the general zoning district and will be consistent with the general character of the area considering population density, design, scale and orientation of structured city area. This Project is consistent with the general character of the surrounding area. The residential units will support existing retail which is currently not thriving due to a lack of residential population within the area. The density is compatible with other urban downtown projects such as the project due east of the subject site. Additionally, this project will accommodate the increased need for housing in the City. (4) Adequate landscaping and screening will be provided. The Project proposes multiple levels that will have a variety of lush landscaped and green areas for not only the benefit • of the residents and the neighboring properties, but to add diveristy to the architecture and design of the building. (5) Adequate parking and loading is provided and ingress and egress is designed so as to cause minimum interference with traffic on abutting streets. The project will be designed to eliminate any significant conflicts in the traffic flow and will support proper site circulation. The residential parking will be provided in accordance with the parking code and will provide ample parking for the proposed Project. (6) Use is consistent with the Comprehensive Plan. The Project is entirely consistent with the underlying Land Use Plan. We are requesting the allocation of 280 residential units. That is consistent not only with the Comprehensive Plan but also with the City CRA Map. There • FTL•1825594:1 2 are adequate units available in the City to accommodate this request, and the new units will provide a variety of new quality housing for residents of the City. (7) That the use will not have a detrimental and environmental impact upon contiguous properties and upon properties located in the general area. As described above, the Project provides a mixed-height design. This approach will mitigate the size and overall impact of the Project. The Project will be designed to provide ample landscaping for the residents and neighboring properties to enjoy and will be an improvement use over the existing mobile home park. (8) That the use will not have a detrimental effect on vehicular/pedestrian traffic. The parking traffic flow has been designed to limit the interference caused by the new residential units. The parking, driveways and site curulation will be designed in such a way to maximize efficiency. The Developer will take appropriate measures to ensure the Project will not increase traffic on the main roadways or cause any unwanted interference for pedestrians. (9) That the use will not utilize turning movements in relation to its access to public roads or intersections, or its locations in relation to other structures or proposed structures on or near the site that would be hazardous or a nuisance. The Developer will ensure that the proposed development will not inhibit turning movements in relation to access onto Dania Beach Boulevard or Gulstream Road and will insure that ingress and egress is provided in a safe and efficient manner. The Developer will ensure that the overall site design, including driveways and acess, will be in harmony with neighboring properties. (10) That the use will not have a detrimental effect on the future development of contiguous properties or the general area according to the Comprehensive Plan. This Project is FTL:1825594:1 3 consistent with the City's Comprehensive Plan. The Developer will provide sufficient setbacks • so as to avoid creating problems for the future development of contiguous properties. (11) That the use will not result in the creation of incompatible noise, lights, vibrations,fumes, odors, dust or physical activities. The Developer intends to design the Project to mitigate any potential that might arise from incompatible noise, lights, fumes, sounds or activities. By placing open spaces and landscaping on the Project as well as varying building heights, the design also allows for certain aesthetic benefits from that landscaping from both the street level or upper levels of other buildings as the case may be. The Developer intends to use some of the latest building construction materials as to sound and wind resistance. (12) That this use will not overburden existing public services and facilities. The City has programmed water/sewer infrastructure improvements which will be available by the time of permitting. (13) That the use will be sufficiently accessible to permit entry onto the property by fire, police, rescue and other public services. The design will provide for safe and adequate access. (14) That the use will be consistent with the definition of a special exception and hill meet the standards and criteria of the zoning classification in which the use is proposed. This use is consistent with the C2 zoning designations. The definition for a special exception provides for "a use which may be allowed within a zoning district subject to the provisions of this chapter and in accordance with the procedures as set forth in Article 10 of this Chapter." We have filed the appropriate special exception application with fees.
