BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the City Commission adopts the City of Dania Beach City Commission Policy Manual, a copy of which is attached as Exhibit "A" and incorporated into this Resolution by this reference. Section 2. That this Policy Manual may be ameneded from time to time by Resolution of the City Commission. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution shall be repealed to the extent of such conflict. Section 4. (City Charter, Part I, Article 4, Form of Government) CITY COMMISSION The Commission consists of five (5) Commissionerswho shall be elected at large in the manner provided in the Charter and who shall take office on:the first 'Tuesday immediately following their election. No Commissioner shall serve more than`two,(�2) consecutive four(4) year terms in office without a full two (2) year interval before ;serving additional terms. At the organizational meeting of the City Commission to be held oii Tuesday following the election, and at each biennial organizational meeting"°held every two "(2), years thereafter, the City Commission candidate receiving the highest number of votes in-""' 'said election shall become Mayor for a term of one year. The candidate receiving the second highest number of votes shall 411 ., become the Vice-Mayor fora t r term of one yea 'and shall automatically be elevated to the position of Mayor after his one year term'"as Vice-Mayorand shall serve as Mayor until his successor is duly elected at the next biennial"organizational meeting. At the Commission meeting at which the Vice-Mayor is elevated to Mayor, a Vice-Mayor will be elected by the City Commission and he or she shall serve until"the next biennial organizational meeting. Any vacancy in the office of Mayor or Vice-Mayor shall be`filled by"a,"ote of the City Commission. The Commission shall,-,have the power to pass ordinances, adopt resolutions, appoint all appointive officers, boards ;and commissions by resolution, and exercise all other powers provided`by Charter. Neither the City Commission nor any of its members shall dictate the appointment of any person to office or employment by 9the City Manager, or in any manner prevent the City Manager from using his own judgmeriviri selecting those officers or employees which he is entitled to appoint or select under the provisions of the Charter. The Commission and its members shall deal with the administrative service solely through the City Manager, and neither the Commission nor any member thereof shall give orders to the subordinates of the City Manager either publicly or privately. The legislative powers of the City shall be vested in and exercised by the City Commission, consistent with the provisions of the Charter, the Constitution of the United States of America and the State of Florida, and the laws and ordinances of the City of Dania Beach. (City Charter, Part II, Article 1, City Commission) CITY COMMISSION POLICY MANUAL Page I of 11 CITY MANAGER The City Commission shall appoint a City Manager who shall be the administrative head of the municipal government under the direction and supervision of the City Commission. He or she shall be chosen on the basis of his or her executive and administrative qualifications, and shall be over the age of twenty-one (21). The City Commission may require the City Manager to be a resident of the City during his or her term of employment. The City Commission shall establish additional minimum requirements which serve as basic A, qualifications for the selection and appointment of a City Manager. One such minimum requirement and qualification shall be that the appomtee"`shall possess a degree in public administration or an equivalent degree, issued by an institution which has"I nationally recognized accreditation. An "equivalent degree" shall, for purposes of this section,_include the type of degree possessed by any Department Director who.;reports to the City Manager,'-such as a degree in engineering or public finance. Any such person who does not meet the foregoing minimum requirements and qualifications may be appointed as City Manager, but such appointment shall require a four-fifths (4/5) vote of the City Commission. It shall not be mandatory on the part of the City Commission to enter into an employment contract with the City Manager and, in the absence-of an &mptoyrnent contract, the City Manager may be appointed by Resolution of the City Commission to serve at the pleasure of the City Commission for whatever compensation such Resolution may fix and determine. (City Charter, Part II, Article 3, City klanager) CITY ATTORNEY: The City-,Commission shall appoint 'a City Attorney who shall serve at the pleasure of the Commission:_ He shall be a lawyer of>at least two (2) years experience and practice in the courts of the State -of_Florida. He shall receive such compensation as the City Commission may by resolution fix anddesignate. The City Attorney shall;be the legal advisor to and attorney and counselor for the municipality and all of its officers in°'matters relating to their official duties. DUTIES/RESPONSIBILITIES The City Commission duties and authority are set forth under the provisions of the City Charter. A copy of the Charter is attached to this manual as Exhibit "A". 