A RESOLUTION OF THE CITY OF DANIA BEACH,FLORIDA,AUTHORIZING
THE PROPER CITY OFFICIALS TO EXECUTE A FIRST AMENDMENT TO AN
EXISTING INTERLOCAL AGREEMENT FOR "GUARANTEED PARTIAL
SERVICE BUILDING CODE SERVICES TO BE PERFORMED BY THE
BROWARD COUNTY BUILDING CODE SERVICES DIVISION,DEPARTMENT
OF URBAN PLANNING AND REDEVELOPMENT"; PROVIDING FOR
CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA;
Section 1. That that certain First Amendment to an existing Interlocal Agreement for
"Guaranteed Partial Service Building Code Services to be Performed by the Broward County
Building Code Services Division,Department of Urban Planning and Redevelopment",in substantial
form as Exhibit"A", attached,is approved and the proper city officials are authorized to execute it.
Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 3. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.

SUBJECT: Broward County Building Services Contract Amendment: FY 06/07
In July 2006, Broward County Building Services Division requested a 30%
increase in the hourly rates for county building inspectors/plan reviewers,
effective October 1 , 2006 (see attached letter). Broward County Building
Services indicates the increase is necessary to recruit and maintain quality
county inspection/review staff. A leading private provider of these services
quoted a 49% increase over current county rates.

inspection hours to address a higher level of permit activity. With the increase
in county rates plus the additional hours, the 06/07 county contract will cost
$731 ,250 and provide the equivalent of 5.37 full time county employees
("FTE"). Much of this cost will be paid by building permit fees.
Increased county staffing can be summarized as follows:
Maintain 1 .12* FTE for Building Official.
-Increasing Structural plan review/inspection from 1 .12 to 2.24* FTE.
-Increasing Electrical plan review from 0.22 to 0.45 FTE.
-Increasing Plumbing plan review/inspection from 0.56 to 0.78 FTE.
-Increasing AC/Mechanical plan review/inspection from 0.56 to 0.78 FTE.
*Additional hours include providing county staff to cover for city inspectors on
leave or out sick. Additional hours also include emergency "after-hours" call
back (see attached list).
The need for the additional county staff is necessary to provide sufficient time •
for thorough plan review and proper inspections. In 06/07, this is anticipated
to include single family renovations/additions, commercial building
renovations, town-home projects (Aqua Isles, Cape Fear, Forest View,
Hammond Oaks, and Venetian), office/warehouse projects, municipal projects,
and major development such as the Best Western Hotel, Modello
Condominium, and jai Alai.

