HomeMy WebLinkAboutR-2005-046 Adopt Local Mitigation Strategy (LMS) RESOLUTION NO. 2005-046 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, ADOPTING THE LOCAL MITIGATION STRATEGY (LMS) ADOPTED BY BROWARD COUNTY; PROVIDING FOR CONFLICTS; FURTHER PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 163, Florida Statutes, requires the City of Dania Beach to plan for hazard mitigation, hurricane evacuation, post-disaster redevelopment planning, and a local mitigation strategy; and WHEREAS, the State Department of Community Affairs (DCA) has designated the Broward County Emergency Management Division as the local coordinator of the Local Mitigation Strategy Program for the Broward County area; and WHEREAS, the City has entered into an agreement with Broward County and the DCA • to authorize the County to prepare the City's municipal components of a single unified County- wide Local Mitigation Strategy; and WHEREAS, the Broward County Board of County Commissioners adopted the Broward County Local Mitigation Strategy. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the City Commission of the City of Dania Beach adopts Broward County's Local Mitigation Strategy. Section 2. That this Resolution shall be in force and take effect immediately upon passage and adoption. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. PASSED AND ADOPTED this 22°a day of March, 2005. FEMA completed their review of the Unified Plan on December 30, 2004. Broward County subsequently requested on February 7, 2005 that Dania Beach adopt a resolution approving the Unified Plan. • Adoption of the Unified Plan is required for residents to continue receiving credits on federal flood insurance pursuant to the City's Community Rating System. Compliance with these requirements is necessary in order to maintain eligibility for hazard mitigation grant funding after presidential declared disasters. The recently revised multi-jurisdictional mitigation plan has been approved by FEMA in a ,letter dated December 30, 2004 (see attached). Also, enclosed is a compact disc which contains a copy of the plan. Each municipality is being asked to have their respective • Boards to adopt this approved plan in order to assure ongoing and uninterrupted eligibility for federal mitigation grant funding. Please forward to this Agency a copy of this adopted resolution by 1 May 2005 for appropriate processing. The Plan is approved for a period of 5 years,to December 29, 2009. Upon receipt of resolutions adopting the Broward County LMS from Broward County, City of Coconut Creek, City of Diana Beach, City of Deerfield Beach, City of Fort Lauderdale Cooper City, City of Hallandale Beach, Town of Hillsboro Beach, City of Hollywood, City of Lauderdale Lakes, City of Lauderhill, Village of Lazy Lake, City of Lighthouse Point, City of Margate, City of North Lauderdale, City of Oakland Park, City of Parkland, City of Pembroke Park, City of Pembroke Pines, City of Plantation, City of Pompano Beach, Village of Sea Ranch Lakes, City of Tamarac, City of Weston and the • w•tirw.rema.gov . City of Wilton Manors we will issue a follow-up letter to include these jurisdictions in the plan approval, thereby confirming their eligibility for the above referenced FEMA mitigation programs. We commend Broward County for development of a solid, workable plan that will guide hazard mitigation activities over the coming years. Please note, all requests for funding will be evaluated individually according to the specific eligibility and other requirements of the particular program under which the application is submitted. For example, a specific mitigation activity or project identified in the plan may not meet the eligibility requirements for FEMA funding;and even eligible mitigation activities are not automatically approved for FEMA funding under any of the aforementioned programs. We strongly encourage each community to perform an annual review and assessment of the effectiveness of their hazard mitigation plan,however, a formal plan update is required at least every five(5)years. We also encourage each community to conduct a plan update process within one year of being included within a Presidential Disaster Declaration or of the adoption of major modifications to their local Comprehensive Land Use plan or other pIgnc that a ffent hazard mitigatinn or land use and development. When the Plan is amended or revised, it must be resubmitted through the State as a"plan update" and is subject to a formal review and approval process by our office. If the Plan is not updated prior to the required 5-year update,please ensure that the Draft update is submitted at least 6 months prior to expiration of this plan approval. The State and Broward County should be commended for their close coordination and communications with our office in the review and subsequent approval of the plan.