2. . SUNSHINE LAW City Commission meetings shall always comply with Florida Sunshine Law requirements. Florida's Government in the Sunshine Law, commonly referred to ass the Sunshine Law, provides a right of access to governmental proceedings at both the state_and local levels. The law is equally applicable to elected and appointed boards and has been applied to any gathering of two or more members of the sarn'e board to'discuss some matter which will foreseeably come before that board for action. T—here,are three basic requirements of s. 286.011, F. S.: 1. Meetings of public boards or,coinmissions must be open to the public; 2. Reasonable notice of such meetings.must be given, arid" 3. Minutes of the meetings must be taken ,. , 3. COMMISSION"MEETINGS: Each City Commission shalLestablish meeting procedures. The conduct of the meetings is the responsibility of th&M, ayor.`` i A„"Consent Agenda"�section,will be.used to facilitate an orderly and expeditious conduct of business at Commission meetings. The posting of items to'the Agenda for any Regular City Commission meeting shall close at 5:00 p i ``on the Tuesday preceding the meeting. All backup material for such items must be submitted with each request. (Resolution #11-84) Any request for the adoption of an Ordinance must be submitted (with all backup material) by 5:00 p.m. on the Friday preceding the first and third Tuesday of each month. No Ordinance or Resolution will be placed on the Agenda for action unless previously prepared and available in the City Clerk's office unless an extreme emergency is found to exist by the City Commission. (Resolution #11-84) Additional items may be added to the Agenda at the beginning of the Commission meeting by a majority vote of the Commissioners present. (Resolution#11-84) CITY COMMISSION POLICY MANUAL Page 3 of 11 Public input shall be solicited regarding all items of public interest at Commission meetings. There will be a three (3) minute time limit for people speaking on the subject matter. When there is a Quasi-Judicial Land Use application, the applicant will be given sufficient time to present their case and call witnesses. A thirty (30) minute "Citizen Comments" period shall be designated on the agenda for citizens and interested persons to speak on matters not scheduled on that day's agenda. Each speaker shall be limited to three (3) minutes for comments. Persons desiring to speak during the Citizen Comments period shall inform the City Clerk prior to the beginning of the meeting of their intention to speak. If more than ten (10) speakers express a desire to speak, the Commission shall determine, on a meeting by meetingg�basis, whether to (a) extend the time allotted for Citizen Comments to accommodate all speakers, or (b) whether to limit the number of speakers or amount of time per speaker A speaker's time shall not be transferable to another speaker. Note: The Mayor-1, the latitude to keep redundancy from occurring when people are addressing the same issue. (Resolution#2000-165) 4. DEFINITION OF "ORDINANCE" AND'"RESOLUTION" "Ordinance" means an official Legislative action of the City Commission of the City of Dania Beach, which action is al-regulation of a general and permanent nature and enforceable as a local law. (Charter-and Related Laws, Part II,,Article 3, Section 1) "Resolution" means an expression of the City Commission"of the City of Dania Beach concerning matters of administration, expression of a.temporary character, or a provision �z:P for the disposition of`a<particular item f the administrative business of the City Commission of the"City of,Dania Beach. ,:(Charter and Related Laws, Part II, Article 3, Section 1) r. The City , Clerk shall Abe.'responsiblS,for the keeping of all of the Ordinances and Resolutions adopted by Tthe City `Comiiission. (Code of Ordinances, Chapter 2, Administration, Article VIII, City Clerk, Section 2-128 (h)) P F 5. USE'OF:.CITY VEH&LES/EQUIPMENT City Commission members shall not be assigned a designated vehicle. In the event that a vehicle is required,for"City related business, one will be made available for that purpose. City equipment such as telephones, cellular phones, faxes, computers and office supplies will be available in the City Commission office at City Hall for use of Commission members for City related business. Any of the above listed items that are in the Commissioner's possession must be returned to the City immediately upon the expiration of their term. Under no circumstances shall City vehicles or equipment be used for election related activities. CITY COMMISSION POLICY MANUAL Page 4 of 11 6. TRAVEL POLICY All employees (including the City Commission, City Manager and City Attorney) traveling at City expense or on City time are governed by the City of Dania Beach Travel Policy. Overnight travel, out-of—state travel, and air travel require advance approval, in writing, by the City Manager and City Commission. A hotel/motel receipt is required for all lodging, and the hotel/motel must be provided with a copy of the City's tax-exempt certificate upon check-in. A flat rate (per diem and incidental charges) inclusive of-gratuities will be granted to an employee. The City adopts the IRS allowable rate (Publication-1542) which provides a standard rate for most United States counties. Thel; e'r diem eliminates,,the need for actual receipts and itemized meal listings. . All City Commission and staff travel expenses shall be placed under the Consent Agenda section of the Regular City Commission Agenda and shall'include the department, name of the' elected official or employee, destination, date of travel, estimated amount of expenditure, and remaining balance in the expense account. (Resolution 42001-111) 7. PAYCHECKS AND BENEFITS In accordance with the. City Charter, PattAlI, Article 1, Section 2, "Compensation of Officers and Employees", the'City Commission shall by Resolution fix the compensation of the City