HomeMy WebLinkAboutR-2005-010 Bond referendum (Dania Beach) RESOLUTION NO. 2005-010 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA AUTHORIZING REFERENDA FOR THE PURPOSE OF DETERMINING THE ISSUANCE OF SIX SERIES OF GENERAL OBLIGATION BONDS IN THE NOT TO EXCEED AMOUNTS OF $1,000,000, $3,500,000, $2,000,000, $2,200,000, $2,000,000 AND $2,600,000 OF THE CITY TO FINANCE THE COST OF VARIOUS PROJECTS LOCATED WITHIN THE CITY TO BE USED FOR PUBLIC PURPOSES AS DESCRIBED IN THIS RESOLUTION; PROVIDING FOR AND CALLING FOR SIX (6) BOND REFERENDA OF THE QUALIFIED ELECTORS OF THE CITY TO BE HELD ON MARCH 8, 2005; PROVIDING FOR OFFICIAL BALLOTS; PROVIDING FOR BOND REFERENDUM PROCEDURES; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Dania Beach, Florida (the "City") has the opportunity to acquire, construct, equip and improve various capital projects for the benefit of its citizens, such projects being located within the City; and WHEREAS, the City Commission of the City (the "City Commission") determines by this Resolution that the qualified electors of the City should make, through a bond referendum process, the final decision determining whether to proceed with financing such projects through general obligation bonds; and WHEREAS, the City Commission determines by this Resolution that it serves a paramount public purpose that the projects be completed and that it is in the best interest of the City to issue general obligation bonds to finance the costs of the projects; and WHEREAS, the City now desires to issue general obligation bonds in six series in an amount not to exceed the amounts listed in this Resolution (collectively, the "Bonds" and each one a "Series") pursuant to the terms of a general obligation bond resolution hereinafter to be adopted by the City Commission, if the qualified electors of the City approve one or more of the bond referenda authorized in this Resolution; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. Authority for this Resolution. That this Resolution is adopted pursuant to the Constitution and laws of the State of Florida, including Chapter 100, Florida Statutes, Chapter 166, Florida Statutes, the Charter of the City and other applicable[provisions of law (collectively referred to as the "Act"). Section 2. Findings. That the foregoing "WHEREAS" clauses are deemed true and correct and are made a part of this Resolution. Section 3. Authorization of Bonds. That subject and pursuant to the provisions of • this Resolution, Bonds of the City are authorized to be issued in the aggregate principal amounts not exceeding the amounts listed in Section 4 below to finance the costs of the projects listed in Section 4 below, located within the City to be used for public purposes. The monies received and interest earned from the issuance of each Series of the Bonds will be used for such purpose. The Bonds shall be general obligations of the City and shall be secured by the full faith, credit, and unlimited ad valorem taxing power of the City. The Bonds shall mature in not more than thirty (30) annual installments, and the Bonds shall bear interest at a rate not exceeding the maximum rate permitted by law at the time of the sale of the Bonds. Both principal and interest on the Bonds, and redemption premiums, if any, shall be payable at the office of the paying agent to be named by the City at or prior to the sale of the Bonds. The Bonds shall be issued pursuant to authority granted under this Resolution and the Act, but only after approval of the bond referendum hereinafter called and subsequent adoption of an authorizing resolution by the City Commission, as governing body of the City. Section 4. Bond Referendums. That Bond referenda of the qualified electors residing in the City is called by this Resolution to be held on March 8, 2005, to determine whether or not the issuance of the six Series of Bonds in aggregate amounts listed below shall be approved by such qualified electors to finance the cost of the following projects: Pro'ect Not to Exceed Bond Amount 1) City Hall Expansion $1,000,000 • 2) Construction and Equipping of Downtown $3,500,000 Library with Parking Structure 3) Construction and Equipping of Public $2,000,000 Services Facility for Garage, Storage Space, Repair and Maintenance Space, Fuel Facilities and Offices 4) Construction and Equipping of a Fire $2,200,000 Station with a Broward Sheriffs Operations Sub Station 5)Neighborhood Improvements Consisting of $2,000,000 Sidewalks, Lighting, and Traffic Calming Devices 6) Recreation Centers and Parks Expansion $2,600,000 and Improvements All qualified electors in the City shall be entitled and permitted to vote in the bond referenda. The Supervisor of Elections of Broward County, Florida (the "Supervisor of Elections") shall hold, administer and conduct the bond referenda in the manner prescribed by law for holding general elections in the City. The City Clerk of the City (the "City Clerk") and the Supervisor of Elections are directed to take all necessary measures to conduct the bond referenda in all manner required by law. The returns shall show the numbers of qualified electors who voted at such • bond