A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, AMENDING RESOLUTION NO. 2004-165,
PERTAINING TO COMPENSATION ESTABLISHED FOR THE MAYOR
AND CITY COMMISSIONERS; PROVIDING FOR CONFLICTS; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, in accordance with the City Charter, Part III, Article 1, Section 2,
"Compensation of officers and employees," the City Commission of the City of Dania Beach
shall by resolution fix the compensation of the City Commissioners, among others; and
WHEREAS, as a result of the March, 2005 municipal election, it is necessary to amend
the existing Resolution which established compensation for elected City officials;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That Section 1 of Resolution No. 2004-165 is amended to read as follows:
"Section 1. That the annual salary of the City Commission (which forms a part of
the compensation payable to the Mayor and City Commissioners of the City of
Dania Beach) is as follows:
Mayor Anne Castro - $20,596.78
Commissioner John Bertino - $19,044.06
Such annual salaries shall be adjusted at the same time and at the same rate as cost of
living adjustments may be made to the salary paid to general city employees."
Section 2. That except as amended above, Resolution No. 2004-165 is ratified and
reaffirmed as to compensation paid to the other current elected officials.
Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
. Section 4. That this Resolution shall be in force and take effect immediately upon its passage
and adoption.

RE: Salary and Cost of Living Adjustments for Elected Officials
As recently discussed at the April 8, 2005 City Commission Workshop meeting, it is
necessary to undertake some "housekeeping measures" which relate to the compensation
received by the City Commission.
Currently, the City Charter (Part III, Article 1, Section 2) provides in pertinent part
that the compensation of the City Commission shall be fixed "by resolution". However, a
conflicting 1977 ordinance has been discovered in the City Code of Ordinances, which fixed
compensation at the rate of $300.00 per month for the Mayor and $250.00 per month for City
Commissioners. The ordinance directly conflicts with the Charter provision and it is
recommended that the 1977 ordinance simply be repealed.
As a related matter, while the City Commission has fixed its compensation in recent
years by resolution, it was the express intent of the City Commission that a mechanism be put
into place, so that the annual salary for elected officials, once established, is periodically
adjusted based on the same cost of living adjustment as is made to salaries for general
employees of the City.
Consequently, an ordinance repealing the outdated and conflicting "compensation
ordinance", and an amending resolution adding the new officials (Mayor Castro,
Commissioner Bertino) and providing that all officials' salaries will be adjusted at the same
rate and time as is done for general employees, are presented for consideration and adoption.