Commissioners Such annual salaries shall be adjusted at the same time and at the same rate as Costfof Living Adjustments,'(COLA) may be made to the salary paid to general City employees=.;(Res`olution#2005467) v Paychecks will be-.issued once:per month. It is the policy and purpose of the City of Dania Beach, that all of its future elected officials who are sinitially elected on or after the effective date of participation in the Florida Retire stem (March 1, 2006), except those excluded by local law, shall participate in the Florida Retirement System as authorized by Chapter 121, Florida Statutes. All future newly elected officials shall be compulsory members of the Florida Retirement System as of the effective date of participation in the Florida Retirement System so stated in Resolution#2006-035. City Commission members have the option to participate in the City's Health Insurance Program, subject to the same terms, provisions and conditions afforded to City employees. (Ordinance #2003-027) CITY COMMISSION POLICY MANUAL Page 5 of 11 8. CITY ATTORNEY SERVICES The City Commission shall retain the services of a City Attorney. The City Attorney shall report to and operate under the supervision of the Commission directly. The City Commission shall be responsible for reviewing legal expenditures. The City Commission shall conduct an annual performance evaluation of the City Attorney. The City Attorney shall provide services related to City issues. Individual legal needs of Commission members shall not be provided by the City Attorney,.- 9. SPECIAL EVENTS FEES Parties responsible for such events shall pay all .�,Speeial Event fees to the City. The Commission may, at its sole discretion, waive any`or all''Special Event fees,. Waiver of fees will be considered for events which provide a community wide benefit 10. CODE OF ETHICS The Code of Ethics for Public Officers and Employees, adopted by the Legislature as Part III of Chapter 112, Florida Statutes,"contains standards of ethics conduct and disclosures applicable to public officers, employees, eandidates,,lobbyists and others in Florida State and local government. 112.311 Legislative intent and declaration of policy.M (1) It is essential to,.the properconduct and operation of government that public officials be independent and impartial and gthat public office not be used for private gain other than the remuneration provide'&,by law.' Thq public:=interest, therefore, requires that the law protect against�.anyconflict of interest and establish standards for the conduct of elected officials and'government employees in situations where conflicts may exist. (2) Itis also essential t11at government attract those citizens best qualified to serve. Thus, the lawagainst conflict,of interest must be so designed as not to impede unreasonably or unnecessarily the recruitment and retention by government of those best qualified to serve. Public officials should-not be denied the opportunity, available to all other citizens, to acquire and retain private economic interests except when conflicts with the responsibility of such officials to the public cannot be avoided. (3) It is likewise essential that the people be free to seek redress of their grievances and express their opinions to all government officials on current issues and past or pending legislative and executive actions at every level of government. In order to preserve and maintain the integrity of the governmental process, it is necessary that the identity, expenditures, and activities of those persons who regularly engage in efforts to persuade public officials to take specific actions, either by direct communication with such officials or by solicitation of others to engage in such efforts, be regularly disclosed to the people. CITY COMMISSION POLICY MANUAL Page 6 of 11 s (4) It is the intent of this act to implement these objectives of protecting the integrity of government and of facilitating the recruitment and retention of qualified personnel by prescribing restrictions against conflicts of interest without creating unnecessary barriers to public service. (5) It is hereby declared to be the policy of the state that no officer or employee of a state agency or of a county, city, or other political subdivision of the state, and no member of the Legislature or legislative employee, shall have any interest, financial or otherwise, direct or indirect; engage in any business transaction or professional activity; or incur any obligation of any nature which is in substantial conflict with the proper discharge of his or her duties in the public interest. To implement this policy and strengthensthe"faith and confidence of the people of the state in their government, there is enacted"a",code of ethics setting forth standards of conduct required of state, county, and city,officors and employees, and of officers and employees of other political subdivisions`�of the state.-..,in the performance of their official duties. It is the intent of the Legislature4hatfhis code"shall serve not only as a guide for the official conduct of public servants in this state, but also as a basis for discipline of those who violate the provisions of this part. (6) It is declared to be the policy of the state thatpublic',officers and employees, state and local, are agents of the people and hold their positions for the benefit of the public. They are bound to uphold the Constitution of the United States"and the State Constitution and to perform efficiently and faithfully their:;duties under the laws'of the federal, state, and local governments. Such officers and employees are bound to observe,in their official acts, the highest standards of ethics consistent with thiseeode,and theadvisory opinions rendered with respect hereto regardless of personal considerations; recognizing that promoting the public interest and malkaining the respect'of the people in their government must be of foremost concern: 11. LIAISONS_ The;City Commission shall appoint, from its members, representatives to the Broward League of Cities, Met ropolitai"Planning Organization (MPO), General Employees Pension Board; and the Police and Fire Pension Board. 