HomeMy WebLinkAboutR-2006-125 Kodner Variance RESOLUTION NO. 2006-125 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA APPROVING THE VARIANCE REQUEST SUBMITTED BY JAY KODNER FOR PROPERTY LOCATED AT 6 SOUTH FEDERAL HIGHWAY, DANIA BEACH; FROM CHAPTER 28, "ZONING", ARTICLE 6.21 "OFF-STREET PARKING"; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,the Dania Beach Code of Ordinances,Chapter 28,"Zoning",Article 6.21,sets the off-street parking requirements for the City of Dania Beach; and WHEREAS, Jay Kodner has applied for a variance (VA-40-06) to allow 8 parking spaces associated with an auction use. Chapter 28, "Zoning", Article 6.21 "Off Street Parking", requires approximately 30 parking spaces associated with an auction use, for property located at 6 South Federal Highway, Dania Beach; and WHEREAS, the Planning & Zoning Board on July 19, 2006, recommended that the City Commission grant variance request VA-40-06,based upon the criteria set forth in section 10.13 of Article 10, of Chapter 28, "Zoning", of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application VA-40-06, for a variance as described above from requirements in Chapter 28,"Zoning",Article 6.21,"Off-Street Parking",of the City of Dania Beach Code of Ordinances, a copy of which application is attached and made a part of this Resolution as Exhibit "A", is approved subject to the following conditions: 1. Variance effective until January 1,2008,or until such time as Dania Discount Drugs revokes permission, whichever comes first. 2. Variance limited to Friday nights. 3. Applicant to submit a landscape plan(rear of building)for City approval. Landscaping to be installed prior to approval of a Certificate of Occupancy. Section 2. That based upon Section 10.13 of Article 10 of Chapter 28, of the Code of Ordinances of the City of Dania Beach,the variance shall automatically expire and become null and void unless building permits are obtained on or before 12 months from the date of this Resolution. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 4. That this Resolution shall be in force and take effect immediately upon its passage and adoption. PASSED and ADOPTED on August 22, 2006. VARIANCE Variance to allow an auction house/antique gallery with 8 parking spaces (30 spaces parking spaces required). ZONING: Commercial (C-2) LAND USE DESIGNATION: Local Activity Center (LAC) OVERLAY DISTRICT: CRA, Principal Arterial Commercial Design • Standard Applicant indicates 20% of usable floor area is available for auction space. Since staff cannot control the size of the auction area, staff is estimating 50% of gross will be used for auctions, leaving 50% for furniture display. Based on city parking requirements, 30 spaces are required. Only 8 spaces are actually provided, insufficient for auction use. Mr. Kodner has submitted a letter from the owner of Dania Discount Drugs granting permission to use the drug store parking lot (about 15 spaces) for the auctions. Sufficient parking should be available if the two sites can share each other's parking. Since Dania Drugs can withdraw their permission at any time without notice, any variance must be conditioned accordingly. PLANNING AND ZONING BOARD RECOMMENDATION Approval subject to the following: 1) Variance effective until January 1, 2008, or until such time as Dania Discount Drugs revokes permission, whichever occurs first. 2) Variance limited to Friday nights. 3) Applicant to submit a landscape plan (rear of building) for city approval. The survey of the subject property shows 14 parking spaces, including Handicapped on the site. The Auction House-"Estate Auction Company"will need additional parking, which is available at City Hall, already across the street. Auctions will be conducted after 5pm on Friday evenings, so the parking will not conflict with City Hall business. In addition, I own the property at 45 South Federal Highway and 101 South Federal Highway, whose parking facility is never used on Friday evenings. We will Provide Free Valet Parking. ® b).