FIRST AMENDMENT
TO
INTERLOCAL AGREEMENT FOR
GUARANTEED PARTIAL SERVICE
BUILDING CODE SERVICES TO BE PERFORMED BY THE
BROWARD COUNTY BUILDING CODE SERVICES DIVISION OF
THE URBAN PLANNING AND REDEVELOPMENT DEPARTMENT
This is a First Amendment to an Interlocal Agreement, made and entered into by
and between: BROWARD COUNTY, a political subdivision of the state of Florida,
hereinafter referred to as "COUNTY," through its Board of County Commissioners,
AND
CITY OF DANIA BEACH, a municipal corporation existing under the laws of the
state of Florida, hereinafter referred to as "CITY."
WHEREAS, COUNTY and CITY entered into an Interlocal Agreement which was
approved by the COUNTY on June 8, 2005, providing for COUNTY to perform, within the
municipal boundaries of the CITY, guaranteed partial service, building code services
regarding plan review, permit inspections, building official, code enforcement, and other
services relating to building; and
WHEREAS, CITY is desirous of amending the Interlocal Agreement, by amending
the level of service specified in Article 1 — SCOPE OF SERVICES, Section 3 therein; and
WHEREAS, COUNTY has agreed to provide the amended level of service as
requested; and
WHEREAS, COUNTY is desirous of amending the Interlocal Agreement, by
increasing its hourly rates as specified in Article 3 —Compensation, Section 1 therein; and
WHEREAS, CITY has agreed to the new hourly rates, pursuant to the terms and
conditions set forth; NOW, THEREFORE,
IN CONSIDERATION of the mutual terms, conditions, promises, covenants, and
payments hereinafter set forth, the parties agree as follows:
1. The above recitals and representations set forth above in the "WHEREAS" clauses
of this Agreement are true and correct and are incorporated herein by this reference.
2. The parties agree that Article 1 — SCOPE OF SERVICES of the original Interlocal
Agreement shall be amended to reflect the new level of service, and shall read as follows:
1.3 CITY issues permits and retains fees. County charges hourly rate for providing
a guaranteed level of staffing for the year to the CITY. Requested minimum level of
staffing for the term of the agreement will be based on Schedule A A-1. This form of
guarantee will enable BCSD to supply the CITY with dedicated staff that will not be
diverted away.
3. The parties agree that Article 3 — COMPENSATION of the original Interlocal
Agreement shall be amended to reflect the new hourly rates, and shall read as follows:
3.1 For services requested in Schedule A A-1, COUNTY shall provide services set
forth above at the rate of Sixty-five and
• 00/100 Dollars ($65.00) per hour for a Building Code Inspector, €ffi#y few a+
Seventy-five and 00/100 Dollars ($75.00) per hour for a
Plans Examiner, Seventy-seven and 00/100 Dollars ($77.00) per hour for a Chief
Building Code Inspector, Ninety and 00/100
Dollars ($90.00) per hour for Building Official Services. Overtime, when approved
by the CITY, shall be at one and one half the normal hourly rate. All hourly charges
shall be billed in increments of thirty (30) minutes.
3.3 The amounts set forth above shall be adjusted annually by the COUNTY by an
amount not to exceed five percent(5%)to address increases in operating and labor
costs. Notwithstanding the foregoing, COUNTY may also adjust the amounts set
forth above by amounts exceeding five percent(5%) in order to address unforeseen
events and circumstances. No later than May 15 of each year, COUNTY shall
provide CITY with notice of anticipated increases, if any. Any increases shall take
effect on October 1 S , following the Mav 1 s notification.
4. Except as amended herein, all other terms and conditions of the existing Agreement
shall remain in full force and effect.
5. In the event of any conflict or ambiguity by and between the terms and provisions of
the First Amendment to the original Interlocal Agreement and the original Interlocal
Agreement, the terms and provisions of this First Amendment to Interlocal Agreement shall
control to the extent of any such conflict or ambiguity.

Service Provider Increase via Interlocal Agreement
Dear Mr. Pato:
The Building Code Services Division has been providing dependable Florida Building Code
services to many of Broward County's municipalities on a full-cost recovery basis for many
years. As many of you are aware, due to high demand for qualified building inspectors, plan
reviewers and officials, it has become very difficult to maintain and recruit sufficient staff to
serve our contract cities. To address this situation, it has become necessary to increase salaries
and benefits to enable us to maintain staff familiar with your operations and recruit new
employees to satisfy increased demand for service. This has, in turn resulted in a need to
increase hourly rates.
While we have discussed this situation informally with you or your staff, it is now necessary to
request consideration of an amendment to your city's existing interlocal agreement to implement
the new rate structure as follows:
Building Code Inspector - from$54.05/tu to $65.00/hr
Plans Examiner - from $57.29/hr to$75.00/hr
Chief Building Code Inspector - from$77.00/hr(new service being requested)
Building Official - from$69.59/hr to$90.00/hr
This rate increase will apply to all existing contracts, regardless of their expiration dates, as well
as new contracts as they occur. As we are mandated to recover the full costs of providing
services and since we have already begun to pay the increased salaries to enhance recruitment
efforts, we would appreciate implementation of the new rates as soon as possible but no later
than October 1, 2006.
