A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA APPROVING
THE VARIANCE REQUEST SUBMITTED BY BEACON INVESTMENT
PROPERTIES LLC, REPRESENTING PROPERTY OWNER ARCHIBALD
WEINER, SR. FROM CHAPTER 28, "ZONING", ARTICLE 4, "SCHEDULE OF
LOT, YARD AND BULK REGULATIONS", FOR PROPERTY GENERALLY
LOCATED AT THE NORTHEAST CORNER OF DANIA BEACH BOULEVARD
AND GULFSTREAM ROAD(INCLUDING 801 EAST DANIA BEACH BLVD.),
DANIA BEACH;PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, the Dania Beach Code of Ordinances, Chapter 28, "Zoning", Article 4,
"Schedule of Lot, Yard and Bulk Regulations" prescribes the height regulations in the C-2
(Commercial) zoning district; and
WHEREAS, Beacon Investment Properties LLC, representing property owner Archibald
Weiner, Sr., has applied for a variance (VA-43-06) for the following:
1) Variance request to allow varying heights (3 — 14 stories) for a residential building
(maximum height in C-2 is 40 feet), per Chapter 28, "Zoning", Article 4, "Schedule of Lot
Yard and Bulk Regulations";
for property generally located at the northeast corner of Dania Beach Boulevard and Gulfstream
Road (including 801 East Dania Beach Blvd.), Dania Beach; and
WHEREAS, the Planning & Zoning Board on July 19, 2006, recommended that the City
Commission grant variance request VA-43-06 based upon the criteria set forth in section 10.13 of
Article 10, of Chapter 28, "Zoning", of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application(VA-43-06), for a variance as described above
(from requirements in Chapter 28, "Zoning", Article 4, "Schedule of Lot, Yard and Bulk
Regulations"), a copy of which is attached as Exhibit"A"is approved,with the following conditions:
1) Submission of complete site plans (including DBB/Gulfstream Road intersection
improvements) for formal review by February 1, 2007.
. 2) Approval of site plan submission by City Commission.
Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 3. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.

SUBJECT: VA-43-06/SE-42-06 - The applicant, Beacon Investment
Properties LLC., on behalf of Archibald Weiner, Sr., is requesting
a height variance (up to 14 stories) and special exception to
allocate up to 280 Local Activity Center ("LAC") dwelling units to
construct a residential development for property located at 801
East Dania Beach Boulevard (Weiner's Mobile Home Park).

The subject property is located on the north east corner of Dania Beach
Boulevard and Gulfstream Road. The property is currently occupied by a
Trailer/RV Park and an abandoned gas station.
The applicant has submitted a conceptual plan showing building location,
building height, and entrance driveways. The concept proposes 3 to 5 story
townhouse condominiums along the south (vacant land) and east
(Gulfstream Road) lot lines.
•
A multi-story parking structure is located in the middle of the site, in •
between 12 to 14 story condominium towers. Access driveways are located
on Dania Beach Boulevard and Gulfstream Road. Proposed density is 280
units, or approximately 60 units per acre. Building setbacks have not been
provided.
In terms of proposed density (60 units per acre) and building height (3-14
stories with step-back height adjacent to residential) the conceptual plan is
generally consistent with preliminary City Commission zoning criteria (see
below). At the same time, information was not provided to evaluate
parking, landscape, building setbacks, and architecture. Also, information
was not submitted to determine appropriate. intersection improvements at
DBB and Gulfstream Road. As such, any P and Z approval shall be of limited
duration and subject to City Commission approval of a complete site plan.
CITY COMMISSION RECOMMENDATIONS: MAY 23, 2006

along Dania Beach Boulevard.

• Thus far, the City Commission has allocated 417 LAC Units; 112 units for
109 Park and 30S units for Casa Beni. The allocation of 280 units for Wiener
Site will leave a balance of approximately 1 ,700 units.

