Call to Order Mayor Flury called the meeting to order at 4:34 p.m. 2. Roll Call Present: Mayor: Patricia Flury Vice-Mayor: Bob Anton Commissioners: John Bertino Anne Castro C.K. Public Hearin ORDINANCE#2006-027 AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING EXECUTION BY THE PROPER CITY OFFICIALS OF A PURCHASE AND SALE AGREEMENT ON BEHALF OF THE CITY WITH VICTORY VILLAS, INC., AND VICTORY LIVING PROGRAMS, INC., FLORIDA NON-PROFIT CORPORATIONS; COVERING THE PROPERTY KNOWN AS THE VICTORY LIVING FACILITY LOCATED AT 851 WEST DANIA BEACH BOULEVARD, DANIA BEACH, FLORIDA 33004, AND MORE PARTICULARLY DESCRIBED IN A PURCHASE AND SALE AGREEMENT, SUBJECT TO CERTAIN CONDITIONS;PROVIDING FOR CONFLICTS;PROVIDING FOR SEVERABILITY;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. (FIRST READING) Mayor Flury read the title of Ordinance#2006-027. City Manager Pato advised this is approximately 3.5 acres of property that was offered to the City. This property would provide an opportunity for the City to address some of its expansion needs. . Commissioner Bertino noted we could use the business portion of the property for the police while we remodel the governmental campus. He does not see the City as being in the real estate rental business, and suggested the Dania Housing Authority could manage the 12 rental units. This would increase the availability of affordable housing units in the City, and would also bring in additional income for the City. He does not like the accessibility of the police department at this location, and suggested we keep an office at City Hall for people to pick up reports and make complaints. Vice-Mayor Anton recommended moving BSO to the office building, and he agreed with Commissioner Bertino on the affordable housing units. He supports the acquisition of the property. Commissioner McElyea noted it is a good property and would be an asset to the City; he further noted this property is currently not on the tax roll and would not impact the City's tax revenue. Mayor Flury noted the price is $1.5M. She stated the Housing Authority would need to apply for the additional 12 vouchers, and the units would need improvements to become workforce housing; these are small apartments that are not in good shape; and we have the highest number of affordable housing units in Broward County. She thinks we need to consider our options, such as turning it over to a developer who could make workforce housing. Commissioner McElyea motioned to approve Ordinance #2006-027, on first reading; • seconded by Commissioner Anton. Commissioner Bertino questioned how we would purchase the property. Patricia Varney, Director of Finance, recommended using the $750,000 surplus we anticipate from this year's fund balance, and financing the remaining $750,000. She calculated an interest rate of 4.5% for 10 years which would cost the City $96,000 in principal and interest payment. She thought we could use the Police Impact Fees ($122,000) to pay two years of the debt service because BSO will be located on the property. This would require $42,000 in interest cost for the first two years to purchase the land. Commissioner Castro commented the housing units could be sold for workforce housing, as opposed to low income housing, which could produce enough money to offset the purchase price. The redevelopment of these units would benefit the community. Commissioner McElyea commented that perhaps Public Works could move to the facility and this would save us some money on the redevelopment of the current Public Works site. Vice-Mayor Anton commented the Police have Law Enforcement Trust Fund monies and Police Impact Fees. He indicated work would need to be done on the building, some by the City and some by the Sheriff's Office, and that additional funds would be needed for the repairs. Mayor Flury opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, she closed the Public Hearing. Minutes of Special Meeting 2 Dania Beach City Commission Thursday,July 20,2006—4:30 p.m. • City Manager Pato commented there is a concern for the fate of the residents at Victory Village. Mayor Flury responded we have been assured that all the residents have been taken care of. The motion carried on the following 5-0 Roll Call vote: Commissioner Bertino Yes Vice-Mayor Anton Yes Commissioner Castro Yes Mayor Flury Yes Commissioner McElyea Yes Attorney Anderson advised the closing is set for 30 days after the termination date, which should be in approximately 90 days. Vice-Mayor Anton commented that he and City Manager Pato met with Mr. Brogan at FAU yesterday to discuss the marina. The lease expires in 2012 and FAU is pleased that the City is in control of the marina, and they are looking forward to a longstanding relationship with the City. They would like to extend the agreement until 2046 when their agreement expires, with a renewal option. FAU is concerned about the percentage of the net profit that goes to a scholarship fund. Vice-Mayor Anton believes there is room for negotiation in the scholarship funding because of the amount of money the City is putting into the marina. They currently receive 20% of the net profit; however, it is open for negotiation. He indicated a number of ® strategies were discussed, and the Commissioners should pass along whatever strategies they may have to the City Manager. City Manager Pato noted that FAU agreed to accept a fixed amount until 2012, as opposed to a percentage. 4.
