A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA APPROVING
THE VARIANCE REQUEST SUBMITTED BY WILLIAM RUIZ,PERTAINING
TO THE ZONING APPENDIX TO THE CITY CODE OF ORDINANCES,
SECTION 33-40 (12)(A), "REGULATION AND USE OF WATERWAYS AND
FACILITIES", FOR PROPERTY LOCATED AT 974 NAUTILUS ISLE, DANIA
BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS,the Zoning Appendix to the City of Dania Beach Code of Ordinances, Section
33-40(12)(a)"Regulation and use of Waterways and Facilities related thereto",regulates the use and
construction of facilities on or adjacent to waterways in the City of Dania Beach; and
WHEREAS, William Ruiz has applied for a variance (VA-54-06) to allow for the
installation of a boat lift which extends 14' into the adjacent waterway (the City Zoning Code,
Appendix Article II, Sec. 33-40 provides that boat slips and docks are allowed to extend no more
athan 10% of the waterway width, or in this case 8 feet); property is located at 974 Nautilus Isle,
Dania Beach; and
WHEREAS,the Planning and Zoning Board on September 27,2006 recommended that the
City Commission grant variance request VA-54-06,based upon the criteria set forth in section 10.13
of Article 10, of Chapter 28, "Zoning", of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application VA-54-06, for a variance as described above from
requirements in the Zoning Appendix of the City of Dania Beach Code of Ordinances,Section 33-40
"Regulation and use of Waterways and Facilities related thereto", a copy of which is attached as
Exhibit "A" is approved.
Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 3. . That this Resolution shall be in force and take effect immediately upon its
passage and adoption.

PROPERTY INFORMATION
ZONING: Single Family (RS-6000)
® LAND USE DESIGNATION: Low Residential (L-5)
The property is generally located in Melaleuca Gardens, directly south of the Ft.
Lauderdale Hollywood International Airport and is bounded by Griffin Road on the north
and the Dania Cut-off canal on the south.
The property owner wishes to install a boat lift at the rear of the property that abuts the
southern edge of the Tarpon Waterway which measures 80' in width.
VARIANCE
To allow the installation of a boat lift which extends 14' into the waterway; code allows
no more than 10% of the waterway width. Eight feet would be the maximum in this case.
The applicant requests to install a boat lift at the rear of the property where it abuts the
Tarpon Waterway. The structure is to be located at the rear and east side of the lot. The
boat lift will be installed at the outer edge of the seawall cap extending 14' into the 80'
waterway. The edge of the Tarpon Waterway begins precisely where the seawall cap
and water meet.
STAFF RECOMMENDATION
On September 27,2006 the Planning and Zoning Board recommended approval.

RE: Criteria Statement for Variance
Dear Board and Commission Members:
I am requesting this Variance to have a boat lift installed at my residence. The main
reason I moved to Dania Beach was to live in a boating community with ocean access
such as Melaleuca Gardens and to have the convenience of having my boat right behind
my house. Having a boat lift would ensure the security and safety of my boat and
provide added protection in the event of a Hurricane. In addition, I will be removing a
portion of the existing dock to accommodate the boat lift directly against the sea wall to
minimize its impact. This will also provide more than 5 feet of additional navigable
space as opposed to leaving the boat in the water by the existing dock. This would
benefit my neighbors as well anybody using the canal.
I believe my request is within the guidelines set forth in the variance criteria and I will
follow all guidelines, codes and compliances established by the City of Dania Beach.
The boat lift design set forth in the attached plans allows for the minimum variance
required based on the existing sea wall and site conditions at the property. The boat lift is
similar to at least 10 others located on the same canal.
I have notified my neighbors regarding the proposed boat lift and have enclosed written
statements signed by them indicating that they have no objections to the boat lift. I thank

NOTICE IS HEREBY GIVEN that a public hearing will be held before the City Commission on
Tuesday, October 10, 2006, at 7:00 p.m., or as soon thereafter as possible, in the Dania Beach
City Commission Chambers, Dania Beach Administrative Center, 100 West Dania Beach Blvd.,
Dania Beach, Florida 33004, for the purpose of hearing any comments which might be made to
the following request:

VA-54-06 - To allow the installation of a boat lift which extends 14' into the waterway; (The City

Legally described as: Lot 37, "Shelter Island", according to the plat thereof as recorded in plat
book 43, at page 6, of the public records of Broward County, Florida.
Copies of the proposed request is available for viewing in the Community Development
Department, 100 West Dania Beach Blvd., Dania Beach, Florida between the hours of 8:00
