A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, SUPPORTING PROPOSED STATE LEGISLATION
THAT WOULD REGULATE HOMEOWNERS' ASSOCIATIONS AND CO-
OPERATIVE HOUSING IN A MANNER SIMILAR TO FLORIDA LAWS
GOVERNING CONDOMINIUM ASSOCIATIONS; PROVIDING FOR
CONFLICTS; FURTHER,PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Dania Beach supports legislation that is
being proposed to the Florida Legislature that would regulate homeowners' associations and co-
operative housing, with the intention of protecting residents and owners of such housing; and
WHEREAS, Florida State Representative Julio Robaina (R-Miami) plans to introduce
legislation to the Florida Legislature pertaining to homeowner associations, to empower the
existing state condominium agency to investigate violations of state law by such associations'
boards and directors and to hold them accountable for their actions and inactions; and
WHEREAS, other state legislators intend to introduce similar legislation affecting
residents and property owners who have chosen communal living, to afford them more measures
of protection and accountability as to those persons who are selected to govern such associations;
and
WHEREAS, the City of Dania Beach, Florida supports legislation which will apply to
such associations, as well as co-operative housing and condominiums, so that avenues of redress
are made available to affected residents and property owners;and
WHEREAS, the City of Dania Beach, Florida also supports the creation and adequate
funding of offices for state ombudsmen, who could assist residents and owners in a meaningful
way, by providing accessibility to persons who can help mediate and resolve disputes and
address communal living issues, while educating those who are chosen to serve on boards and as
directors;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the City Commission of the City of Dania Beach, Florida, supports
proposed state legislation that would regulate homeowners' associations and co-operative
• housing in a manner similar to Florida laws governing condominium associations and provide
• offices, staff and adequate funding for ombudsmen for each category of such communal living
arrangements.
Section 2. That the City Clerk is directed to furnish certified copies of this Resolution
to all members of the Broward County Legislative Delegation and to both the Broward League
of Cities and the Florida League of Cities.
Section 3. That all resolutions or parts of resolutions in conflict with this Resolution
are repealed to the extent of such conflict.
Section 4. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.
