A RESOLUTION OF THE CITY OF DANIA BEACH, APPROVING THE
VARIANCE REQUEST SUBMITTED BY RONALD AND STACEY COSTELLO,
FROM CHAPTER 28, "ZONING", ARTICLE 4, "DISTRICT REGULATIONS",
"SCHEDULE OF LOT,YARD AND BULK REGULATIONS",FOR PROPERTY
LOCATED AT 262 SW 8 STREET, IN THE CITY OF DANIA BEACH;
PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the Dania Beach Code of Ordinances, Chapter 28, "Zoning", Article 4,
"District Regulations", sets the lot,yard and bulk regulations for the City of Dania Beach; and
WHEREAS,Ronald and Stacey Costello have applied for a variance (VA-12-05)to allow
an addition to their private residence to be located five (5) feet from the east side property line
(where seven (7) feet is required by the Code); the subject property is located at 262 SW 8 Street,
Dania Beach; and
WHEREAS,the Planning&Zoning Board on April 20, 2005, recommended that the City
Commission grant variance request VA-12-05, based upon the criteria set forth in section 10.13 of
Article 10, of Chapter 28, "Zoning", of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application VA-12-05, for a variance as described above from
requirements in Chapter 28,"Zoning",Article 4,"District Regulations","Schedule of Lot,Yard and
Bulk Regulations", of the City of Dania Beach Code of Ordinances, a copy of which application is
attached and made a part of this Resolution as Exhibit "A", is approved.
Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 3. That this Resolution shall be in force and take effect immediately upon its passage
and adoption.

SUBJECT: VA-12-05: The applicant, Ronald and Stacey Costello,
is requesting a setback variance to allow an addition to
their private residence 5 feet from the side property line,
where 7 feet is required, located at 262 SW 8 Street.
VARIANCE
To allow an addition located 5 feet from the east property line; 7 feet
required.
® PROPERTY INFORMATION:
ZONING: RD-8000
PROPERTY WIDTH: 50 feet
The homeowners are proposing a 518 square foot addition to accommodate a
handicapped child. The addition will follow the same setback established by the
existing structure. The applicant has indicated that the wall will have two
windows facing the east property line.
STAFF RECOMMENDATION
The applicant must demonstrate to the Planning and Zoning Board and City
Commission that they have met the requirements of Section 10.13 of the Zoning
Code to establish a hardship. Based on hardship established by medical
condition, staff can support the variance if there is no objection from the abutting
property owner.
PLANNING AND ZONING BOARD
On April 20, 2005 the Planning and Zoning Board recommended approval of the
requested variance.