12. ADVIS0RVil0ARDS`" The City Commission may at any time by Resolution appoint advisory boards composed of men or women who are residents of the City for a period of six (6) months prior to their appointment and otherwise qualified to act in an advisory capacity to the City Commission, the City Manager, or to any department of the City government, with respect to the conduct and management of any property or institution or the exercise of any public functions of the City. The members.of such board shall serve without compensation at the pleasure of the Commission, and their duties shall be to consult and advise with such municipal officers and make written recommendations which shall become part of the records of the City. Each board shall adopt its own by-laws and elect a chairperson and a vice-chairperson from CITY COMMISSION POLICY MANUAL Page 7 of 11 the membership. Minutes of each meeting shall be prepared and filed with the City Clerk. (City Charter, Article 3, Advisory Boards, Sec. 1, How Constituted) The minutes of all Boards will be kept in the Office of the City Clerk. Copies of the minutes will be distributed to the Mayor and City Commission. Dismissal "for cause" shall apply to all Boards and shall mean misfeasance, malfeasance or nonfeasance. The importance of attendance should be stressed for both regular and alternate members. It is the intent of the Commission that all members, including alternates, attend all meetings. Any member missing three (3) meetings without obtaining"excused absences from the Board shall automatically be removed from the Board and replaced in the same manner in which that member was originally appointed. (ResolutionY#2005 187) Terms will be limited as specified by Ordinance, Resolution or City Charter. 13. NOTIFICATION FOR REZONING The Planning & Zoning Board hears applications for rezoning and makes recommendations to the City Commission. Notice of"fhe.;public hearing shall�be mailed, by regular mail, to the applicant and to the owners, as shown':on the latest tax'Ils, of all property located within three hundred (300) feet of the land which is the subject of the rezoning request. The costs of mailing and publishing such,,notices shall, be borne by the applicant for rezoning. i A 14. CLERICAL STAFF,=SUPPORT Staff supports will be made availabfe: to any Commission member upon request. Coordination sliall,be;,,condu6to through the City Manager. 15. REQUEST FOR FUNDING Funding may :be considered for non-profit or charitable organizations that clearly demonstrate a'City-wide public good, with such recommendations coming from the Human Relations Board. ' 16. BUDGET As soon as practicable after receipt of the annual report and estimate of the City Manager, the City Commission shall meet and carefully consider the same; shall determine and fix the amount necessary to carry on the government of the City for the ensuing year; shall by Resolution adopt a Budget setting for the amount necessary to be raised for the various departments; and shall determine the amount of applicable funds on hand, the estimated CITY COMMISSION POLICY MANUAL Page 8 of 11 departmental revenues, and the amount of millage necessary to be levied. (City Charter, Part VII, Article 1, Section 2, Annual Budget and Appropriation) The City Commission shall have the power by Resolution to raise such a sum of money by taxation, and to levy upon the taxable property in the City of Dania Beach such a millage or tax, as it shall determine to be necessary in order to raise such sum for the operation of the said municipality; the right to levy such additional taxes as may be necessary to pay interest on outstanding bonds or such bonds as the City may from time to time issue in accordance with law, and also to provide a sinking fund for the redemption of said bonds; and shall have the power to levy additional taxes for other purposes provided for in the City Charter and by the laws of the State of Florida. (City Charter, Part VII, Article 1, Section 4, Power to Levy) The City Commission shall have authority to transfer: any part ..of any unencumbered balance of an appropriation to a purpose or object for which the appropriation of the current year has proved insufficient, or may authorize,'a transfer to be made between items appropriated to the same office or department, provided the provisions of'this section shall not apply to special earmarked funds nor to the.sinking,funds. (City Charter, Part VII, Article 1, Section 6, Transfer of Funds) At the close of each fiscal year,­the unencumbered balance of each appropriation shall revert to the respective fund from which;it was appropriated^and shall be subject to future appropriation, except that special funds shall remain intact Any accruing revenue of the City, not appropriated as hereinbefore provided,3And any balance at any time remaining after the purpose of the appropriation shall Have been satisfied or abandoned, may from time to time be appropriated_by Resolution''of the City,.Commission to such use as will not conflict