HomeMy WebLinkAboutR-2005-005 FHP Road Resurfacing RESOLUTION NO. 2005-005 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA AUTHORIZING THE CITY MANAGER TO PURCHASE ROAD RESURFACING SERVICES IN AN AMOUNT NOT TO EXCEED $200,000.00 IN THE FISCAL YEAR 2004-2005, UNDER PALM BEACH COUNTY BID 03/04-06; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Charter of the City of Dania Beach, Part III, Article 3, Section 4, Subsection 0), authorizes the City Manager to purchase supplies, services, equipment and materials for the city government in amounts in excess of Fifteen Thousand Dollars ($15,000.00) if he is authorized to do so in advance by a resolution adopted by the City Commission and if such purchases are made pursuant to a competitive bid obtained within the last twelve (12) months by other governmental agencies such as the federal government, State of Florida or a Florida county or municipality; and WHEREAS, the City Manager has determined that it is necessary to purchase road resurfacing services for the Public Services Department; and WHEREAS, the City Manager has determined that such services can be obtained at the least cost to the City by purchasing them from Florida Highway Products, Inc., under Palm Beach County Bid 03/04-06, a copy of which is attached and made a part of this Resolution as Exhibit "A", NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the proposal from Florida Highway Products, Inc., for road resurfacing services in an amount not to exceed $200,000.00 in Fiscal Year 2004-2005, under Palm Beach County Bid 03/04-06, in substantial form as Exhibit "A", is approved and the City Manager is authorized to pay Florida Highway Products for such services from the Public Services Fund Budgets for the fiscal year 2004-2005. Section 2. That this resolution shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED on January 11, 2005. r / C.K. Director of Public Services BY: Leo Williams, Public Works Superintendent LW Date: December 3, 2004 ®We r n v h a f road are requesting approval by the Commission at the 01/11/05 meeting the purchase o d resurfacing services from Florida Highway Products, Inc. This is the same type of resurfacing we have used the past few years and the product has proven itself in the areas we have resurfaced. This is a fairly new technique that incorporates a micro surfacing which is more suited to a lot of our roads now that we have basically resurfaced them all over the last 5-6 years. This way of resurfacing does away with sewer and water risers and elevation concerns and blends almost seamlessly into driveways doing away with milling necessities and the costs of such services. The new surface retains the darker color of new asphalt and does not fade like regular resurfacing providing better visuals for striping and crosswalks for years to come. The cost of this service is generally less then regular resurfacing but this product generally lasts longer then regular resurfacing and is far less pothole prone while providing a smoother surface. The product is in use throughout the Country and includes such users as F.D.O.T., Palm Beach County and the City Of Plantation. WITNESSETH, that the Contractor and the owner, for the consideration hereinafter named, agree as follows: I. THE PROJECT The Contractor hereby agrees to furnish all the materials, equipment, and labor necessary to perform in a good, firm, substantial, workmanlike manner all the work shown in the plans and described in the specifications for the project entitled: CITY OF WEST PALM BEACH,FLORIDA Sealed Bid No. 03/04-06 PROJECT TITLE: ANNUAL MICROSURFACING CONTRACT PROJECT NO.YARIOUS if. CONTRACT PRICE A. Estimated Expenditures/Availability of Funds. The anticipated value of this contract for the first annual term is: Three Hundred. Forty-Two Thousand Seven Hundred Thirty-Nine and 00/100 )dollars ($342,739.00). The City reserves the right to increase or decrease the anticipated value as necessary to meet actual requirements. The City does not guarantee any minimum amount of work,or the extent of services required. Purchase Orders. The City shall request work hereunder by issuance of a Purchase Order which shall specify the assignment, location and completion times. Contractor shall provide the services requested under each Purchase Order, as indicated in accordance with the unit prices provided in the bid and contained herein. C. Payment: Payment will be made by the City for each Purchase Order after the work has been performed, accepted and properly invoiced. Invoices must bear the City's purchase order number. III TIME OF COMPLETION AND LIQUIDATED DAMAGES Time of Completion for the work authorized under each work order will be established at the time of issuance of such work order and shall be of the essence. Contractor acknowledges that failure to complete the Work under each work order by the indicated time of completion will result in substantial damages to the Owner, the amount of which is difficult, if not impossible,to ascertain as of the date of the bid and, contract. If Contractor shall fail to complete the work under any work order within the time allotted,Contractor agrees to pay Owner$100 per calendar day for each and every day the time for completion exceeds the time allowed for that purpose. Owner shall and may deduct and retain the amount of such liquidated damages out of any money which may be due under this Contract. Contractor's Surety shall acknowledge it will be bound by these provisions on liquidated damages on the face of Surety's Bond. IV. CONTRACT TERM/EXTENSION The Contractor shall be awarded a contract for twelve (12) months. At the sole option of the City, the contract may be renewed for up to three (3) additional twelve (12) month periods. Options to renew will only be effective upon a written contract amendment executed by both parties. Renewal terms and conditions will be the same as the base contract except that the bid prices will be subject to adjustment, up or down, pursuant to the Producer Price Index. The index to be used for this purpose will be the Highway & Street Construction Index, Series ID PCUBiiWY# (N) category as published by the U.S. Department of Labor. The index at the time of advertisement of this project shall be the preliminary September 2003 Index value of 136.9. The Contract shall commence on the date when the contract is executed by the City. Any renewals will be subject to the appropriation of funds by the City. V.
