HomeMy WebLinkAboutR-2005-061 Senate Bill 2416 re Workers' Compensation Law RESOLUTION NO. 2005-061 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA URGING THE FLORIDA LEGISLATURE TO DEFER CONSIDERATION AND ADOPTION OF SENATE BILL 2416, PERTAINING TO NUMEROUS PROPOSED CHANGES TO THE FLORIDA WORKERS' COMPENSATION LAW UNTIL THE FINANCIAL IMPACTS OF EACH PROPOSAL IS THOROUGHLY ANALYZED BY LOCAL GOVERMENTS; PROVIDING FOR CONFLICTS; FURTHER PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Senator Hill has sponsored Senate Bill 2416 in the Florida Legislature, which bill purports to add thirty-three (33)new provisions to the Florida Workers' Compensation Law and to reinstate provisions governing "bad faith dealings" by insurance carriers; and WHEREAS, the National Council on Compensation Insurance, Inc. ("NCCI") has analyzed the bill and concluded that the overall system costs in Florida may increase between thirty- two percent (32%), which would be a system-wide increased cost of$1.3 Billion Dollars or as high as fifty-two percent(52%) system-wide, which equates to $2.1 Billion Dollars; and WHEREAS, the City Commission of the City of Dania Beach, Florida urges the Florida Legislature to allow local governments ample opportunity to analyze the financial burdens of each of the thirty-three proposed new changes, as well as allow the review of the "bad faith" provisions, since if the impacts are as dire as analyzed and reported by the NCCI, the City of Dania Beach and numerous other localities will sustain extraordinary financial burdens for which there are no funding sources; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the City Commission of the City of Dania Beach urges the Florida Legislature to defer consideration and adoption of Senate Bill 2416, pertaining to numerous changes to the Florida Workers' Compensation law until the financial impacts are thoroughly analyzed by local governments. Section 2. That the City Clerk is directed to forward certified copies of this Resolution to the members of the Broward County Legislation Delegation, the Florida League of Cities and the Broward League of Cities. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 4. That this Resolution shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED on April 12, 2005. ��-,,.mac.