with any uses for which such revenue specifically accrued. No money shall be drawn from th6"depository of the City, nor`shall,.any obligation for the expenditure of any money be incurred,`�except pursuant to the appropriation made by the City Commission. (City Charter, Part VII,.Article 1, Section,7;Limitation of Appropriations) Additional budget policy is asxfollows: r - a Fixed Capital Assets and Expenditures will be those items with a value of$1,000.00 or more; and having a use life of more than one year. • The City Manager is authorized to approve purchases up to $15,000.00 without City Commission approval. • The Commission shall have a strategic planning session to provide direction to staff in preparation of the ensuing year's budget. • All inter-department and inter-fund budget transfers and Capital item transfers require Commission approval. • Aside from adopting the annual millage rate, the City Commission shall annually adopt the Fire Assessment Rate, Solid Waste Fees, Water and Sewer Fees, and Stormwater Fees to ensure a sound financial funding for the level of service to be provided. CITY COMMISSION POLICY MANUAL Page 9 of 11 17. CAPITAL PROJECTS Each year the City Commission shall review and update a City Five-Year Capital Improvement Plan prepared by the City Manager. 18. LABOR RELATIONS The City Manager is recognized as the administrator of employee relations for the City per the City Charter. Union Contract negotiations shall be conducted by the City Manager:and other staff. 19. COMMISSION COMMUNICATIONS WITH EMPLOYEES ESN k Neither the City Commission nor any of its members shall dictate the appointment of any person to office or employment by the City Manager, 'or in any manner prevent the City Manager from using his own judgment in selecting those officers or employees which he is entitled to appoint or select under the"provisions of the Charter. The Commission and its members shall deal with the administrative service solely through the City Manager, and neither the Commission nor any member thereof shall:give orders to the subordinates of the City Manager either publicly or privately (City Charter, Part II, Article 1, City . Commission) On April 26, 2005 the City Commission ado"pted Resolution #2005-066 to inform all City Commissioners and employees how the Charter provision governing communications between elected officials and all,�'City ern_ployees (City Charter, Part II, Article 1) is intended td°be applied. Resolution #2005-06b, The`City Manager has, delegated to each of the Department Directors the authority to respond,to any City business-related matter raised by any City Commissioner. Contacts (communications) between a City Commissioner and a City employee, when of a casual nature and unrelated,_to City business, are always permitted. However, if any City business is irivolved '`employees are required to ask the City Commissioner to contact the appropriate Department Director. In turn, the Director will contact the City Manager if the City business matter warrants the attention of the City Manager. The City Commissioners are aware that they cannot, due to the Charter provision mentioned above, ever "give orders" or directives to any City employee, including Department Directors. If a question ever arises as to this Policy, the City Commissioner, the City employee or both are always free to first contact the City Department Director for guidance or assistance. Furthermore, if a request for information by a Commissioner may require an extensive commitment of time by the Department Director or staff, CITY COMMISSION POLICY MANUAL Page 10 of 11 resulting in a loss of resources for normal City operations, the Department Director will forward the request to the City Manager for consideration and resource planning. For any breach or violation of the policy, the City Commission may, after deliberation and consideration of all relevant facts at a regular meeting of the City Commission, issue a public reprimand or adopt a Resolution which publicly censures the violator, dependent upon the nature and circumstances of the breach or violation. The City Commission Members shall have mail boxes located inside City Hall to facilitate the flow of correspondence related to City business. 20. SURPLUS PROPERTY The City Commission shall follow all applicable State, Laws in declaring surplus property each year. The property may be disposed of by selling°to the highest bidder, for cash, at public auction, on-line auction, or by sealed bids. Items may also be used`as a trade-in to reduce the cost of replacement. City employees are perrnitted to participate in the auction of surplus property. r� 21. COMMUNITY REDEVELOPMENT AGENCY (CRA) x The City Commission commissioned a"`Finding of Necessitykfor Redevelopment Study" to determine whether any portions of the City of Dania`Beach displayed sufficient indication d�of blight in order t warrant designation:.of the area as a "Community Redevelopment Area" (CRA). The area covered by this study is generally described as that portion of the City of Dania .Beach bound'by the Dania Cut-Off Canal on the north, Sheridan Street on the south, NW 9th Avenue on the west, and Gulfstream Road on the east. The City Commission accepted a delegation of powers from the Broward County Board of County Commissioners regarding the establishment and implementation of a Community ;Redevelopment Agency (CRA) on:.June 25, 2002. The City Commission established itself to be the Community Redevelopment Agency for the City, with the Mayor serving as the Chairman, and the Vice=Mayor serving as the Vice-Chairman.