referendum on the proposition and the number of votes cast respectively for and against 2 RESOLUTION#2005-010 . approval of the proposition. The returns shall be properly canvassed by the Supervisor of Elections, a member of the Board of County Commissioners of Broward County, Florida and a Circuit Court Judge, heretofore appointed for such purpose (collectively, the "Canvassing Board") and all procedures and requirements of the laws of the State of Florida, the Charter of the City and other applicable law shall be complied with for the purpose of conducting the computation of ballots and completion of bond referendum procedures. Section 5. Notices of Bond Referendums. That notices of the bond referenda shall be published in a daily newspaper of general circulation in the City, at least twice, once in the fifth week and once in the third week prior to the week in which the bond referenda are held, in substantially the form attached to this Resolution as Exhibit A and in the manner provided in Section 100.342, Florida Statutes. The first publication of such notice shall be at least thirty (30) days prior to the date of the bond referenda. Section 6. Official Ballots. That the form of ballots for voting in the bond referendums shall be in substantially the following forms: OFFICIAL BALLOT CITY OF DANIA BEACH, FLORIDA CITY HALL EXPANSION BOND REFERENDUM March 8, 2005 Shall the City of Dania Beach, Florida issue General Obligation Bonds not exceeding $1,000,000, bearing interest not exceeding the maximum legal rate, maturing in not more than 30 annual installments, pledging the City's full faith, credit and unlimited taxing power, to finance the construction, improving and equipping of an expansion of the City Hall? Yes -For Bonds No - Against Bonds • 3 RESOLUTION #2005-010 • OFFICIAL BALLOT CITY OF DANIA BEACH FLORIDA LIBRARY/PARKING BOND REFERENDUM March 8, 2005 Shall the City of Dania Beach, Florida issue General Obligation Bonds not exceeding $3,500,000, bearing interest not exceeding the maximum legal rate, maturing in not more than 30 annual installments, pledging the City's full faith, credit and unlimited taxing power, to finance the construction, improving and equipping of a public library with a parking facility? Yes - For Bonds No - Against Bonds 4 RESOLUTION#2005-010 • OFFICIAL BALLOT CITY OF DANIA BEACH, FLORIDA NEIGHBORHOOD IMPROVEMENTS BOND REFERENDUM March 8, 2005 Shall the City of Dania Beach, Florida issue General Obligation Bonds not exceeding $2,000,000, bearing interest not exceeding the maximum legal rate, maturing in not more than 30 annual installments, pledging the City's full faith, credit and unlimited taxing power, to finance the acquisition, construction, improving and equipping of neighborhood sidewalk improvements, neighborhood lighting and traffic calming devices in City neighborhoods? Yes - For Bonds No - Against Bonds OFFICIAL BALLOT CITY OF DANIA BEACH, FLORIDA PARKS AND RECREATION BOND REFERENDUM March 8, 2005 Shall the City of Dania Beach, Florida issue General Obligation Bonds not exceeding $2,600,000, bearing interest not exceeding the maximum legal rate, maturing in not more than 30 annual installments, pledging the City's full faith, credit and unlimited taxing power, to finance the acquisition, expansion, renovation, construction and equipping of City recreation centers and parks? Yes - For Bonds No - Against Bonds Section 7. Bond Referenda Results. That returns of the votes cast at the bond referenda shall be made to and canvassed by the Canvassing Board and such Canvassing Board shall declare the results of the bond referenda and certify the same to the City Clerk to be recorded in the minutes of the City. If a majority of the votes cast at the particular bond referendum shall be "Yes - For Bonds," the particular Series of Bonds shall be approved, and then the Series of Bonds shall be issued as shall be provided by supplemental resolution the City Commission, as governing body of the City. If less than a majority of the votes cast at the particular bond referendum shall be "Yes - For Bonds," such Series of Bonds shall be defeated, and no such Series of those Bonds shall be issued pursuant to this Resolution. Regardless of the results of the bond referenda, the City Clerk is directed to submit such results to the Department of State pursuant to 100.351, Florida . Statutes. 5 RESOLUTION #2005-010 • Section 8. Languages. That to the extent required by law, the Official Ballots and Notices of Bond Referendum shall be published in both the English and the Spanish languages. Section 9. Intent to Reimburse. That the City Commission expresses its intention that the City be reimbursed from the proceeds of the Bonds for costs relating to the projects. Pending reimbursement, the City expects to use funds on deposit in the City's general fund or other appropriate fund or account to pay such costs. This Resolution is intended to constitute with respect to the projects a "declaration of official intent" within the meaning of Section 1.150- 2 of the Federal Income Tax Regulations. Section 10. Conflicts. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 11. Effective Date.
