WHEREAS,the Dania Beach Code of Ordinances,Chapter 28,"Zoning",Article 6.21,sets the off-street parking requirements for the City of Dania Beach; and WHEREAS,Jeffrey Gross,architect,on behalf of property owner Jorge Fallad,Ornamental Designs, has applied for a variance (VA-27-06) to allow 7 parking spaces associated with a showroom/office use; Chapter 28, "Zoning", Article 6.21 "Off Street Parking", requires approximately 12 parking spaces associated with a showroom/office use,for property located at 102 North Federal Highway, Dania Beach; and WHEREAS, the Planning & Zoning Board on July 19, 2006, recommended that the City Commission grant variance request VA-27-06, based upon the criteria set forth in section 10.13 of Article 10, of Chapter 28, "Zoning", of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application VA-27-06, for a variance as described above from requirements in Chapter 28,"Zoning",Article 6.21,"Off-Street Parking",of the City of Dania Beach Code of Ordinances, a copy of which application is attached and made a part of this Resolution as Exhibit"A", is approved subject to the following condition: Approval to allow nine parking spaces, subject to curb installation, swale landscaping, and Knox Entry Systems along US 1 and NE I St Street. • Section 2. That based upon Section 10.13 of Article 10 of Chapter 28, of the Code of Ordinances of the City of Dania Beach,the variance shall automatically expire and become null and void unless building permits are obtained on or before 12 months from the date of this Resolution. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 4. Federal Highway). Variance • To allow Seven (1) parking spaces for showroom/office use. The parking code requires twelve parking spaces. (1)Applicant's alternative site plan provides nine parking spaces. Site Plan Site plan review for the modification of buildings to allow a decorator showroom and office. Property Information ZONING: Commercial (C-2) LAND USE DESIGNATION: Local Activity Center (LAC) OVER LAY DISTRICT: Community Redevelopment Area (CRA), Principal Arterial Commercial Design • Standard Overlay District. The applicant currently sells ornamental iron at 227 North Federal Highway. • The applicant wishes to relocate his sales/display operation to the subject parcel, located at the northeast corner of US 1 and NE 11t Street, formerly Garrison's Garage & the UMT building. The applicant proposes significant changes to the building elevation (see attached plan). With the exception of building color (red), the elevations are generally consistent with Principal Arterial Design ("PAD") Standards. Seven parking spaces are provided (Nine spaces pursuant to the alternative site plan see site plan attachment). Vehicle access to the front yard is restricted to NE 1 st Avenue; a pedestrian gate is shown on US 1 . The owner intends to exhibit wrought iron, aluminum, and wood work in the front yard. No specific examples are shown on the plan. Assembly, fabrication (including welding), and outdoor storage are prohibited at this location. Applicant indicates that he may need to repair a broken piece of ironwork damaged in shipping. Staff has no objection to "incidental repair or assembly" provided no welding is required. PRINCIPAL ARTERIAL DESIGN STANDARDS The PAD Standards require the use of "earth tone" or "light pastel colors" unless specifically approved by the City Commission. The rendering does not depict an earth tone or pastel red. The City Commission will need to determine, as part of their approval, if the proposed building color is acceptable. Applicant's current operation includes 2-4 decorative signs erected without permits. These decorative signs will not be allowed at the new site unless the City Commission determines they are works of art and not signs. • • No information is provided regarding the iron, aluminum, and wood artwork to be displayed in the front yard. The City Commission will need to determine, as part of their approval, if they wish to impose any conditions concerning the size, height, or media of the artwork. Staff recommends only that art cannot.exceed 20 feet in height (Building is 7 6 feet high). VARIANCE The project includes 4,262 square feet of showroom area and 348 square feet of office space, which requires a total of 12 parking spaces. The applicant's alternative parking plan provides nine parking spaces (four in the front and five in the rear). Applicant's current business, albeit smaller, is seldom occupied by more than 3 cars. Staff can support the variance based on the alterative nine space parking plan.
