A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING
THE REQUEST MADE BY ED MATSON, FOR AN EXTENSION OF
VARIANCE VA-62-04 AND SITE PLAN SP-63-04,BOTH DATED MAY 24,2005
APPROVED BY RESOLUTION NO. 2005-087 AND RESOLUTION NO. 2005-
088, RESPECTIVELY, EXPIRE ON NOVEMBER 24, 2006; PROPERTY
GENERALLY LOCATED AT THE SOUTHWEST CORNER OF SW 23KD
TERRACE AND STATE ROAD 84, DANIA BEACH; PROVIDING FOR
CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS,on May 24,2005,the City Commission approved the request for variance VA-
62-04 by Jody Oberholtzer, representing 84 Commerce Center, Inc., to allow construction of a
15,000 square foot office/warehouse with an 8 foot rear yard setback (10 feet required), and the
following waivers:
1. to provide a 10' street side setback (north); 30' required.
2. to provide an I F rear set back (west); 20' required.
3. to provide 25.9%pervious area; 30%is required(Article 29, Section 29.10 of the City's
Zoning Code);
.. by Resolution 2005-087 which will expire on November 24, 2006; and
WHEREAS, on May 24, 2005, the City Commission approved the request for a site plan
(SP-63-04)by Jody Oberholtzer,representing 84 Commerce Center,Inc.,to allow construction of a
15,000 square foot office/warehouse in an IROM (Industrial Research Office Marine) Zoning
District, by Resolution 2005-088 which will expire on November 24, 2006, pertaining to property
located at the southwest corner of SW 23rd Terrace and State Road 84, Dania Beach; and
WHEREAS,Ed Matson is requesting extensions of the variance and site plan approvals until
May 24, 2007;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the requests to extend the expiration date for the approval of the variance
is VA-62-04 and site plan SP-63-04, until May 24, 2007, are approved, subject to construction
drawings being submitted to the Community Development Department within 30 days.
Section 2. That such approvals are subject to the conditions previously approved by the City
Commission.
Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 4. That this Resolution shall be in force and take effect immediately upon its passage
and adoption.

SUBJECT: VA-62-04/SP-63-04: The applicant, Ed Matson, is
requesting a variance, waiver and site plan extension to
allow the construction of an office/warehouse, located at
the south west corner of State Road 84 and SW 23
Terrace.
The City Commission conditionally approved this site plan and variance on
July 9, 2002 and again on May 24, 2005. The applicant is requesting an
extension of the approvals to May 24, 2007 to allow the applicant additional
time to obtain a building permit.
VARIANCE
To provide an 8' setback (south); 20' required.
WAIVER
i . To provide a 10' street side setback (north); 30' required.
2. To provide an 1 1 ' rear set back (west); 20' required.
3. To provide 25.9% pervious area; 30% is required.
SITE PLAN
To allow the construction of a 15,000 square foot office/warehouse
facility.
PROPERTY INFORMATION:

VARIANCE
To provide an 8' setback (south); 20' required.
A small portion of the building is setback 8' from the south lot line. This
requires a variance because it is less than the minimum 10' by code. The
building placement is the same as the original site plan approved in 2002.
WAIVER
1 . To provide a 10' street setback (north); 30' required.
2. To provide an 1 1 ' setback (west); 20' required.
The IROM zoning requires a 30' street yard setback along State Road 84 and
SW 23 Terrace and a 20' west setback. However the code allows the City
Commission to reduce these setbacks to 10' without a variance. The
building placement is the same as the original site plan approved in 2002.
3. To provide 25.9% pervious area; 30% is required.
Waiver of this requirement was conditionally approved by the City
Commission in 2002 if the applicant provided additional storm water
capacity to compensate for the 5% decrease in pervious area, said
improvements to be in the form of a French drain or other on site storm
water measure to be determined by the Public Work/Utilities Director.
The original site plan was approved with 25% pervious area; the applicant is
now proposing to provide 25.9% pervious area.
SITE PLAN
The proposed site plan was reviewed by City staff in various departments and
all of staff's concerns have been addressed.
STAFF RECOMMENDATION
The proposed development is consistent with the existing and proposed
development along the Marina Mile Corridor. Staff has no objection to
approval.

"ZONING", ARTICLE 18, "INDUSTRIAL RESEARCH OFFICE MARINE
ZONING DISTRICT", FOR PROPERTY LOCATED AT THE SOUTHWEST
CORNER OF SE 23RD TERRACE AND STATE ROAD 84, DANIA BEACH;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:

requirements in Chapter 28, Zoning, Article 18), and for the waivers specified above, a copy of
which application is attached as Exhibit "A" is approved.