Justification for Height Variance
•
Beacon Investment Properties, LLC, ("Developer"), is the contract purchaser of the
property located on the NE corner of Gulfstream Road and Dania Beach Boulevard ("Property")
in the City of Dania Beach ("City"). Developer proposes to build an upscale multi-story
residential development comprised of 280 residential units ("Project"). In furtherance of the
Developer's design for the Project, Developer seeks a variance under the City's Code of
Ordinances ("Code"), Chapter 28, section 10.13; namely, a variance from section 4.202, in order
to construct a residential project which will incoprate residential building heights from 5 to 15
stories with a maximum height of 160 feet to the highest point of the building, where the Code
limits development to 3 stories, with a maximum height of 40 feet.
As discussed below, the requested variance adheres to the variance review criteria set
forth in Chapter 28, section 10.13 of the Code. Specifically, Developer will demonstrate that: (a)
special conditions and circumstances exist which are peculiar to the land, structure or building
involved and which are not applicable to other lands, structures or buildings in the same zoning
district; (b) the special conditions and circumstances do not result from the actions of the
applicant; (c) granting the variance requested will not confer on the applicant any special
privilege that is denied by this chapter to other lands, buildings or structures in this same zoning
district; (d) literal interpretation of the provisions of this chapter would deprive the applicant of
rights commonly enjoyed by other properties in the same zoning district under the terms of this
chapter and would work unnecessary and undue hardship on the applicant; (e) the variance
granted is the minimum variance that will make possible the reasonable use of the land, building
or structure; and (0 the grant of the variance will be in harmony with the general intent and

purpose of this chapter, and that such variance will not be injurious to the area involved or
• otherwise detrimental to the public welfare. '
(a) Special conditions and circumstances exist which are peculiar to the land,
structure or building involved and which are not applicable to other lands, structures or
buildings in the same zoning district. Special conditions and circumstances exist which warrant
the granting of the requested variance. The Code never anticipated the population boom which
has occurred in South Florida. This population boom and the lack of available vacant land has
created a need for cities to be creative in the way they plan and build residential areas, and a
result, the concept of taller multi-family residential developments has been incorporated into
modern cities in the South Florida area. Much like all the other cities in South Florida, Dania
Beach is growing, and is no longer the small town that the code was designed for. The City's
small town concept has limited the amount of new development within the City. In response to
• such growth, the City has adopted some of the more flexible mechanisms such p as the Local
Activity Center ("LAC") to create flexibility in addressing population growth and land
availability. This request is consistent with the provisions of the LAC. The proposed upscale
mixed-height residential development - is very innovative and unique. The existing Code,
therefore, being outdated and designed for a small town, anticipated much smaller buildings and
does not address the current demand for a new, creative development concepts.
(b) That the special conditions and circumstances do not result from the actions of the
applicant. The special conditions and circumstances are not a result of action by the Developer.
Currently, the height requirements in the Code are not designed for larger residential
developments. The Code is designed for the traditional small town development, where the
population was small, thereby making the demand for residential units much less than that which

we are currently experiencing. Buildings did not need to be very tall to provide the adequate
number of residential units to serve a smaller population. The proposed Project provides a

creative and unique solution to some of the problems facing the City, such as a lack of new
quality development to house and service the ever-growing population.
(c) That granting the variance requested will not confer on the applicant any special
privilege that is denied by this chapter to other lands, buildings or structures in this same zoning
district. Granting the Developer's request for a variance will not confer on the applicant any
special privileges denied to any other properties in the same zoning district. The City has
previously recognized that the Code does not adequately address the need for multi-level
development and more specifically the need for residential development exceeding 40 feet. If
the variance is granted, it would not be a special privilege as others have been granted similar
variances. Any future project that meets the same criteria and requests a similar variance would
be in the same position as the Developer is today. •

(d) That literal interpretation of the provisions of this chapter would deprive the
applicant of rights commonly enjoyed by other properties in the same zoning district under the
terms of this chapter and would work unnecessary and undue hardship on the applicant. Literal

City are older and were constructed at a time when real estate costs were significantly less while
vacant land was still a variable. Further, these structures were not designed for a modern
metropolitan area. The existing code provisions were designed when the City was a small
suburban town, and did not and could not envision the current demand for new, upscale

residential developments. If those outdated provisions were applied to the proposed Project, the
• Developer would no
t of be able to provide the City with the residential units it requires to service
its growing community and to attract new consumers tq the area. Therefore, the denial of this
variance would deny the Developer rights commonly enjoyed by other properties in the same
zoning district and would result in undue hardship.
(e) That the variance granted is the minimum variance that will make possible the
reasonable use of the land, building or structure. The variance requested is the minimum
variance that will make possible the reasonable use of the Property. The Developer will comply
with all other Code requirements.
(fl That the grant of the variance will be in harmony with the general intent and
purpose of this chapter, and that such variance will not be injurious to the area involved or

increase the tax base of the City and attract new residents to the City. The Code encourages new
